December 17, 1996The Johnston County Board of Commissioners resumed regular session on Tuesday, December17, 1996, at 700 oclock pm at the Kenly Town Hall, Kenly, North Carolina, with the followingmembersPresent Norman C Denning, Chairman, James W Cash, Vice Chairman, Jerry F Wood,Eleanor N Creech, Cookie Pope, Thomas M Moore, and James H Langdon, JrAbsent NoneAlso Present Richard B Self, County Manager, and Joyce H Ennis, Clerk to the Board and membersof the Kenly Town CouncilThe Kenly Town Council was called into session by Mayor Scott Turik, and Chairman NormanC Denning called the County Commissioners meeting to order Following the Pledge of Allegiance andinvocation, the following business was transacted1 Cleaning of Waterways RequestedIn response to the many concerns from citizens about the condition of our streams, rivers andcreeks, Commissioner Eleanor N Creech moved the Board formally request the appropriate federalagencies to clean all Johnston County waterways Commissioner James H Langdon, Jr seconded themotion, which carried by unanimous vote2 Request for Community SignCommissioner Jerry F Wood moved the Board request that the NC Department of Transportationplace a Stewartsign in front of the old church building on SR 1009, which is being converted by the arearesidents into a community center Commissioner James W Cash seconded the motion, which carried byunanimous voteMAYOR SCOTT TURIK EXPRESSES KENLY CONCERNS3 Future of Rescue SquadsKenly Mayor, Scott Turik, noted the Kenly rescue squad is having a difficult time financiallyHe stated the collection rate on fees is very low, and it is difficult to keep the units replenished He askedthe Board to see if something can be done for the future of the rescue squads in the CountyCounty Manager, Richard Self, responded that several months ago, the Board of Commissionersappointed a committee and authorized a study to look at the problems facing rescue squads, with a goalof trying to find ways to address some of these problems The committee has begun its study, and theresults should be in within a few months4 Water Transmission MaintenanceMayor Turik stated an additional concern is the maintenance of the County owned water toweroff Interstate 95 at exit 106 This tank feeds the Kenly water tower, and on several occasions the gearshave malfunctioned and the tower has overflowed, creating problems for Kenly The water loss is costlyto the town, and on several occasions the towns water supply has been depleted He requested that theCounty check on the maintenance problem and see if it can be remediedCounty Manager, Richard Self, stated the County would check into this matter5 Water Wastewater to Serve Glendale Kenlv SchoolMayor Turik stated the main reason for this meeting is to discuss the water and wastewater forthe new Glendale Kenly School He called on Commissioner Thomas M Moore, who was instrumentalin arranging for the two boards to meet for this discussionCommissioner Moore presented a drawing showing the proposed utility lines and an aerial mapof the vicinity A 12 water main is proposed Concerning sewer, he noted that a 4 force main would besufficient for the school, however, in order to serve the entire area and accommodate future growth, a 12gravity line would be needed from the existing Kenly interceptor to the school site The difference in theI I cost of the 12 line over the 4 force main would be 120,000 Commissioner Moore stated, in hisopinion, the 12 line would make economic sense, would be a wise investment for the County, and wouldbe for the betterment of the citizens He stressed the urgent need to make a decision in order to have thenecessary utilities at the school when it opens prior to the `97 -98 school yearA discussion ensued about who would pay the additional 120,000 Mayor Turik stated the towncould not afford this as they will be spending money on upgrading their treatment plant He noted theTreatment facility is currently at 80 capacity and must be upgraded by law He stressed however thatcapacity would be available by the time it was neededChairman Norman C Denning stated that in his opinion, there are three options to providewastewater service to the school on -site treatment, a 4 force main, or a 12 gravity sewer line Hestressed that he agrees the 12 line would be preferable, but noted the County can not afford to providethis upgrade for one area of the County unless they can do the same for all areas He asked the Kenlyofficials if there was some way the town could provide the additional cost and then pay for this throughcollection of feesMayor Turik stated the town does not have the funds, and also they have not done this for otherareas He suggested that since the wastewater line is needed to serve the school, the County should payfor the entire cost of the needed 12 line, then recoup the additional funds through water acreage fees Hisproposal would be for the town to own the wastewater line since it will feed back into their treatmentplant, and the County own the water lineIt was pointed out the County can not charge water fees to recoup wastewater cost CommissionerJerry Wood noted the County must treat all areas alike He pointed out that Meadow School does nothave County water, and other areas have wastewater problems The County can not afford to use taxdollars to provide for future growth in Kenly unless it can afford to do this countywide, which would beimpossibleSeveral Board members responded Commissioner James W Cash stated that other areas of theCounty would be standing in line for similar help Commissioner James H Langdon, Jr pointed out thatdetails as to ownership of the line need to be worked out Commissioner Eleanor N Creech noted theBoard of Commissioners are the guardians of the taxpayers money and the County has to answer to allcitizensSeveral persons in attendance spoke of the expected growth around the new school if water andwastewater is made available Bobby Moore and Hampton Ethridge stressed that money should not bea reason to lose this opportunity for growth in the Kenly area Dale Jones, auto dealer, stated hisorganization is very interested in opening a Chevrolet dealership in this vicinity if water and sewer is madeavailableCounty Manager, Richard Self, and Town Manager, Ed Temple spoke briefly with ChairmanDenning and Mayor Turik in a effort to come up with a possible solution It was suggested the Countypay for the upsized line with the understanding they would own the line and charge acreage fees, 10,000for commercial tap -ons and 2,500 for residential No acreage fees would be charged by the town Kenlywould maintain the line, and have the water and wastewater retail customers, however the school wouldbe the Countys water customerFollowing further discussion, the Commissioners agreed to work out an arrangement based onthe suggestion from the two managers, and make a formal agreement at their January 6, 1997 meetingIn an effort to prevent further delay in the design phase of this project, Commissioner CookiePope moved the Board authorize Engineer Tim Broome to proceed with design of the 12 water main anda 12 gravity sewer line, with the understanding an arrangement will be worked out for reimbursementof payment for the upsized sewer line Commissioner James H Langdon seconded the motion, whichcarried by unanimous voteThere being no further business, Commissioner Eleanor N Creech moved the Board adjournCommissioner Thomas M Moore seconded the motion, which carried by unanimous
