10 690 December 6 , 1999 The Johnston County Board of Commissioners met in regular session Monday , December 6 , 1999 , at 1000 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , Attorney , and John R Massey , Finance Officer 1 Minutes - November 1 , 8 , 10 , 1999 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the November 1 , 8 , 10 , 1999 board meetings There being no corrections , the Chairman declared the minutes approved as presented Public Comments 2 Request for Waiver from Mandatory Sewer Connection Surveyor , Jimmy Barbour , requested the Board waive the mandatory sewer connection on property owned by Trudy Benson and Estella Flowers , located on Hwy 210 west of Lassiter Road The owners wish to divide the property into an additional lot for a mobile home The proposed structure is located within 200 feet from a County sewer force main , which requires mandatory connection to the public sewer service Compared to a septic system , connection to the public force main would be much more expensive for the owners Engineer Tim Broome stated the owners could move the structure beyond the 200 boundary ; however , this would create problems in the placement of a septic system He recommended the Board approve the waiver Commissioner Thomas M Moore noted , in his opinion , this mandatory connection policy was mainly for large subdivisions , not individual cases of this nature He suggested the Board consider authorizing the engineer to make such decisions in the future Following discussion , Commissioner Cookie Pope moved the Board waive the mandatory connection to public sewer for Trudy Benson and Estella Flowers for their property at Hwy 210 Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 3 Approval of Appointment of Cecil M Massengill as Register of Deeds - Effective January 2000 At the recommendation of the Democratic Party , pursuant to NCGS § 161 - 5 , Commissioner Eleanor N Creech stated it was her pleasure to move that the Board approve the appointment of Cecil M Massengill , to replace retiring Register of Deeds , Phyllis Wall , effective January 1 , 2000 , at the current salary paid for that position Commissioner Jerry F Wood seconded the motion , which carried by unanimous vote Cecil M Massengill thanked the Board for their vote of approval and stated he has three goals as Register of Deeds of Johnston County a friendly service to the citizens , open communications and innovative technology 4 Reorganization of the Board The Chairman turned the meeting over to the Vice Chairman for the election of Chairman The Vice Chairman called for nominations for Chairman of the Board for a one year term Page691 Commissioner Jerry F Wood nominated J H Langdon , Jr as Chairman Commissioner Thomas M Moore seconded the motion There being no further nominations , the Board unanimously selected Commissioner James H Langdon , Jr as Chairman of the Board of Commissioners for the coming year Commissioner Wood thanked Commissioner Langdon for the outstanding job he has done as Chairman over the past year and stated he is looking forward to another year of his leadership Commissioner Eleanor N Creech concurred Chairman Langdon thanked the Board for the opportunity to serve as Chairman for another year He called for nominations for Vice Chairman Commissioner Allen L Mims , Jr nominated Commissioner Cookie Pope as Vice Chairman for a one year term Commissioner Jerry F Wood seconded the nomination Commissioner Eleanor N Creech moved the nominations be closed and Cookie Pope was unanimously selected as Vice Chairman for the coming year 5 Adoption of the Schedule of Regular Board Meetings for 2000 Upon a motion by Commissioner Jerry F Wood seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following schedule of regular meetings for 2000 JOHNSTON COUNTY BOARD OF COMMISSIONERS SCHEDULE OF REGULAR BOARD MEETINGS for 2000 Meeting Place - The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the proposed revenue bonds in the amount of not more than 3 million for the financing of an industrial project for Edwin Ray Hales Michael de Sherbinin , Economic Development Director , stated the project is a 40,000 sq footPage692 addition to an existing facility for structural steel products The Industrial Facilities and Pollution Control Financing Authority has supported this financing request There being no further comments , the Chairman closed the public hearing Commissioner Jerry F Wood introduced the following resolution , the title of which was read APPROVAL IN PRINCIPLE OF INDUSTRIAL PROJECT FOR EDWIN RAY HALES OR AN AFFILIATED COMPANY AND THE FINANCING THEREOF WITH INDUSTRIAL REVENUE BONDS IN THE PRINCIPAL AMOUNT OF UP TO 3,000,000 WHEREAS , the Johnston County Industrial Facilities and Pollution Control Financing Authority the " Authority " has agreed to assist in the financing under the North Carolina Industrial and Pollution Control Facilities Financing Act the " Act " of an industrial project by Edwin Ray Hales or an affiliated company the " Borrower " , for i the acquisition , construction and equipping of a 40,000 square foot facility for the manufacture of coated structural steel products and ii the retrofitting and equipping of an existing 13,000 square foot facility to be used for the manufacture of fabricated structural steel products the " Project " , all located or to be located on a 15 acre site at 