January 6, 1997The Johnston County Board of Commissioners met in regular session Monday, January 6, 1997,at 10 oclock am in the Commissioners Room, Johnston County Courthouse Annex, Smithfield, NoneAlso Present Richard B Self, County Manager, and Joyce H Ennis, Clerk to the BoardThe Chairman called the meeting to order and the following business was transacted1 MinutesChairman Norman C Denning asked if there were any corrections to the minutes of the December2, 17, 1996 board meeting There being no corrections, the Chairman declared the minutes approved aspresented2 Chairman Excused - No additional Items to be DiscussedChairman Norman C Denning stated he was not feeling well and asked to be excused He requestedthat in his absence, the Board discuss only those items on the prepared agendaUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner Eleanor N Creech andcarried by unanimous vote, the Board excused Chairman Denning and agreed to discuss only items on theprepared agenda, with the exception of a Health Department budget amendment, which was added priorto the meeting3 Department of Transportation - Addition to SystemThe Board reviewed petitions presented by the North Carolina Department of Transportationrequesting the following road be added to the State Secondary System for maintenance Lee Drive, FoyPowell Estate, Cleveland TownshipFollowing review, Commissioner Cookie Pope moved the Board concur with the NC Departmentof Transportations request to add Lee Drive in Cleveland Township to the State Maintained SystemCommissioner Eleanor N Creech seconded the motion, which carried by unanimous vote4 Resolution Authorization to Execute Documents for EDA GrantMichael de Sherbinin, Economic Development Director, explained that Johnston County, due tothe destruction from Hurricane Fran, is eligible to apply for up to 725,400 in matching funds throughan Economic Development Administration EDA grant to provide water and sewer service to industrialcorridors in the CountyMr de Sherbinin noted he originally was looking at four projects Winn Dixie, I- 95701, BurrisRefrigeration, and a proposed industrial project in the Benson area The Burris project, however, hasproceeded with construction in order to meet their deadline, and can no longer be considered for the grantfunds This eliminates the 250,000 county commitment for this project from being used as a matchWith the Burris project no longer considered, the County now has in committed funds only 400,000 forthe Winn Dixie project He suggested the County ask the towns involved in the remaining projects if theycan provide any of the match money If not, the grant application may need to be scaled backFollowing discussion, Commissioner Jerry F Wood moved the Board adopt the following resolutionauthorizing the execution of the necessary documents for an EDA Grant for up to 725,400, and instructMr de Sherbinin to contact the towns about additional matching funds for this grant CommissionerEleanor N Creech seconded the motion, which carried by unanimous vote442RESOLUTION TO SUBMIT AND EXECUTE DOCUMENTSFOR AN EDA TITLE IX PUBLIC WORKS GRANT APPLICATIONWHEREAS, the County of Johnston has been formally invited to submit an application to theEconomic Development Administration EDA for 725,400 in EDA funds, project number NNC 0423and;WHEREAS, these funds would be used for the extension of water and sewer service to threeindustrial corridors contained within Johnston CountyNOW, THEREFORE, BE IT RESOLVED that the Johnston County Board of Commissionershereby authorizes the Chairman of the Board of Commissioners and or the County Manager to executeall necessary forms and grant documents to apply for and receive grant funds from this programAdopted this the 6th day of January, 19975 Award of Engineering Agreement for EDA ProjectsCounty Manager, Richard B Self, stated that following the December 2, 1996 Board approval forMcKim and Creed to provide engineering services for the proposed EDA projects, the County was notifiedby EDA officials they would have to advertise for engineering resumes for these projects The County didadvertise and receive resumes from four firms McKim and Creed; Piedmont, Olsen, Hensley; LeonhardtEnvironmental; and Trigon Engineering Consultants, Inc After reviewing the resumes, the staffrecommended the Board re- approve the amendment to the June 21, 1996 agreement with McKim andCreed to include engineering services on the EDA projects at a total amended cost of 148,300Upon a motion by Commissioner Thomas M Moore, seconded by Commissioner James HLangdon, Jr and carried by unanimous vote, the Board approved an amendment to the existing June 21,1996 agreement with McKim and Creed Engineers for engineering services on the proposed EDA projectsfor a total amended cost of 148,300, subject to EDA funding for these projects6 Public Hearing Rezoning