10 490 June 29 , 1999 The Johnston County Board of Commissioners met in special session on Tuesday , June 29 , 1999 , at 9 30 am in the Conference Room , First Citizens Bank , Market Street , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Jerry F Wood , Eleanor N Creech , Thomas M Moore , Allen L Mims , Jr and Wade M Stewart Absent None Also Present Joyce H Ennis , Clerk to the Board , Rick J Hester , County Manager , Attorney Luther D " Lew " Starling , Jr , Former Manager , Richard B Self , Attorney , Renee J Montgomery and Mediator , James G Billings Chairman Langdon called the meeting to order 1 Closed Session - NCGS § 143 - 31811 3 - Case Richard B Self vs Johnston County Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board recessed regular session to meet in closed session as allowed by NCGS § 143 - 31811 6 " To consult with an attorney employed or retained by the public body in order to preserve the attorney - client privilege between the attorney and the public body , which privilege is hereby acknowledged " Case Richard B Self vs Johnston County Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board adjourned closed session and resumed regular session 2 Motion to Accept Terms of Settlement in the Case of Richard B Self vs Johnston County Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board agreed to the terms of a settlement agreement as negotiated in the case of Richard B Self vs Johnston County The settlement agreement as hand - written at the time of settlement was signed by each Board member Attorneys informed the Board a formal typed document with the negotiated terms will be drafted and sent to both parties Note A copy of both the hand - written and formal document will be on file in the Clerk's office There being no further business , Commissioner Cookie Pope moved the Board adjourn Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote ____________________________________ James H Langdon , Jr , Chairman ______________________________ Joyce H Ennis , ClerkPage
