November 4, 1996The Johnston County Board of Commissioners met in regular session Monday, November 4, 1996,at 10 oclock am in the Commissioners Room, Johnston County Courthouse Annex, Smithfield, NorthCarolina, with the following membersPresent Norman C Denning, Chairman, Dr John M Booker, Vice Chairman, James W Cash,Jerry F Wood, DDS, Cecil M Massengill, Eleanor N Creech and Cookie PopeAbsent NoneAlso Present Richard B Self, County Manager, and Joyce Ennis, Clerk to the BoardThe Chairman called the meeting to order and the following business was transacted1 MinutesThe Chairman asked if there were any corrections to the minutes of the September 3, 9, 1996 andOctober 1, 1996 board meetings There being no corrections, the Chairman declaredthe minutes approvedas presented2 Authorization Removal of Storm Debris from CreeksKenneth York, District Conservationist, informed the Board the Federal Government has a grantprogram to remove trees and debris from creeks and waterways The Grant requires a 25 local match,which the State Division of Emergency Management has agreed to pay due to the damage caused byHurricane Fran He stated that 28 sites across the County have been identified as having considerabledebris, however, only 3 county waterways fit the highest category for immediate attention under the grantfunds Moccasin Creek, a small creek that runs parallel to Hwy 222 in the Kenly area, and Little Creek,which is located both in the County and in the Town of Clayton The Little Creek project would be a jointeffort on the part of both the County and Clayton A fourth creek in Four Oaks is eligible, however it iscompletely within Four Oaks jurisdiction and will be handled by their town councilHe requested the Board approve applications for grants on these projects and authorize theChairman andor County Manager to sign the necessary documents He also asked the Board to appointRichard B Self as liaison between the County and the Natural Resources Conservation Service on theseprojectsChairman Denning stated he was pleased to hear that these creeks would get some attention;however, he noted other waterways in the County need attention also Mr York responded that he woulddo everything possible to get as many projects funded as possibleFollowing further discussion, Commissioner Jerry Wood moved the Board approve applications forfederal grants to clean debris from Johnston Countys creeks and waterways and authorize the Chairmanandor County Manager to sign all the necessary documents Commissioner Wood further moved theBoard appoint Richard B Self, County Manager, as liaison between the County and the USDA NaturalResources Conservation Service for these projects Commissioner John M Booker seconded the motion,which carried by unanimous vote3 Veterans Proclamation ApprovedUpon a motion by Commissioner Eleanor N Creech, seconded by Commissioner Cookie Pope andcarried by unanimous vote, the Board adopted the following proclamation and presented a signed copyto Retired Army Colonel John Reeder, Past President of the Johnston County Veterans CouncilVETERANS DAY - 1996WHEREAS, for decades America has paused on the 11th of November, the anniversary of thearmistice that concluded World War I, to remember and to honor our veterans of military service in proudand grateful recognition of the hardships and sacrifices by the millions of men and women who havedefended our land in war and in peace; and417WHEREAS, the freedoms we enjoy have been purchased and maintained at a high price, asAmericans have been willing, throughout our history, to fight and die to preserve their individual rightsas guaranteed in the United States Constitution and the Bill of Rights; andWHEREAS, Americans owe a great debt to all those who have served day of November, 19964 Public Hearing 1015 am - Rezoning CasesAdvertised October 22, 29, 1996 - The Smithfield HeraldCertified letters were mailed to adjoining property on October 23, 1996 and noticeswere hosted at the locations on October 23 1996The Chairman opened the public hearing and invited anyone who wished to speak on the followingrezoning cases Those persons wishing to give testimony on Case 187 were sworn in by the ClerkCase 187 Petition to rezone approximately 421 acre parcel on SR 2141 in Pine Level Townshipfrom ARR -40 to ARR -40 Special Use District Owners James and Leta EdwardsCal Genereux, Planning Director, displayed a map of the property and explained the acreage hasbeen amended to 55 acres to include only the area required to erect the proposed BellSouth tower andnecessary fall zone He noted the property is located between Pine Level and Princeton close to Highway70Walter Ehrhardt, who lives in the vicinity, presented a petition with 18 signatures opposing therezoning Mr Ehrhardt stated this is a residential area and in his opinion, does not need a tower He voicedconcern that the structure would be unsightly and would decrease the value of property in the areaGray Styers and Kelly Davenport, both of