10 347 April 5 , 1999 The Johnston County Board of Commissioners met in regular session Monday , April 5 , 1999 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , Interim County Manager , Joyce H Ennis , Clerk to the Board , John R Massey , Finance Officer and Mark Payne , Attorney 1 Minutes Chairman James H Langdon , Jr asked if there were corrections to the minutes of the March 1 , 8 , and April 1 , 1999 board meetings There being no corrections , the Chairman declared the minutes approved as presented 2 Public Comments Sandy Austin and her husband , property owners on Homestead Lane in Wilson’s Mills Township , stated that in January 1998 , while they were in the process of remodeling an older home in order to relocate from Wake County to Johnston County , they were informed by Environmental Health staff that there were no plans for public water or sewer in that area for the next few years Soon after they moved into the house , they were asked to provide an easement for the Wilson’s Mills Water District water line She maintained that had they known of the proposed water line , they would have waited until public water was available instead of spending money on a well Ms Austin noted she and her husband own 13 acres and would like to subdivide into lots for additional family members Some of the land is not suitable for a well , and their well water has so much iron , they would also like to have public water She asked if the County would allow them a reduced tap since they were misinformed earlier The Board thanked the Austins for their comments and asked the staff to check into this matter 3 Department of Transportation - Additions to System and Abandonment of Road The Board reviewed petitions presented by the North Carolina Department of Transportation requesting that Neuse River Parkway and Motorcycle Road Alignment be added to the State Secondary System for maintenance , and a request to abandon Motorcycle Road Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to add the roads listed above to the State Maintained System , and abandon Motorcycle Road Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 4 Public Hearing - COP’s Financing Advertised March 19 , 26 , 1999 - The Smithfield Herald The Chairman opened the public hearing and announced this scheduled hearing needs to be postponed until additional information is received on one of the projects involved Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board recessed the hearing until Monday , April 12 , 1999 at 6 45 pm 5 Update on Adult Care Facilities The Chairman announced that Social Services Director Earl Marett was scheduled to give the Board an update on Adult Care Facilities in the County Due to a death in Mr Marett’s family , he stated this matter will be tabled until a later meeting Page348 6 Presentation - Performance Audit Services - David M Griffith Tim McKinney , Vice President of David M Griffith & Associates , and Richard Brady , head of the firm’s Management Audit Team , presented information about the performance audit services they could provide the County Mr McKinney gave a brief history of the company and noted much of their work has been with the governmental segment Mr Brady informed the Board there are several approaches that can be used in evaluating performances ranging from very general to extremely detailed studies He recommended a middle ground approach for a County the size of Johnston , in which there would be approximately 100 interviews with department heads , supervisors and other personnel In response to questions from Board members , he noted the Commissioners would also be interviewed and there would be public briefings Commissioner Allen L Mims , Jr asked if the Company has experience with performance audits for schools since the Board of Education has indicated they too would be interested Mr Brady responded they have done some schools , but not as extensive as local governments The Board thanked Mr McKinney and Mr Brady for their presentation 7 Proclamations Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Jerry F Wood and carried by unanimous vote , the Board adopted the following proclamations A International Building Safety Week - April 4 - 10 , 1999 INTERNATIONAL BUILDING SAFETY WEEK 1999 - April 4 - 10 , 1999 WHEREAS , the safety of the buildings we occupy daily is essential to the health , safety and welfare of the citizens of the world ; and WHEREAS , among the worlds most fundamental laws and ordinances are those which provide standards for the safe construction of buildings in which people live , work and play ; and WHEREAS , for construction and building codes to be effective and enforced , understanding and cooperation must exist between code officials and the people they serve ; and WHEREAS , through the efforts of code officials worldwide , and their cooperative relationship with the construction industry , the administration of these health and life - safety standards is assured ; and WHEREAS , units of government across the world - - along with such prestigious organizations as Building Officials & Code Administrators BOCA International , Inc , International Conference of Building Officials ICBO , Southern Building Code Congress International SBCCI , Inc , the Council of American Building Officials CABO , the National Conference of States on Building Codes and Standards NCSBCS , and the World Organization of Building Officials WOBO - - are joining to promote the use of building and construction codes today , for a lifetime of building safety , through the observation of International Building Safety Week ; and WHEREAS , the theme of International Building Safety Week 1999 has been established as A Safer World Is on the Horizon NOW , THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS , does hereby proclaim the week of April 4 - 10 , 1999 as INTERNATIONAL