Hearing - Rezoning CasesAdvertised - The Smithfield Herald - April 28, May 5 1998Certified letters were mailed to adjoining property owners on April 30, 1998, and notices wereposted at the locations on April 30, 1998The Chairman opened the public hearing and invited anyone who wished to comment on thefollowing rezoning casesCase 321 Petition to rezone approximately 3344 acres located at the intersection of NC 42 andOld Drug Store Road State road 1524 in Cleveland Township fromAgricultural Residential 40 to General Business Owner and Applicant Irene SJohnsonPlanning Director, Cal Genereux, directed attention to a GIS map of the property and noted thesurrounding zoning is ARR -40, Interstate Highway District, and Industrial I The property is locatedbetween NC 42 and Old Drug Store Road at the point where they intersect, and has road frontage on bothroads The Planning Board recommended denial based on the fact that the property is outside of theInterstate Highway District, where there is still undeveloped property for commercial and industrialgrowthLee Hatch, speaking on behalf of the owner, presented a map and packet containing picturesshowing the commercial growth near the property He noted that even though there is some undevelopedproperty within the Interstate Highway District, much of it is in large land tracts that is being marketedfor industry or large scale development, and other parcels would require considerable fill work or bridgingto make them suitableJudy Coats and her son James Coats, who live across from the property, stated the area used to bea nice residential community, but it has now become commercial They pointed out that with the trafficand the surrounding commercial growth, the property is not suitable for anything but commercialdevelopment They supported the request for rezoningWayne Lewter, who owns 19 acres on NC 42 across from the site, opposed the rezoning He statedthe neighborhood has been residential and should remain residential He voiced concern about what he seesas unplanned growth in the area Rose Damon, resident of South Hills Subdivision, agreed Although sheopposed the rezoning, she noted that if it was rezoned, she would prefer to see something upscale andsophisticated rather than another motel or gas stationAbe Matthews, pastor of Saint Amanda Baptist Church on NC 42, opposed the rezoning He statedthe Church plans to stay at this location and does not wish to be closed out by commercial growth LeroyBadger and Gerald Mitchell, church members, also spoke in oppositionAlso opposing the rezoning were Frances Parker, who noted the residential area is already congestedwith commercial growth, and traffic problems, and Thomas Godwin, adjacent property owner47Mr Genereux responded that some ofthe commercial properties Mr Hatch referred to were existingprior to countywide zoning, and some are within the Interstate District He voiced concern that if theproperty is rezoned for commercial development, the driveway cuts on both roads would add to the trafficcongestion He agreed this property is best suited for commercial development, however, he maintainedthat suitability alone does not always constitute good planningCommissioner Tom Moore asked if the Subdivision Ordinance addresses the driveway cuts forcommercial subdivisions Staff responded that as long as the property is subdivided, the Ordinance doesregulate the location of driveways It was pointed out, however, that multiple businesses could locate onthe site without subdividing the property, in which case the Subdivision Ordinance would not applyBoard members discussed the problems with controlling growth and trying to be fair to everyoneCommissioner Eleanor N Creech noted this is a difficult case as both arguments are valid Regardlessof what the Boards decides, it will not suit everyone The Commissioners, however, have theresponsibility of making the best decision they can for the greatest number of peopleCommissioner Cookie Pope noted Cleveland is her community, and she understands how all of theparties feel, especially the members of Saint Amanda Baptist ChurchCase 322 Petition to rezone approximately 173 acres located at the intersection of NC 210 andSwift Creek Road State road 1501 in Smithfield Township fromAgricultural Residential 40 to Highway Business Owner and Applicant HenryHowleyMr Genereux pointed out the property on the GIS map and noted the surrounding zoning is ARR-40 and Mobile Home Park He noted Mr Howley wishes to reopen the existing facility as an ice creamshop The Planning Board recommended approval of this caseCase 323 Petition to rezone approximately 12 acres located on US 70 in Wilsons MillsTownship from Agricultural Residential 40 and General Business to Residential 30Owner and Applicant Mellie Gene BarbourCase 323 -A Petition to rezone approximately 34 acres located on US 70 in Wilsons MillsTownship from Agricultural Residential 40 and General Business to Residential 10Owner and Applicant Mellie Gene BarbourMr Genereux addressed cases 323 and 323 -A He directed the Boards attention to the GIS mapand noted that both cases refer to the same parcel A portion at the back of the property is in thewatershed protection area and case 323 is a request to rezone that portion to R -30 Case 323 -A is apetition to rezone the middle section, which does not fall within the watershed area to R -10 The frontportion of the property is located in the Highway Overlay Business District and is already zoned GeneralBusiness The surrounding zoning is Mobile Home Park District, ARR -40, Industrial 1, Residential 10,Watershed Protection District and General Business 1 The Planning Board recommended approvalClifford and Linda Uzzle stated they wanted to go on record that they own an active livestock hogfarming operation north of this property They asked if there was some way this fact could be indicatedon the plat to make sure future property owners will be forewarnedThe Board discussed the fact that this information definitely needs to be disclosed to potentialproperty ownersDennis Blackman, representing the owner and the potential developer, stated the developer is awareof the livestock operation, but he stressed that before the Board makes any stipulation requiring thisinformation be recorded on the permanent documents, he would ask that petitions case 323 and 323Abe tabled until next month He pointed out the farm operation may not always be thereIn discussion, the Board agreed it would not be appropriate to record this information on thepermanent documents, however they did stress the importance of disclosure of all the facts to potentialproperty ownersM I ?