April 6, 1998The Johnston County Board of Commissioners met in regular session Monday, April 6, 1998, at 1000am in the Commissioners Meeting Room, Johnston County Courthouse Annex, Smithfield, read a letter from Susan J Banks, President of the North Carolina Association ofCounty Clerks to the Boards of County Commissioners, informing the Board of the election of Joyce HEnnis as Vice President of the AssociationCommissioner Eleanor N Creech moved the Board formally recognize and support Ms Ennis asthe new vice president of the North Carolina Clerks Association Commissioner Cookie Pope secondedthe motion, which carried by unanimous vote3 Board of Education - Reauest for Funds for Mobile UnitsDr James Causby, Superintendent of Schools, addressed the Board concerning the need for 70 newplacements of mobile units for the 1998 -99 school year Dr Causby explained that due to recentconstruction, the schools will be able to move 29 units from campus sites that no longer need them Herecommended the additional 41 units be leased for one year since most of them will only be needed untilscheduled facility construction is completed The cost of leasing the 41 units, plus furniture, would be427,524 Relocation of presently owned units, plus removal and installation of canopies would be anadditional 383,940 for a total cost of 811,464 He asked the Board for a special appropriation so theSchool Board can go ahead and purchase these units to make sure they are in place by the beginning ofthe school yearFollowing discussion, Commissioner James H Langdon, Jr moved the Board approve the followingbudget amendment from unappropriated surplus to provide mobile units for the Johnston County SchoolsCommissioner Cookie Pope seconded the motion, which carried by unanimous in Millard Crossing Subdivision, SmithfieldTownshipFollowing review, Commissioner Eleanor N Creech moved the Board concur with the NCDepartment of Transportations request to add the roads listed above to the State Maintained SystemCommissioner Cookie Pope seconded the motion, which carried by unanimous vote25 Request for Fireworks Display - Archer Lodge Community CenterUpon a motion by Commissioner Eleanor N Creechand carried by unanimous vote, the Board adopted the following proclamationPROCLAMATIONINTERNATIONAL BUILDING SAFETY WEEK 1998 - April 5-11,1998Whereas, the safety of the buildings we occupy daily is essential to the health, safety and welfareof the citizens of the world; andWhereas, among the worlds most fundamental laws and ordinances are those which providestandards for the safe construction of buildings in which people live, work and play; andWhereas, for construction and building codes to be effective and enforced, understanding andcooperation must exist between code second reading, the following Emergency MedicalService and Granting of Franchises to Emergency Services Providers OrdinanceAN ORDINANCE REGULATING EMERGENCY MEDICAL SERVICEAND GRANTING OF FRANCHISES TO EMERGENCY SERVICES PROVIDERSCOUNTY OF JOHNSTONAn ordinance governing the granting of franchises for ambulance services and other pre - hospitalemergency medical services The County of Johnston Board of Commissioners does ordain the followingSECTION 1 DEFINITIONSUnless the context otherwise requires, the following definitions shall apply in the interpretation andenforcement of this ordinance11 AMBULANCEThe term ambulance means any privately or publicly owned motor vehicle, aircraft, or vessel thatis specially designed, constructed, or modified and equipped and is intended to be used for and ismaintained or operated for the transportation on the streets or highways, waterways or airways ofthis State of persons who are sick, injured, wounded, or otherwise incapacitated or helpless12 Medical ResponderThe term Medical Responder means an individual who has completed a training program inemergency medical care and first aid approved by the North Carolina Department of HumanResources and has been certified as a Medical Responder by the Department of Health and HumanResources, Office of Emergency Medical Services13 EMERGENCY MEDICAL TECHNICIAN EMTThe term Emergency Medical Technician means an individual who has completed a trainingprogram in emergency medical care at least equal to the National Standard Training Program forEmergency Medical Technicians as defined by the United States Department of Transportation andhas been certified as an emergency medical technician by the State of North Carolina Office ofEmergency Medical Service14 AMBULANCE PROVIDERThe term ambulance provider means an individual, firm, corporation or associationwho engages or professes to engage in the business or service of transporting patients in anambulance15 APPROVEDThe term approved shall mean approved by the North Carolina Medical Care Commissionpursuant to the latters rules and regulations promulgated under NC General Statutes 