to SystemThe Board reviewed petitions presented by the North Carolina Department of Transportationrequesting the following roads be added to the State Secondary System for maintenanceGrant Street in Glenn Powell Subdivision, Clayton Township, and Briarwood Drive inCountryside Subdivision, Selma TownshipFollowing review, Commissioner James W Cash moved the Board concur with the NCDepartment of Transportations request to add Grant Street, Clayton Township, and BriarwoodDrive, Selma Township, to the State Maintained SystemCommissioner Cookie Pope seconded the motion, which carried by unanimous vote3 Amendments to Cable TV Ordinance - Second VoteThe Board discussed the proposed amendments to the Cable TV Ordinance, which wereadopted at the first reading on March 6, 1995 In a few sections, additional wordage was insertedin an effort to clarify the meaning of the amendmentsClarificationsSection 127 A add to first sentence the words to the greatest extent possibleSection 127 E add to first sentence the words for County DataSection 129 F to the statement service to all County government add facilities andtelevision service to the public school facilities without chargeSection 129 G to the statement, allow for a coordinated interconnect add wheretechnically and economically feasibleFollowing further discussion, Commissioner Cecil M Massengill moved the Board JOHNSTON COUNTY CABLE TV ORDINANCEADOPTED AT TWO READINGS ON MARCH 6, 1995 AND APRIL 3, 1995SECTION 122 ADD B RIGHT OF COUNTY TO ISSUE FRANCHISE Granteeacknowledges and accepts the legal right of the County to issue this FranchiseSECTION 123 F GROSS REVENUE ADD or as amended by the FCC or CongressSECTION 124 FRANCHISE REQUIRED APPLICATION0 REPLACEMENP In selecting a franchisee pursuant to this chapter, the applicantshall furnish the following informationSECTION 126 DURATION OF FRANCHISE; TERMINATION; TRANSFER; RENEWALDELETE A within sixty 60 days of the receipt of the notice ADD A within one -hundred twenty 120 days of the receipt of the noticeSECTION 126 E ADD Renewal Discretion Unless otherwise provided by federal law,but no later than eighteen months prior to the end of the franchise, application is to be madeby the grantee for renewal The Board may take into account quality of service, customercomplaints, degree to which the grantee has extended service, condition of to exceed 6 MHz, and onereverse data path not to exceed 6 MHz, shall be reserved for use by the County forCounty data Franchisee shall provide these channels without charge to the Countygovernment facilities These data channels shall be coordinated so as to provideconsistent quality transmission within and between CATV systemsSECTION 128 E ADD The grantee shall own the cable communications system, butshall have no property right in the public rights of way upon the completion of the Franchiseterm or any extension thereofADD YAND GSECTION 129 F As a condition of the Franchise, grantee shall provide television and dataservice to all County government facilities, and television service to the public school facilitieswithout chargeSECTION 129 G At all points where separate CATV systems are in the same general area,they shall allow for a coordinated interconnect where technically and economically feasible,between their systems to allow the flow of data on the county government channels Theexpense to be shared between the granteesSECTION 129 C in at least forty 40 per cent of the franchise area, ADD for homeswithin 350 feet of the cable system Residences for the Franchise cable system shall be offeredthe option to pay the construction costs for the number of feet exceeding 350 feet which arerequired to service such residenceSECTION 1215 EFFECTIVE DATE by any Federal, state or Local statute or regulation,such portion shall be deemed a separate, distinct and independent provision and such holdingshall not affect the validity of the remaining portions thereof4 Cable TV Franchise - Transfer of Cable Operation - Carolina Cable Partners - SecondVoteSecond Vote First vote was taken at the March 6, 1995 meeting following a public hearingUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner James W Cashand carried by unanimous vote, the Board approved the transfer of cable operation from ChannelMaster Cable to Carolina Cable Partners and approved a franchise for Carolina Cable Partners tooperate cable system in Johnston County in the areas, which were franchised to Channel MasterCable Company5 Rescue Sauads - ChanL-es in Level of Service - Second VoteSecond Vote First vote was taken at the March 6, 1995As recommended by the Johnston County Emergency Management Advisory Board,Commissioner Eleanor N Creech moved the Board approve the following changes in the level ofservice for the Micro Rescue Squad and the Newton Grove Rescue SquadMicro Rescue Squad - re-franchised at EMT-Basic Level due to a shortage of volunteers forday-time coverageNewton Grove Rescue Squad - upgrade to EMT-D level of service as they have met all therequirementsCommissioner Cookie Pope seconded the motion which carried by unanimous vote6 Zebulon Rescue Squad - Request for Funds for Service in Johnston