8027 Highway 70 West , Clayton , North Carolina , in Johnston County and has indicated that agreement by the execution of an Inducement Agreement between the parties dated November 3 , 1999 , and ; WHEREAS , under GS § 159C - 7 each project must be approved by the Secretary of the Department of Commerce and , under Article 51B of Chapter 143 of the North Carolina General Statutes , the Federal Tax Reform Allocation Committee must allocate a sufficient amount of North Carolina's " volume cap " , as defined in Section 146 of the Internal Revenue Code of 1986 , as amended the " Code " to the financing ; and WHEREAS , the Rules and Procedures of the North Carolina Department of Commerce require that the governing body of a county approve in principle any project to be financed under the Act ; and WHEREAS , the Board of Commissioners has today held a public hearing with respect to the advisability of the Project and the issuance of bonds therefor , as evidenced by the Certificate and Summary of Public Hearing attached hereto as Exhibit A ; and WHEREAS , section 147 f of the Code requires that the Board of Commissioners approve the plan of financing for the bonds ; and WHEREAS , the Authority intends to issue its Industrial Development Revenue Bonds Ray Hales Project , Series 1999 the " Bonds " in the principal amount of 3,000,000 which will be secured by a letter of credit issued by a United States bank ; and WHEREAS , under Section 159C - Coordinator's Position Dale Bender , Coordinator for Johnston County's Special Olympics , requested the Board consider making her job a county paid position Ms Bender stated that in most counties , the Special Olympics coordinator is a county employee under the Parks & Recreation Department She stated the job has grown into a full time position and she would require a salary plus office space Commissioner Allen L Mims , Jr pointed out that Johnston County does not have a Parks & Recreation Department and asked if she had contacted the municipalities In response , Ms Bender stated she runs eight programs for over 600 school age athletes , as well as seniors throughout the County , and therefore , no single municipality would consider her for a position Chairman Langdon thanked Ms Bender for bringing this matter to the Board's attention and instructed the County Manager to evaluate ways the County might be able to lend their support and report back to the Board 14 Resolution - Prioritization Plan for Hazard Mitigation Program - Update on Hurricane Floyd Emergency Management Director , Dewayne West , updated the Board on the recovery process from Hurricane Floyd He noted that in much of the County , flood waters were two to five feet higher than with Hurricane Fran He presented a map showing all the roads that were impassable at one time or another during and immediately following the storm Mr West noted that 155 families overall have received assistance and all critical needs have been met ; however , there are still people who need help in recovering from their loss He spoke of thePagePage pageNumber7696 Federal buy - out program and showed on the map the 15 sites in the County that are eligible The County's application for the federal funds has been submitted to Raleigh for review and we are now waiting for FEMA to respond Hopefully funds will be provided for all 15 sites ; however with the extensive damage in the eastern portion of the state , this might not be the case , therefore , the sites have been prioritized He asked the Board to approve the resolution of prioritization Commissioner Wade M Stewart asked if anything can be done to assist citizens who are having trouble with their insurance companies He noted some insurance companies are saying that it will be June before a decision on claims will be made Mr West responded that in many cases , neither the agents nor policy holders really understand what is covered and what is not covered since much of the information is in fine print He stressed , however , that some companies have paid very well Following further discussion , Commissioner Cookie Pope moved the Board adopt the following resolution of prioritization , send a letter to the Insurance Commission concerning the problems the citizens are having in collecting on their claims , and look for better ways to help prepare the citizens of Johnston County for the future Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote RESOLUTION ADOPTING PRIORITIZATION PLAN FOR VOLUNTARY PROPERTY ACQUISITION ACTIVITIES HAZARD MITIGATION GRANT PROGRAM HMGP FOR JOHNSTON COUNTY , NORTH CAROLINA WHEREAS , Johnston County intends to procure HMGP funds in order to conduct a voluntary property acquisition program , in order to remove households from the threat of flooding which endangers health and safety and ; WHEREAS , the Robert T Stafford Disaster Relief and Emergency Assistance Act requires that each HMGP project funded be cost effective see 42 USC 517c and ; WHEREAS , it is the finding of the State and County that exposure to the risk of future flooding is directly related to cost - effectiveness THEREFORE , Johnston County has established the following methodology to prioritize homeowners who have expressed an interest in participating in the proposed voluntary HMGP acquisition program in the County METHODOLOGY Each structure will be evaluated based upon its exposure to the