14313-16516 SECONDARY AMBULANCE PROVIDERThe term secondary ambulance provider shall mean the system of personnel and equipmentmeeting the same criteria as a primary ambulance provider, but not normally dispatched on first callresponse17 COMMITTEEThe term committee shall mean the Johnston County Emergency Services Advisory Committee18 COUNTYThe term county shall mean the County of Johnston Board of Commissioners or their designatedrepresentative19 TELECOMMUNICATORThe term Telecommunicator shall mean a person who is available at all times to receive requestsfor emergency services, to dispatch emergency services, and to advise local law enforcementagencies, and fire departments and emergency medical facilities of any existing or threatenedemergency110 EMERGENCYThe term emergency and emergency transportation service shall mean the use of an ambulance,its equipment and personnel to provide medical care and transportation of a patient who is in needof immediate medical treatment in order to prevent loss of life or further aggravation orphysiological or psychological illness or injury111 RESPONDERThe term responder shall mean an organization with personnel trained in emergency medical carethat is dispatched to the scene of a medical emergency for the primary purpose of providingemergency medical assistance to a patient until the ambulance and additional medical aid arrivesM112 FRANCHISEThe term franchise shall mean a permit issued by the County to a person for the operation of anambulance service, rescue squad or first responder unit113 FRANCHISEEThe term franchisee shall mean any person having been issued a franchise by the County for theoperation of an ambulance service, rescue squad or first responder unit114 LICENSEThe term license shall mean any drivers license or permit to operate a motor vehicle issued underor granted by the laws of the State of North Carolina115 NON - EMERGENCY TRANSPORTATION SERVICESThe term NON- EMERGENCY transportation service shall mean the operation of an ambulancefor any purpose other than transporting emergency patients116 OPERATORThe term operator shall mean a person in actual physical control of an ambulance which is inmotion or which has the engine running117 OWNERThe term owner shall mean any person or entity who owns an ambulance118 PATIENTThe term patient mean an individual who is sick, injured, wounded, or otherwise incapacitated orhelpless such that the need for some medical assistance might be anticipated while being transportedto or from a medical facility119 PERSONThe term person shall mean any individual, firm, partnership, association, corporation,company, group of individuals acting together for a common purpose, or organization of any kind,including any governmental agency other than the United States120 RESCUEThe term rescue shall mean situations where the victim cannot escape an area through the normalexit or under his own power121 ADVANCED LIFE SUPPORT NON - TRANSPORTING UNITA vehicle identified as an Advanced Life Support non - transporting unit It shall carry equipmentand supplies in accordance with the level of Advanced life Support care offered by the provider withwhich the vehicle is affiliated These vehicles shall comply with requirements as set forth by theOffice of Emergency Medical Services and other applicable NC General Statutes122 EMERGENCY MEDICAL DISPATCHEmergency Medical Dispatch is the approved program with procedures established for themanagement and delivery of emergency medical assistance by a public or private agency that sendsemergency medical assistance to requesting persons and provides pre - arrival instructions for avictim of sudden injury or illnessSECTION IL FRANCHISE REQUIRED21 No person either as owner, agent or otherwise, shall furnish, operate, conduct, maintain, advertise,or otherwise be engaged in or profess to be engaged in the business or service of emergency andorNON - EMERGENCY transportation or patients within the County of Johnston unless the personholds a valid permit for each ambulance used in such business or service issued by the NorthCarolina Department of Human Resources, Office of Emergency Medical Services, and has beengranted a franchise for the operation of such business or service by the County pursuant to thisOrdinance22 No person shall drive an ambulance, attend a patient in one, or permit one to be operated whentransporting a patient within the County of Johnston unless he or she holds a currently validcertificate as an medical responder, emergency medical technician, EMT -D, EMT - Intermediate,EMT - Advance Intermediate or EMT - Paramedic issued by the North Carolina Department ofHuman Resources, Office of Emergency Medical Services23 No person either as owner, agent or otherwise, shall furnish, operate, conduct, maintain, advertise,or otherwise be engaged in or profess to be engaged in the business or service