CountyGarland Tant, captain of Wake Countys Zebulon Rescue Squad, addressed the Boardconcerning the cost of providing service in Johnston County Mr Tant explained that since 1974,Zebulon Rescue has served Johnston County citizens who live in the area and who are not servedby a Johnston County squad The only funds they receive for this service come from a limitednumber of 50 membership fees and donations from the citizensWake County handles their billing for non-members and insurance claims, and unlikeJohnston County, the money received does not go directly back to the squads In Wake County thefunds collected for rescue service are used to provide paramedics for each of the squads Mr Tantasked the Board to consider providing some assistance so they will be able to continue the same levelof service in Johnston County690Chairman Norman Denning thanked Mr Tant for his comments and assured him the Boardwould take this request under advisement Commissioner Eleanor N Creech and other boardmembers expressed gratitude for the service Zebulon Rescue Squad is providing in Johnston County7 Board of Education - Amended Application for State ADM Funds Wilsons Mills SchoolCounty Manager, Richard B Self, informed the Board the State ADM funds in the amountof 2,000,000 for Wilsons Mills School were approved last spring At that time, the state allocated1,500,000 for FY 1994-95, and the remaining 500,000 for FY 1995-96 The State has informed theCounty the 500,000 is now available in this years funding and has recommended the Countyamend their current year application to request the entire amountCommissioner James W Cash moved the County approve the amended application for StateADM funds for the Wilsons Mills Project to reflect the entire amount of 2,000,000 in this yearsrequest Commissioner Jerry F Wood seconded the motionDiscussionCommissioner Cookie Pope stated she would support this request, but felt the architecturalcost associated with this project and other school projects is too high and needs to be addressed bythe Board of EducationCommissioners Eleanor N Creech and Cecil M Massengill concurred, but pointed out theBoard of Education is bound by the mandates and requirements of the State in this matterThe motion passed by unanimous vote8 Board of Education - Reauest for Countv Water SewerCounty Manager, Richard B Self, explained the Board of Education is requesting that theCounty assign retail customer status to all future county schools for water and sewer service,wherever these services are availableUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner John M Bookerand carried by unanimous vote, the Board approved the Board of Educations request for Countywater and sewer for all future county schools wherever these services are available9 Proclamation Child Subbort Awareness Month - MavUpon a motion by Commissioner Eleanor N Creech, seconded by Commissioner Cookie Popeand carried by unanimous vote, the Board adopted the following proclamationPROCLAMATIONWHEREAS The welfare of our children is the most important responsibility we have asparents, and all children should be able to depend on support from both parents;andWHEREAS Children who do not receive adequate financial and emotional support from bothparents traditionally experience greater difficulty in becoming healthy, happyand productive citizens; andWHEREAS Many concerned and dedicated people, especially child support enforcementprofessionals, work to establish and enforce child support orders to make errantparents accountable; andWHEREAS In fiscal year, 1993-94, the Johnston County Child Support Enforcementprogram, with a caseload of 4123, established 725 new child support obligationsand collected 3,600,250 for the support of these childrenNOW, THEREFORE, the Johnston County Board of Commissioners does hereby applaud the effortsmade by the Johnston County Child Support Enforcement program and other programs across thestate, and joins in the effort to increase public awareness of the importance of child support to thefuture of our children; location or expansion of industry, and to discusswith an attorney matters relating to the lawsuit, Bob Hollister vs Johnston CountyRegular Session ResumedUpon a motion by Commissioner John M Booker, seconded by Commissioner Eleanor N Creechand carried by unanimous vote, the Board adjourned closed session and resumed regular sessionLUNCH WITH TOURISM AUTHORITY18 CHANGE IN MEETING LOCATIONDue to the large number of people in attendance, Commissioner John M Booker moved theBoard move to the Old Superior Courtroom Commissioner Eleanor N Creech seconded the motion,which carried by unanimous vote19 Liquor by the DrinkJason Shallcross presented petitions asking the Board of Commissioners to call for a referendumon liquor by the drink in Johnston County The petitions contained over 1000 signaturesLee Colbert, Pastor of First Baptist Church in Smithfield, spoke on behalf of a group of localministers He asked the County to require those interested in a referendum to obtain signatures of 35of registered voters He pointed out this would automatically mandate a vote of the people and wouldprevent the Board