10 1 January 3 , 2000 The Johnston County Board of Commissioners met in regular session Monday , January 3 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , Attorney , and John R Massey , Finance Officer 1 Minutes - December 3 , 13 , 1999 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the December 3 , 13 , 1999 board meetings There being no corrections , the Chairman declared the minutes approved as presented Public Comments 2 Citizen Complaint Mobile Home Park owner , Richard Sauls of Selma , stated that after a mobile home in his park was abandoned by the owners , he contacted the lien holder and was in the process of purchasing the home when the County seized it for taxes He noted the County did not contact him or the lien holder before taking this action Furthermore , once it was removed by the County , he was told in order to get the home back , the taxes plus the levy expenses would have to be paid These expenses included insurance , moving and storage fees The taxes owed on the home were 45102 ; the amount to get it released was 1,42152 The mortgage company sent the money , but since the check came to him late on a Friday , the home stayed in storage for three additional days at a cost of 60 , which brought the total up to 1,48152 Once he returned the home to its original site , the cost of resetting and reconnecting everything brought his cost to over 3,900 He suggested a phone call to him by the Tax Office prior to seizing the mobile home would have prevented the entire situation from happening Mr Sauls went on to say he now has another abandoned mobile home in his park , which is older than the first and has very little value When he asked the Tax Department to take it , he was told that no taxes were owed After he got a permit to remove it himself , the Tax Department found that taxes were due in another person’s name Now he is not allowed to move it and the Tax Department has said they would not take it because it is not worth enough to cover the expense of seizure He asked the Board for their assistance in this matter He specifically asked the County to remove the second mobile home from his park , stating this situation is no different from the first one that was taken without him being notified In response to questions from Board members , Mr Hancock stated that in most cases the mobile home park owners work with the Tax Office and notify the County when there is an abandoned mobile home He pointed out sometimes , prior notification to property owners and lien holders has resulted in the homes being moved or sold before the Tax Department has an opportunity to take the property , in which case the County has no chance to recover the taxes Concerning the fact that Mr Sauls was given conflicting information about taxes owed on the second mobile home , he noted the moving permit which Mr Sauls originally presented and the VIN # for the home were in two different names Taxes were listed according to the name associated with the ownership VIN # The Chairman thanked Mr Sauls for his comments and suggested he and the Tax Department staff meet with Mr Sauls to try to resolve this matter 3 Benchmark Cable - Resolve to Improve Cable System Danny Frazier with Benchmark Cable Company informed the Board that once his company finalizes their purchase of the Johnston County Cable system , they plan to assess the many problems and make every effort as soon as it is feasible to bring the system up to standard and make it ready for the future Page2 4 Approval of Tax Exempt Loan Status - Princeton Fire Department Upon a motion by Commissioner Jerry F Wood , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board adopted the following resolution NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to Princeton Volunteer Fire Department , Inc the “ VFD ” , from First Citizens Bank , in the principal amount of 300,00000 , which loan is for the following purpose The purchase by the VFD of a fire truck which fire truck will be owned and operated by the VFD , and will be maintained at the following address 501 West Dr Donnie Jones Blvd , Princeton , NC 27569 5 Authorization to Refund Excise Stamps The Law Office of Joseph A Calder filed a deed in Johnston County in error They were supposed to file the deed in Wake County The firm is requesting a refund of the excise stamps paid in the amount of 5500 Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board authorized the refund of 5500 to Joseph A Calder law firm for excise taxes paid Johnston County in error 6 Budget Amendments Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the following budget amendments Department Health Department - Rural Development approval and to an agreement with River Dell Company concerning their participation Following discussion , Commissioner Allen L Mims , Jr moved the Board award contracts toPagePage pageNumber55 Thalle Construction Co of Mebane , NC in the amount of 3,635,129 for the construction of the Archer’s Lodge water distribution system , and to Caldwell Tanks , Inc of Louisville , Kentucky in the amount of 418,900 for the elevated tank ; approve the total project budget in the amount of 5,733,000 , all subject to approval of USDA Rural Development and subject to an agreement with River Dell Company concerning participation in the project in the amount of 404,000 Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Archer’s Lodge Water District Board adjourned and regular session was resumed 9 Engineering Agreement with Hazen & Sawyer - Reclaimed Effluent Land Application System At the recommendation of Engineer Tim Broome , Commissioner Thomas M Moore moved the Board approve an agreement with Hazen & Sawyer Environmental Engineers and Scientists , PC for engineering services for the reclaimed effluent land application system project Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 10 Water Plant Enhanced Coagulation Study Approved Engineer Tim Broome asked the Board to authorize an on - site testing and evaluation study to assure the County Water Plant complies , in the most cost - effective way , with new EPA requirements , which will become effective in the next two years He recommended the County contract with Hazen & Sawyer engineering firm in the amount of 50,000 to conduct the study , which would be done over a period of time to fully evaluate the operation during extreme seasonal conditions He noted , in his opinion , this firm would be the