10 20 February 7 , 2000 The Johnston County Board of Commissioners met in regular session Monday , February 7 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , Attorney , and John R Massey , Finance Officer 1 Minutes - January 3 , 10 , 19 , 2000 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the January 2 , 10 , 19 , 2000 board meetings Commissioner Allen L Mims , Jr moved the minutes be approved as presented Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 2 Public Comments - No one spoke during the public comment time 3 Resolution of Appreciation - Phyllis N Wall , Former Registrar of Deeds Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution of appreciation for retired Registrar of Deeds , Phyllis N Wall Resolution of Appreciation WHEREAS Phyllis N Wall has been a vital part of the Johnston County Register of Deeds office for many years ; first for a period of time from 1964 until 1969 , then again beginning January 1974 until retiring December 1999 ; and WHEREAS she first served as a deputy registrar , then moved up to assistant registrar in 1981 , and finally became Registrar of Deeds in 1987 ; and WHEREAS the performance of her duties and responsibilities were always characterized by an obvious efficiency and dedication to the safe keeping of records for this County ; and WHEREAS Mrs Wall has gained the respect and admiration of all who have known her and worked with her over the years , and will be missed both professionally and as a friend NOW , THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS does hereby extend this Resolution of Appreciation to Phyllis N Wall , recognizing her years of exemplary service and contributions to the citizens of Johnston County , and offering to her and her family the very best wishes for the future th Adopted this the 7 Day of February , 2000 Presentation of Registrar Seal Chairman James H Langdon , Jr presented Mrs Wall with the official registrar seal that she used during her years as Johnston County Registrar of Deeds Mrs Wall stated it was a pleasure and honor to serve the citizens of Johnston County , and thanked the Board of Commissioners for their support of her and her staff over the years 4 Department of Transportation - Addition to System The Board reviewed a petition presented by the North Carolina Department of Transportation requesting the following road be added to the State Secondary System for maintenance Horse Creek Trail in Horse Creek Subdivision , O’Neals Township Following review , Commissioner Eleanor N Creech moved the Board concur with the NC Department of Transportations request to add the road listed above to the State Maintained System Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote Page21 5 Presentation of Appreciation - Capital Area Workforce Development Barry Davis , chairman of the Capital Area Workforce Development Board , introduced his vice chairman , Durwood Woodall and Brenda Savage , director of the Capital Area Workforce Development Consortium He also recognized Johnston County Job Training Director , Robert Davis and highly commended these three individuals for the excellent job they do Mr Davis greeted the Board and voiced his appreciation for Commissioner James H Langdon , Jr who also serves on the Workforce Development Board He explained the Capital Area Workforce has operated 16 years under the Job Training Act , which came to an end in North Carolina on December 31 , 1999 He noted that new challenges face them as they begin operating under the new Federal Workforce Investment Act , however , they are committed to continued promotion and support of employment needs in the area He thanked the Board of Commissioners and Administrative Staff for their support over the years and presented a token of appreciation Chairman Langdon thanked Mr Davis and the others in attendance and voiced his appreciation for what Job Training and Capital Area Workforce Development have done in Johnston County 6 State of the Youth Address - Johnston County Juvenile Crime Prevention Council Addie Rawls , chairman of the Juvenile Crime Prevention Council , addressed the Board concerning the youth in our County She recognized Commissioner Wade M Stewart , who also serves on this council Ms Rawls explained that under the new Juvenile Code , the council was formed to address the needs of the youth at risk in Johnston County She briefly outlined the federal funded services that the council oversees , and noted 23 youth have been served since July 1 , 1999 A conference is being held to train leaders , including school officials , to work with the youth at risk She stressed the goal of the council is to make changes that will make a difference in the lives of these children , and ultimately keep them from a lifetime of criminal activities The motto of the council is , “ Child by Child , We Build a Nation ” In response to a question from Commissioner Cookie Pope concerning the people that are involved , Ms Rawls stated the council strives to include church groups and parents in the programs and have invited them to participate in the upcoming conference The Chairman noted the council has , in Addie Rawls , a leader who brings excitement to her job and a person who genuinely cares about children He thanked Ms Rawls for her presentation and the fine work she and the council are doing 7 Reorganization Plan - Sheriff’s Department Sheriff Steve Bizzell presented his plan for reorganizing the Sheriff’s Department He recognized Chuck Fuller , his former chief of staff , who has continued to work with the Sheriff