from having to make a decision on this sensitive issueSeveral persons spoke in opposition of liquor by the drink in Johnston County Robert Brooks,Clayton minister; Keith Kimbel, Micro; Hank Daniels, Smithfield; Horace Ricks, Selma; John DenningKight, Smithfield; Jana Branscome, Clayton; Gayle Bizzell, Smithfield; Bessie McElveen, Smithfield;and Becky Knott, SmithfieldPaul Mason from the Clayton area stated that, in his opinion, the citizens of the County shouldhave the opportunity to vote on the matterChairman Norman C Denning stated the Board would consider this matter and take everyonesviews into consideration20 Home Builders Association of Johnston County and Johnston County Board of Realtors -Impact Fees and Land Transfer TaxGloria Faulk, representing the Johnston County Board of Realtors, spoke in opposition to theproposed 2 land transfer tax and 750 impact fee on new construction She stated the realtors feel thiswould be unfair to young homeowners She asked the Board to find a broader-based solution forsecuring the needed revenue for school construction in Johnston CountyBruce Nichols, President of the Home Builders Association, stated that in his opinion, thebuilding industry is the third largest industry in Johnston County and already generates muchrecurring revenue through property taxes He stated the Home Builders Association believes theproposed taxes are too aggressive and would seriously deter growth in their industry He alleged thatfarmers would reduce their land to the least resale value before selling He asked the Board to considerother ways to find the necessary revenue for schoolsKay Smith with Branch Banking Trust, spoke on behalf of mortgage lenders in the CountyShe voiced opposition to the proposed taxes and stated their goal is to move people into their own homeswhereby they will contribute to the Countys revenue by paying higher property taxes The proposedtaxes, or any effort to place a moratorium on building in the County, would, in her opinion, punish thepeople who are creating growth and make them pay for problems caused by what she sees as theCountys failure to keep up with school construction needsMs Smith pointed out the local legislators, in response to their request, have placed a blank billbefore the General Assembly to allow the Commissioners, with the help of the Home Builders, Realtorsand lending institutions, to come up with other ways to generate revenue for school constructionChairman Norman C Denning thanked everyone for their comments, but asked what solutionsthey were offering He pointed out the average homeowner who has two children in school does not payenough property taxes to cover the Countys contribution to school current expense for those twochildren, much less cover school capital outlay expenses or the other expenses associated with theoperation of local government He stressed that the greatest need in Johnston County is to offer the besteducation to our children The school needs are real and the County simply does not have the moneyto meet those needsThe following persons spoke in opposition to the proposed taxes Carroll Stephenson, SonnyJohnson, Ashley Turner, Hutch Earp, Horace Cox, Jerry Clifton, Debra Clifton, and Whit DavisCommissioner Cookie Pope responded that she is very interested in finding alternatives to thetaxes She challenged the Board of Commissioners and the Board of Education to look at their budgetsin an effort to see if the taxpayers can be spared She suggested the Commissioners might look atrefinancing the current debt of approximately 16,000,000 to provide needed revenueCommissioner Eleanor N Creech stressed that each member of the Board wants to be fair to allthe citizens She stated that perhaps the fairest method of generating revenue might be a sales taxincrease, but that, too, would be a problem when it comes to finding support She noted there has beentalk of a bond issue, but questioned how many would actually support a bond issue if it came to a votein Johnston County, especially if it meant increased property taxesm 19Commissioner John M Booker stated the Board recognizes that any new tax would affect thecitizens in some manner; however the problem is simply that schools need to be built in JohnstonCounty and the money is not available It seems that everyone agrees with the need, but no one wantsto pay the price He noted the County would not be in this position if it were not for unfunded mandatesfrom the state and federal governments, which have depleted the county tax dollarCommissioner Booker noted that the Board was aware a blank bill had been introduced, but wasunsure what it would to be used for He stated the Commissioners would welcome suggestions Hestressed that all meetings, including budget sessions, and all books and figures have always been opento the public, unfortunately, very few people have ever shown any interestCommissioners James W Cash remarked that the Board is not against growth and wants thecounty citizens to be successful He agreed that the Commissioners would welcome all suggestions fromthe citizensCommissioner Jerry F Wood concurred and stated the Board now has to wait to