10 61 March 6 , 2000 The Johnston County Board of Commissioners met in regular session Monday , March 6 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , March 1 , 2000 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the February 7 , 9 , 14 , 15 , and March 1 , 2000 board meetings Commissioner Allen L Mims , Jr moved the Board approve the minutes as presented Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 2 Public Comments - There were no public comments 3 Public Hearing - Housing Assistance Payment Program HAPP Annual and Five Year Plans Advertised The Smithfield Herald - January 18 , 2000 The Chairman opened the public hearing and invited public comment on the proposed Johnston County HAPP annual and five - year plans Anne Eason , Director of HAPP , presented her agency’s annual and five year plans to the Board for their approval Concerning the five - year plan , Ms Eason outlined the following goals Application for additional vouchers when available ; promotion of de - concentration of poverty ; encouragement to builders to build more three bedroom rental units ; publishing of a newsletter ; encouragement to landlords to check references carefully ; encouragement of tenants to take more pride in their homes ; referrals to weatherization programs for more efficient units ; securing more and better housing for tenants with special needs and promoting self - sufficiency among tenants The annual plan would put steps into place to begin implementing the five - year plan Ms Eason noted her agency would apply for home buyers assistance funds when available , promote lease - to - own contracts , encourage appropriate tenants to apply for Habitat for Humanity and Low Income loans to purchase homes , refer appropriate tenants to Job Link Center , ESC and other work programs , promote HAPP in low poverty areas , speak with Realtors and builders about larger units , secure cooperative agreements with other agencies to provide services to HAPP tenants ; begin a biannual newsletter , and provide a list of agencies and resources for tenants , as well as driving directions and transportation information There being no further comments , the Chairman closed the public hearing Board Approves HAPP Plans Following discussion , Commissioner Jerry F Wood moved the Board accept the HAPP five year and annual plans as outlined by Director , Anne Eason Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 4 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Pisgah Drive and Uwharri Court in Oak Forest Subdivision , Cleveland Township ; Trey Drive , Elton Lane , and Rhea Court in Carrie Woods Subdivision , Elevation Township ; Happy Trails Drive in Happy Trails Subdivision in Pleasant Grove Township Following review , Commissioner Cookie Pope moved the Board concur with the NC DepartmentPage62 of Transportations request to add the roads listed above to the State Maintained System Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 5 Tax - Exempt Loan Status - West Johnston Fire Department Upon a motion Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to West Johnston Volunteer Fire Department , Inc the “ VFD ” , from First Citizens Bank , in the principal amount of 175,00000 , which loan is for the following purpose Construction of a new fire station at 5503 Old Fairground Road , Benson , NC 27504 6 Call for Public Hearing - Bayer Incentive Grant Michael de Sherbinin , Economic Development Director , asked the Board to set a public hearing date to hear public comment on the expenditure of funds from the Bayer Incentive Grant program to accommodate Bayer’s expansion project Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board called for a public hearing at the for the following new vehicles for FY 00 - 01 , which would be delivered after July 1 and would be paid from his FY 00 - 01 budget He explained these would replace vehicles that need to be removed from the fleet 15 Crown Victorias ; one Ford F - 150 truck , and two Ford Expedition 4x4 s for a total cost of 364,014 Upon a motion by Commissioner Jerry F Wood , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board authorized the Sheriff to place his advance order for fleet replacement vehicles , with the understanding payment of 364,014 will be from his FY 00 - 01 budget 9 New Position Approved for Health Department Dr LS Woodall , Health Director , requested a Teen Care Coordinator position for a new state project that is being piloted in Johnston County The Department of Health and Human Services would provide 25,000 for the remainder of this year , and 50,000 for next year to fund this position The employee would work with teens who test negative for pregnancy at the Health Department , in an effort to counsel concerning the problems with teen pregnancies He noted that statistics show that 64 of the young women who test negatively for pregnancy become pregnant shortly thereafter Following discussion , Commissioner Jerry F Wood moved the Board approve a teen care coordinator position for the Health Department , as long as the State funds the position Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 10 Resolution Adopted Establishing Endowment Fund for Johnston County Heritage Center Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following resolution authorizing the establishment of a designated endowment fund for the Heritage Center in order to receive funds through the NC Community Foundation RESOLUTION BE IT RESOLVED that Johnston County Heritage Center , an agency of Johnston County and a charitable organization , does hereby