of providing rescueservices, first responder services, basic life support, advanced life support or advanced life supportNON - TRANSPORTING services unless they have been granted a franchise for the operation ofsuch business or service by the County pursuant to this Ordinance24 No Franchise shall be required fora Any entity operated from a location or headquarters outside of the County of Johnston inorder to transport patients who are picked up beyond the limits of the County of Johnston, toXfacilities located within the County of Johnston, or to pick up patients within the County ofJohnston for transporting to locations outside the County of Johnston; but no such entity shallbe used to pick up patients within the County of Johnston for transporting to locations withinthe County of Johnston or other locations unless it is rendering assistance to a franchisedambulance service in the case of a major catastrophe, mutual aid or emergency with whichthe services franchised by the County of Johnston are insufficient or unable to cope asreferred to in 24A above; or,b Ambulance owned and operated by an agency of the United States governmentSECTION IIL APPLICATION FOR AMBULANCE FRANCHISE31 Application for a franchise to operate ambulances in the County of Johnston shall be made by theambulance provider upon such forms as may be prepared or prescribed by the County and shallcontaina The name and address of the ambulance provider and of the owner of the ambulancesb The trade or other fictitious names, it any, under which the applicant does business, along witha certified copy of an assumed name certificate stating such name or articles of incorporationstating such namec A resume of the training and experience of the applicant in the transportation and care ofpatientsd A full description of the type and level of service to be provided including the location of theplace or places from which it is intended to operate, the manner in which the public will beable to obtain assistance and how the vehicles will be dispatched A financial statement of theapplicant as the same pertains to the operations in the County of Johnston, said financialstatement to be in such form and in such detail as may be required by the Countye A list of radio frequencies the applicant is authorized to operate on, and a copy of the FCClicenses in the name of the person providing the servicef A description of the applicants capability to provide twenty -four hour coverage, seven daysper week for the district covered by the franchise applied for, and an accurate estimate of theminimum and maximum times for a response to calls within such districtg Any information the County shall deem reasonably necessary for a fair determination of thecapability of the applicant to provide ambulance services inthe County of Johnston in accordance with the requirements of state laws and the provisionsof this regulationh The County of Johnston may establish and from time to time revise a schedule of rates, feesand charges that may be charged by franchised operatorsI The County of Johnston may establish and from time to time revise a schedule of rates, feesand charges that may be charged for the review of franchise applicationsSECTION IV GRANTING OF FRANCHISE41 Prior to accepting applications for the operation of an ambulance service, the Board ofCommissioners may designate specific service areas as franchise districts Said districts will beestablished using criteria that includes geographic size, road access, the location of existing medicaltransportation services, population, and response time The County shall have the authority toredistrict or rearrange existing districts at any time at their discretion42 An applicant may apply for a franchise to operate either emergency transportation service or NON -EMERGENCY transportation service, rescue services, first responder services, or advance lifesupport NON - TRANSPORTING services If more than one type of service is to be provided,separate applications may, at the discretion of the Committee be required for each type43 Upon receipt of an application for a franchise, the County shall schedule a time and place for hearingthe applicant Within 30 days after hearing, the County shall cause such investigation as it maydeem necessary to be made of the applicant and his proposed operations44 A franchise may be granted if the County finds thata The applicant shows a reasonable effort to meet state standards and standards outlined in thefranchise ordinanceb The proposed service will fit within the existing service so as not to adversely affect the levelof service or operations of other franchisees to render servicec A need exists for the proposed service in order to improve the level of services available toresidents of the County and that a reasonable and cost effective manner of meeting the needSECTION V TERM OF FRANCHISEl?J51 