July 6, 1998 - Regular102July 6, 1998The Johnston County Board of Commissioners met in regular session Monday, July 6, 1998, at 1000am in the Commissioners Meeting Room, Johnston County Courthouse transacted1 1 MinutesChairman Norman C Denning asked if there were any corrections to the minutes of the June 1, 8,9, 10, 16, 19, 1998 board minutesCommissioner Thomas M Moore asked for certain changes to the minutes of the June 16th meetingpertaining to his comments during the discussion of the budgetFollowing discussion, Commissioner James W Cash moved the Board approve the minutes aswritten Commissioner Jerry F Wood seconded the motion, which carried by unanimous vote2 Local Government Budgeting - Fund BalanceDue to the many questions and comments that have been made recently concerning the Countysbudget, Chairman Norman C Denning asked the County Manager to explain the fund balance andindicate in what circumstances the required 8 reserved unappropriated surplus can be usedCounty Manager, Richard B Self, explained this year the Commissioners appropriated general fundbalance in order to balance the budget, leaving the County with no excess that can be used throughout theyear for unexpected expenses that arise This leaves only the 8 required by the Local GovernmentCommission, which is to be kept available for cash flow The reason this cash flow money is essential isbecause the County revenues are not received on a uniform basis throughout the year The majority ofproperty taxes, which represent the largest single revenue source, are not received until December;therefore, the County must operate from July 1 to December 31 with very little new money He sharedinformation from an article written by Lee Carter and John Vogt from the Institute of Government entitledFund Balance in Local Government Budgeting and Finance, and pointed out the 8 is the minimumamount, below which the Countys budget should never fall Most counties the size of Johnston maintainan average of 18 This reserve money can not be spent on unexpected expenditures, and really should not be used evenin an emergency, unless provisions are made to replace it immediately, as it could affect the countysability to meet its monthly obligations3 Futures Committee on School Facilities FundingEd Renfrow, chairman of the Futures Committee on School Facilities Funding, reported hiscommittee has met and is recommending the Board employ a consulting firm to develop a financial modelfor Johnston County The Barents Group from Washington, DC, is recommended due to their experienceworking with governmental entities The Group would work with the Board and County staff to build abudget planning model, which would produce a 10 -year forecast of expenditures, revenues and budgetbalance, based on the existing levels of government services and tax structure This would allow theCounty to simulate various situations and make informed decisions based on the projected outcomes Thegoal is to provide a sound system for dealing with the Countys financial future, and develop innovativeideas for meeting the future needs The Barents Group has submitted a proposal in the amount of 80,000for this service1047 Designation of Voting Delegate - NACo and NCACC ConferencesUpon a motion by Commissioner Eleanor N Creech, seconded by Commissioner Cookie Pope andcarried by unanimous vote, the Board designated County Manager, Richard Self, as voting delegate to theupcoming NACo and NCACC Annual Conferences8 Public Hearing - Community Development Block GrantAdvertised - June 12, 1998 in the Smithfield HeraldThe Chairman opened the public hearing and invited anyone who wished to address the Board onthe Countys proposal to seek funds from the North Carolina Department of Commerce, Small Cities andCommunity Development Block Grant Program CDBGMichael de Sherbinin, Economic Development Director, explained that Johnston County isconsidering applying for a CDBG Economic Development grant This type ofgrant is offered to industrialconcerns that can show that in excess of 60 of the grant funds will provide benefit to low or moderateincome persons through new job creation or job retention When the County has an interested industry thatmeets this criteria, a second public hearing will be scheduled for public inputThere being no further comments, the Chairman closed the public hearing9 Recreation Grant ApplicationsThe County Manager explained that 40 recreation grant applications have been received for a totalof 80,000 The Commissioners budgeted 75,000 for recreation grants in the 1998 -99 budget If theBoard approves all the applications, a budget amendment in the amount of 5,000 would be needed Healso recommended the Board include in their motion that no further applications be accepted during thefiscal yearFollowing discussion, Commissioner James W Cash moved the Board postpone approval ofrecreation grants until August, and set a deadline for accepting additional applications of July 24, 1998Commissioner Jerry F Wood seconded the motion, which