minutes approved aspresented2 Property AcquisitionCounty Manager, Richard Self, explained that after having received verbal approval from Boardmembers, the County purchased the Carolyn and George Howard property on the corner of Second andJohnston Streets The building will be used to house the Public Utilities Department and paid for withpublic utility funds He asked the Board to confirm the purchase of this property for the recordUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner Eleanor N Creech andcarried by unanimous vote, the Board confirmed the purchase, in the amount of 210,000, of the Howardproperty located on the corner of South Second and Johnston Streets in Smithfield3 Presentation of Plaque to Retiring Commissioner John M BookerChairman Norman C Denning presented a resolution of appreciation to retiring Commissioner,John M Booker Chairman Denning thanked Dr Booker for 20 years of service to Johnston County asa County CommissionerCommissioner SpeerPlanning Director Cal Genereux pointed out the property on a map He explained theSpeers wish to open an upholstery shop in an existing building on the property The PlanningBoard recommended approval as a special useCase 194 Petition to rezone approximately 108 acres on NC 222 West in Beulah Townshipfrom ARR -40 to General Business Special Use District Owners Elmer and DorisBaumgardner Applicant Jim Creech, JrMr Genereux indicated the property on a map and noted the applicant, Jim Creech, Jr,plans to operate an automotive machine shop at the site He explained this would be a machineshop, not an automobile repair shopMr Jim Creech stated that he would be working primarily on automotive engines, andthere would not be vehicles in various stages of repair parked around the shop He noted theproperty will not perk for residential useCase 195 Petition to rezone approximately 198 acres on Interstate 40 in Cleveland Townshipfrom ARR -40 to R -30 Owner William Parker, JrMr Genereux pointed out the property on a map and explained the surrounding zoningis ARR -40 and R -30 with several subdivisions in the area The Planning Board recommendedapprovalWilliam K Britt, resident of Southfort Subdivision, voiced concern that this developmentwould create additional traffic on Southfort Drive, which is the only current access into theproperty He stated the developers of Southfort Subdivision did not build Southfort Drive to statestandards, and therefore, the road is not state - maintained He questioned who would make repairswhen the construction vehicles and other traffic created problemsMr Genereux noted that an additional access to this property, other than Southfort Drive,was required by the Planning Board when the adjacent subdivision, Lancaster Place, wasdevelopedSonny Johnson, developer ofboth Southfort and Southgate subdivisions which border thisproperty, stated he would take full responsibility for the maintenance to the roads in hissubdivisions until he can get them on the state - maintained system He noted he is trying to bringall his roads up to standard for this purpose He noted he has informed Mr Parker that he canextend a road in James and Leta Edwards BellSouthCounty Manager, Richard Self, reminded the Board that Case 187 was tabled last monthin order to allow BellSouth time to work with the Communications Department on betteridentification of 911 calls coming in from their cellular phones He stated that BellSouth has metwith him and several department heads, and the County has been assured that better locationtechnology is being developedAl Gaskill, Communications Director, noted the cellular industry is mandated to have thistechnology available within five years, however, BellSouth has indicated it should be availablewithin two to three years Johnston County has requested they be provided this technology as soonas possibleGray Styers, Counsel for BellSouth, showed a map of the County indicating BellSouthscoverage He stated an independent real estate expert has provided a study showing there is noadverse affect to area property owners431Mr Styers stated his company will be glad to work with Mr Gaskill and make anyinformation available, as well as provide technical assistance, however, in his opinion, they shouldnot be required to provide the software and equipment at no cost Other cellular companies operatein Johnston County, and should share the responsibility He did, however, offer the County freeuse of their towers for radio equipment, when space is availableFollowing further discussion, Commissioner Thomas M Moore moved the Board approveRezoning Case 187 for Leta and James Edwards of 55 acres on SR 2141 in Pine Level Townshipfrom ARR -40 to ARR -40 Special Use District Commissioner Jerry F Wood seconded themotion, which carried by unanimous voteCase 190 16192 acres on NC 50 Westin Cleveland Township from ARR -40 to R -30Owner J Harold Tharrington Applicant Jerry DaltonCal Genereux, Planning Director, reminded the Board that Case 190 was postponed inNovember in order to determine the type of water system to be used in this development Theapplicant, Jerry Dalton, has informed him that developer Sonny Johnson has an option to purchaseand develop this property, and intends to use community wells and a community water system withHeater Utilities The system will be up to County standards, including fire flow specificationsIn response to a question by Commissioner Thomas M Moore concerning the Countypossibly purchasing the system in the future, County Manager