The County may issue a franchise hereunder to an ambulance provider or other provider as outlinedin Section IV, 42, to be valid for a term to be determined by the County provided that either partyat its option, may terminate the franchise upon sixty 60 days prior written notice to the other partyAfter a notice of service termination is given, the provider may reapply for a franchise if continuedservice is desired52 Franchised providers receiving revenues from the county through county contract or subsidy, shallprovide adequate and complete information annually for audit purposes Failure to do so, will resultin termination of subsidy until such information is provided and may at the discretion of the boardresult in revocation of the franchise agreement53 Upon suspension, revocation, or termination of a franchise granted hereunder, such franchisedambulance service, rescue squad, first responder unit, ALS non - transporting unit immediately shallcease operations Upon suspension, revocation, or termination of a drivers license or attendantscertificate or emergency medical technician certificate, such persons shall cease to drive anambulance or provide medical care in conjunction with an ambulance service, or attend anambulance The franchisees shall not or permit such an individual to drive an ambulance or providemedical care in conjunction with the ambulance service, rescue squad or first responder unit54 Each franchised ambulance service shall comply at all times with the requirements ofthis Ordinance,the franchise granted hereunder, and all applicable state and local laws relating to health, sanitation,safety, equipment, ambulance design and all other laws and ordinances55 Prior approval of the County shall be required where ownership or control of more than 10 percentof the right of control of franchisees is acquired by a person or group of persons acting in concert,non of whom own or control 10 percent or more of such right of control, singularly or collectively,at the date of the franchise By its acceptance of the franchise, the franchisee specifically agrees thatany such acquisition occurring without prior approval of the county shall constitute a violation ofthe franchise by the franchisee and shall be cause for termination at the option of the County56 Any change of ownership of a franchised ambulance service without the approval ofthe County shallterminate the franchise and shall require a new application and a new franchise and conformancewith all the requirements of the current Ordinance57 Any change in the level of service offered of a franchised ambulance service, rescue squad or firstresponder unit without the approval of the County shall terminate the franchise and shall require anew application and a new franchise and conformance with all the requirements of the currentOrdinance as upon original franchising58 No franchise may be sold, assigned, mortgaged, or otherwise transferred without the approval oftheCounty; and a finding of conformance with all requirements of this Ordinance as upon originalfranchising Each franchised ambulance service, its equipment and the premises designated in theapplication and all records relating to its maintenance and operation, as such, shall be open toinspection by the State, the County, or their designated representativesSECTION VI STANDARDS FOR DRIVERS AND ATTENDANTS61 Standards for drivers and attendants as developed by the North Carolina Medical Care Commissionas requirements for certification of medical responders and emergency medical technicians pursuantto Article 7, Chapter 131E -158, and Article 56, Chapter 143, of the General Statutes of NorthCarolina, and rules and regulations promulgated by the Board of Medical Examiners for AdvancedLife Support Technicians shall be applied and the same are incorporated herein by referenceSECTION VII STANDARDS FOR VEHICLES AND EQUIPMENT71 Vehicle and equipment standards as developed by the North Carolina Medical Care Commissionpursuant to Article 7, Chapter 131E -157, and Article 56, Chapter 143, of the General Statutes ofNorth Carolina, and shall be applied and the same are incorporated herein by referenceSECTION VIII STANDARDS FOR COMMUNICATIONS81 Each ambulance vehicle shall be equipped with an operational two -way radio capable of establishinggood quality voice communications from within the geographic confines of the county to eachhospital s emergency department in the county in which the ambulance is based Each ambulancevehicle shall be equipped with two -way radio communications capabilities for Communications withall hospital emergency departments to which transportation of patients is made on a regular orroutine basis anywhere within the state Each ambulance vehicle shall be equipped with anoperational two -way radio capable of establishing good quality voice communications from withinthe geographic confines of