best qualified to do the study as they have had great success in similar studies He suggested the project could be funded with money already budgeted for painting an elevated tank , which can be postponed until next year Following discussion , Commissioner Jerry F Wood moved the Board approve an engineering agreement with Hazen & Sawyer of Raleigh to conduct an on - site testing and evaluation study at the County Water Plant to assure the plant complies , in the most cost - effective way , with new EPA requirements that will become effective in the new future Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 11 Approval of Engineering and Design for the Wastewater Facilities Improvements at the Bayer Corporation Complex Engineer Tim Broome noted that recently Bayer informed the County and the Town of Clayton , that they plan to continue maintaining their wastewater treatment facility at its current location , but will be increasing their wastewater discharge by approximately 250,000 gpd for a three to four year period of time during the next few years The County will need to complete , as soon as possible , certain improvements to the existing facilities in order to accommodate the projected short - term increase The County owns the pump station that currently can pump this wastewater to Clayton or to the WWTP in Smithfield ; however , this will need to be upgraded so that the wastewater can be diverted in both directions simultaneously This , along with other needed additions and improvements are estimated to cost approximately 275,000 Staff is recommending the Board approve an engineering services agreement with McKim and Creed Engineers to design the project They would be the logical choice to complete the work most efficiently since they completed engineering and design for the existing facilities and are knowledgeable about the existing operations Incentive grant reserve funds are available to cover the cost of this project Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved an agreement with McKim and Creed for engineering and design of wastewater facilities improvements at the Bayer Corporation Complex 12 Award of Bid - Landfill Gate Site ImprovementsPagePage pageNumber66 Tim Broome reminded the Board the County received bids on October 25 , 1999 for joint st projects the landfill gate site improvement and the WWTP access road At the November 1 meeting , the Board awarded a contract for the access road ; however , due to a much higher than anticipated bid on the gate site , they instructed staff to work with the design engineer to reduce the scope of that project and negotiate a new price with the low bidder The project has been redesigned to reduce the scope of the existing project , but would allow for expansion in the future A negotiated bid amount for the reduced scope contract with W E Garrison Construction Company of Raleigh would be 275,459 Staff is recommending the Board award the contract based on the new design and cost Following discussion , Commissioner Wade M Stewart moved the Board award a reduced scope contract , in the amount of 275,459 , to W E Garrison Construction Company of Raleigh , for the landfill gate site improvements project Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Commissioner Allen L Mims , Jr stated he would like to see the new design Other commissioners also indicated they would be interested in viewing the new drawings Mr Broome responded he would get the information to the Board 13 Additional Allocation Approved for the Broadmoor Weston Woods Development Project Mr Broome noted that in September 1998 , the County agreed to participate in the cost of a gravity sewer line and upsizing of a pump station and generator set for the Broadmoor and Weston Woods development in the Cleveland area , as this would result in the elimination of a wastewater pump station The anticipated cost to the County was 100,000 Due to unforeseeable conditions including rock excavation and deeper trenching , the County’s portion of the project cost was increased by 36,000 Staff is recommending the Board approve a budget amendment from “ outside areas ” sewer capital reserve fund to cover the additional cost Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the following budget amendment to allocate an additional 36,000 from the Outside Areas Sewer Capital Reserve Fund for the Broadmoor Weston Woods Development Project DEPARTMENT - Tax Department Policy for Seizing Property Commissioner Wade M Stewart voiced his feeling there should be a better way to handle seizing property than the way it is being done and stated he was glad the Chairman plans to meet with staff about this concern ? Tax Revaluation The Board agreed to discuss at their meeting next Monday night whether to have an in - house revaluation or contract for the service ? Board of Equalization and Review Commissioner Wade M Stewart suggested the Board consider appointing a separate E & R Board to hear citizen’s tax appraisal appeals It was suggested this might be discussed when the Board goes on retreat 17 Retiree’s Health Insurance Commissioner Thomas M Moore informed the Board that he has asked Payroll Officer , Jan Whitley , to research the records to find out the number of living retirees with 30 or more years of service , who retired prior to the County adopting a policy to include retirees in the County’s health insurance plan Elizabeth Lane and Rupert Barbour were found to be the only two former employees that met that criteria Commissioner Moore then moved the Board include them in the policy noting this would be for the supplemental policy since both are on Medicare Commissioner Jerry F Wood seconded the motion Page313 In discussion , other Board members suggested before they vote on this matter , they would like to know how many other living retirees there are , whose service records fall between 10 and 30 years Commissioner Thomas M Moore moved to table his motion , Commissioner Jerry F Wood agreed The Board voted unanimously to table this decision until next Monday night Commissioner Allen L Mims , Jr also spoke of the policy as it pertains to Commissioners , and staff agreed to look into this There being no further business , Commissioner Cookie Pope moved the Board adjourn Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote ______________________________________ James H Langdon , Jr , Chairman ____________________________ Joyce H Ennis , ClerkPage