BellSouth, provided information about the proposedtower and the new type of combination home cellular telephone service they hope to provide for JohnstonCounty Mr Styers stated the tower would be positioned away from the road and would back up to awood line to be as inconspicuous as possible The lattice tower would be self - supporting with no guidewires and would cause no interception or interference with any other device such as television, radio,garage doors, etcIn response to a question from Commissioner John M Booker concerning the number of towersproposed for Johnston County, Ms Davenport explained that six or seven sites are planned at this timeShe noted that BellSouth would use other facilities and would participate in co- locations where possibleIn this area of the County, however, no existing structures would be adequateCommissioner Cecil M Massengill commented on the difficulty that 911 Communications hasexperienced when they are unable to determine where a cellular call originates He asked if BellSouth hadany plans to work with Communication software to distinguish such callsMr Styers responded that digital technology is in the planning stage that would determine fromwhich tower and sector of that tower a call is comingCase 188 Petition to rezone approximately 56 acres at intersection of US 301 and SR 1345 inSmithfield Township from ARR -40 to Office Institutional Owners Bailey and AnnSwertfeger•Mr Genereux pointed out the two parcels on a map and indicated the surrounding zoning He notedthe property is located behind Holt Lake BBQ Restaurant One parcel is the site of a potential newindustry, and the other is Mr Swertfegers existing, non - conforming business, which was grand- fatheredin when zoning went into affect Mr Swertfeger wishes to bring this into conformity in order to expandDennis Blackmon spoke on behalf of Mr Swertfeger and stated the area is non - residential andcompatible with Industrial I developmentCase 189 Petition to rezone approximately 822 acres on SR 2360 in Boon Hill Township fromARR -40 to R -30 Owner Wade Eason and noted this property is located behind and adjacentto Mr Amans existing subdivision, Broadmoor He noted the PUD designation would allow four unitsper acre and would include residential units, recreational area and commercial usesDennis Blackman, surveyor representing Mr Aman, stated that a portion of this property is notsuitable for a septic system, and the PUD zoning would allow for more unanimous vote8 Public Hearing 1130 - Industrial Revenue Bonds Mebane Packaging - ResolutionAt 1100 AM, Chairman Norman C Denning announced that the Board of Commissioners for theCounty of Johnston the Board opened the public hearing and invited anyone who wished to be heardon the proposed restructuring by The Johnston County Industrial Facilities and Pollution ControlFinancing Authority the Authority of its 8,500,000 Johnston County Industrial Facilities andPollution Control Financing Authority Industrial Development Revenue Bonds Mebane PackagingCorporation Project Series 1992 the Bonds , at the request of MPC Packaging Corporation formerlyknown as Mebane Packaging Corporation, to a extend the maturity date for the Bonds until December1, 2005 and b change the schedule of principal amortization for the BondsIt was stated that the Board has reviewed an affidavit of publication of this hearing and a resolutionadopted by the Authority expressing its intention to so restructure the Bonds420Michael de Sherbinin, Economic Development Director, informed the Board that Mebane PackagingCorporation wishes to restructure their Industrial Development Revenue Bonds to extend the maturity alcohol abuse to the existingdrug addendum which tenants must sign; 2 establishment of a payment standards for the voucherprogram currently the County is using 80 of fair market rent and would like approval to continue thismethod; and 3 approval to change back to a policy requiring that tenants report a change in income whena change occurs, instead of the current method of reporting changes only been received from Larry WMassengill and Jackie E McLambThere being no further comments, the Chairman closed the public hearing42111 Appointments to Benson Planning BoardUpon a motion by Commissioner Cecil M Massengill, seconded by Commissioner John M Bookerand carried by unanimous vote, the Board appointed Larry W Massengill and Jackie E McLamb as ETJmembers of the Benson Planning Board for three year terms to expire November, 199912 Department of Transportation - Thoroughfare PlanWes Stafford from NC Department of Transportation met with the Board to discuss the possibilityof initiating a thoroughfare plan for Johnston County Mr Stafford explained that thoroughfare planningis a process whereby DOT and local officials look at traffic patterns, environmental concerns and potentialgrowth in a county, or other identified area, to determine and plan for future needs He noted this is nota promise to build roads, however, careful