April 13, 1998The Johnston County Board of Commissioners met in regular session Monday, April 13, 1998, at 700pm in the Commissioners Room, Johnston County Courthouse Annex, Smithfield, North Carolina, withthe following membersPresent Norman C Denning, Chairman, James W Cash, Vice Chairman, Jerry F Wood,DDS, Eleanor N Creech, Cookie Pope, Thomas M Moore and James H Langdon, JrAbsent NoneAlso Present Richard B Self, County Manager, Mark Payne, Attorney, and Joyce H Ennis,Clerk to the BoardThe Chairman called the meeting to order and the following business was transacted1 Public Hearing - Rezoning CasesAdvertised - The Smithfield Herald - March 31, April 7, 1998Certified letters were mailed to adjoining property owners on April 2, 1998, and notices wereposted at the locations on April 2, 1998The Chairman opened the public hearing and invited anyone who wished to comment on thefollowing rezoning cases He stressed that in case 319 which is proposed as special use district, the onlything that can be discussed is whether the property should be rezoned No discussion about the proposeduse can be heard until the second hearing on the special use permitCase 317 Petition to rezone approximately 201 acres located on Powhatan Road State road 1901in Clayton Township from Agricultural Residential 40 to Light Industrial Owners andApplicants The Winstead Building a NC Partnership composed of Stephen CWoodard, Jr and Jerry W StevensCal Genereux, Planning Director, pointed out the property on the GIS map and stated thesurrounding zoning is ARR -40, Industrial I, General Business I and Highway Business 4 Industries inthe area include Bayer, Pharmacia UpJohn, C K, and Novo NordiskStephen Woodard stated he and Mr Stevens would like to see the property developed for an industrybased on the surrounding zoning He asked the Board to approve the rezoning so the EconomicDevelopment Office can begin showing the property for prospective industryCase 319 Petition to rezone approximately 1958 acres located on NC 50 South in MeadowTownship from Agricultural Residential 40 to Highway Business Special Use DistrictOwners and Applicants Leonard and Doris WoodMr Genereux indicated this tract on the GIS map and stated the surrounding zoning is ARR -40,Industrial I, and General Business I He noted this 1958 acres is a portion of a larger 12 acre tractCase 320 Petition to rezone approximately 2243 acres located on Old Drug Store Road Stateroad 1524 in Cleveland Township from Agricultural Residential 40 to Residential 30Owner Julia Gray Langdon Petitioners Son -Lan Development Company, Inc - application conferences held by the Planning Department with the applicantson this case Response Yes, Sir2 Did the applicants meet the requirements at that time by providing a sketch plan illustrating thelocation, size and major design elements of the development of this site Response Yes, Sir3 Did your department prepare an analysis of the application including conformity with zoning,subdivision, soil erosion and sedimentation, and health regulations Response Yes we did4 Did the Planning Board advertise and hold a hearing open to the public Response Yes, Sir5 Was written certification sent to the adjacent property owners in a timely fashion Response Yes Sir6 What is the recommendation of the Planning Board Response The Planning Board recommendedapproval of this case based on findings of factChairman Are conditions attached to these cases Response No, SirChairman Mr Genereux, please read to this Board the summary of the evidence supporting thePlanning Boards recommendations Response Mr Genereux read the following evidence of support foundby the Planning Board for Case 3191 All the work will be conducted indoors2 Sufficient landscaping will be required to protect adjoining property owners3 Use will provide a service not otherwise available7 Did you notify the applicants in writing of the Planning Boards recommendation Response Yes,Sir8 Are the applicants aware that if the Commissioners deny the request that no application can beaccepted for the same or a similar use affecting the same property for a period of twelve 12months Response Yes, Sir9 Are the applicants aware that the right of appeal to the Board of Adjustment must be exercisedwithin thirty 30 days of this date Response Yes, Sir10 Are the applicants aware that the permit will expire at the end of twelve 12 months if it is not usedas permitted within that time period Response Yes, SirThere being no further comments, the Chairman closed the public hearing4 Decisions on Special Use PermitsCase 319 Special use permit petition for paint and body shop on approximately 1958 acreslocated on NC 50 South in Meadow Township Owners and Applicants Leonardand Doris WoodUpon a motion by Commissioner Cookie Pope, seconded by Commissioner Eleanor N Creech andcarried by unanimous vote, the Board authorized the Planning Department to issue a special use permitto Leonard and Doris Wood for a paint and body shop on approximately 1958 acres on NC 50 South inMeadow Township, based on the following findings of fact1 All the work will be conducted indoors2 Sufficient landscaping will be required to protect adjoining property owners3 Use will provide a service not otherwise available5 Easements - McGees Crossroads Sewer LineCommissioner Cookie Pope asked to abstain from discussion and action on this matter The Boardexcused Ms PopeCommissioner James H Langdon, Jr reported he has contacted each of the parties concerning theeasements for the McGees Crossroads gravity sewer line, and although they have all responded that theywill sign the easements, they have not done so at this time He recommended a time frame be determined,at which time the County would drop the gravity line and proceed with a force main on Hwy 210In response to a question from Commissioner Thomas M Moore concerning which easements havenot been signed, Engineer Tim Broome stated the Bessie Langdon property Mrs Dan Matthews, theGeorge Coats and the Mike and Danny Coats easements have not been signedCommissioner James H Langdon, Jr moved the Board agreed that if the easements are not signedby 500 pm on Thursday, April 16th, the County change to a force main along Hwy 210 CommissionerJames W Cash seconded the motion30Commissioner Thomas M Moore stated, in his opinion, this would be short- sighted on the part ofthe County, and in the long run would cost the County money He noted if the gravity line is not built,approximately 600 acres would be deprived from access to sewer The Board can use condemnation ifnecessary, both for the permanent easements now, and later for the options He noted that with the forcemain, there would be too many pump stations along Hwy 210Commissioner Langdon withdrew his motion Commissioner Cash withdrew his secondFollowing discussion, the Board instructed Engineer Tim Broome to contact the property ownersagain and give them another opportunity to sign the easements, by Thursday if possible It was noted theBoard will hold a special meeting if needed on this matter6 MAPS Group -
