10 271 February 1 , 1999 The Johnston County Board of Commissioners met in regular session Monday , February 1 , 1999 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , Interim County Manager , Joyce H Ennis , Clerk to the Board , and Mark Payne , Attorney 1 Minutes Chairman James H Langdon , Jr asked if there were corrections to the minutes of the January 4 , 11 , 1999 board meetings There being no corrections , the Chairman declared the minutes approved as presented Public Comments 2 Carolina Builders - Sewer System Hutch Earp with Carolina Builders noted that on August 3 , 1998 , he appeared before the Board concerning sewer service for his company’s new addition to their facility on Cleveland Road He stated at that meeting he was told that County policy requires gravity lines whenever the cost of gravity does not exceed a 4 to 1 ration over the cost of pump and force main Carolina Builders portion of the cost of the gravity system was determined to be 44,976 , which has been paid Now , he stated he has received an additional bill in the amount of 4,768 from Southwind Surveying and Engineering for engineering services on this project He objected to this additional cost The Chairman stated the matter would be checked into as soon as possible 3 Citizen Request for Reduced Rate for Water District Connection Jessie and Ruby Parrish , owners of property on Guy Road in Clayton , stated they were never notified of the opportunity to connect to the Clayton Water District water lines at the reduced incentive fee of 7500 They currently live in Raleigh , but are building a home on their Guy Road property and wish to take advantage of the lower rate Interim Manager , Rick Hester , explained that in each water district , the “ early bird ” incentive connection fee of 75 is highly advertised and information is mailed or otherwise distributed to each property owner during the early stages of developing the project This opportunity lasts only for a limited time , usually 60 to 90 days , and is offered in order to get enough citizen participation to make the project work Those citizens who miss this initial incentive period also have an opportunity to connect for 600 approximately one - half the regular cost , and this lower connection fee is offered until the construction project is completed Since the Clayton Water district project is still in the construction phase , the 600 offer is currently in effect He offered to check the County’s records to determine what address and to whom the original information was mailed , and assured Mr and Mrs Parrish he would get back with them before the 600 offer expired 4 Public Hearing - 10 15 am - Industrial Revenue Bonds for House Autry Mills Advertised - The Smithfield Herald January 15 , 1999 The Chairman opened the public hearing and invited anyone who wished to comment on the proposed financing in the amount of 8 million in NC Industrial Revenue Bonds for the construction and installation of a facility for House - Autry Mills , Inc Michael de Sherbinin explained the Johnston County Industrial Facility Pollution Control Financing Authority has met with House - Autry Mills , Inc and has agreed to assist in the financing of their construction project for a facility in Johnston County , under the North Carolina Industrial andPage272 Pollution Control Facilities Financing Act He requested the Board’s approval of the financing plan There being no further comments , the Chairman closed the public hearing 5 Resolution Approving Industrial Revenue Bonds for House - Autry Mills , Inc Commissioner Jerry F Wood introduced the following resolution , the title of which was read APPROVAL IN PRINCIPLE OF INDUSTRIAL PROJECT FOR HOUSE - AUTRY MILLS , INC , AND THE FINANCING THEREOF WITH INDUSTRIAL REVENUE BONDS IN THE PRINCIPAL AMOUNT OF UP TO 8,000,000 WHEREAS The Johnston County Industrial Facilities and Pollution Control Financing Authority the Authority has agreed to assist in the financing under the North Carolina Industrial and Pollution Control Facilities Financing Act the Act of an industrial project by House - Autry Mills , Inc , a Delaware corporation the Company , which plans to acquire , construct and install a facility for the manufacture of corn meal products and other food products in Johnston County the Project and has indicated that agreement by the execution of an Inducement Agreement between the parties dated December 7 , 1998 , and ; WHEREAS Under GS § 159C - 7 each project must be approved by the Secretary of the Department of Commerce and , under Article 51B of Chapter 143 of the North Carolina General Statutes , the Federal Tax Reform Allocation Committee must allocate a sufficient amount of North Carolinas volume cap , as defined in Section 146 of the Internal Revenue Code of 1986 , as amended the Code to the financing ; and WHEREAS The Rules and Procedures of the North Carolina Department of Commerce require that the governing body of a county approve in principle any project to be financed under the Act ; and WHEREAS This Board of Commissioners has today held a public hearing with respect to the advisability of the Project and the issuance of bonds therefor , as evidenced by the Certificate and Summary of Public Hearing attached hereto as Exhibit A ; and WHEREAS Section 147 f of the Code requires that the Board of Commissioners approve the plan of financing