October 1, 1996The Johnston County Board of Commissioners met in regular session Tuesday, October 1, 1996,at 10 oclock am in the Commissioners Room, Johnston County Courthouse Annex, Smithfield, transacted1 Resource Officers for Schools Introduced to BoardSheriff Freddy Narron introduced the six new resource officers that were hired to work in the fivehigh schools and the alternative school He thanked the Board for approving these State funded positions,and stated he has high expectations for these six young men2 Department of Transportation - Addition to SystemThe Board reviewed petitions presented by the North Carolina Department of Transportationrequesting the following roads be added to the State Secondary System for maintenancePowell Drive in Glenview Acres, Section Four Subdivision, Wilsons Mills Township, and TylerDrive an industrial road in Smithfield TownshipFollowing review, Commissioner John M Booker moved the Board concur with the NC Departmentof Transportations request to add the roads listed above to the State Maintained System CommissionerCookie Pope seconded the motion, which carried by unanimous vote3 Proclamation Recording Termination of County State of EmergencyCommissioner John M Booker moved that the Chairmans proclamation, which was issued onSeptember 14, 1996, for the purpose of terminating the County State of Emergency, be entered in therecords of this meeting Commissioner Cookie Pope seconded the motion, which carried by unanimousvotePROCLAMATION TERMINATING A COUNTY STATE OF EMERGENCYSection 1 On September 6, 1996 at 330 am, I determined and proclaimed a localState of Emergency for the County of Johnston and ordered the executionof the emergency reaction planSection 2 On September 6, 1996 at 330 am, I imposed a curfewSection 3 I have determined that a State of Emergency no longer exists in the County of JohnstonSection 4 I thereby terminate the proclamation of a local state of emergency and all of the restrictionsand orders thereinSection 5 This proclamation is effective immediatelyProclaimed this 14th day of September at 600 amSigned Norman C Denning, Chairman4 Hurricane Fran - Update on Status of County Authorization to Apply for Federal AssistanceDewayne West, Emergency Management Services Director, reported on the status of the Countyfollowing Hurricane Fran He thanked the more than 290 employees who participated in the recoveryprocess, and the many field personnel who willingly risked their lives to help others in need He referencedthe week -long All Hazards Integrated Emergency Management Course that approximately 70 peoplefrom Johnston County attended last year at Emmitsburg, Maryland, and stated the information gained onthat trip served the County extremely well in this emergency407Mr West noted the Countys response and recovery plan worked very well, however, several areaswere identified as needing further study Flooding has been a real concern, which has pointed out a needto address the height of the dike at the sewer plant, as well as potential problems with countywide waterand wastewater systems More back -up generators and easier access to essential emergency items will beaddressed both at the state and local level He requested the Board approve application for state andfederal funds under the Disaster Relief Act andor the Presidents Disaster Relief FundUpon a motion by Commissioner Cecil M Massengill, seconded by Commissioner Eleanor NCreech and carried by unanimous vote, the Board authorized application for state and federal financialassistance, and designated the County Manager to sign the necessary forms5 Temporary Deputy Fire Marshall Position - Emergency Management DepartmentCounty Manager, Richard B Self, informed the Board that the federal government will providetemporary funds for a deputy fire marshall This position would provide much needed help for DewayneWest, allowing him time to pursue every avenue and meet all requirements for state and federal assistanceto help Johnston County totally recover from Hurricane Fran He noted that the position would bedependent on federal fundsCommissioner Cookie Pope questioned whether this work could be done by a clerical positionDewayne West responded that only a qualified fire marshall could provide the assistance he needsFollowing further discussion, Commissioner John M Booker moved the Board approve a federallyfunded deputy fire marshall position for up to 18 months for the Emergency Management DepartmentCommissioner James W Cash seconded the County and its citizens experienced significant damage, discomfort andimposition from Hurricane Fran in early September 1996, including the widespread loss of electricservice; andWHEREAS, the citizens of Johnston County and its leaders exhibited exemplary patience,understanding and teamwork in rising above the difficult aftermath of the storm; andWHEREAS, the citizens of Johnston County and its letters were mailed to adjoining property on September 19, 1996 and notices wereposted at the locations on September 19, 1996The Chairman opened the public hearing and invited anyone who wished to speak on the followingrezoning cases Those persons wishing to speak on Case 182, 183, and 184 were sworn in by the ClerkCASE #178 Petition to rezone approximately 10 acres parcel located on Old Fairground RoadSR 1309 in Pleasant Grove Township from ARR40 to General BusinessOwners Michael WeeksCal Genereux, Planning Director, explained that Case 178 was tabled by the Planning Board, andthe Owner withdrew his request by phone, but not in writing as required by the Zoning OrdinanceBecause the withdrawal was never formalized, the case was again considered by the Planning Board andrecommended for denialRobert Parker, adjacent property owner, stated he was opposed to the rezoning He noted Mr Weekshas built a professional motorcycle race track on the property and is allowing friends to race This hasbecome a problem for the neighbors, and if he is given permission to operate as a commercial business,he feels this would make matters worse Ernest House, who also lives in the surrounding zoning He notedthere was no opposition at the Planning Board hearing, and the case was recommended for approvalKathy Peralta, who lives in a subdivision in the area, asked if traffic serve no alcohol, allow no dancing and close by 1200 midnightLou Jernigan, prior property owner, asked ifthe use could change if the property was later sold MrGenereux explained that zoning runs with the land and the same requirements would be for any newownerMIDCASE #184 Petition to rezone approximately 55 acres located on Cleveland Road SR 10 10in Cleveland Township from ARR40 to Residential 10 Special Use DistrictOwner Heirs of Nancy Lee - Administrator Nancy JonesCal Genereux indicated the property on a map and explained the property is about 1000 feet fromthe Cleveland Elementary school property, with the only road frontage on SR 1010 He stated there wasdiscussion at the Planning Board hearing about traffic concerns, and the applicant owner has consentedto special use for single family detached stick built homes The property would be served by both publicwater and sewerKathy Peralta, representing the Cleveland School PTA, voiced concern about the rapid growth,which has created school overcrowding and traffic problems in the area She stated that the people sheis representing feel the area does not need another subdivision with more families; especially one with onlyone entrance near the school where the safety of the children is a priority She stated the people in hercommunity want better land use planningChairman Norman Denning responded that this hearing is part of the Countys land use planningprocess; however, he pointed out the Board has to look at everyones interest He noted the people whoown the land feel they should be allowed to develop the property As much as the County might like to,it cannot hold up growth until everyone is readyAnna Childers who lives near the property agreed with Ms Peralta voicing further concerns aboutthe traffic and the general attractiveness of the area She asked if the development would have governmentsubsidized housing and asked about the size of the lots and the houses proposed Marvin Williams,adjacent land owner, also opposed the rezoningNancy Jones, representing the heirs to this land, responded she and her sisters want to market theproperty now that water and sewer are available They have agreed to 13,000 to 14,000 sq ft lots andonly single family stick -built homes, which will probably be between 1400 to 1800 sq ft in size Shestated they have been working with District Engineer, Ken Murphy, with the NC Department ofTransportation, and are prepared to extend the existing turning lane to help traffic problems at the schoolBellman Blieff stated that even though he opposed the rezoning at the Planning Board hearing, henow supports the petition as he feels the major concerns have been addressed He pointed out the area isgoing to continue to grow, and he feels everyone should have the opportunity to be a part of the growthTom Davis, Deputy Superintendent of Schools, expressed concern that high density dwellings willadd more traffic and more strain on the already crowded schools in
