Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , Attorney , and John R Massey , Finance Officer 1 Minutes - August 2 , 9 , 23 , 1999 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the August 2 , 9 , 23 , 1999 board meetings There being no corrections , the Chairman declared the minutes approved as presented Public Comments 2 Bentonville Battleground - Request for Endorsement of Grant Application Planning Director , Cal Genereux , informed the Board that John Goode , Director of Bentonville Battleground , has requested the Board’s endorsement of his application for a Federal Department of Transportation grant The Grant would provide funds to construct pull - off areas around historical markers at Bentonville These pull - offs would allow visitors to stop and read the historical information without creating a traffic hazard He noted the State DOT supports this request also Following discussion , Commissioner Eleanor N Creech moved the Board endorse Bentonville Battleground’s application for a Federal Department of Transportation grant for pull - offs around historical markers in the battleground area Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 3 New County Forest Ranger District Forester , Hunter Birckhead , introduced to the Board the new County Ranger , Charles Massey Mr Massey , who has worked for the Forest Service for the past 19 years , is replacing Bennie Casey who retired June 30 , 1999 4 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Atkinson Farm Circle , Mather Court , Olympic Trail , Rainer Court , Adirondack Place , and Acadia Court in Lee’s Plantation Subdivision , Cleveland Township Marshall Lane , Sallie Drive , and Sarah’s Court in Lassiter Place Subdivision , Elevation Township Ridge Way Lane , Justin Court , Kay Circle , Kristen Court , and Courtland Circle in Primrose Ridge Subdivision , Cleveland Township Sandy Branch Lane , Plantation Court , Creekbend Circle , and Hinton Circle in Sandy Branch Subdivision , Wilders Township Brookhill Drive , Michael Way , Christopher Drive , Claire Drive , and Katie Court in Ole Mill Stream Subdivision , Clayton Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to add the roads listed above to the State Maintained System Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote Page562 5 Public Hearing - Industrial Revenue Bond Financing - Flanders Corporation Advertised The Smithfield Herald - September 20 , 1999 The Chairman opened the public hearing and invited anyone who wished to address the Board on the industrial revenue bond financing for the Flanders Corporation Economic Development Director Michael de Sherbinin informed the Board that Flanders is seeking industrial revenue bond financing to expand their existing facility on Walpat Road in Smithfield Construction should begin by the end of the year , and when completed is expected to create up to 50 additional jobs He introduced Flanders Plant Manager , Roy Boswell , who offered to answer any questions the Board might have There being no further comments , the Chairman closed the public hearing 6 Board Adopts Resolution Approving Industrial Revenue Bond Financing Commissioner Jerry F Wood introduced the following resolution , the title of which was read APPROVAL IN PRINCIPLE OF POLLUTION CONTROL PROJECT BY FLANDERS CORPORATION OR AN AFFILIATE , SUBSIDIARY OR RELATED COMPANY THEREOF , AND THE FINANCING THEREOF WITH POLLUTION CONTROL FACILITIES REVENUE BONDS IN THE PRINCIPAL AMOUNT OF UP TO 4,000,000 WHEREAS , The Johnston County Industrial Facilities and Pollution Control Financing Authority the “ Authority ” has agreed to assist in the financing under the North Carolina Industrial and Pollution Control Facilities Financing Act the “ Act ” of a pollution control project by Flanders Corporation , a North Carolina corporation the “ Company ” or an affiliate , subsidiary or related company thereof , which plans to acquire , construct and equip an industrial glass recycling facility in Johnston County the “ Project ” and has indicated that agreement by the execution of an Inducement Agreement between the parties dated August 17 , 1999 , and ; WHEREAS , Under GS § 159C - 7 each project must be approved by the Secretary of the Department of Commerce and , under Article 51B of Chapter 143 of the North Carolina General Statutes , the Federal Tax Reform Allocation Committee must allocate a sufficient amount of North Carolina’s “ volume cap ” , as defined in Section 146 of the Internal Revenue Code of 1986 , as amended the “ Code ” to the financing ; and WHEREAS , The Rules and Procedures of the North Carolina Department of Commerce require that the governing body of a county approve in principle any project to be financed under the Act ; and WHEREAS , This Board of Commissioners has today held a public hearing with respect to the advisability of the Project and the issuance of bonds therefor , as evidenced by the Certificate and Summary of Public Hearing attached hereto as Exhibit A ; and WHEREAS , Section 147 f of the Code requires that the Board of Commissioners approve the plan of financing for the bonds ; and WHEREAS , the Authority intends to issue its Pollution Control Facilities Revenue Bonds Flanders Corporation Project , Series 1999 the “ Bonds ” in the principal amount of 4,000,000 which will be secured by a letter of credit issued by a United States bank ; and WHEREAS , under Section 159C - 4 of the Act the issuance of bonds under the Act must be approved by the governing body of the county in which the project to be financed under the Act is located ; NOW , THEREFORE , the Board of Commissioners of Johnston County , meeting in regular session at Smithfield , North Carolina , on September 7 , 1999 , do the following BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR JOHNSTON COUNTY 1 The proposed “ pollution control project ” consisting of the acquisition , construction and equipping of an industrial glass recycling facility by Flanders Corporation or an affiliate , subsidiary or related company thereof in Johnston County and the issuance of bonds in an amount not to exceed 4,000,000 therefor are hereby approved in principle 2 The Board of Commissioners hereby requests the Federal Tax Reform Allocation Committee to allocate up to 4,000,000 of North Carolina’s 1999 “ volume cap ” , as defined the Board adopted the following proclamation PROCLAMATION Hunting and Fishing Day - September 25 , 1999 WHEREAS Conserving our States natural and wildlife resources is one of the most important responsibilities we have to this and future generations of North Carolina ; and , WHEREAS Hunters and anglers were among the first to realize this responsibility almost 100 years ago ; and , WHEREAS North Carolina hunters and anglers took steps to organize