Cases - 1015 amAdvertised December 24, 27, 1996 - The Smithfield HeraldCertified letters were mailed to adjoining property on December 23, 1996 and notices wereposted at the locations on December 27, 1996The Chairman opened the public hearing and invited anyone who wished to speak on the followingrezoning cases Those persons wishing to give testimony on Cases 197, 199 and 201 were sworn in bythe ClerkCase 197 Petition to rezone approximately 203 acres on NC 42 in Cleveland Township fromARR -40 to Industrial l Special Use District Owner J C Johnson, JrCal Genereux, Planning Director, indicated a map of the area and showed a photograph of the siteHe stated a portion of the property is in the flood plain and the protected area for the dwarf wedge mussel,therefore certain state and federal requirements will have to be met During the Planning Board hearing,the owner agreed to change his application to a special use district for a truss factorySonny Johnson, developer in the area, stated he located the property for Jerry Ward, owner ofCapital Area Truss Company, Inc Mr Ward wishes to relocate in Johnston County and expand hisbusiness He would use only a small portion of the property for his operation and leave the rest for abuffer zoneMr Wards investment would be in excess of 1 million and he would initially employ 32 personsAndy Spence, an area contractor, stated he has purchased trusses from Mr Ward for 15 years andbelieves he would be an asset to the communityCase 198 Petition to rezone approximately 16 acres on SR 1934 in Beulah Township fromARR -40 to Highway Business 4 Owners Margie Jane Creech, Donnie Lee Creechand Eddie Ray CreechMr Genereux pointed out the area on a map and showed a photograph of the property He indicatedthe owners wish to reopen a community store that has been closed for many years, and was therefore notgrandfathered in when countywide zoning went into place443Case 199 Petition to rezone approximately 2 acres on SR 1511 in Cleveland Township fromARR -40 to Community Business Special Use District Owners Terry and JoanSpenceMr Genereux indicated the area on a map and showed a photograph of the property He noted thesite petitioned for rezoning is located in front of Mr Spences home Mr Spence wishes to operate anoutdoor equipment, sales and service businessTerry Andrew Andy Spence, property owner, stated this is a service that is needed in the area Heasked the Board to approve the rezoning Terrence Bjorling, who lives across the road from the property,voiced his supportCounty Manager, Richard Self, noted the staff has 10 10 in Cleveland Township from ARR -40 toR -10 SUD Owners Heirs of Nancy Lee, Administrator Nancy JonesI I IThis Case was originally heard in public hearing October 1, 1996, and sent back to the PlanningBoard for further study It was brought back to the Commissioners and discussed at the December 2,1996 meeting, at which time it was tabled for 30 days and a committee was appointed to work with MsJones to see if additional conditions could be agreed uponCal Genereux reported that the committee met, and following discussion, concluded the R -10rezoning would best serve the owner and the community under the present zoning ordinanceNancy Jones, representing her family, again asked the Board to approve the rezoning She stated sheand the developer, Steven Eastman, have tried to answer all the concerns to the best of their abilityMary Nell Ferguson, principal at Cleveland Elementary School, opposed the rezoning due to theadditional burden the dense development would, in her opinion, put on the already overcrowded schoolMs Ferguson stated that since 1992 her schools enrollment has doubled, and the facility, even withmobile units and a recent addition, is at capacity She referenced the existing traffic problems and notedthat although a new elementary school is scheduled to open in 1998, the project may be delayed Shestated she believes that dense development should be in towns, not in rural areas, and asked the Board tolook at the community needs and the safety and welfare of the childrenCommissioner Thomas M Moore stated that in his opinion, there would be little difference betweenR -10 and R -30 development in relation to the impact on the school He pointed out the R -10 zoningdesignation, with all its requirements, guarantees a quality developmentCommissioner Eleanor N Creech noted the Board shares the concerns that have been expressed atthe meetings and has studied this issue for several months in an effort to find the best solution foreveryone She, too, questioned if the impact on the school would be significantly different between R -10and R -30, pointing out the community apparently will continue to grow at a rapid rate, regardless of thisparticular subdivision She stressed that the Board intends to reconsider the ordinance and look for waysto improve