530March 28, 1994The Johnston County Board of Commissioners met in special session Monday, March 28, 1994, at1215 pm in the CommissionersRoom, Johnston County Courthouse Annex, Smithfield, North Carolina, withthe following members presentNorman C Denning, Chairman, James W Cash, John M Booker, DVM, Jerry F Wood, DDS,Eleanor N Creech, and Cecil M MassengillAbsent Frank B Holding, Vice ChairmanAlso Present Richard B Self, County Manager, and Joyce H Ennis, Clerk to the BoardThe Chairman called the meeting to order and the following business was transacted1 Resolutions NC Clean Water Wastewater Grant and Loan ProgramCounty Manager, Richard B Self, informed the Board the County has the opportunity to be includedin the first round of applications for new State Clean Water Wasterwater loan and grant funds Herecommended the Board adopt resolutions making application for each of the following projectsPROJECT CONSTRUCTION OF PURPOSESR 1010 Water Main Loop Transmission Main, Appurtenances, Water extension from Cleveland School toEngineering and Administration HPWDBenson 301 Water Main ConnectorNew Clayton School Water FacilityNew Clayton School AreaWastewater FacilityMeadow School Area Water FacilityCorinth Holder School Area WaterFacilityWilson Mills Wastewater CollectionFacilitiesJohnston County Water TreatmentPlant and Water MainsTransmission Main, Appurtenances,Engineering and AdministrationTransmission Main, Appurtenances,Engineering and AdministrationW astewaterF acilities,Appurtenances,engineering and administrationTransmission Main, Appurtenances,Engineering and AdministrationTransmission Main, Appurtenances,Engineering and AdministrationHwy 27 Waterline loop to US 301 north ofBensonProvide water for new elementary school onNC 42Provide wastewater for new elementaryschool on NC 42Extension of water line down Hwy 50 toMeadow SchoolExtension of water line from Wendell toCorinth Holder SchoolWastewaterFacilities ,Appurtenances, Extension of water from Utilicom toEngineering and Administration Wilsons Mills School4 mgd Surface Water Treatment Reapplication for water plant withPlant, Water Transmission Main, additional information includedAppurtenances, Engineering andAdministrationUpon a motionby Commissioner James W Cash, seconded by Commissioner Eleanor N Creech and carriedby unanimous vote, the Board adopted the following resolution for each of the projects listed aboveSTATE CLEAN WATER REVOLVING LOAN AND GRANT FUND RESOLUTIONWHEREAS The North Carolina Clean Water Revolving Loan and Grant Fund Act of 1993 has authorized themaking of loans and grants to aid eligible units of government in financing the cost of constructionof wastewater treatment works, wastewater collection systems, andWHEREAS Johnston County has need for and intends to construct a water transmission project described as theINSERT NAME OF PROJECT consisting of the INSERT CONSTRUCTION OF foreach project above, andWHEREAS Johnston County intends to request State loan assistance for the projectNOW THEREFORE BE IT RESOLVED, BY JOHNSTON COUNTY BOARD OF COMMISSIONERSTHATJohnston County will arrange financing for all remaining costs of the project, if approved for a State loanaward2 Johnston County will adopt and place into effect on or before completion of the project a schedule of fees andcharges which will provide adequate funds for proper operation, maintenance and administration of thesystem531The governing body of Johnston County agrees to include in the loan agreement a provision authorizing theState Treasurer, upon failure of Johnston County to make scheduled repayment of the loan, to withhold fromJohnston County and State funds that would otherwise be distributed to the local government unit in anamount sufficient to pay all sums then due and payable to the State as repayment of the loan4 Johnston County will provide for efficient operation and maintenance of the project on completion of theconstruction thereof5 That Richard B Self, County Manager, and successors so titled, is hereby authorized to execute and file anapplication on behalf of Johnston County with the State of North Carolina for a loan to aid in the constructionof the project described above6 That Richard B Self, County Manager, and successors so titled, is hereby authorized and directed to furnishsuch information as the appropriate State agency may request in connection with such application or theproject; to make assurances as contained above; and to execute such other documents as may be required inconnection with the application7 That Johnston County has substantially complied or will substantially comply with all Federal, State, andlocal laws, rules, regulations, and ordinances applicable to the project and to Federal and State grants andloans pertaining theretoAdopted this the 28th day of March, 1994, at Smithfield, NCThere being no further business, Commissioner John M Booker movedthe Board adjourn commissioner JerryF Wood seconded the motion which carried by unanimous vote