as a consultant on this project since he left County employment He asked Mr Fuller to review with the Board the proposed changes Mr Fuller explained he and the Sheriff worked on this plan for the last 13 months , evaluating the job classifications and performance of each employee He outlined the proposed changes noting six positions would be upgraded and five positions would be downgraded Titles for seven other positions would be changed In response to a comment from Commissioner Wade M Stewart concerning the expense to implement the plan , Mr Fuller stated the Sheriff’s good management throughout the year has provided enough savings to cover the costs Following discussion , Commissioner Allen L Mims , Jr moved the Board approve the reorganization plan presented by the Sheriff for his department Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Board members congratulated the Sheriff and Mr Fuller for a plan that is simple , direct and easyPage22 to understand 8 Surplus Property - Sheriff’s Department and Public Utilities Vehicles Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board declared the following vehicles surplus and authorized the County Finance Officer , John R Massey , to arrange for the sale of these vehicles , by public auction through Randy Wester of Wester Auction and Realty , Inc , on Upon a motion by Commissioner Jerry F Wood , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board adopted the following resolution RESOLUTION 1999 - 2000 BY JOHNSTON COUNTY WHEREAS , in North Carolina the Lead Regional Organizations , as voluntary organizations serving municipal and county governments , have established productive working relationships with the cities and counties across the state ; and WHEREAS , the General Assembly continued to recognize this need through the appropriation of 990,000 to help the Lead Regional Organizations assist local governments with grant applications , economic development , community development , and to support local industrial development activities and other activities as deemed appropriate by their local governments ; and WHEREAS , these funds are not intended to be used for payment of members ’ dues or assessments to Lead Regional Organization or to supplant funds appropriated by the member governments ; and WHEREAS , in the event that a request is not made by a unit of government for release of these funds to our Regional Council , the available funds will revert to the State’s General Funds ; and WHEREAS , in Region J funds in the amount of 55,000 will be used to carry out the economic development plan approved by the COG Board of Delegates and especially to improve the economy of the counties and towns of the Region by strengthening ties to , and consequently , the benefits of the Research Triangle Park NOW THEREFORE BE IT RESOLVED , that JOHNSTON COUNTY requests the release Health Department Dr Woodall noted the department currently sees about 2000 patients per month , most of which are medicare or medicaid patients Another doctor is needed since state and federal requirements stipulate that a licensed physician must oversee physician assistants attending these patients He stated medicaid and medicare reimbursements should cover the cost of the position Upon a Allen L Mims , Jr , Jerry F Wood , and Cookie Pope Voting for John Suggs Eleanor N Creech , James H Langdon , Jr , Wade M Stewart , and Thomas M Moore By the preceding vote , John Suggs was reappointed to the Board of Adjustments for a three year term to expire February 2003 Commissioner Allen L Mims , Jr requested Ms Underhill’s application be held over until the next opening on this board C Airport Authority - 1 position for a four year term Commissioner Thomas M Moore nominated Harold Keene to be reappointed by waiver of the length of term policy Commissioner Allen L Mims , Jr nominated Lynn Muchmore The Chairman called for a vote on the two nominees Voting for Harold Keene Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Jerry F Wood Voting for Lynn Muchmore Allen L Mims , Jr , Cookie Pope , and James H Langdon , Jr Based on the preceding vote , the Board waived the length of service policy and reappointed Harold Keen to the Airport Authority for a four year term to expire February 2004 Commissioner Allen L Mims , Jr requested Mr Muchmore’s application be held over until the next opening on this board D Motor Vehicle Value Review Board - 1 position for a two year term Commissioner Cookie Pope nominated Jesse Gutierres to serve on the Motor Vehicle Value Review Board There being no further nominations , the Board appointed Jesse Gutierres to the Motor Vehicle Value Review Board for a two year term to expire February 2002 E Juvenile Crime Prevention Council - 1 position for person under 21 years of age Upon a motion by Commissioner Jerry F Wood , seconded by Eleanor N Creech and carried by unanimous vote , the Board appointed Channon Genereux to the Juvenile Crime Prevention Council for a two year term to expire February 2002 F Town of Clayton Planning Board - ETJ Members Upon a motion by Commissioner Allen L Mims , Jr , seconded by Thomas M Moore and carried by unanimous vote , the Board reappointed David W Pittman , Robert W Barber , and Frank Price to the Clayton Planning Board as ETJ members , as requested by the Clayton Town Council 13 Interlocal Agreement with Whitley Heights Sanitary District for Water & Sewer Service Engineer Tim Broome informed the Board the Whitley Heights Sanitary District has requested the County provide them retail water and sewer