for the bonds ; and WHEREAS , the Authority intends to issue its Industrial Development Revenue Bonds House - Autry Mills , Inc Project , Series 1999 the Bonds in the principal amount of 8,000,000 which will be secured by a letter of credit issued by a United States bank ; and WHEREAS , under Section159C - 4 of the Act the issuance of bonds under the Act must be approved by the governing body of the county in which the project to be financed under the Act is located ; NOW , THEREFORE , the Board of Commissioners of Johnston County , meeting in regular session at Smithfield , North Carolina , on February 1 , 1999 , do the following BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR JOHNSTON COUNTY 1 The proposed industrial project consisting of the acquisition , construction and equipping of a facility for the manufacture of corn meal products and other food products by House - Autry Mills , Inc in Johnston County and the issuance of bonds in an amount not to exceed 8,000,000 therefor are hereby approved in principle 2 The Board of Commissioners hereby requests the North Carolina Federal Tax Reform Allocation Committee to allocate up to 8,000,000 of North Carolinas 1999 volume cap , as defined above for the financing of the Project 3 The Board of Commissioners hereby approves the plan of financing as required by Section 147 f of the Code 4 The issuance of the Bonds in the principal amount of 8,000,000 is hereby approved for purposes of Section159C - 4 of the Act Commissioner Jerry F Wood moved the passage of the foregoing resolution and Commissioner Eleanor N Creech seconded the motion , and the resolution was passed Video ProductionPage273 Michael de Sherbinin informed the Board that he and David Wehbie , Director of Vocational Education for the Johnston County School system , recently met with the human resource directors of four of the local industries to discuss the type of job opportunities that are available to our young people As a result of these meetings , it was determined that the best way to interest students , guidance counselors and parents in the manufacturing career possibilities that are available in the County would be to produce an annual video to show students the course of study they would need to prepare for these jobs This first production would focus on careers with Caterpillar , Novo Nordisk , Hamlin and Channel Master and would be available to the schools this spring Future videos would hopefully include other industries in the area Mr de Sherbinin stated that production cost would be approximately 15,000 and would be paid for by his department with existing funds In response to a question from Board members , he noted this film would only have a short segment on the industries themselves , but would go into some detail about the vocational career pathways that students can follow as they further their education The industries will most likely produce companion videos that highlight their individual companies In future videos , cost sharing with the industries might be considered Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board voiced their support for the vocational career video project 7 Johnston Community College Request for Funds - Howell Woods Project Joanne Johnson , Chairman of the Johnston Community College Board of Trustees , spoke to the Board about the need for additional funds to manage the Rudolph Howell & Sons Environmental Learning Center She thanked the County for their continued support , but pointed out that as the public school system grows , the college and its needs also grow She introduced the new college president , Dr Don Reichard Dr Reichard explained the 2,850 acre Howell Woods property , which was given to the college by Rudolph Howell , represents a challenge for development He referenced the proposed current operating budget which was provided the Board , and stated the college is asking the County to allocate 100,000 in annual recurring categorical restricted funding for the operation of the environmental education center The college is currently looking at a usage fee schedule that should generate a limited amount of revenue , however , the income from hunting and farming can only be used for capital expenses , and any money from the timber and mineral rights must go into the Howell Scholarship Fund In response to a question from Commissioner Wade M Stewart , Dr Reichard noted the college also plans to ask the state for additional funding for this project The Board thanked Dr Reichard and Ms Johnson for their comments and agreed to give this request consideration when they work on the upcoming budget 8 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Kerri Drive , Chase Circle , Kasey Dee Circle , Zachary Way , Samatha Drive , Todd Place , Sherry Lynne Drive , Ashley Place , Charlotte Drive , and Margaret Place in South Hills Subdivision , Cleveland Township Serenity Drive , Alexander Road and Russ Road in Glad Acres Subdivision , Smithfield Township Woodstone Drive and Callie Court in Archer’s Pointe Subdivision , Wilders Township Southwick Avenue , Southmead Drive , Bay Leaf Circle , Watson Circle , Bradford Circle and Holder Circle in Southwick Farm Subdivision , Wilders Township Broadmoor Way , Lockfield Drive , Bradford Place and Granite Lane in Broadmoor Subdivision , Cleveland Township Amy Lane and Zeb Lane in Winding Meadows