it, but for the time being has to operate under the existing regulations, which allow R -10developmentCindy Nyberg, PTA president, and Paula Elliot, volunteer at the school, also opposed the rezoningciting the problems rapid growth is causing in the area Debra Stancil, parent of a young child who willattend Cleveland Elementary next year, suggested the area needs time to catch up with the growth beforefurther developmentBellman Blieff, who spoke in opposition at the hearing in October, stated his concerns have beenanswered and he now supports the rezoning He stated that although he would like less dense development,he prefers the proposed subdivision over other possible options for the propertyDeveloper Steven Eastman stated that growth is inevitable in the Cleveland Community, and whathe is proposing for the Jones property is, in his opinion, responsible growthCommissioner James H Langdon, Jr commented that changes need to be made at the planningstage, not at the expense of any one developmentCounty Manager, Richard Self, reminded those present that the Board has authorized a rewrite ofthe zoning ordinance, which is currently underway, and has asked the NC Department of Transportationto prepare a Thoroughfare Plan for the CountyFollowing further discussion, Commissioner Thomas M Moore moved the Board approve rezoningcase 184 for heirs of Nancy Lee of 55 acres on Cleveland Road in Cleveland Township from ARR -40to Residential 10 Special Use towork with Kenly on an agreement concerning water and sewer service to the new Glendale KenlyElementary SchoolKenly Manager, Ed Temple, and Council Member, Shannon Hinnant, were presentFollowing discussion concerning the terms of the agreement, Commissioner Thomas M Mooremoved the Board approve the following Memorandum of Understanding Commissioner James HLangdon, Jr seconded the motion, which carried by unanimous voteMEMORANDUM OF UNDERSTANDINGThis Memorandum of Understanding made and entered into this 6th day of January, 1997, by andbetween Johnston County and the Town of Kenly, a North Carolina municipal corporation;The above parties enter into this Memorandum of Understanding to set forth the parties agreementconcerning a certain water and sewer line to be constructed to serve the new Glendale - Kenly ElementarySchool on Bay Valley Road, according to the terms listed below1 The water and sewer lines shall be constructed and paid for by Johnston County2 Johnston County will charge acreage fees to recoup its cost of construction The County shallpay the Town of Kenly the amount of the Towns required acreage fee for sewer connection, notto exceed the current fee in affect by Kenly as of this date; these funds will come from theacreage fees charged by Johnston County3 Johnston County will retain ownership of all water and sewer lines installed at the Countysexpense to serve the new school facilities4 The Town of Kenly will control and maintain the water and sewer lines from the school back toKenly, and shall provide retail water and sewer services to customers connecting to said linesAll customers connected to the lines shall be customers of the Town of Kenly with oneexception, the new school facility The new school shall be a sewer customer of the Town ofKenly, charged at its rate for customers outside of the Town boundaries, and the school shall bea Johnston County water customer5 The Town of Kenly will control all water and sewer taps, and approve and make all water andsewer taps All persons and businesses connecting to these lines shall be customers of the Townof Kenly, with the exception of the school as outline above A potential customer shall makeapplication with the County and pay its sewer acreage fee and water tapping fee, and shall thenpay the Town of Kenly the water and sewer tap to cover the cost of making the taps6 Upon Johnston Countys recoupment of its cost of construction of the lines, all sewer tap feesshall be placed in a County sewer reserve fund The Town of Kenly will thereafter be able toapply to use the reserve fund when needed for industrial expansion or for major repairs7 The Town of Kenly waives all fees and charges associated with water and sewer to the newschool facility11 County to Transfer Old School Property to Town of KenlyUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner Thomas M Mooreand carried by unanimous vote, the Board agreed that if the Board of Education offers the County the oldKenly school campus, the County would accept the property and give it to the Town of Kenly12 Deputy Fire Marshall PositionThe County Manager reminded the Commissioners that at the October, 1996 board meeting, theyapproved a temporary 18 month deputy fire marshal position to help during the Hurricane Fran recoveryperiod The position was contingent on anticipated funding from the Federal Emergency ManagementAgency FEMA