BUILDING SAFETY WEEK , and urge all citizens to participate in International Building Safety Week activities to help promote building safety , to create awareness as to the importance of construction and building codes , and to spotlight the role of the dedicated code officials in administering those codes th Adopted this the 5 day of April , 1999 B Litter Sweep - April 17 - 30 , 1999 LITTER SWEEP - 1999 WHEREAS , Johnston County , as well as all of North Carolina enjoys the beautiful scenery and clean environment , which are a source of great pride , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the North Carolina Department of Transportation’s Office of Beautification Programs organizes a statewide cleanup campaign each spring and fall to ensure clean roadsides throughout our State ; and WHEREAS , a spring cleanup campaign has been planned for April 17 - 30 , 1999 , to help educate the public about the harmful effects of litter on the environment and give every citizen the opportunity to take responsibility for clean roads in North Carolina ; and WHEREAS , the Adopt - A - Highway program began in North Carolina in 1988 with a few hundred groups and has grown to approximately 6,000 groups More than 200 Adopt - A - Highway groups have been cleaning theirPage349 adopted highways since the program began ; and WHEREAS , the 1999 spring cleanup will give citizens the opportunity to make our roadsides clean and beautiful to enhance North Carolina’s welcome to the Special Olympics World Games and the U S be for the base bid , less 14,337 value engineering reduction , and alternate # 3 The total project budget would be 706,207 Currently the Heritage Commission has on hand 469,436 , which leaves a shortfall of 236,771 He asked the Board to guarantee the additional funds , based on approval of the proposed Certificates of Participation COP’s funding , of which this would be one of the projects Mr Johnson noted that 350,000 of the proposed COP’s has been designated for this project , which would be repaid through uncollected pledges The Heritage Commission intends to continue its fund - raising efforts , and should the current outstanding pledges not come in , he stated the Commission should be able to repay the County loan within five years In response to a question from Commissioner Thomas M Moore concerning the Ava Gardner Museum , Mr Johnson stated there would not be enough room in the Heritage Center to display the entire collection He noted the Heritage Center , unlike the Ava Gardner Museum , is primarily for Johnston County citizens Wingate Lassiter , Chairman of the Heritage Commission , addressed the issue of funding He and Mr Johnson assured the Board the Heritage Commission plans to ultimately pay for the capital project through donations ; the only cost to the county would be the yearly cost of operation , which should amount to approximately continue to work with Wake County , as this arrangement has worked well for everyone involved Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following resolution RESOLUTION CAPITAL AREA WORKFORCE DEVELOPMENT CONSORTIUM WHEREAS , Johnston County is currently a partner in the Capital Area Workforce Development Consortium for administration of federal and state workforce funds for Johnston and Wake Counties ; and WHEREAS , the Capital Area Workforce Development Consortium has been designated by Governor James B Hunt , Jr to continue as a Workforce Investment Area under the federal Workforce Investment Act of 1998 ; and WHEREAS , Johnston County wishes to continue the Capital Area Workforce Development Consortium Agreement with Wake County NOW , THEREFORE , BE IT RESOLVED that the Johnston County Board of Commissioners hereby authorize the Chairman of the Johnston County Commissioners to Communications , requested the Board approve the purchase of radio tower equipment for a new site near Archer’s Lodge In accordance with NCGS § 143 - 129 f quotes were requested from companies that provide equipment compatible with the rest of the County’s system Southern Communications offered the low quote of 86,620 Funds are available in the current Communications budget Mr Gaskill explained this is the beginning of a process to remove the County’s equipment from the WRAL Tower in Wake County and place it at four locations within Johnston County Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the purchase of radio tower equipment from Southern Communications at a cost of 86,620 , with funds Commissioner Jerry F Wood , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board adopted the following resolution APPROVAL OF TAX - EXEMPT LOAN TO VOLUNTEER FIRE DEPARTMENT NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Kenly Volunteer Fire Department , Inc the “ VFD ” , from Heritage Bank of Kenly in the principal amount of 280,00000 , which loan is for the purchase by the VFD of a fire truck , and which fire truck will be owned and TRADITIONALLY IN THE DIVISION OF ENVIRONMENTAL HEALTH UNDER THE ORGANIZATION OF THE DEPARTMENT OF HEALTH AND HUMAN SERVICES WHEREAS , Delivery of Environmental Health services to the Citizens of North Carolina is carried out at the county level by local health department employees ; and WHEREAS , Delivery of Environmental Health services at the local level is funded by local dollars 97 local and 3 state ; and WHEREAS , Environmental Health services at the local level include on - site wastewater ie septic systems food , logging and institutional sanitation restaurants , nursing homes , food borne disease investigation child care sanitation , child lead program , swimming pools , rabies control , safe drinking water ; and WHEREAS , Having two different proposed State environmental health authorities for local health departments is inefficient and will cause regulatory confusion for the public and severely