risk of future flooding Specifically , the county will establish base flood elevations BFEs for a 100 - year flood event for the structure Additionally , the County will establish the elevation of the first finished floor in each structure These inputs will produce the estimated depth of flooding in each structure at a 100 year flood event The depth of flooding at the 100 year flood event will establish the priority of each structure to be purchased The structure with the greatest depth of flooding at the 100 year flood event will be prioritized first , with other structures following in a descending order If this methodology results in a tie , tie - breaking criteria will be utilized Tie - breaker criteria was developed from available survey data These tie - breaking criteria are as follows Wood Frame Structure 15 points Masonry Structure 10 points Structure more than 20 years old 10 points Held Flood Insurance at time of September , 1999 Flood 5 points Special Needs eg Elderly or Handicapped 5 points Acquisition offers will be made in chronological order based upon priority rank Homeowners will have thirty 30 days to accept or reject an offer If the homeowner does not respond within thirty 30 days , funds will no longer be reserved for their acquisition and the offer will be invalid Offers will be made until available funds are exhausted th Adopted this the 6 day of December , 1999 Sites Become County Property Since properties bought in the federal buy - Approval of New Administrative Plan HAPP Director , Anne Eason , informed the Board that due to the frequent changes in HUD regulations , the Johnston County HAPP agency contracted with a consultant to develop a generic plan that will be updated as new HUD requirements become effective The plan was developed to also incorporate issues specific for each local agency She asked the Board to adopt the overall plan and approve the following three new policies that pertain to this local office 1 Policy to provide landlords any and all information available about a potential tenant's eviction history , past damage to rental units and drug trafficking record 2 Policy to allow units that are sold to someone else during the leasing period to be handled with an assignment of contract rather than a new contract in the middle of a term 3 Policy to allow the local Director , on an individual basis , to make a decision on the termination of a contract when a tenant's death occurs during the last few days of the month Following discussion Commissioner Thomas M Moore moved the Board accept the new plan including the three new policies specific to the local HAPP agency as presented Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 16 Audit Report for Year Ended June 30 1999 Davin Brown , Managing Partner with the firm of Brown , McLeod & Johnsen CPAs , PA , presented the audit report to the Board for fiscal year ended June 30 , 1999 He went over the highlights of the report and noted that Johnston County has a healthy fund balance , which is important to the County's overall financial picture The collection rates were good , even though there was a slight decrease in the collection of motor vehicle taxes The only findings in the report pertain to fixed assets for construction projects , which he suggested resulted from rapid growth of the County and the number of new capital projects He spoke highly of the Finance staff and the excellent job they do , but suggested the Board might need to consider additional help in that department Commissioner Cookie Pope stated she was pleased with the report , and complimented the Finance staff on their work In response to a question from Commissioner Allen L Mims , Jr concerning the collection of motor vehicle taxes , Finance Director John Massey noted part of the problem seems to be timing Some of the May and June bills may have gone out late from the Tax Department Attorney Mark Payne pointed out also that sometimes information from the Department of Motor Vehicles is not sent to the County on a timely basis Mr Brown agreed and noted this seems to be the same in other counties as well Following discussion , Commissioner Eleanor N Creech moved the Board accept the Audit Report for year ended June 30 , 1999 Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 17 Budget Amendments Approved Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the following budget amendments Department Social Services - Replacing Lights at American Legion Field As requested by the Board at the November 1 , 1999 meeting , County Manager , Rick Hester , reported he met with Smithfield Manager , Pete Connet concerning the issue of replacing the lights on the American Legion field The American Legion has received a recent estimate in the amount of 83,000 for the project using the wood poles He recommended the Board consider the possibility of the County , Town of Smithfield and the American Legion Post sharing the cost of the project equally Smithfield Manager , Pete Connet , was present and noted this request would also be on the agenda for consideration by the Town Council at their next meeting He noted the Town would want the American Legion to take bids or informal quotes before proceeding with the project since the 83,000 was only an estimate He and Mr Hester agreed their recommendations to their respective boards would be for approval of one -