Richard Self explained HeaterUtilities has indicated they would not be interested in selling He requested the Board require thatthe system be approved by the Public Utilities DepartmentUpon a motion by Commissioner Cookie Pope, seconded by Commissioner James HLangdon, Jr and carried by unanimous vote, the Board approved Rezoning Case 190 with thestipulation that the developers water system meet County standards and be approved by theJohnston County Public Utilities DepartmentCASE HELD OVER FROM OCTOBER, 1996 BOARD MEETINGCase 184 55 acres on Cleveland Road SR 1010 in Cleveland Townshipfrom AR R-40 to R-10 SUD Owners Heirs of Nancy Lee -Administrator Nancy JonesMr Genereux pointed out this case was referred back to the Planning Board in Octoberfor a traffic study He outlined the proposed improvements the owner has agreed to put in place,and stated the Department of Transportation feels this would improve the traffic situation in thearea The developer would extend the existing turn lane into Cleveland School all the way backto the entrance to the subdivision, allowing approximately 25 additional cars in that lane, thusfreeing the flow of traffic in the other lane The Planning Board recommended approval based onDOTs findingsDeveloper Steve Eastman stated, in his opinion, there is no other economically feasibleway to develop this property other than R -10 He noted that since Ms Jones has addressed thetraffic problem, and since the area is obviously going to continue to grow, this would seem to bea responsible way to growIn response to a question about water runoff from the property, Mr Eastman andengineer, Allen Keith, noted there is a stream that will ultimately take the developments runoffThey pointed out, too, that the State will require a soil and erosion plan before the property isdevelopedChairman Norman C Denning stated he is sympathetic with Ms Jones and does not wishto bar her family from developing this property, however, he voiced concern that four homes peracre is too dense for rural development432In response, Ms Jones agreed and noted she has already stipulated she would not developthe property that dense, however, at this time, the County has no zoning designation between R -10and R -30 She pointed out they plan to build a responsible development, which she feels mighthelp bring Natural Gas into the area, and could be the impetus needed to have DOT install muchneeded stoplights at the intersectionKen Britt, who lives in the area, voiced concern about the traffic situation at the SchoolDavid Stubbs, representing a family partnership that owns adjacent property, stated that in hisopinion, R -10 development in this area is not good planningMs Jones asked if the Board could add an additional condition to the special use to limitthe number of lots so she can move forward with her plans The Board discussed this option,however, felt the size of all lots was the issue, not the number of lotsFollowing discussion, Commissioner Thomas M Moore moved the Board approveRezoning Case 184 for Heirs of Nancy Lee Nancy Jones, Administrator of 55 acres onCleveland Road in Cleveland Township from ARR -40 to R -10 SUDFurther discussion followed, and when there was no second, Commissioner Moorewithdrew his motion The Chairman declared the decision tabled for an additional 30 days Heasked County Manager Richard Self, Planning Director Cal Genereux, and Commissioners JamesH Langdon, Jr and Tom Moore, to work with Ms Jones to see if special use conditions can beagreed upon, which would enable support it11 Emergency Management - Update on Recovery Operations from Hurricane FranDewayne West, Emergency Management Director, informed the Board that his departmentis still working closely with FEMA Federal Emergency Management Agency in helping peoplerecover from Hurricane Fran He stated that Johnston County has been selected for a study to beconducted by personnel from Fort Bragg to provide information on better planning for futuredisasters Fort Bragg personnel will come into the County and conduct a survey, determine thelocation of utility lines and collect other data, which will be extremely useful when added to ourGIS mapsMr West noted the Department of Transportation has been throughout the County onceand is currently going over all areas a second time to pick up yard debris from Fran It isestimated that about 98 of the storm debris has been taken care of, and he asked the Board toset a cut off date for free disposal of yard waste at the County LandfillFollowing further discussion, Commissioner James W Cash moved the Board set a dateto discontinue free disposal of yard debris effective December 31, 1996, and instructed that noticeof this cut -off date be advertised in local newspapers and posted at the landfill CommissionerJerry F Wood seconded the motion, which carried by unanimous vote12 Court Update - Judge Knox JenkinsJudge Knox Jenkins appeared before the Board with a report on progress within the courtsystem since Johnston County became a separate court district He spoke of new calendar rulesand policies concerning jurors which seem to be working well He also spoke of the affect thegrowth in the County is having on the courtsBoard members commended Judge Jenkins for the fine job he is doing13 Early Sign Up for McGees Crossroads Water DistrictUpon a motion by Commissioner James H Langdon, Jr, seconded by CommissionerCookie Pope and carried by unanimous vote, the Board approved the early sign -up period forpersons in the McGees