impact centralized training , authorization , regulatory direction and uniformity ; and WHEREAS , The NC Association of County Commissioners , the NC Association of Local Health Directors , the Association of North Carolina Boards of Health , the NC Environmental Health Water Service Engineer Tim Broome discussed with the Board a proposed bulk wastewater transmission and treatment agreement with Carolina Water Service CWS He explained that currently CWS has a wastewater discharge permit for 049 mgd into White Oak Creek and a 50,000 gpd treatment plant that serves White Oak Plantation Subdivision Under this agreement , CWS would transfer the permit to the County but would continue to maintain and operate the plant until it is abandoned CWS would build , own , operate , and maintain a sewer system large enough to serve White Oak Plantation and the proposed 826 acre land development on Winston Road The wastewater from this system would feed into a new County offsite force main to connect to the existing County force main on NC 42 CWS would pay one - half of the estimated 150,000 cost for the new force main , leaving a cost to the County of 75,000 , which is available through the Public Utilities Capital Reserve budget The County would own , operate and maintain the equalization pumping station and force main Mr Broome noted that special fees and charges would be set for this project , due to CWS’s assessment policy being different The County has lower assessment fees , but commodity charges are higher The over all end result for the County over the 20 year period would be approximately the same Board members expressed concern that retail customers in this project would be paying a different amount from other County customers In response it was explained that CWS has indicated the County’s fee schedule would not work for them What they assess their retail customers is up to them as long as the satisfy the Utilities Commission Commissioner Thomas M Moore pointed out the important thing is to provide the overall protection to the citizens by assuring them up - to - date wastewater treatment for the future Page0356 In response to questions about why CWS was ever given a discharge into White Oak Stream , and what precedent this might be setting for the County , Mr Broome noted that back in the 1970 s , environmental requirements were not as strict , and the State’s policy was to issue discharge permits to anyone who could treat wastewater The only other situations in the County would be similar permits given to Rebecca Flowers for her development ; one permit to discharge in the Neuse River and one for Buffalo Creek Mr Broome continued by saying , in his opinion , there are two reasons to enter into this agreement with CWS First , it is the right thing to do , there should be no discharge into White Oak Stream Second , the County needs this in order to receive the Clean Water Trust Fund 38 Million grant for effluent land application Following further discussion , Commissioner Jerry F Wood moved County desires to provide bulk wastewater transmission and treatment service to CWS , and CWS desires to purchase bulk wastewater transmission and treatment service from County ; and WHEREAS , the service to be provided shall be applicable for the potential 826 acre development tract and the existing White Oak Plantation Subdivision , as shown and described in Attachment A , and referred to hereafter as the Winston Road tract ; and WHEREAS , CWS desires to abandon its existing 50,000 gpd package wastewater treatment plant serving White Oak Plantation Subdivision and to transfer its existing 049 mgd NPDES discharge permit on White Oak Creek to the County NOW , THEREFORE , for and in consideration of the premises and rights , powers and duties hereinafter set forth to be performed by each , the sufficiency of which are acknowledged by the parties , County and CWS mutually do agree as follows I County Agrees as Follows 1 The County agrees to receive untreated domestic and commercial wastewater from existing and future development on the Winston Road tract , transmit the wastewater to an appropriate wastewater treatment plant , treat , or have treated the wastewater and dispose , or have disposed the treated wastewater in an environmentally sound manner in accordance with regulatory requirements The volume of wastewater shall not exceed 500,000 gpd on an average daily flow basis , and the peak rate of delivery shall not exceed 320 gpm for an average daily flow of up to 300,000 gpd and 400 gpm for an average daily flow of up to 500,000 gpd 2 Upon written request by CWS , the County agrees to provide additional bulk wastewater service to CWS , subject to availability and further subject to the Countys applicable policies , fees , and charges in effect at that time 3 The County will own , operate , and maintain a wastewater metering , flow equalization , and pumping facility constructed by CWS 4 The County will acquire , at its own cost , easements as necessary for construction of a wastewater force main from the CWS constructed pumping facility to an existing County wastewater pump station or force main The County will pay one half the cost of the force main or the amount above the CWS share limit of 90,000 II CWS Agrees as Follows 1 CWS agrees to transfer NPDES permit no NC0060330 to Johnston County within 30 days of the date of this Agreement 2 CWS will continue to own , operate , maintain , and repair the existing package wastewater treatment plant and will hold the County harmless from any damages , effluent limits contraventions , spills , or other damages or claims resulting from CWS operations 3 CWS agrees to pay a one time assessment charge in the amount of 1,40000 per residential unit served and 5,900 per platted acre for all commercial development served The assessment fee shall be due on or