carried by unanimous vote10 AppointmentsUpon a motion by the need forincreased environmental and planning procedures for highway projects Specifically, this grant agreement,in the amount of 25,000 per year for a total of 125,000 was approved in conjunction with the US 70Clayton Bypass construction project He recommended the Board adopt the following resolution acceptingthe five year grantUpon a motion by Commissioner Eleanor N Creech, seconded by Commissioner Thomas M Mooreand carried by unanimous vote, the Board adopted the following resolutionRESOLUTIONWHEREAS, the North Carolina Department of Transportation has prepared and adopted plans tomake improvements within Johnston County under Project R -2552, said plans consisting of theconstruction of the US 70 Clayton Bypass from I -40 in Wake County to US 70 in Johnston County; andWHEREAS, said Department of Transportation and the County have agreed to establish a positionwithin the County to implement, manage, and carry out the stormwater permitting program in compliancewith the Countys Stormwater Management Ordinance; andWHEREAS, the Department agrees to reimburse the County 125,00000 for said StormwaterAdministrator position in the five 5 annual installments of 25,00000 each beginning July 1, 1998NOW, THEREFORE, BE IT RESOLVED that Project R -2552, Johnston County, is herebyformally approved by the Board of Commissioners of the County and that the County Manager and Clerkto the Board are hereby empowered to sign and execute the Agreement with the Department ofTransportationAdopted this 6t day of July, 199813 Comprehensive Water and Sewer PolicyCounty Manager, Richard Self, explained that as requested by the Board, Tim Broome has revisedthe document combining the Countys water and sewer policies, and will discuss several recommendedadditions The draft document was originally presented to the Board in November If the additions areapproved, staff is requesting the Board adopt the compiled policies as a single document includingdefinitions of terms, as the Johnston County Comprehensive Water and Sewer PolicyTim Broome reviewed with the Board the following recommended additions to the Water and SewerPolicyProposed Additions to the Countys Water and Sewer PoliciesWater Main Construction StandardAdditions to the Countys water system shall be constructed to minimize dead end mains byinstallation of looping mains to create hydraulic circulation A loop main shall beconstructed In cases where the total length of the looped main is not greater than 133 timesthe length of the planned dead end main106Sewer Line Construction StandardExtensions to the Countys sewer system shall be designed with maximum use of gravity flowpipeline facilities wherever it is feasible In any case where sewer service is required and achoice exists for pumped service verses gravity service, then gravity service shall beconstructed provided that the construction cost of gravity facilities does not exceed four timesthe construction cost of pumped facilities The County reserves the right to pay the amountabove four times the cost of pumped service to achieve gravity service, provided publicpurpose is best achieved by gravity service and subject to the availability of funds The basisof cost and cost comparisons must be approved by the Johnston County Department ofUtilitiesWater and Sewer Capital ReimbursementFor water and sewer facilities constructed by private entities and individuals, which shallbecome the property of, and operation and maintenance responsibility of the County, theCounty may enter a reimbursement agreement upon written request from the entity orindividual constructing the addition subject to the following conditions• For water facilities only main sizes 8 in diameter and larger will be eligible forreimbursement• For sewer facilities only gravity sewer lines 8 in diameter or larger, wastewater pumpstations 80 gpm and larger, and force mains 4 in diameter and larger shall be eligiblefor reimbursement• The amount of developer reimbursement payment shall be calculated on the basis ofthe ratio of the peak flow rate of the new, additional load to the existing main dividedby the total peak flow capacity of the main or pumping station, times the originalproject cost of the affected facilities• The amount of original cost to be included in the calculation shall be limited to the costfor only the portion of the facilities serving the new user• Reimbursement amounts shall be based on the original project cost or appropriate pro -rata portion of the initial project cost which may include construction, engineering,land and easements, and other incidental administrative costs, which shall be subjectto the approval by the Johnston County Department of Utilities No interest,appreciation, or depreciation shall be factored into the cost calculation• The Johnston County Department of Utilities shall receive and disburse all paymentsEmergency Operation and Maintenance ChargesIn cases where the Johnston County Department of