November 6, 1995The Johnston County Board of Commissioners met in regular session Monday,November 6, 1995, at 10 oclock am in the Commissioners Room, Johnston CountyCourthouse Annex, Smithfield, North there were any corrections to the minutes of the October2, 24, 1995 board meetings There being no corrections, the Chairman declared theminutes approved as presented2 Regular Meeting in December RescheduledCounty Manager, Richard Self, reminded the Board that several Commissionersand other staff members will be attending the Emergency Management Course atEmittsburg, Maryland, from December 3rd through December 8th He recommended theBoard reschedule the December Board meetingUpon a motion by Commissioner John M Booker, seconded by CommissionerCookie Pope and carried by unanimous vote, the Board rescheduled the regular Decembermeeting to Friday, December 1, 1995, at 1000 am3 Proclamation - Veterans DayUpon a motion by Commissioner James W Cash, seconded by CommissionerEleanor N Creech and carried by unanimous vote, the Board adopted the followingproclamationVETERANS DAY - 1995WHEREAS, for decades America has paused on the 11thofNovember, the anniversaryof the armistice that concluded World War I, to remember and to honor our veterans ofmilitary service in proud and grateful recognition of the hardships and sacrifices by themillions of men and women who have defended our land in war and in peace; andWHEREAS, the freedoms we enjoy have been purchased and maintained at a highprice, as Americans have been willing, throughout our history, to fight and die to preservetheir individual rights as guaranteed in the United States Constitution and the Bill of Rights;andWHEREAS, Americans owe a great debt to all those who have served in defense ofthis nation throughout the generations; for their sacrifices, often resulting in permanentinjury or death, which have preserved our unique form of government dedicated to humanright and respect for the individual, and preserved Department ofTransportation requesting the following roads be added to the State Secondary System formaintenanceAustin Drive and Lindsay Drive in LaFayette Place Subdivision, ClevelandTownship; Northside Drive, in Northside View, Boon Hill TownshipFollowing review, Commissioner Eleanor N Creech moved the Board concur withthe NC Department of Transportations request to add the roads listed above to the StateMaintained System Commissioner Cookie Pope seconded the motion, which carried byunanimous vote5 Solid Waste Decal Fees ProratedCounty Manager, Richard Self, recommended the Board consider further prorationof the solid waste decal fee to accommodate the many new people moving into the CountyHe recommended the following breakdown of fees for new users, pointing out this wouldnot affect citizens renewing decals from the previous yearNew Users Purchasing Decals July - September 4000New Users Purchasing Decals October - December 3100New Users Purchasing Decals January - April 2300New Users Purchasing Decals May - June - Prorated and added to nextyears costFollowing discussion, Commissioner Cookie Pope moved the Board adopt theprorated solid waste decal fees for new users as recommended Commissioner Jerry FWood seconded the motion, which carried by unanimous vote6 Release of State Funds to Triangle J Council of GovernmentsUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner JamesW Cash and carried by unanimous vote, the Board adopted the following resolutionRESOLUTIONWHEREAS, North Carolina recognizes leadregional organizations as voluntary groupsserving municipal and county governments; andWHEREAS, the 1995 General Assembly appropriated 864,270 to help the leadregional organizations assist local governments with grant applications,economic development, community development, and to support localindustrial development activities and other activities as deemedappropriate by their local governments; andWHEREAS, in the event that a request is not made by a unit of government for releaseof these funds to the lead regional organization, the funds will revert tothe State of North Carolina general fund; andWHEREAS, the Region J funds in the amount of 48,015 will be used to carryeconomic development plans for the regionNOW THEREFORE BE IT RESOLVED, that the Board of Commissioners of JohnstonCounty requests the release of its 6,29838 share of these funds to the Triangle J Councilof Government in accordance with the provisions of Chapter 324, House Bill 229, Section94 of the 1995 Session LawsAdopted this 6th the following resolutionRESOLUTION FOR PUBLIC AUCTIONWHEREAS, the County of Johnston is the owner of that certain property inClayton Township, Johnston County, North Carolina, more particularly described asfollowsBeing a triangle bounded on the west and north by Frazier Drive in theTown of Clayton, and on the east by Fire Department Road, and assignedParcel Identification No 3346 in the Mapping Office of the County ofJohnston, and also being identified by Tax Lot No 0394AND WHEREAS, the County of Johnston declared that this property is surpluspropertyUpon Motion duly made, seconded and carried, the Commissioners of JohnstonCounty adopt a Resolution as followsRESOLVED, that the real property described in Exhibit A attached hereto andincorporate herein by reference shall be sold cause of death by disease in the UnitedStates; andWhereas, in this year alone, more than 650,000 Americans will contact the diseaseand 160,000 will die from it, including a disproportionate number ofHispanic Americans, African Americans, and Native Americans; andWhereas, people with diabetes have a high risk of developing serious complications,such as blindness, kidney disease, heart attack and the Corinth Holder line in order to comply withthe contract with WendellIn response to a question concerning the cost of wells, Commissioner John MBooker stated that wells in that area would cost from 1800 to 4500, depending on thedepth of the well He suggested the Board consider re-establishing a fee countywide in aneffort to build a fund for future cost of water lines He noted that with the growth in theCounty and the continued need for new lines, this would provide a source of revenue