February 23, 1998The Johnston County Board of Commissioners met in Special Session on Monday, February 23,1998, at 400 pm in the Commissioners Meeting Room, Johnston County Courthouse Annex, Smithfield,North Carolina, with the following membersPresent Norman C Denning, Chairman, James W Cash, Vice Chairman, Jerry F Wood,Eleanor N Creech, Cookie Pope, and James H Langdon, JrAbsent Thomas M MooreAlso Present Richard B Self, County Manager and Joyce H Ennis, Clerk to the BoardChairman Norman C Denning called the meeting to order and the following business wastransacted1 Clayton, Cleveland and Wilsons Mills Water Districts - Resolutions Accepting Conditionsfor Project Loans and Approving Water System Management ContractsUpon a motion by Commissioner Cookie Pope, seconded by Commissioner James W Cash andcarried by unanimous vote, the Board recessed regular session to sit as the Clayton Water District Board,the Cleveland Water District Board and the Wilsons Mills Water District BoardEngineer Tim Broome introduced Barbara Beard Hinton from USDA Rural Development todiscuss the final documentation for loans for the Clayton, Cleveland and Wilsons Mills Water DistrictsMs Hinton outlined the letter of conditions for loans on the three water district projects Shestated a resolution accepting the required conditions will have to be adopted for each district She reviewedthe rate schedule for each of the projects and noted the interest rate will be no more than 4875 The ratecould be lower if the prevailing interest rate is lower at final closing The loans are set up on a 40 -yearschedule for repayment She stated the final plans and specifications have been accepted, however anyproject changes must be reported to her agencyMr Broome pointed out the Clayton base rate is high because USDA Rural Developmentremoved the Sweetwater Subdivision taps from the formula Staff is currently working on ways to reducethis rate, at which time the agreement can be amended accordingly He also requested the Board approvethe proposed Water System Management Contract for each districtCLAYTON WATER DISTRICTFollowing discussion, Commissioner James W Cash moved the Clayton Water District Boardadopt the following resolution and approve the proposed Water System Management Contract BetweenJohnston County and the Clayton Water District, which is on file in the Clerks Office, approve theMitigation Measures as presented, and authorize the County to advertise for bids on the project,contingent upon the final letter of loan approval from USDA Rural Development Commissioner JerryF Wood seconded the motion, which carried by unanimous voteCLAYTON WATER DISTRICT RESOLUTIONBE IT RESOLVEDThat the Board of Commissioners of the Clayton Water District accepts the conditions set forth in theLetter of Conditions dated February 23, 1998, and Form FmHA 1942 -47, Loan Resolution;That the Board of Commissioners approves as shown on Form FmHA 442 -7, Operating Budget, theproposed budget;That the Chairman and Clerk be authorized to execute all forms necessary to obtain a loan from the RuralUtility Service RUS, including, but not limited to the following formsForm FmHA 1942 -47Loan ResolutionForm FmHA 442 -46Letter of Intent to Meet ConditionsForm FmHA 442 -7Operating Budget740Form FmHA 400 -1Equal Opportunity AgreementForm FmHA 400 -4Assurance AgreementForm FmHA 1940 -1Request for Obligations of FundsForm FmHA 1910 -11Applicant Certification Federal Collection PoliciesForm AD -1047Certification Regarding DebarmentThat if the interest rate charged by USDA Rural Development should change between this date and thedate of actual loan approval, the Chairman and Clerk be authorized to execute new forms reflecting thecurrent interest rate and revised payments as required by USDA Rural Development;The proposed rate schedule for residential water use is as followsMinimum 2470 per 1,000 gallons of water usageAll over 1,000 gallons -