Unfortunately, FEMA has recanted their offer and are now only willing to provide asmall portion of the costDewayne West, Emergency Management Director, stated he has interviewed several qualifiedpersons for the position, however, with only limited funding from FEMA, he was uncertain whether toproceed He stated that even without the extra work caused by Fran, the workload in his office hasincreased significantly due to the tremendous growth in the County He asked the Board to considerfunding this as a permanent position for his departmentII ?Following discussion, the Commissioners suggested Mr West bring his request for a permanentposition back to the Board for consideration at budget time13 Letter of Support of Durwood Stephenson for NC Board of TransportationAfter contacting Chairman Norman C Denning for his concurrence on taking up this matter in hisabsence, Commissioner Thomas M Moore moved the County write a letter to Governor James B Hunt,Jr, in support of M Durwood Stephenson as a candidate for appointment to the North Carolina Board ofTransportation Commissioner Cookie Pope seconded the motion, which carried by unanimous vote14 Recordation of Deeds - Change in PolicyAs recommended by the Register of Deeds, Tax Administrator, and GIS Director, CommissionerThomas M Moore moved the Board adopt the following policy for recording deeds in Johnston CountyCommissioner Jerry F Wood seconded the motion, which carried by unanimous votePolicy on Recordation of Deeds1 All deeds of conveyance shall have affixed the following information prior to recordation, and shallnot be recorded without such information affixed the documenta current property ID parcel number and any future methodology of parcel locational IDnumberb the most current mailing address of the grantee of each deed of conveyance to be recorded2 Tax Office approval will not be needed unless a property identification number cannot beascertained3 If a property ID number cannot be ascertained, the following procedure will be in effecta The Register of Deeds will not record the instrument but will direct the instrument to te hattention of the Tax Administrators office for assistance in determining the parcelidentification numberb Tax Office personnel will determine the parcel identification number ofthese instruments andaffix such number to the instrumentc If the parcel ID number cannot be determined expediently, the personnel of the TaxAdministrators office will then stamp the instrument in such a manner that will give approvalto the Register of Deeds for recordation of that instrumentd Completion of a real property transfer form will no longer be needed4 The Register of Deeds shall furnish the Tax Administrators Office the ApplicationsC Area Mental Health BoardUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner Eleanor NCreech and carried by unanimous vote, the Board appointed Glenda Peacock Flemer to the Area MentalHealth Board to serve a four year term to expire 12310117 Update on Water DistrictsEngineer Tim Broome updated the Board on the status of the new water districtsA Clayton, Cleveland and Wilsons Mills Water DistrictsMr Broome stated that the engineering design for Wilsons Mills water district is approximately85 complete; for Clayton, approximately 55 complete, and for Cleveland, approximately 25complete The USDA Rural Development had earlier indicated that funding for these three projects shouldbe approved during the first quarter of 1997, however, they have now issued notification that theseprojects will not be funded during this federal fiscal year This will, unfortunately, delay the bidding andconstruction phase of these projects at least six months, if not longer It is hoped that new money will beavailable and all three will be approved in next years funding allocation, which begins October 1, 1997He pointed out that McKim and Creed has been working on a deferred compensation basis and charging8 interest He asked the Board for direction on whether to continue with the design or wait until definitefunding is availableIn discussion, Mr Broome pointed out that another possibility, if federal money is not approved,would be to proceed with general obligation bonds on the open market This would, however, increase theuser charge about 2 per month, and Wilsons Mills would no longer be eligible for federal grant moneyFollowing further discussion, the Board instructed Mr Broome to continue with the design so thatall three projects will be ready for bids when funding is availableB McGees Crossroads Water DistrictMr Broome reported that McKim and Creed has completed the preliminary engineering reporton McGees Crossroads water district He noted the early sign -up period will end this week, and theyshould have a feasibility report ready in the near futureThere being no further business, Commissioner Jerry F Wood moved the Board