the county in which the ambulance dispatching agency is located[A82 Each ambulance provider shall maintain current authorizations or Federal CommunicationCommission licenses for all frequencies and radio transmitters operated by that provider Copies ofall authorizations and licenses shall be on display and available for inspection per FederalCommunication Commissions Rules and Regulations83 Each base of operations must have at least one open telephone line Telephone numbers must beregistered with each law enforcement agency and communications center in the County of Johnston84 Each ambulance shall be dispatched from the county communications center or an acceptable andapproved alternativeSECTION IX INSURANCE91 No ambulance franchise shall be issued under this Ordinance, nor shall such franchise be valid afterissuance, nor shall any ambulance be operated in the County of Johnston unless the franchisee hasat all times in force and effect either insurance coverage, issued by an insurance company licensedto do business in the State of North Carolina, or a bond with personal corporate surety for each andevery ambulance owned and or operated by or for the ambulance service providing for the paymentof damagesa In the minimum sum of 500,000 for injury to or death of one individual and a minimum of1,000,000 per accident in accidents resulting from any cause for which the owner of saidvehicle would be liable on account of liability imposed on him by law, regardless of whetherthe ambulance was being driven by the owner or his agency, andb In the minimum sum of 100,000 for the loss of or damage to the property of another,including personal property, under like circumstances, in sums as may be required by the Stateor as approved by the County of Johnston92 The Franchisee shall hold harmless and indemnify the County from and against any and allliabilities, costs, damages, expenses, and attorneys fees resulting from or attributable to any andall acts and omissions of the franchisee All franchisees shall maintain an errors and omissionspolicy at an amount not less than 1,000,000 To the extent that any such liabilities, costs, damages,expenses, and attorneys fees are compensated for by insurance, the franchisee shall not be requiredto reimburse the County or the insurer for the sameSECTION X RECORDS101 Each franchisee shall maintain the following recordsa Record of Dispatch - Shall show time call was received, time ambulancedispatched, time arrived on scene, time arrived at destination, time in service, and timereturned to baseb Trip Record - Shall state all information required in Section a in addition to information ona form approved by the County The trip record shall be so designed as to provide the patientwith a copy thereof containing all required information A copy of the trip record may serveas a receipt for any charges paidc Driver and Attendant Checklist and Inspection Report - Shall list contents and description ofoperations for each vehicle, signed by the individual verifying vehicle operations andequipmentd Other Data - To be submitted as requested by the committee or the Johnston County Directorof Emergency ManagementSECTION XI RATES AND CHARGES111 Each franchisee shall submit a schedule of rates to the County for approval and shall not chargemore nor less than the approved rates without specific approval by the County112 No ambulance service shall attempt to collect rates on emergency calls until the patient has reachedthe point of destination, has received medical attention and is in a condition deemed by the physicianfit to consult with the ambulance service, but such services may attempt to collect rates with familyor guardian of the patient once the patient is in the process of receiving medical attention113 On non - emergency calls, or calls where a person requires transportation to a non - emergency facility,attempts to collect payment may be made before the ambulance begins its tripSECTION XIL ENFORCEMENT121 The Johnston County Office of Emergency Management shall be responsible fori the oversight of the regulations contained within this ordinanceb receiving all franchise proposals from potential providersh reviewing each proposal for conformance to this OrdinanceF6601i With the approval disapproval of the Committee, recommend to the Board of Commissionersthe approval disapproval ofthe franchises to the applicants submitting the proposals,Insurej by cooperative agreement with other ambulance services the continued service in a districtwhere an ambulance service franchise has been suspendedMaintain all records required by this Ordinance and other applicable County regulationsk Serve as staffto the Johnston County Emergency Services Advisory Committee on all mattersthat pertain to the Committees function122 It shall be the responsibility of the ambulance provider to ensure that the ambulance operationcomplies