Subdivision , Elevation Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to add the roads listed above to the State Maintained System ,Page274 with the understanding that Amy Lane and Zeb Lane in Winding Meadows Subdivision , Elevation Township be conditional upon the developer fulfilling the final conditions required by the Department of Transportation Commissioner Jerry F Wood seconded the motion , which carried by unanimous vote 9 Authorization for Interim County Manager to Execute Documents Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved a resolution designating Interim County Manager , Rick J Hester , as applicant’s agent for federal forms relating to disaster funds , and further granted him authorization to sign and execute all documents , which the former county manager was authorized to sign DESIGNATION OF APPLICANT’S AGENT - RESOLUTION BE IT RESOLVED BY the Board of Commissioners of Johnston County that Rick J Hester , Interim County Manager is hereby authorized to execute for and in behalf of Johnston County , a public entity established under the laws of the State of North Carolina the application and to file it in the appropriate state office for the purpose of obtaining certain federal financial assistance under the rd Disaster Relief Act public law 288 , 93 Congress or otherwise available from the President’s Disaster Relief Fund THAT Johnston County , a public entity established under the laws of the State of North Carolina , hereby authorized its agent to provide to the State and to the Federal Emergency Management Agency FEMA for all matters pertaining to such Federal disaster assistance the assurance and agreements on the agreement 10 ABC Board Request for Approval of 2,000 Contribution to Day By Day Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Commissioners approved the ABC Board’s request for a one - time contribution in the amount of 2,000 to the Day By Day Treatment Center 11 Council on Aging - Report on Additional State Funds Donna Creech , Executive Director of Council on Aging , reported on the additional funds her agency received from the General Assembly She pointed out the various ways in which this money has been used to provide additional services for seniors in the County , and noted she was able to find the required 10 matching funds from within her budget Ms Creech noted she would be coming back to the Board requesting funds in the near future as the Council on Aging begins a building campaign The agency’s current facility is in very bad shape and can no longer be repaired and renovated The Board thanked Ms Creech for her report 12 Budget Amendments Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the following budget amendments A Social Services Department Moore , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board waived the length of service policy and reappointed Bobby Pope to the Beulah Fire Protection District for a two year term to expire February 2001 C Livestock Arena Management Board Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Jerry F Wood and carried by unanimous vote , the Board reappointed Andrew Denning and James T Johnson , and appointed David Fields to the Livestock Arena Management Board for two year terms to expire February 2001 D Nursing Home Domiciliary Home Advisory Board Commissioner Eleanor N Creech moved the Board reappoint Harriett Creech and appoint Martha Parrish and Carol Belisle to the Nursing Home Domiciliary Home Advisory Board Commissioner Creech further moved the Board also waive the length of service policy and reappoint Ruth Daniel to this board , with all terms being three years to expire February 2002 Commissioner Thomas M Moore seconded by unanimous vote , the Board appointed Danny Allen to the Local Emergency Planning Committee for a two year term to expire March 2001 F Industrial Development Commission Commissioner Thomas M Moore moved the board appoint Bobby Parnell from Kenly to the Industrial Development Commission for a two year term to expire February 2001 Commissioner Jerry F Wood seconded the motion , which carried by unanimous vote G Town of Clayton Planning & Zoning Board As recommended by the Clayton Town Council , Commissioner Allen L Mims , Jr moved the Board appoint Donna White as regular ETJ member of the Clayton Planning and Zoning Board for a three year term to expire December 2001 Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 14 Update on Central Permitting David Lasater , updated the Board on the status of Central Permitting He thanked the Board for their encouragement and support and stressed that efforts are being made to address the problems that th th were apparent when the office was open for two days , January 11 and 12 Mr Lasater outlined the goals of the department which are to create a greater level of customer service for permitting and inspections by providing a central location , easy and prompt access to information , and coordination of service between the different agencies He explained that when the office opened , it was realized that these goals were not being met The major problems that surfaced were location of the office , which needs to be in close proximity to the service operations involved , critical data that was not converted prior to implementation , and lack of training on the software Now that staff recognizes the software problems and