to beused in lieu of ad valorem taxesCommissioner Cecil M Massengill voiced concern that the people in the area wouldbe confused due to earlier talk of small tap-on fees when the community was discussinga water district194Commissioner Eleanor N Creech pointed out that there is a difference in theCounty building a line with tax dollars, and the people of an area establishing a waterdistrict The County met in the Corinth Holder Community several times in a effort toencourage the citizens to establish a water district, but there was little interest Since theCounty has now built the line to the school, citizens along that line that want waterservice must realize they will have to pay for that service Her biggest concern, she noted,is that the County be fair and consistent and provide the citizens information explainingwhat has happenedFollowing further discussion, Commissioner John M further comments, the Chairman closed the public hearing19522 Resolutions Creating Water DistrictsA CLEVELAND WATER DISTRICTUpon a motion by Commissioner Cookie Pope, seconded by Commissioner Cecil MMassengill and carried by unanimous vote, the Board adopted the following resolutionRESOLUTION CREATING THE CLEVELAND WATER DISTRICTOF JOHNSTON COUNTYWHEREAS, the Johnston County Board of Commissioners hereinafter theBoard at its regular meeting on October 2, 1995 resolved that a Public Hearing be held,pursuant to NC General Statutes Chapter 162A-88 et seq, to consider creation of theCleveland Water District of Johnston County; and,WHEREAS, the Board further resolved that the said Public Hearing should beheld on Monday, November 6, 1995 and directed the appropriate representative of theCounty to take the necessary actions to hold the Public Hearing; andWHEREAS, the Board further resolved that the appropriate representatives ofthe County take the necessary actions to properly notice said Public Hearing as providedby law; andWHEREAS, pursuant to NC General Statutes Chapter 162A-86, a Notice ofPublic Hearing was prepared stating the date, hour and place of the hearing and itssubject and setting forth a description of the territory to be included within the proposedCleveland Water District of Johnston County; and,WHEREAS, pursuant to said NC General Statutes Chapter 162A 86, the Noticeof Public Hearing was published once a week for three weeks in newspapers that circulatein the proposed district and posted in at least three public places in the district TheNotices of Public Hearing were posted and published the first time not less than twentydays before the hearing; and,WHEREAS, a Public Hearing was held at 1100 am on November 6, 1995 in theCommissioners Room, Courthouse Annex, Smithfield, North Carolina at which timetaxpayers and all other interested persons appeared and were heard concerning thequestion of creating the Cleveland Water District of Johnston County; andWHEREAS, the Board, following the Public Hearing, finds that1 There is a demonstrable need for providing in thedistrict water services;2 The residents of all the territory to be included in thedistrict will benefit from the districts creation; and3 It is economically feasible to provide the proposedservice or services in the district without unreasonableor burden- some annual tax levies; andWHEREAS, the Board recognizes that vital matters to be considered in creatingthe district are the availability of federal funding and the successful issuance of bondsand or notes for the purpose of providing funding to provide water to the district, orportions thereof, and the number of users who contract to purchase water; and,WHEREAS, the Board finds that the district shall be defined as set forth in theNotices of Public Hearing and,WHEREAS, the Board now desires to create the Cleveland Water District ofJohnston County,NOW, THEREFORE, BE IT RESOLVED by the Johnston County Board ofCommissioners, as follows1 It is hereby found thata There is a demonstrable need for providing in thedistrict water services;b The residents of all the territory to be included in thedistrict will benefit from the districts creation; andc It is economically feasible to provide the proposedservice or services in the district without unreasonableor burdensome annual tax levies; and2 The Cleveland Water District of Johnston County is thereby created asprovided above and the said District is hereby described as follows196DISTRICT BOUNDARIES FORTHE PROPOSED CLEVELAND WATER DISTRICTBeginning at the Johnston CountyWake County line intersection with White Oak Creekfollowing the centerline of White Oak Creek in a southeasterly direction to a point 500north of the centerline of SR 1550; thence in a westerly direction parallel with SR 1550approximately 2,500 to a point on the eastern boundary line of Orton Acres subdivision500 north of SR 1550; thence in a northwesterly direction along Orton Acres subdivisionboundary line approximately 550 to a point; thence in a westerly direction along thenorthern boundary of Orton Acres subdivision approximately 820 to a point; thence in asouthwesterly direction along the western boundary of Orton Acres subdivisionapproximately 430 to the point of intersection between the western boundary of OrtonAcres subdivision and the northern boundary of Fashion Homes subdivision; thence in awesterly direction 660 to a point; thence in a southerly direction along the westernboundary of Fashion Homes subdivision to a point 500 south of SR 1550; thence in aneasterly direction parallel with SR 1550 approximately 1,400 to a point on the westernboundary of White Oak Ridge subdivision; thence in a southeasterly direction then awesterly direction along the boundary of White Oak Ridge subdivision approximately3,600 to the intersection with White Oak Creek; thence in a southerly direction alongWhite Oak Creek to the confluence with Swift Creek; thence in a southeasterly directionalong Swift Creek to a point at the intersection of Swift Creek and the northwesternboundary of the Hopewell-Pisgah water Monday, November 6, 1995 and directed the appropriate representative of theCounty to take the necessary actions to hold the Public Hearing; andWHEREAS, the Board further resolved that the appropriate
