September 9, 1994The Johnston County Board of Commissioners met in special emergency session at 830 am in theCommissioners Room, Johnston County Courthouse Annex, Smithfield, North Carolina, with the followingmembersPresent Norman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash,John M Booker, DVM, and Cecil M MassengillAbsent Jerry F Wood, DDS, and Eleanor N CreechAlso Present Richard B Self, County Manager, and Joyce H Ennis, Clerk to the BoardThe Chairman called the meeting to order and the following business was transacted1 Resolution Approving Temporary Operation by Board of Education of a School Outside OfJohnston CountyUpon a motion by Commissioner James W Cash, seconded by Commissioner Cecil M Massengill andcarried by unanimous vote, the Board adopted the following resolutionRESOLUTION OF APPROVAL BY JOHNSTON COUNTY BOARD OFCOMMISSIONERS APPROVING THE TEMPORARY OPERATION BY THEJOHNSTON COUNTY BOARD OF EDUCATION OF A SCHOOL WITHIN THEBOUNDARIES OF WILSON COUNTY, NC NCGS SECTION 115C-366WHEREAS, the Johnston County Board of Education operates Glendale-Kenly ElementarySchool in the Town of Kenly, Johnston County, North Carolina; andWHEREAS, on the 6th day of September, 1994, the school building structure in whichGlendale-Kenly Elementary School was housed and operated was destroyed by fire; andWHEREAS, the Johnston County Board of Education needs to acquire or locate a temporaryfacility for the operation of Glendale-Kenly Elementary School until such time as portableschool building units can be manufactured and placed on premises within Johnston County forthe continued operation of Glendale-Kenly Elementary School; andWHEREAS, the Johnston County Board of Education has located certain facilities which willbe suitable as a location for the temporary housing, conduct and operation of Glendale-KenlyElementary School, said facilities being the Church of God Assembly grounds located onHighway No 581 in Wilson County, North Carolina; andWHEREAS, NCGS Section 115C-517 provides that no school may be operated by a localschool administrative unit outside it own boundaries, ; andWHEREAS, NCGS Section 115-C-366e allows the Boards of Education of adjacent localschool administrative units to operate schools in adjacent units upon written agreementsbetween the respective Boards of Education and upon approval by the County Commissionersand the State Board of Education; andWHEREAS, the Wilson County Board of Education and the Johnston County Board ofEducation are entering into an agreement to allow the Johnston County Board of Educationto operate Glendale-Kenly Elementary School within Wilson County on a temporary b asis; andWHEREAS, the provisions of NCGS Section 115C-366e require that such agreement beapproved by the Board of County Commissioners of the respective counties; andWHEREAS, the Wilson County Board of Education and the Johnston County Board ofEducation have requested the Johnston County Board of Commissioners to approve suchagreement pursuant to the provisions of NCGS Section 115C-366e; andWHEREAS, the Johnston County Board of Commissioners is agreeable to approving saidoperation of a school within Wilson County by the Johnston County Board of Education for theterm set forth in and subject to the conditions set forth in the attached agreement between theWilson County Board of Education and the Johnston County Board of Education;NOW, THEREFORE, be it resolved by the Johnston County Board of Commissioners asfollows1 The Johnston County Board of Commissioners does hereby grant its approval for theJohnston County Board of Education to operate the Glendale-Kenly Elementary Schoolon a temporary basis as set forth in the attached agreement2 This approval by the Johnston County Board of Commissioners is subject to the term,conditions and provisions of the attached agreement being entered into between theWilson County Board of Education and the Johnston County Board of Education617This resolution of approval by the Johnston County Board of Commissioners is madesolely for the purposes of complying with the provisions of NCGS Section 115C-366eand for no other purpose, and neither Johnston County nor the Johnston County Boardof Commissioners shall have any liability, obligation or duty as a result of the JohnstonCounty Board of Educations temporary operation of Glendale-Kenly Elementary Schoolwithin Wilson County, North Carolina, and the Johnston County Board of Educationshall be fully responsible for the operation of said school, for the staffing of said school,for the supervision of students attending said school, and fully responsible for any andall expenses, costs, obligations, and any and all other expenses or liabilities incurredin connection with the temporary operation and location of said Glendale-KenlyElementary School within Wilson County, North CarolinaThis resolution has been duly adopted by the Johnston County Board of Commissioners at aregularly scheduled meeting held on the 9th day of September, 1994There being no further business, Commissioner Frank B Holding moved the Boardadjourn Commissioner John M Booker seconded the motion which carried by unanimous vote