needed additional training , these issues are being addressed The greatest dilemma is finding a suitable location where this concept can work Different options are being considered including building an addition to the facility that houses the Planning and Inspections Departments , or finding a location that could incorporate all the services involved , Planning , Inspections , Environmental Health , and Public Utilities Again he thanked the Board for their patience and noted that staff is committed to finding solutions that will make the permitting process user friendly and efficient , and provide better service to the citizens of Johnston County Board members discussed the various options Following discussion , Chairman Langdon thanked Mr Lasater for this update and for the work he and other staff have put into this project He voiced the Board’s support for making this endeavor work 15 Beaver Bounty Program Dissolved Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board dissolved the inactive County’s Beaver Bounty Program since the Beaver Management Assistance Program through the Cooperative Extension Office is now providing this service to the citizens of the County 16 Economic Development Proposal Harold Keene informed the Board that at the request of Commissioner Thomas M Moore , he prepared a proposal for creating an Economic Development Authority modeled after the Johnston County Airport Authority The Economic Development Authority , which would have to be established by the General Assembly , would consist of a board made up of business people in the community that would , according to Mr Keene , have both the directive of the County Commissioners and the structure to enhance the economic development of the County The Authority would replace the existing Industrial Development Commission , which acts in an advisory capacity with the Economic Development Director He shared with the Board the success the Airport Authority has had over the past , and suggested the County’s tax base would have increased significantly if this type of structure had been put in place twenty years ago for economic development He noted the authority would havePagePage pageNumber7277 ownership and control , therefore , they would put more effort into making sure progress was made Linwood Byrd , member of the County’s Industrial Development Commission , endorsed the proposal presented by Mr Keene Commissioner Thomas M Moore stated he served on the Industrial Development Commission in the past and felt frustrated because the commission really has no authority to do anything He suggested it is time for the County to take a fresh look at where it is going with economic development Commissioner Cookie Pope stated she would like to see chambers of commerce , municipalities and other interested citizens included in any new structure In response , Mr Keene stressed an authority should be a small board , however an additional advisory committee might be possible In response to a question from Commissioner Mims about funding , Mr Keene stated he was unsure of how this could be funded , but was under the impression that a large amount of federal money is available for economic development At the request of the Board , Economic Development Director Michael de Sherbinin responded to the proposal He stated he was encouraged by the enthusiasm , however , the County under the current operation has , in his opinion , been active and very successful in recruiting industry , considering the amount of money available He reviewed the recent accomplishments of his department , which included the expansion of Bayer , Winn Dixie Distribution Center , Caterpillar , and many smaller industries such as Hamlin , Burris Refrigeration , PCX , and This End Up He stated the proposal has merit , however in his opinion , a funding mechanism needs to be considered before creating a different delivery mechanism In response to the grants and federal funds Mr Keene spoke of , he stated he was unaware of any federal money that did not include regional participation and ownership , which would defeat the purpose of significantly increasing the County tax base The Commissioners thanked Mr de Sherbinin for his comments and agreed that the County would need to look carefully at all aspects of this before further consideration They agreed to discuss this at their upcoming retreat 17 Wilson’s Mills - Request for Extraterritorial Jurisdiction Area Kenneth Jones , Mayor of Wilson’s Mills , appeared before the Board again requesting extraterritorial jurisdiction ETJ He pointed out the town first originally asked for ETJ in 1996 when they incorporated , and has never received a decision from the Board Wilson’s Mills is the only town in the County that does not have an ETJ , and Mayor Jones stated they should be allowed to manage their growth like the other towns in the County He noted that Wilson’s Mills town limits are within three - tenths of a mile from another town , and they can not plan without knowing whether they will be able to go beyond their existing limits In response to questions from the Commissioners , Mayor Jones acknowledged that at present , the town contracts with Johnston County for almost all of its services He noted the town council is concerned that without an ETJ , by the time Wilson’s Mills is ready to grow , the other towns will have