June 27, 1995The Johnston County Board of Commissioners resumed regular session Tuesday,June 27,1995, at 7 00 oclock pm in the Commissioners Meeting Room, Johnston CountyCourthouse Annex, Smithfield, North Carolina, with the following membersPresent Norman C Denning, Chairman, Dr John M Booker, Vice Chairman,James W Cash, Jerry F Wood, DDS, Cecil M Massengill, Eleanor NCreech and Cookie PopeAbsent NoneAlso Present Richard B Self, County Manager, and Joyce H Ennis, Clerk to the BoardThe Chairman called the meeting to orderMocassin Creek Service DistrictLetters mailed to each property owner within the proposed districtThe Chairman explained the purpose of the meeting was to set boundaries anddetermine a tax rate for the proposed Mocassin Creek Service District He stated an auditof the old drainage district books has been completed and the balance sheet and aproposedbudget was sent to all property owners He directed attention to a boundary map preparedby the Countys GIS Mapping Department using the original drainage district boundariesHe invited those present to examine the map to make sure they were in agreement as tothe area to be included in the districtThe Chairman noted Commissioners would appoint a board to oversee the districtand recommend future tax rates He suggested a five member board, one member fromeach of the towns involved, Selma and Pine Level, and three members from the rural areaof the district In discussion it was determined that all members, including thoserepresenting the towns, should be residents of the district It was pointed out the boardwould be subject to the Open Meetings Law, therefore, all meetings would have to beadvertised and open to the publicCounty Manager, Richard B Self, reviewed the figures on the balance sheet andthe proposed budget He explained the new service district would be under CountyGovernment whereas the original district was not The County would maintain the books,which would be audited each yearCounty Forgives DebtFollowing discussion, Commissioner John M Booker moved the Board ofCommissioners forgive the outstanding debt of 5,47758, which was owed the County bythe old drainage district, and recommended these funds be used to make some neededimprovements to the drainage ditchCommissioner Cookie Pope seconded the motion, which carriedby unanimous voteDiscussionBoard members asked if anyone present had any questions on the figures presentedin the balance sheet or the proposed budget for the districtWade Miller, Lee Best, and Grover Godwin each spoke of problems they have hadwith water standing on their property The Board explained that these types of problemsshould be addressed to the district board once it is formed There will be some funds,including the amount the County is making available by forgiving the debt, which can beused for improvements to the canal75Dicky Braswell and Teeny Bizzell asked if a maximum rate could be set for thedistrictThe Board explained that it would be illegal to set a maximum rate, as one Boardcan not bind a future Board; however, they assured those present that they would alwaystry to adhere to the wishes of those in the districtCommissioner John M Booker pointed out that the reason the County isconsidering establishing this service district is because many citizens came to boardmembers and complained about the way the original drainage district was set up Hestressed that the Commissioners do not wish to run this district The Board ofCommissioners will be the governing body, but they would prefer if those living in thedistrict made the decisions on how it is run The appointed district board would be madeup of people in the district and they would be required to meet in public so all residentscould have input in their recommendations to the CommissionersMocassin Creek Service District CreatedFollowing further discussion Commissioner John M Booker moved the Boardestablish the Mocassin Creek Service District with the boundaries as indicated on the mapprepared by the Johnston County GIS Mapping DepartmentvoteCommissioner Jerry F Wood seconded the motion, which carried by unanimous04 Tax Rate Set for Mocassin Creek Service DistrictUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner JohnM Booker and carried by unanimous vote, the Board set the 1995-96 tax rate for theMocassin Creek Service District at 04 per one-hundred dollar property valuationFive Member Board Established for Mocassin Creek Service DistrictCommissioner Jerry F Wood moved the Commissioners establish the MocassinCreek Service District board to oversee the maintenance and operation of the MocassinCreek Drainage District with membership as followsthree rural district residents and one district resident from the Town of Selma andone district resident from the Town of Pine LevelCommissioner Cecil M Massengill seconded the motion, which carried byunanimous vote2 Recreation Grant ExtensionsUpon a motionby Commissioner Jerry F Wood, secondedby Commissioner EleanorN Creech and carried by unanimous vote, the Board approved 30-day extensions of thefollowing Recreation Grants Four Oaks Elementar School 9495-13;
