however, these vehicles will be gone once the fill -in process is completeMr Green is requesting the property be rezoned so that he can park on the lot one heavy vehicle, a hydro -axcutting machine used in forestry He noted Mr Green would be willing to plant a buffer along the front ofthe property to hide the equipment from viewBob Spence, Jr, Attorney representing Jim Woody who lives across from the property, stated theentire community is residential, and, in his opinion, this rezoning would not be compatible with the rest ofthe area It would, according to Mr Spence, serve only Mr Green, and would damage property values forothers in the neighborhood He presented detailed maps showing the number of homes in relation to thisproperty, and showed recent pictures of the lot with large equipment, piles of construction materials, debris,and fuel storage tanksJim Woodv stated, to his knowledge, there has been no sedimentation or erosion control practicedon the property, and in his opinion, the lot has become a type of demolition landfill He voiced the followingconcerns ifthe property is rezoned excessive noise in a residential neighborhood, heavy vehicles on a narrowroad which is posted with a weight limit, and safety for children playing in the area He also remarked thatMr Green has installed a large light that shines in many of the area homes at nightMark Peterson who lives in the neighborhood concurred with Mr Woody and stated he wasespecially concerned that contaminants that could affect ground water have been dumped on the propertyTerri Penny, Elaine Ellis, and Carol Woody also spoke in opposition and asked the Board to deny therezoningConcerning contaminants Mr Ragland responded the empty fuel tanks on the property belong to MrRowland and will not remain there after the fill -in project is completed He noted the tanks and the fill inmaterial have been checked by environmental personnel and are safeB CASE #53 - Petition to rezone an 187 acre parcel on SR 1517 Sanders Road adjacentto South Breeze Mobile Home Park from AR R 40 to Mobile Home Park DistrictPetitioner Hubert FutrellJeff Coutu, Planning Director, pointed out the property on a map He explained the petitioner hasan existing mobile home park on adjacent property and wishes to expand Planning Board recommendationApprovalGlenn Futrell, co -owner of the park, stated he and his brother, Hubert Futrell, wish to addapproximately 32 additional mobile home lots to their park He noted they have operated at their presentlocation for five years and have had no problems with other people in the neighborhoodThere being no further comments, the Chairman closed the Public Hearing7 Decisions on Rezoning CasesA CASE 452 - Larry Green - DELAYEDUpon a motion by Commissioner Eleanor N Creech, seconded by Commissioner Jerry FWood and carried by unanimous vote, the Board delayed action on CASE 452 until later in the day, andcontinued a Special Use Permit Hearing on this case until such time as a decision on the rezoning is reachedB CASE 453 - Hubert Futrell - APPROVEDUpon a motion by Commissioner Cecil M Massengill, seconded by Commissioner Jerry FWood and carried by unanimous vote, the Board approved rezoning CASE 453, an 187 acre parcel on SR1517 adjacent to South Breeze Mobile Home Park, from ARR 40 to Mobile Home Park District forapplicant, Hubert Futrell8 Smithfield Rural Fire District - Revision of District DescriptionCounty Manager, Richard B Self, informed the Board the Department of Insurance has recommendedchanges in the wording of the Smithfield Fire District description to reflect its rural nature345Upon a motion by Commissioner Jerry F Wood, seconded by Commissioner John M Booker andcarried by unanimous vote, the Board approved the following revised description for the Smithfield Rural FireDistrictSmithfield Rural Fire DistrictFive Mile District - Served by Smithfield Fire DepartmentBeginning at a point 1 on US 70, 12 miles east of SR 1918; andWHEREAS, the County of Johnston recognizes the plight of the various telephone companies in NorthCarolina to have an adequate supply of telephone numbers; andWHEREAS, Johnston County has a strong history of working with the various businesses and industrieswhich are located in Johnston County; andWHEREAS, the division of Johnston County into two separate area codes, 919 and 910, creates ahardship on the citizens of the County, the businesses and industries of the County; and thecitizens of the United States in calling to Johnston County; however no additional R -20 zoning designations would be made after amendment approvalJeff Coutu, Planning Director, explained the Planning Board has recommended an R -30 Single FamilyResidential District as a substitute for the R -20 district classification Mobile homes would not be a permitted347use on R -30 zoned property Properties currently zoned R -20 would not be affected by this amendment,including properties in various stages of development if they have been approved, platted and recordedB Add footnote to Table IV - Area, yard, and height requirements to read as follows1 When the property line lies within an easement not associated with the lot Le power line,sewage, road right -of -way etc the setback shall be measured from the easement boundary2 When the property line lies within an easement associated with the lot ie drainage,walkway, utility the setback shall be measured from the property lineJeff Coutu, Planning Director, informed the Commissioners the Planning Board at the January 19thmeeting recommended the minimum building front setback line be 35 feet from the property line, or theeasement boundary line, whichever is greater He explained the amendment would assure that developers,when dividing property into lots, allow sufficient construction area outside any easement or other restrictivearea designated on the deed He noted CP L does not allow any construction within their easementsMike McIntyre, Land and Right -of -Way Supervisor for CP L, was present to answer any questionsthe Board might have He explained CP L will not allow any structure in the easement, including wells, sewerlines, and septic tanksCP Thompson, Chief Inspector for Johnston County, pointed out the amendment should be wordedto include at least 3 additional feet to satisfy State Building Code regulation He explained a 3 area aroundany structure, where no digging is allow, is required to protect the structures foundation He suggested morethan 3 would be preferable to allow a person sufficient area should he later wish to build a stoop, porch, orother extension to his buildingFollowing discussion by the Board, the Chairman asked if there were any other comments Therebeing none, the Chairman closed the Public Hearing13 Decisions on Proposed Zoning Ordinance AmendmentsA ADD Section 461 - R -30 30,000 sqft Single Family Residential District and Section461A - R -30 Special Use District ADD R -30 Districts to all Related Listings in theJohnston County Zoning Ordinance ADD To Section 46 and Section 46A thefollowing No Additional R -20 Zoning Designation, Effective 2193Commissioner John M Booker moved the Board approve an amendment to the Johnston CountyZoning Ordinance to add Section 461, R -30 Single Family Residential District, and Section 461A, R -30Special Use District, with the same permitted uses as R -20 but requiring minimum 30,000 sq ft lots, andadd the new R -30 zoning designation to all related lists and charts of zoning districts in the Zoning OrdinanceCommissioner Booker further moved the Board stipulate that this amendment not affect existing R -20 zonedproperty as long as that property has been approved, platted, and recorded;