the conservation movement ; supported laws to stop exploitation of wildlife ; aided in establishing game and fish laws ; and were instrumental for establishing hunting and fishing license fees , raising over 21 billion , now adding some 35 million per day nationally ; and , WHEREAS Financial support has provided the basis for scientific research , habitat restoration , and education which have led to the dramatic come back of wildlife in North Carolina such as wild turkey , river otters , tundra swans , and other waterfowl , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board called for a public hearing at 10 30 am , October 4 , 1999 , on a proposed amendment to the Time Warner Cable TV Franchise 9 Surplus Property - Communications Department Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board declared the following property surplus and authorized the County Manager to dispose of this equipment by private sale for a negotiated price , in accordance with GS 160A - 267 1988 Magnasync reel to reel recorder - serial number 113038 - 19 10 Surplus Property - Sheriff’s Department The Board discussed a request from Sheriff Steve Bizzell to trade in the Department’s two 9 - mm sub - machine guns for 45 - caliber sub - machine guns In response to a question concerning the need for these weapons , Sheriff Bizzell explained that unfortunately , these types of guns are on the streets , and occasionally , Thomas M Moore , Allen L Mims , Jr , and Wade M Stewart Nays None Not Voting None 18 Proposed Solid Waste Ordinance - Presentation Public Works Director , Haywood Phthisic , reviewed with the Board the new proposed solid waste ordinance He outlined the major differences in this document and the existing ordinance , which was adopted in November , 1985 The Board discussed various regulations and controls in the new ordinance It was pointed out that much of the document reflects state regulations that impact the County’s program Sheriff Steve Bizzell , who was present at the meeting , questioned the use of decals for the container sites throughout the County He noted there is a portion of the population that will not purchase the sticker , and since they can not go to the sites without the decal , they tend to dump their trash along the highways in ditches and wooded areas Mr Phthisic noted the decal program was initiated when private and municipal haulers felt they should not have to subsidize the rural sites Over the years , the system has proven satisfactory and routine for most citizens He noted the revenue generated by the decals pays only for the cost of disposal The County’s general fund supports the operation cost of the manned container sites Following further discussion , Commissioner Thomas M Moore moved the Board hold a public hearing at 10 45 am , October 4 , 1999 to hear public comments on the proposed solid waste ordinance Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 19 Public Hearing - Local Law Enforcement Block Grant Advertised August 27 , 1999 - The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the Sheriff’s Department use of relocation or installation of master meters which may be required when a District is annexed by a municipality ; to allow for the annexation of a portion of a District prior to the expiration of the initial five year sales period subject to certain conditions ; and to provide standing approval for District to exercise eminent domain in certain limited circumstances ; NOW , THEREFORE , BE IT RESOLVED BY the Johnston County Board of Commissioners , meeting in regular session at Smithfield , North Carolina , on September 7 , 1999 , do the following 1 Rewrite Section 6 , paragraph b as follows In the event that a portion of a District is annexed by a municipality , certain assets of the District may be acquired by the annexing municipality , provided the District has been in service ie , actively selling retail water to its customers for at least five 5 years The acquisition price for such assets shall be the greater of i the actual original cost of the facilities , less depreciation based on a fifty 50 year straight line schedule with a 25 residual ; or ii the original cost per tap less depreciation times the number of taps on the pipelines involved , not to exceed a maximum of 25 taps per mile of pipeline The municipality shall reimburse the District for relocation of existing master meters or installation of new master meters which may be required for the proper operation and management of the District’s system The District may , in its sole discretion , exclude from any asset sale to a municipality transmission lines , storage facilities and pumping stations The scope and area of facilities acquired may , based on mutual agreement between the District and the municipality , exceed the extent of the annexed area when necessary and beneficial for identification and assignment of maintenance and operation responsibility 2 Add a new paragraph c to Section 6 and renumber the remaining paragraph appropriately as follows a The five 5 year facilities asset sales period may be waived provided the municipality shall pay the District the present worth cost of the minimum monthly bill for each service for the five year period or appropriate portion thereof ; and , for new services installed within the affected area within the five year period , the municipality shall pay the District for the District’s prevailing water assessment fees The interest rate for the present worth cost calculation shall be the municipality’s bond rate or 6 , whichever is greater b In the event a municipality annexes a portion of a District within the initial five 5 years of retail service , or if the municipality elects not to purchase a District’s assets following annexation , the County will cooperate with the municipality by offering to manage service billings on behalf of the municipality for sewer service installed by the municipality at a nominal fee 3 Add Section 30 Standing Authority to Exercise Eminent Domain for Certain Water Line Easements In cases involving acquisition of water main easements where the easements are in floodways , wetlands , riparian buffers , and or other unbuildable areas , eminent domain may be exercised if reasonable negotiation for acquisition has proven unsuccessful 4 This resolution will become effective upon adoption 24 Public Hearing - Department of Transportation Grant Funds Advertised August 27 , 1999 - The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the use of DOT Rural Operation Assistance Program ROAP grant funds for the Elderly Disabled Transportation Assistance Program EDTAP , the Rural General Public Program RGP and the Work First - Transitional Employment Transportation Program Donna Creech , executive