before a building permit is issued for any residential unit or commercial development 4 CWS agrees to install or contract to have installed all required wastewater collection infrastructure to serve the Winston Road tract , a wastewater flow meter , a wastewater flow equalization and pumping station , and standby power generator set , and will provide a suitable site with all weather access road for same , at its ownPage1357 cost , in accordance with the County’s specifications and design standards The wastewater flow equalization , metering , and pumping facilities , required land parcel and access and utility easements shall be deeded to the County at no charge All construction shall be subject to the Countys review and approval Said approval shall not be unreasonably withheld CWS also agrees to install or have installed a wastewater force main to connect to a County pumping station or force main in accordance with the County’s specifications and design standards CWS agrees to pay for one - half the total cost of the connection to the force main or pumping station , not to exceed 90,000 5 Any adjustments in the commodity charge shall be based directly on the County’s actual increase in cost of providing service throughout its service area , including but not limited to power , labor , equipment repair replacement , administration , and or changes in state or federal regulations Any adjustments in the commodity charge to CWS will be in same amount charged throughout the County’s sewer system for bulk wastewater service 6 For any facilities constructed by CWS which are to be deeded to the County which lie outside public rights of way or fee simple land parcels , CWS shall obtain and transfer to the County a permanent utility easement ; and the County shall , in writing , approve the form and substance of any and all easements 7 CWS shall pay a monthly commodity charge to the County within fifteen 15 days from the date of invoice for water It is understood that the commodity charge is subject to adjustment annually by the County Board of Commissioners with 90 days written notice As of the date of this Agreement , the commodity charge is 390 per 1,000 gallons 8 CWS shall pay a fixed monthly charge to County , which is the fixed cost of providing service to bulk users As of the date of this Agreement , the fixed monthly charge is 20000 9 In the event wastewater collection facilities and the new flow equalization , metering , and pumping facility , including the connecting pipeline to the existing package wastewater treatment plant , are not constructed within three years from the date of this Agreement , CWS shall construct at its own cost , a wastewater flow meter , pump station , and force main to connect to the closest County wastewater facility of sufficient capacity to serve the White Oak Plantation Subdivision , and shall abandon the existing package wastewater treatment plant and cease discharge into White Oak Creek The wastewater pump station , flow meter , and force main shall be constructed to County standards and shall be deeded to the County The County will own and operate the wastewater pump station 10 Within six months from the date of this Agreement , CWS shall connect the White Oak Plantation Subdivision water distribution system to the new 8 water main on Guy Road in the Clayton Water District , and CWS shall install a meter meeting County specifications at its own cost CWS shall disconnect its well or wells which currently serve the system III ADDITIONAL COVENANTS AND AGREEMENTS 1 Emergency Operator CWS is a utility company regulated by the North Carolina Utilities Commission hereinafter the “ Commission ” For the term of this agreement , if the Commission declares an emergency in the service area provided by CWS , the County shall become the emergency operator , and the County will operate and maintain the system and shall be compensated at its then prevailing retail fees In the event all fees are not paid , it is agreed that a lien in the amount of the unpaid fees shall be placed against the wastewater system infrastructure The term of emergency operations shall be one year and shall be renewable in one year periods subject to the written consent of the County In the event of continued non - payment of all fees for a period of three 3 years , the water lines , services and appurtenant equipment and all easements shall be deeded to the County at no cost 2 Terms Terms of this Agreement shall be ten 10 years , with five 5 automatic renewals for ten 10 years each , unless a one 1 year written notification for cause cause being a material breach of this Agreement which remains uncured after notice by the other party is provided by either party to the other 3 Service Area The area served by CWS , referred to as the Winston Road tract and subject to this Agreement shall be that property shown on Exhibit A attached hereto and incorporated herein 4 Inspections CWS shall permit periodic inspections of the sewer system during construction and operation by County to ensure compliance with State Plumbing Codes and County Utility standards and specifications 5 Capital Reimbursement CWS may enter a capital reimbursement agreement with the County to facilitate reimbursement of a portion of its original capital investment for the wastewater flow equalization - pumping station and offsite force main from future third party connections to these facilities The terms of the agreement shall be in establish a plan to minimize the number of individual pump stations , which the County will ultimately have to maintain and operate He recommended the Board participate in the cost of a gravity sewer line for that area in the amount of 155,000 , which would be funded by the Public Utilities Capital Reserve account Mr Broome also recommended the Board approve the County’s participation with the