request and authorize establishment of a Designated Endowment Fund in its name , on its behalf and for its benefit by the North Carolina Community Foundation , Inc NCCF , pursuant to the Agreement signed by Donor and NCCF The Designated Endowment is to be owned and managed by the NCCF as provided by said Agreement and held by the NCCF as a component fund thereof ; and BE IT RESOLVED that Johnston County Heritage Center hereby authorizes NCCF and its officers and agents to accept contributions to the said Designated Endowment Fund on its behalf , and further authorizes its own officers and directors to execute and deliver to NCCF any instruments or documents necessary or useful to effect the authorization , establishment , use and continued maintenance of such Designated Endowment Fund PagePage pageNumber565 ADOPTED on March 6 , 2000 , by such organization’s governing body at a meeting duly called and held , at which a quorum was present and acting throughout 11 Nursing Home Domiciliary Home Advisory Board - Update Steve Strickland , Chairman of the Johnston County Nursing Home Domiciliary Home Advisory Board , talked to the Commissioners about the function of this committee He noted that lately the committee has experienced a high turnover in membership , created by new appointees once they find out the amount to time and commitment that is required Each new member must go through a training program at Triangle J Council of Governments with the Regional Ombudsman , and then must visit the different types of homes in the County , first with the Ombudsman , then with committee members to learn what they will need to be looking for in their monthly visits Once trained , each committee member will spend an average of eight to 10 hours each month visiting homes and writing reports to be sent to the chairman He noted this can be depressing and very frustrating , since as an advisory committee , there is no real authority to make sure corrections are made He stressed the committee members have a difficult job since , unfortunately , serious problems do exists in some facilities Currently there are five vacancies on the 25 member board which need to be filled with dedicated volunteers Mr Strickland suggested the Commissioners have potential applicants contact him prior to making application so he can give them some idea of what being on the committee entails He introduced Christy Russ , Regional Ombudsman Ms Russ concurred with the comments made by Mr Strickland and noted the volunteers on the committee play a very important roll in the lives of those who live in the homes She noted as advocates for the residents , they are able to report the inadequacies , neglect and abuse , which hopefully can be corrected She pointed out the local Department of Social Services and the State Division of Facility Services can address these matters once they are reported Commissioner Cookie Pope noted she has heard complaints that people who are appointed are not contacted by the committee and offered training in a timely manner Ms Russ responded that when she is notified of the appointment , the new members are contacted and given three dates for training Sometimes there may be scheduling conflicts She noted of the 20 persons left on this committee , only 12 or 13 are active , which makes it difficult for the others , since there are 22 homes in the County that have to be visited Board members expressed their understanding of the importance of this committee and asked the Clerk to make sure that notice is recorded that applicants are to contact the committee chairman for information about the committee prior to being appointed The Clerk also was asked to make sure the chairman of the committee is aware of new appointees so that training can begin as soon as possible Chairman Langdon thanked Mr Strickland for his informative presentation 12 Appointments A Board of Adjustment - Kenneth York and Bill Guthrie to the Local Emergency Planning Committee for two year terms to expire March 2002 PagePage pageNumber767 13 Engineering Consultant Approved - 201 Facilities Plan Amendment Study Engineer Tim Broome informed the Board that in order to receive State low interest Clean Water Revolving loans , the County must complete a 201 Facilities Plan Amendment study The study needs to be completed as soon as possible ; therefore he has requested proposals from three firms that have excellent credentials in this type of work He presented the following results for the Board’s consideration Hazen & Sawyer , Raleigh - estimated fee of 34,000 with a 2 month delivery schedule CH2M Hill , Raleigh & Charlotte - estimated fee of 49,700 with a 4 month delivery schedule McKim & Creed Engineers , Cary - estimated fee of 50,000 with a 2 ½ month delivery schedule Based on the favorable delivery schedule and estimated fee , Mr Broome recommended award of contract with Hazen & Sawyer Engineers and Scientists of Raleigh for an estimated fee of 34,000 , which would be paid from the capital reserve funds of the Central Johnston County Regional Wastewater Facilities and the outlying sewer service areas Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Jerry F Wood and carried by unanimous vote , the Board approved a contract with Hazen & Sawyer for a 201 Facilities Plan Amendment study at an estimated cost of 34,000 , with the understanding the fee would be paid from the central wastewater and outlying sewer service area capital reserve funds 14 Bulk Water Supply Agreement with Town of Benson Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the following