planning and study can be very beneficial and cost saving ThePlan would identify in advance the areas where there will be need, and would subsequently affect planningand zoning for those areas identified with potential traffic problemsMr Stafford explained the first step would be to meet with the planning staff, Planning Board, andlocal officials to determine background and general information about the County An engineer would beassigned to ride the County and collect field data The engineer would look at past, current and projectedpopulation figures, study land use pattern and roadway and bridge conditions He would collect trafficdata such as peak hours and accident information, with particular attention to the current condition ofroads and whether these roads would be able to carry additional traffic All data would be analyzedresulting in recommendations, which would be brought back to the County Public meetings would bescheduled to get input from the citizens and a final plan would be presented to the Board and DOT forapproval The final document would then be sent to the Department of Transportations TIP Committeefor consideration in the transportation program for Johnston CountyFollowing discussion, Commissioner Cecil M Massengill moved the Board authorize the NCDepartment of Transportation to proceed with a Thoroughfare Plan for Johnston County, and appoint CalGenereux, Planning Director, as the contact person to unanimous vote, the Board adopted the following resolution approving a tax exempt loan forthe Thanksgiving Fire DepartmentAPPROVAL OF TAX - EXEMPT LOAN TO VOLUNTEER FIRE DEPARTMENTNOW, THEREFORE, BE andcarried by unanimous vote, the Board adopted the following resolutionRESOLUTIONWHEREAS, North Carolina recognizes lead regional organizations as voluntary groups servingmunicipal and county governments; andWHEREAS, the 1995 General Assembly appropriated 864,270 to help the lead regionalorganizations assist local governments with grant applications, economic development,community development, and to support local industrial development activities andother activities as deemed appropriate by their local governments; andWHEREAS, in the event that a request is not made by a unit of government for release of thesefunds to the lead regional organization, the funds will revert to the State of NorthCarolina general fund; andWHEREAS, the Region J funds in the amount of 48,015 will Manager informed the Board that Wilsons Mills has requested the County provide thefollowing services for the town Planning and zoning, financial, tax billing and collections, building andfire inspections, and retail water and sewer serviceFollowing discussion, Commissioner John M Booker moved the County agree to provideplanning zoning, financial, tax billing and collections, building and fire inspections, and retail water andsewer service for the Town of Wilsons Mills as requested Commissioner Cecil M Massengill secondedthe motion, which carried by unanimous vote24 County Water ServiceThe Board discussed a recent letter from Kenly Town Manager, Ed Temple, written on behalf ofthe Kenly Town Council The letter stated that the Town of Smithfield has offered to sell water to Kenly,and referenced the possibility of Kenly contracting with the County for transmission service, as the waterlines between Smithfield and Kenly belong to the CountyChairman Norman C Denning pointed out that many of the municipalities, including Kenly,encouraged and formally supported the Countys decision to built a new water plant Now the County hasbuilt a first -rate plant and, in his opinion, ifthe municipalities want water through the Countys lines, theyshould buy their water from the CountyBoard members agreed that the County has always tried to work with the municipalities concerningtheir water needs The Commissioners pursued the construction of a new water plant on good faith, basedon the needs of the towns that approached them for assistance Considering this letter from Kenly, theydiscussed the possible need for a policy concerning use of County water and sewer transmission linesCommissioner Cecil M Massengill stressed the need to sit down with Kenly and discuss the matterwith all parties present, and not depend on correspondence He pointed out the County is in the waterbusiness now, and will have to protect its investmentCommissioner Cookie Pope agreed the Board needs to meet with Kenly about this matterFollowing further discussion, Commissioner John M Booker moved the Board establish a policystating that with the exception of emergency situations, the County -owned water and sewer transmissionlines would be used only for County water and sewer, and for contracted services approved by the Board,including, but not exclusive of, the current contracts with Wendell, Dunn, and Harnett CountyCommissioner Jerry F Wood seconded the motion, which carried by unanimous vote42625 Commissioner John M Booker Retiring After 20 Years As Johnston County