with the provisions of this Article and all rules adopted for this Article Upon the violationof any part of this Article or any rule adopted under authority of this Article, the County shall havethe power to revoke or suspend the franchise ofthe violator The operation of an ambulance withouta valid franchise or after a franchise has been suspended or revoked or without an emergencymedical technician andor medical responder aboard as required by G S 131E -158, shall constitutea misdemeanor punishable by a fine or imprisonment or both in the discretion of the courtSECTION XIIL COUNTY EMERGENCY SERVICES ADVISORY COMMITTEE131 The Johnston County Emergency Services Advisory Committee whose membership shall beappointed by the Board of County Commissioners shall have the responsibility and duty of advisingthe Emergency Management Director and Board of Commissioners on matters relating to theenforcement of this Ordinance as specified in Section XIII above and shall develop and recommendfor approval by the Board of County Commissioners such standards of care, policies, proceduresand actions which will maintain and improve the quality of emergency medical services for theresidents of Johnston County132 Membership of the Committee shall consist ofa One 1 County Commissionerb Two 2 members of a franchised EMS service or Rescue Squad in Johnston Countyc Two 2 members of the Johnston County Fire Service, one being a Fire Chief of a FirstResponder Departmentd One 1 representative of the Emergency Room physicians of Johnston memorial Hospitale One 1 representative of the Department of Continuing Education of Johnston CommunityCollegef Two 2 citizens at large134 All members of the Committee shall have full and equal voting rights on matters to be consideredby the CommitteeSECTION XIV ADDENDUMS TO ORDINANCE141 The Board of Commissioners of the County of Johnston may, through appropriate actions, amendor expand this Ordinance to include other emergency departments or agencies as deemed necessarySECTION XV EFFECTIVE DATEThis Ordinance shall take effect on the 6th day of April, 1998, and shall supersede all previous Ordinancesand amendments pertaining to the regulation of emergency medical services in the County9 Approval of Projects - Distribution of HUD Grant FundsThe Board held a public hearing on a motion by CommissionerThomas M Moore, seconded by Commissioner James H Langdon, Jr and carried by unanimous vote,was entered into the minutesJust for the record, I would like to make a few comments about some things that were said inthe Board room last month concerning the fire departmentsDuring the audit report, the AUDITOR discussed his recommendation that all fire departmentsbe required to have a full independent audit each year He made a couple of remarks that were quotedin the local papers, which have upset many of the firemen in the County Specifically, the auditorstated that SOME of the fire departments were loath to turn over their records to him, and thatSOME of the departments were spending their money rather looselyUnfortunately, the newspapers did not make it clear that these comments came only from theauditor and did not, nor do they now, reflect the feelings of the Board of Commissioners or Countystaff Whereas the Board does agree it would be wise for everyone concerned to have the firedepartments records audited for the protection of the firemen since the fire tax money is involved,it was never the intention of this Board or staff to be critical of how most of the fire departments havebeen handling their accountingThe Board of Commissioners recognizes the contributions of these volunteers and istremendously proud of the great job they do We couldnt do without our firemen, and in no way dowe want any one of them to feel unappreciated They make a lot of sacrifices each year, they puttheir lives on the line for the rest of the citizens of this County, and have, in almost all cases, beenvery responsible in the way they spend the tax dollars The few problems that have been identifiedshould not reflect on all the rest of the departments, and we are here to make sure this will neverhappenThe Board discussed the auditors recommendation for audits and itemized budgets for both the firedepartments and rescue units The County Manager suggested the audits should be phased in two stages,the first year audit to include the financial records only, the second year to include fixed assetsFollowing discussion, Commissioner James H Langdon, Jr moved that all fire departments andrescue squads be required to submit itemized budgets each year and have full audits conducted annually,with fixed assets not being included as a part of the audit until the second year Commissioner Langdonfurther moved the County provide the necessary computer software to assist the units with the necessaryaccounting Commissioner Cookie Pope seconded the