Utilities is requested or required to operateand maintain water andor sewer facilities for another public utility or a private utility, theCounty shall charge base and commodity fees of 133 times the prevailing County retail ratesWastewater Capital Commodity Surcharges, Assessment Fees and Connection FeesThe wastewater capital fee structure adopted in June 1997 will be modified as followsFor users tributary to the Central Johnston County Wastewater Treatment Plant and theClayton, Benson, Princeton, and Kenly Wastewater Treatment Plants-Commodity Charge for all County bulk Unit amount per 1,000 gallons,customersdetermined annually-Commodity Charge for all County retailUnit amount per 1,000customersgallons, determined annually-Commodity Surcharge for bulk and retail045 per 1,000 gallonscustomers-Residential Assessment Fee for all new2,000 per tapresidential users outside sewer service areasof the Towns of Smithfield, Selma, Pine Level,Four Oaks, Benson, Clayton, Kenly, and Princetonwhich receive retail service from the County-Commercial Acreage Fee for all new7,500 per acre proratedcommercial users outside the sewer servicewith a minimum of 3,800areas of the Towns of Smithfield, Selma,Pine Level, Four Oaks, Benson, Clayton, Kenly,and Princeton which receive retail service fromthe County-Non-profit Entity Assessment Fee for usersoutside the Towns of Smithfield, Selma, PineLevel, Four Oaks, Benson, Clayton, Kenly,and Princeton which receive retail service fromthe Countyper parcel1000 per gpd of requiredwastewater capacity 107-Connection Charge Tap Fee for County 500 minimum or cost plusinstalled taps 10 , whichever is greater2 For users on County wastewater collection and treatment facilities in the northwesternand western areas of the County which will eventually be tributary to the Countysplanned western area wastewater treatment plant-Commodity Charge for all County retail Unit amount per 1,000customers gallons, determined annually-Commodity Surcharge for all County 045 per 1,000 gallonsretail customers-Residential Assessment Fee for all new2,500 per tapresidential users which lie outside town sewerservice areas-Non-profit Entity Assessment Fee for new1000 per gpd of requiredusers outside town sewer service areasaverage wastewater capacity-Commercial Acreage Fee for all new10,000 per acre prorated withcommercial users which lie outside towna minimum of 5,000 per parcelsewer service areas-Connection Charge Tap Fee for County 500 minimum or cost plusinstalled taps 10 , whichever is greaterWater Capital Assessment Fee for Non - Profit EntityNon - profit Entity Assessment Fee for new users shall be 200 per gpd of required averagewater capacity Options 1 Town or municipal sewer service areas are defined as any areas provided retailsewer service by municipalities or other public utilitiesor2 Town or municipal sewer service areas are defined as any areas providedretail sewer service by municipalities or other public utilities through non-County owned wastewater collection and transmission facilities Average capacity is defined as the average daily water usage calculated on a monthly usagebasis Water usage shall be based on historic water use records for existing facilities For newfacilities, water usage may be based on documented water use information for similar, existingfacilitiesIn discussion, it was noted that a ten -year time frame was intended but not included in the proposedpolicy on Water and Sewer Capital Reimbursement Also, not included was a statement concerningwhether this policy would be retroactive Mr Broome recommended the 10 -year expiration period beincluded, as well as a notice that the policy would apply retroactively only to projects already in theplanning and design stage at the time of adoptionConcerning the policy on Wastewater Capital Commodity Surcharges, Assessment Fees andConnection Fees, Mr Broome noted the Board will need to determine how they wish to define town ormunicipal sewer service areas Two options were offered for the Boards decision Option 1 would beeasier to administer, however if approved, the County could not charge fees for future connections to theselines, and therefore would have no way to recoup costs or build reserves for the Countys future sewersystem Option 2 would allow the County to collect assessment and connection fees on all County linesregardless of locationBoard members discussed the options presented Commissioner Eleanor N Creech asked if theBoard selected option 1, if some arrangement could be worked out with the towns so the County couldrecoup some of their costs It was stressed by the Board that the County needs to work with and cooperatewith all the towns as much as possibleMr Broome noted the County has built, or participated in the cost of building, many lines nearmunicipalities, either to accommodate industries or schools Some towns have adopted policies and chargecapacity feesWINFollowing discussion, Commissioner Thomas M Moore moved the Board adopt the JohnstonCounty Comprehensive Water