annexed up to their city limits Commissioner Allen L Mims , Jr suggested that Wilson’s Mills appoint a planning board , adopt an zoning ordinance and begin looking out for their own needs This would show that the town is ready to manage its property Commissioner Thomas M Moore pointed out many of the other towns are asking for extensions of their ETJ He suggested the County needs a policy Commissioner Wade M Stewart stated he would like to see Wilson’s Mills treated the same way all other towns have been treated , and suggested the Board discuss this matter at their upcoming retreat 18 Board of Education - Surplus Property The Board of Education has declared surplus and offered the County a vacant lot in Clayton ,PagePage pageNumber8278 which was part of the old Clayton Elementary School campus property The rest of the campus , minus this parcel , was declared surplus and given to the County in July 1997 , at which time the County immediately transferred this property to the Town of Clayton for their future use Commissioner Allen L Mims , Jr explained the Town of Clayton needs this parcel for their redevelopment project They mistakenly thought this was included in the original property transfer , and need the space for parking to meet the town’s ordinance In accordance with GS § 115C - 518 , Commissioner Mims moved the Board accept from the Board of Education the old Clayton Elementary School property that has been declared surplus , and transfer the title to the Town of Clayton , with the understanding that if , in the future , the Town of Clayton ceases to have a use for this property , it would revert back to the County of Johnston Commissioner Thomas M Moore seconded the motion Discussion Commissioner Wade M Stewart voiced concern that the County might not have been consistent in their policy of giving surplus school property back to the towns He referenced the fact that at least one municipality had to pay for surplus school property in the past He suggested that with the need for additional funding for school facilities , it would be wiser to sell the properties In discussion it was explained the Board of Education owns their properties , and until recent years had not declared any surplus At one point several years ago , the Board of Education declared a parcel surplus in the Town of Benson and negotiated an offer with the Town for certain compensation They had already made the offer when they realized they were required by law to first offer surplus property to the County The County declined the offer in order to allow the town and School Board to work out their arrangements It was after this situation that the School Board decided to offer future surplus properties at no cost , to the County and subsequently recommend they be transferred by the County to the communities Vote Ayes James H Langdon , Jr , Cookie Pope Jerry F Wood , Eleanor N Creech , Thomas M Moore , Allen L Mims , Jr No Wade M Stewart 19 Board of Education - Request for Commitment of FY 1999 - 2000 for Buses Dr James Causby , Superintendent of Schools , asked the Board to make a commitment of FY 1999 - 2000 school capital outlay funds for buses that need to be ordered now to assure they will be available by the first of the next school year He stated that 11 regular school buses , 4 buses for exceptional children , and 4 activity buses will be needed at a cost of 902,220 He pointed out that for the first time in many years , the Schools will not require additional mobile units for the coming year Following discussion , Commissioner Jerry F Wood moved the Board commit funds in the amount of 902,220 from the 1999 - 2000 budget as part of the annual capital allocation for the Johnston County Board of Education Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 20 Resolution for Grant Anticipation Notes on School State Bond Funds At the January 4 , 1999 Board meeting , the Commissioners approved the School Board’s application for grant anticipation notes against future state bond funding , with the understanding the bond funds would probably be available and the notes would most likely never have to be completed The Local Government Commission has now informed the County a formal resolution needs to be adopted approving the application Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Jerry F Wood and carried by unanimous vote the Board adopted the following resolution RESOLUTION AUTHORIZING APPLICATION TO LOCAL GOVERNMENT COMMISSION FOR AUTHORITYPagePage pageNumber9279 TO ISSUE GRANT ANTICIPATION NOTES WITH RESPECT TO FUNDS DUE TO JOHNSTON COUNTY UNDER THE PUBLIC BUILDING ACT OF 1996 WHEREAS , the Public Building Bond Act of 1996 has taken effect and the Board of Commissioners of the County of Johnston desires to borrow money for the purpose for which bonds are authorized to be issued by said Bond Act in anticipation of the receipt of a grant of a portion of the proceeds of the sale of said bonds ; NOW , THEREFORE , BE IT RESOLVED by the Board of Commissioners of the County of Johnston as follows 1 The maximum aggregate principle amount of notes to be issued is 6,903,000 Negotiable notes , each designated “ Public Building Bond Act of 1996 Grant Anticipation Notes ” shall be issued for any portion of said sum so borrowed 2 The Chairman of the Board of Commissioners of the County of Johnston is hereby authorized to fix the rate of
