January 17, 1995The Johnston County Board of Commissioners met in special session Tuesday, January 17,1995, at 600 pmin the Commissioners Room, Johnston County Courthouse Annex, Smithfield, North Carolina, with the followingmembers presentNorman C Denning, Chairman, John M Booker, Vice Chairman, James W Cash, Jerry F Wood, DDS,Eleanor N Creech, Cecil M Massengill, and Cookie PopeAbsent NoneAlso Present Richard B Self, County Manager, and Joyce H Ennis, Clerk to the BoardThe Chairman called the meeting to order and the following business was transacted1 Public Hearing - Schedule of Values for the 1995 RevaluationAdvertised January 6, 1995 in The Smithfield HeraldThe Chairman opened the public hearing and invited anyone who wished to address the Board on the proposedtrue value and present use value schedules, standards and rules to be used in the 1995 revaluation of real property inJohnston CountyThere being no comments, the Chairman closed the public hearingCounty Manager, Richard B Self, noted the Board will consider adoption of the schedule of values on January24, 1995, and following adoption will give public notice that the schedule is open for 30 days for citizen review2 Award of Bid Financing of Water Treatment PlantProposals received December 21, 1994The Board considered the following bids in response to the requests for proposals for a ten -year loan in theamount of 31 million to construct the Johnston County Water Treatment FacilityFirst Citizens BankFixed 563Variable 1 - 5 year 5266 - 10 years 68 of prime with minimum of 526 cap of 660BB TFixed 624Variable 67 of prime with minimum of 550 cap of 900Centura75 of Centuras prime rate to change as prime changesCounty Manager, Richard B Self, informed the Board that he and Finance Director, John Massey, havereviewed the bids and recommend the variable bid from First Citizens Bank Trust Company as low bidFollowing discussion, Commissioner Jerry F Wood moved the Board award bid to low bidder, First CitizensBank Trust, at the quoted variable rate as follows 1- 5 years at 526 , 6 -10 years at 68 of prime with minimumof 526 and cap of 660 Commissioner Cecil M Massengill seconded the motion which carried by unanimous vote3 Tax Exempt Loan Request - Pine Level Fire DepartmentUpon a motion by Commissioner John M Booker, seconded by Commissioner Jerry F Wood and carried byunanimous vote, the Board adopted the following resolution approving a tax exempt loan for the Pine Level FireDepartmentApproval of Tax Exempt Loan to Volunteer Fire DepartmentNOW, THEREFORE, BE IT HEREBY RESOLVED, that the Board of Commissioners of JohnstonCounty, North Carolina, does hereby approve a tax - exempt loan to the Volunteer Fire Department of Pine Level, NorthCarolina, the VFD , from Emergency One, Inc, in the principal amount of 101,58500, which loan is for thefollowing purposeThe purchase by the VFD of a fire truck which fire truck will be owned and operated by the VFD, and will bemaintained at the following addressP O Box 609Pine Level, NC 275686624 Department of Transportation Proposed Closing of Railroad Crossing on SR 1914County Manager, Richard B Self, informed the Board that DOT has responded to the Countys October 3rdrequest that the State pave the portion of SR 1914 from Hwy 70 to the intersection of SR 1912 and improve therailroad crossing on SR 1914 Reference Minute book 19, p 619 The response, dated January 10, 1995, indicatedthe State plans to close the crossing due to the close proximity of the five crossings in the Wilsons Mills area Mr Selfpointed out this road represents the planned access to the new water plant, and recommended the Board request thatDOT cancel any plans to close this crossingFollowing discussion, Commissioner James W Cash moved the Board adopt the following resolution andCommissioner John M Booker seconded the motion which carried by unanimous voteRESOLUTIONWHEREAS Johnston County is in the process of constructing a 4 mgd water treatment plant to providequality water for its citizens; andWHEREAS the new Johnston County Water Treatment Plant will be located on property north of Hwy 70in Wilsons Mills Township off SR 1912; andWHEREAS the most logical entrance, hence the planned access, to the water plant from Hwy 70 is SR1914 adjacent to the Hesco property, across the railroad tracks to SR 1912 and then north tothe plant site; andWHEREAS Johnston County, on October 3, 1994, formally requested the NC Department ofTransportation to pave SR 1914 from Hwy 70 to the intersection of SR 1912 and improve therailroad crossing to grade in order to allow easy access to the new facility; andWHEREAS the North Carolina Department of Transportation has now informed the County that the stateis considering closing the railroad crossing on SR 1914 which would prevent this most logicaland planned entrance to the new Johnston County Water Treatment PlantNOW THEREFORE, the Johnston County Board of Commissioners does hereby request that the NC Departmentof Transportation discontinue plans to close the SR 1914 railroad crossing; andFURTHER, Johnston County reaffirms its request of October 3, 1994, that SR 1914 be paved from Hwy 70 to theintersection of SR 1912 and the railroad crossing on SR 1914 be brought to grade to allow access to the new JohnstonCounty Water Treatment PlantAdopted this 17th day of January, 19955 Johnston County Visual Arts - Request to Use Courthouse AtriumDan Lee, member of Johnston County Visual Arts, a support group for artists in the county, met with the Boardrequesting special permission to use the Courthouse Atrium for an art exhibit during the weekend of the Ham YamFestival in April Mr Lee explained he had spoken with County Manager, Richard Self, and been informed the exhibitwould be welcome and could be viewed during the week, however, the Courthouse is closed on weekends Mr Leeasked the Board to make an exception in this situation and allow the artists to show their work to people attending theweekend festival, especially on that SaturdaySeveral reasons why the County does not open the atrium on weekends were discussed security, liability,heating and air conditioning, and uncontrolled access to offices and courtroom facilities Mr Lee assured the Boardhis committee could block off entrances into other parts of the Courthouse, provide a security guard, and limit thenumber of people in the atrium at any given timeFollowing discussion, Chairman Norman C Denning stated the Board would consider the request and makea decision at the February 6, 1995 regular meetingThere being no further comments, Commissioner John M Booker moved the Board recess until 600 pm,Tuesday, January 24, 1995 Commissioner Eleanor N Creech seconded the motion which carried by unanimous voteDetailsAnnotationsEntry PropertiesModified11192013 125128 PMCreated4152003 102744 AMTemplateMinutesFieldsMinutes - TypeSpecialMinutes - Date1171995Book19