and Sewer Policy, with the additions presented above as amended to includethe 10 -year expiration period and notation regarding retroactive projects in the section titled Water andSewer Capital Reimbursement, and incorporating option 2 as the definition of a town or municipal sewerservice area Commissioner Jerry F Wood seconded the motion, which carried by unanimous voteNote Complete Comprehensive Water Sewer Policy is on file in the Clerks Office and is herebyincorporated into the minutes of this meeting by reference14 Aman - Millard AgreementTim Broome discussed with the Board a proposed agreement for sewer service for the jointconstruction projects of Millard and Millards Weston Woods Subdivision of approximately 150 homes,and Aman Wessels Broadmoor Subdivision of approximately 290 homes The County would constructa segment of interceptor line, upsize the pump station and pay the cost of upsizing the gravity sewer linefrom 8 to 10 , and the force main from 6 to 8 , at a cost of approximately 150,000 He indicated themoney is available in the Public Utilities Reserve Fund and would, in his opinion, be reimbursed fromassessment fees within a period of 12 to 18 monthsMr Broome noted that after review, Attorney, Mark Payne, has recommended the following itemsbe added to the proposed agreement1 A statement as to the Countys benefit from the agreement2 A statement requiring the contractors to comply with all applicable standards concerning bidprocedures3 A statement acknowledging the Countys waiver under the provisions of NCGS § 159 -6434Following further discussion, Commissioner Jerry F Wood moved the Board approve the agreementbetween the County and Aman- Millard with the amendments as recommended by the County AttorneyCommissioner Thomas M Moore seconded the motion, which carried by unanimous voteAgreement Concerning Wastewater Facilities Constructionto Serve Weston Woods and Broadmoor Subdivisionsin the Cleveland Area of Johnston County, North CarolinaThis Agreement for design and construction of wastewater collection facilities to serve the Weston Woodsand Broadmoor Subdivisions on Cleveland Road SR 10 10 in the Cleveland community of Johnston County ismade this day of July 1998 between Millard Millard, Inc, hereinafter referred to as Millard Millard ,Aman Wessel Partnership, hereinafter referred to as Arran Wessel , and Johnston County, hereinafterreferred to as County WITNESSETHWhereas, it is mutually beneficial for all parties of this Agreement to construct interconnecting wastewatercollection facilities to serve the Weston Woods and Broadmoor Subdivisions, as well as future undeveloped landin the vicinity, andWhereas, it is in the interest of the developers, Millard Millard and Aman Wessel, to design andconstruct wastewater facilities on a common schedule, andWhereas, by participating in this wastewater facilities project, the County can realize long term savings inutility operation and maintenance costs through the elimination of two or more wastewater pumping stations, andWhereas, the County intends to participate in the cost of certain facilities and procurement of these facilitiesmust be in accordance with the statutory laws and regulations of North CarolinaNow, therefore, Millard Millard, Aman Wessel, and the County due to the mutual benefits occurring,agree in generator with a deduct alternate bid for a T diameter wetwell, an 8 force mainto the existing Cleveland Middle School wastewater pump station with deduct alternate bidsfor a 6 force mainc Pay for the cost of an 8 gravity sewer segment from a point between lots 48 and 49 in theBroadmoor Subdivision to the wastewater pump station, a 180 gpm pump station with 7diameter wetwell, 35 of the cost of a standby generator, and 6 force main to the existingCleveland Middle School pump stationd Reimburse the County for the equivalent cost of an 8 gravity sewer line for the portion of the10 gravity sewer interceptor used in the future by Broadmoor Subdivision, from the point ofthe line between lots 48 and 49 to the northwest corner of the Broadmoor tract Said paymentto be the original cost of an 8 sewer line based on the alternate bid by the successfulcontractor on the original construction and without adjustment for depreciation orappreciatione Pay for the cost of all technical services for the design, bidding, and constructionadministration for the wastewater facilitiesSection 3 The County agrees toPay the difference in construction costbetween the 8 gravity sewer line and a 10 gravity interceptorline between the northeast corner of the Weston Woods tract and the northwest corner of theBroadmoor tractPay for the construction cost of the 10 sewer line segment from the northwest policies and construction standards, shall apply tothe terms of this Agreement including assessments, as amended from time to time, except thatthe County waives the provisions of N C Gen Stat § 143 Board of Commissioners the Board has adopted uniformpolicies and fee schedules for customers of all water districts