•Case 324 Petition to rezone approximately 1212 acres located at the intersection of South ShilohChurch Road State road 1526 and Cleveland Road State road 1010 in ClevelandTownship from Residential 30 to General Business Owners and Applicants J Troyand Geraldine C LancasterMr Genereux pointed out the property on the GIS map and noted the surrounding zoning is ARR-40, R -30, General Business, Community Business and Highway Business 4 -SUD Multiple subdivisionsare located in the area The Planning Board recommended approvalSteven Sanderson, with Southwind Surveying and Engineering, spoke on behalf of the propertyowners stating they wish to develop a strip mall on the property to provide services for the people in thearea He pointed out that commercial development on this acreage would increase the tax base withoutadding students to the already overpopulated schoolsCommissioner Cookie Pope asked it the entrance exit driveways would be on SR 1010 or ShilohChurch Road and stated she was concerned about the traffic situation Mr Sanderson responded thelocation of driveways has not been determined, however, he would imagine the owners would wantdriveway cuts off both roads, with the one on SR 1010 having a left turn laneLinwood Jones, representing the adjoining property owners, spoke in favor of the rezoningChristine Walczky and Theresa Frattim, who live in the area, opposed the rezoning Ms Walczkyvoiced concern that shops would decrease property values, promote crime in the area, and create moretraffic problems She stated with the shopping area at I- 4042, there is, in her opinion, no need for anyadditional shops at this location Ms Frattim stressed that both SR 1010 and Shiloh Church Road aretwo -lane and were not built to accommodate high traffic useCase 325 Petition to rezone approximately 101 acres located at the intersection of Black CreekRoad State road 1162 and Elevation Road State road 1308 in Elevation Townshipfrom Agricultural Residential 40 to General Business Owner and Applicant AnthonyIvan LassiterMr Genereux pointed out the property on the GIS map and noted the surrounding zoning is ARR-40 He stated Mr Lassiter wishes to operate a business on the 101 acres, which is part of a larger tractPrior to zoning, a business was operated on this property, and several buildings still exist The PlanningBoard recommended approvalAndy Lassiter stated he wishes to establish a new business on the property, using an existingbuilding for office spaceCase 326 Petition to rezone approximately 4 acres located at the intersection of SoutherlandRoad State road 1904 and Fire Department Road State road 1908 in Wilsons MillsTownship from Agricultural Residential 40 to Community Business Owners andApplicants Tommy and Rebecca IvesMr Genereux indicated the property on the GIS map and noted the surrounding zoning is ARR -40Currently this property is vacant The Planning Board recommended denial of this rezoning based on theunsuitability of the property for this purposeLinwood Jones, of Southwind Surveying and Engineering, stated the owners approached him abouttheir need to liquidate the property East Coast Migrant Headstart has indicated they would like topurchase the property and build a 500,000 school facility for migrant children, ages 0 -5William Murphy, Associate Director of East Coast Migrant Headstart, noted the organization hasseven centers in North Carolina with administrative offices in Wilson The proposed school would replacethe one currently operating in Clayton and would serve 82 families In response to a question fromCommissioner James W Cash, Mr Murphy stated the organization is financed by federal funds anddonations The school would operate three or four buses and one van at this siteGlenn Ballridge, contractor for the organization, stated a church would be built next to the school,and the entire project would, in his opinion, increase the property values in the areaJames Ross, adjacent property owner, stated the property fronts Southerland Road, which wouldmean the schools driveway would be directly across from his home He opposed the rezoning and statedthe intersection is dangerous and not suitable for school trafficBlannie Charles Parrish, property owner in the area, stated there is no access to public water orsewer service, and in his opinion, the lot is not suitable for a septic system large enough to accommodatea school and a church He voiced concern too that if the school failed, the property would be open for anydesignated use of community business zoningCarolyn Parrish, Janet Lee and Charles Lee also opposed the rezoning stating the property is notsuitable for a school for children as it is low, swampy and infested with snakes and ratsIn response to Mr Parrishs comments, Linwood Jones stated the Environmental Health Departmenthas approved the property for a septic system He noted he would have no problem if the Board chose tomake this a special use He pointed out the owners asked for this designation based on conversations withthe Planning staff and were frustrated by the final recommendations of both the staff and Planning BoardMr Genereux noted that neither the staff or the Planning Board objected to the general location fora migrant headstart school, however it was felt there were better suited propertiesMaria Baltierra, with East Coast Migrant Headstart, stated the organizations centers are accredited,AA licensed, and provide quality child care The program supervision exceeds the requirements, and therehas never been a problem at other centers She maintained the children the school would be serving willend up in the fields if a school is not provided Tammy Boykin agreed and noted the agency has beenchoosing sites for over 24 years without once making a wrong choiceElaine Langdon, director ofthe Clayton school who would move to the proposed facility, stated thislocation is better than the Clayton site because of its central location She noted many of the families arein the CommissionerJames W Cash seconded the motion, which carried by unanimous voteCommentsCommissioner Eleanor N Creech commented that without a doubt, the facility is needed and thechildren deserve to have the opportunities the school can provide, however, it is important that it belocated on a safe, suitable site Commissioner Cookie Pope agreed and commended the East CoastMigrant Headstart organization for the good job they are doing in ClaytonChairman Norman Denning stated he was impressed with the way the organization presented theircase and knows the need is real He thanked the organization and expressed hope they could find a suitablesite3 Request for Variance - Twin StateCounty Manager, Richard Self, explained that Twin States Farming, Inc has requested a variancefrom the 50 access road requirement in the Subdivision Ordinance They have requested the PlanningBoard approve an addition to an existing subdivision along a 16 wide private road at the Johnston CountyCountry Club The Subdivision Ordinance does not allow additional lots on private roads The PlanningBoard recommended approval subject to the Board of Commissioners approving the variance for the road51Upon a motion by Commissioner Jerry F Wood, seconded by Commissioner Eleanor N Creech andcarried by unanimous vote, the Board approved a variance from the Subdivision Ordinance requirementfor Twin States