see what thelegislature will do concerning the bills He pointed out the Commissioners only option is to find someway to resolve this problemIn response to Commissioner Popes comments, Commissioner Cecil M Massengill stated thatthe Board has looked carefully at the budget and will continue to do so The fact is that there is enoughmoney coming into the County to meet our needs; however, the Commissioners are forced to use over50 of the Countys revenue for services for which the Board has no control He referenced the coststo the County for supplementing the jail, the ever-increasing cost of Social Services programs, and theloss of revenue from the intangibles tax, which is being repealed by the General Assembly Thesefactors greatly impact the Countys budget, and Commissioner Massengill invited the citizens to writetheir legislators for relief He also invited the public to give the Board suggestions and noted theCommissioners need the help and support of the citizens to solve this problemChairman Denning again thanked everyone for expressing their opinions and invited them toattend the Commissioners meetings He stated the Board will now wait to see what the legislature doesconcerning the local billsTHE BOARD RETURNED TO THE COMMISSIONERS MEETING ROOMRefinancing of Current Debt DiscussedCounty Manager, Richard B Self, at the request of the Chairman responded to the suggestionby Commissioner Pope that the County might refinance their current debt of approximately16,000,000 Mr Self explained the following• The 9 million bond issue for the Four Oaks School, which is now reduced toapproximately 6 million, is not callable - can not be refinanced• The monies owed on the sewer plant and landfill property are being paid through userfees, not ad valorem taxes The Public Utilities Department is largely self supporting• The airport loan represents funds borrowed by the Airport Authority and is being paidback by the airport through rental fees for hangars• The funds borrowed for the construction of the Social Services addition and renovation arebeing paid by reimbursements from the State• The funds borrowed for the construction of the ASCS building are being paid through rentfrom ASCS• The Cleveland School loan was obtained at 38 interest and with the current economy,this interest rate can not be improved uponMr Self continued that this leaves very little debt, all of which is tax exempt21 Mike Moodv - School NeedsMike Moody from the Corinth Holder Community spoke with the Board concerning the need fornew schools and school renovation in the County Mr Moody offered his support in the event the Boarddecides to call for a school bond referendum He spoke of the need to cut budgets and specificallyquestioned the operational expenses in school administration He asked the Commissioners to requestthat the Board of Education take a good look at their budget and make cuts, especially in the area ofhigh paid school administratorsCommissioner Eleanor N Creech pointed out the State is responsible for tenure of schoolpersonnel and the County has no control over this matter The School Board determines their ownbudget and the County does not have the authority to oversee this Concerning the Countys budget,she noted that in past years when she served as Clerk to the Board, she knows the County Manager,on his own initiative, asked the department heads to cut their budgets to provide for a lean Countygovernment She assured Mr Moody that the Board will not sanction any fat in any budget over whichthey have controlWChairman Norman C Denning remarked that the County Commissioners are very tax consciousand will certainly look carefully at the Countys budget He also stated he believes the Board ofEducation will make every effort to cut their budget wherever possibleCommissioner John M Booker asked the County Manager to explain how factors outside of theCountys control, influence the current expense figure the County allocates to the schools each year, MrSelf explained that Johnston County is considered a low wealth county and thereby is subject tosubstantial additional funding from the State In order to keep that status, the County must maintainthe same per pupil dollar figure from the previous year, regardless how great the increase inenrollment The County is currently paying 631 per pupil, and this means that for each additionalstudent enrolled, the countys current expense appropriation must increase 631 In the 1995-96 schoolyear, the County is expecting the enrollment to increase by more than 800 students - a substantialincrease that does nothing but maintain the status quoFollowing further discussion the Chairman thanked Mr Moody for his comments and assuredhim that the new Corinth Holder School is still the number two project on the priority list, only behindthe replacement of the burned Glendale-Chapel school The Board voiced their appreciation for MrMoodys support22 Liquor by the Drink DiscussedCommissioner Jerry F Wood moved the Board call for a countywide referendum on liquor by thedrink and malt beverages to be held in conjunction with the next electionIn response from several commissioners indicating they