the Districts within Johnston County, asamended from time to time by the Board the Uniform Policy; andWHEREAS, the Board has determined that it is in the best interest of the County and the Districtsfor the County to amend the Uniform Policy in order to establish the rules pursuant to which amunicipality may purchase the assets of a District and to set forth the requirements for cooperationbetween a municipality and a district;NOW, THEREFORE, BE IT RESOLVED BY the Johnston County Board of Commissioners,meeting in regular session at Smithfield, North Carolina, on July 6, 1998, do the following1 The Uniform Policy applicable to all water districts is hereby amended by adding a new Section 6thereto in the form attached hereto as Exhibit A, in order to establish the rules pursuant to which amunicipality may purchase the assets of a District and to set forth the requirements for cooperationbetween a municipality and a district2 The amendment to the Uniform Policy attached hereto as Exhibit A, is incorporated herein byreference, and shall be applicable to all water districts in the County3 The County and its officers, agents and attorneys are hereby directed to take any further actionsas may be required by the laws of the State of North Carolina to perform lookedthroughout the budget and have been unable to find the additional 75,000 If the funds can not be found,an option might be to downsize the force main from 6 to 4 A 6 line would certainly be preferable inorder to provide for future growth, however the 4 force main would be sufficient to serve the school,which needs the service for their new construction The low bidder has been asked for revised costsestimates on a 4 line in case this is the only option the County has to provide this service for the schoolBoard members voiced strong opposition to building a sewer line that would not provide for futuregrowth in the area Following discussion, they agreed to delay award of bid until Monday, July 13, 1998in order to give the County Manager additional time to find a way to fund this project without downsizingthe lines17 Approval of Engineering Consultant on Midstate Mills ProjectThe Board reviewed the following engineering proposals received by the County for two projects,one of which is the design and bidding phase of the Midstate Mills projectSouthwind Surveying Engineering Co, Garner, NC 32,00000McKim Creed Engineers, PA, Cary, NC 41,00000The County Manager explained these proposals include engineering for both Midstate Mills andCleveland Middle School sewer projects The funding for the school project is uncertain at this time Staffis recommending award of contract to Southwind Surveying and Engineering authorizing them to proceedwith the Midstate Mills project at a cost of 6,720, with the understanding the Clayton Middle Schoolproject will be contingent upon funding He noted that school personnel has been contacted concerningfunding for the school project112Following discussion, Commissioner Cookie Pope moved the Board award a contract toSouthwind Surveying Engineering Company of Garner, NC, with authorization to proceed with theMidstate Mills project at a cost of 6,720, with the understanding the Cleveland Middle School projectauthorization is discussion, Commissioner James W Cash moved the Board defer the implementationof the permit provisions of the Stormwater Ordinance until June 26, 1998, with the stipulation that thiswould apply only in situations where site plans meeting the Countys minimum criteria were submittedto the Planning Office prior to June 26, 1998 Commissioner Jerry F Wood seconded the motion, whichcarried by unanimous vote19 Midstate Mills Considering Application for Community Development Block GrantThe County Manager informed the Board that Midstate Mills would appear to be an eligibleproject for application of a Community Development Block Grant CDBG in the amount of 130,000The company has indicated an interest in being identified as a potential grant project at the upcomingpublic hearing in August If approved, the grant would provide the County with the necessary funds toextend water and sewer to the site, which was a commitment made by the Board in 1994 when the industryfirst indicated interest in locating in Johnston CountyBased on the willingness of Midstate to participate in a CDBG grant application, and based onthe fact that Midstate has donated a one -acre site to the County for an elevated tank and pump station,Economic Development Director, Michael de Sherbinin, on behalf of Midstate Mills, has requested theBoard consider waiving the Countys permitting fees for the construction project in the amount of 30,000Bernard Art with Midstate Mills thanked the Board for their consideration in this matter He notedhis company originally planned to move to Johnston County in 1994, and even though this was delayed,there was always a commitment to develop the site Construction of the facility should begin in the verynear futureFollowing discussion, Commissioner Thomas M