service Currently the District has its own water distribution system and buys bulk water from the County They have recently obtained a grant for the construction of a wastewater collection system and want the County to treat their wastewater , as well as operate and maintain both systems Mr Broome recommended the County provide this service for Whitley Heights on the same basis as other customers served by the County He noted the District’s bond debt for their water system is being retired by District tax revenue , and the system would become County - owned when the debt is retired The sewer facilities would become the County’s property one year after completion of the system Following discussion , Commissioner Thomas M Moore moved the Board approve the followingPagePage pageNumber827 interlocal agreement with Whitley Heights Sanitary District for water and sewer service Commissioner Cookie Pope seconded the motion , which carried by unanimous vote NORTH CAROLINA BULK WASTEWATER SERVICE AGREEMENT JOHNSTON COUNTY WHITLEY HEIGHTS SANITARY DISTRICT THIS AGREEMENT , dated , 2000 , between JOHNSTON COUNTY , hereinafter referred to as County , and WHITLEY HEIGHTS SANITARY DISTRICT , hereinafter referred to as “ WHSD W I T N E S S E T H WHEREAS , WHSD desires to have the County provide operation , maintenance , and administrative services for its existing water distribution system and its proposed wastewater collection system ; and WHEREAS , WHSD currently purchases its bulk water supply from the County ; and WHEREAS , WHSD desires to have its wastewater received , transmitted , and treated by the County ; and WHEREAS , County has the resources to provide operation , maintenance , and administrative services for the WHSD water distribution system and proposed wastewater collection system , and to receive , transmit , and treat the wastewater from WHSD NOW , THEREFORE , for and in consideration of the premises and rights , powers and duties hereinafter set forth to be performed by each , the sufficiency of which are acknowledged by the parties , County and WHSD mutually do agree as follows I WHSD Agrees as Follows 1 WHSD will install at its own cost a wastewater collection system meeting the County’s design and construction standards and shall allow the County’s representatives to make inspections of construction periodically 2 WHSD will be responsible for payment of the remaining debt on its water distribution system 3 WHSD will pay to the County , on or before the date the County commences water and sewer operation , maintenance , and administrative services , and meter setting fees and a sewer assessment fee as follows Water 75 per existing service Sewer 2,000 per existing service 4 For any sewer customers who have individual well supplies , WHSD will install or will have installed a meter on the well head meeting County standards and will have the customer provide the County an access easement for purposes of making meter readings 5 WHSD agrees that for any new service , assessment and connection fees will be consistent with the County’s rates in effect at the time II County Agrees as Follows 1 The County will install its service meters in each existing water service in the WHSD system and will deliver the existing meters to the WHSD 2 The County will operate , maintain , and repair the existing WHSD distribution system including all services up to and through the outlet side of meter boxes 3 The County will cease to read the WHSD master meter for billing purposes and will cease billing WHSD for bulk water supply 4 The County will operate , maintain , and repair the proposed wastewater collection system including sewer services within public rights of way and easements including up to two wastewater pump stations 5 The County will read water meters monthly and will bill the WHSD customers for retail water and sewer service The water rates shall be the same as for the Wilson’s Mills Water District and the sewer rates shall be the County’s standard retail sewer rate for areas outside the Central Johnston County Regional Wastewater System As of the date of this Agreement , the user rates are Water Sewer 1300 minimum per month 500 minimum per month plus 270 per 1,000 gallons plus 337 per 1,000 gallons of usage of usage 6 The County will administer water and sewer services in accordance with its Uniform Policy III ADDITIONAL COVENANTS AND AGREEMENTS 1 Ownership of Infrastructure It is understood that the water distribution collection infrastructure within the WHSD boundaries shall remain the property of WHSD until the bond debt on the water system is retired Thereafter , the water system shall be transferred to the County for ownership All sewer infrastructure shall be conveyed to the County for permanent ownership one year from the date of substantial completion of construction and startup of the system 2 Terms Terms of this Agreement shall be thirty 30 years , with four 4 automatic renewals for five 5 years each , unless a six 6 month written notification of intent to terminate is provided by either party to the other 3 Service Area The area to be served shall consist of the area within the legal boundaries of WHSD , plus any gravity sewer lines which extend outside WHSD to pump station s site s 4 Inspections WHSD shall permit periodic inspections of the sewer system during construction byPagePage pageNumber928 County to ensure compliance with State Plumbing Code and County utility standards and specifications 5 Notices Any notices required to be given by this Agreement shall be deemed to have