agreement with the Town of Benson for bulk water supply Bulk Water Purchase Agreement Between Johnston County and the Town of Benson This Contract is made and entered into this day of , 2000 by and between the Town of Benson hereinafter referred to as “ Town ” or “ first party ” and Johnston County hereinafter referred to as “ County ” or “ second party ” RECITALS WHEREAS , the Town has secured by contract an additional bulk water supply allocation from the City of Dunn ; and WHEREAS , the County desires to increase its water supply capacity ; and WHEREAS , the Town desires to sell some of its additional capacity to the County and the County desires to purchase the same from the Town ; NOW , THEREFORE , in consideration of the mutual covenants herein contained , IT IS AGREED TERMS Town Reserves The Town agrees to reserve a 05 mgd million gallons per day water supply allocation in its water supply allocation from the City of Dunn for the exclusive use of the County County Purchase Terms The County shall receive and purchase water up to 05 mgd on a monthly average basis as its system demands require Peak withdrawals shall not exceed 0625 mgd , total of all points of supply Town Minimum Daily Purchase Amount For each week that the County receives water from the Town , the Town’s required minimum daily purchase of 020 mgd shall be waived Town Charges The Town shall charge the County a bulk rate which shall be based on the bulk rate charged by the City of Dunn plus the actual cost of booster pumping and booster disinfection chloramination st The initial bulk rate shall be 130 per 1,000 gallons The rate may be adjusted July 1 of each year with 90 days written advance notice ; however , the adjustment shall not exceed the increase in the actual unit price of water charged by the City of Dunn plus any increase in the Town’s direct power and chemical cost Billing Procedure Each party will read meters during its regular cycle , issue bills , and collect payments in accordance with its existing policy Minimum Monthly Fee The minimum monthly water availability fee now charged by the County to the Town shall be waived The Town shall not charge the County a minimum monthly availability fee for any point of water delivery Disinfection System Improvements The County agrees to provide certain equipment to effect booster chloramination at the Dunn Booster Pump Station That equipment includes two fiberglass chemical feed buildings and ammonium feed equipment The Town agrees to provide chlorine feed equipment and install , startup , and operate the chlorine and ammonia equipment PagePage pageNumber868 Water Delivery The County shall receive delivery of the water from the Town at the South Johnston , Raleigh Road , and NC 50 master meters The Town shall use its existing pumping equipment and distribution system to transfer the water from the Dunn transmission main to the County’s system The meters shall be calibrated biannually at the County’s cost The Town may install and maintain monitoring and other metering equipment at the delivery points at its own cost No Town Transmission Charge In deference to the County’s past investment in water facilities construction in the Town’s water service area , the Town shall not include in its bulk rate calculations any amount or allowance for water transmission through the Town’s distribution system from the Dunn Booster Station to points of delivery Town Water Quality The Town shall strive to provide water meeting all federal and state regulations with a chemical composition compatible with the County’s water The Town shall maintain a total chlorine concentration of 20 to 40 mg l at all points of delivery Emergency Notification Each party shall notify the other in case of an emergency or a condition which would affect the quality or quantity of water in the other party’s system Term of Agreement This agreement shall be valid for five 5 years and may be automatically renewed in one year increments thereafter The agreement may be amended by mutual written consent Merger and Modification This instrument constitutes the entire agreement between the parties and supersedes any and all prior agreements , arrangements and understandings , whether oral or written , between the parties All negotiations , correspondence and memorandums passed between the parties hereto are merged herein and this agreement cancels and supersedes all prior agreements between the parties with reference thereto No modification of this instrument shall be binding unless in writing , attached hereto , and signed by the party against whom or which it is sought to be enforced Waiver No waiver of any right or remedy shall be effective unless in writing and consideration He pointed out that with the County’s limited wastewater treatment facilities , the wastewater agreement with Clayton , and the continuing problems with growth , a policy is badly needed This proposal would limit sewer service outside of municipal transition zones to commercial and industrial uses , with the exception of mixed use development and in cases of failing systems The Board discussed the policy and noted several issues that needed further clarification They noted the term “ planned unit developments of exceptional value and benefit to the County ” should be defined by giving specific criteria Mr Broome asked the Board for direction on the matter of “ grand fathering ” existing developments that have been approved , but not built out Following discussion , staff agreed to make the suggested revisions and bring this back to the Board next Monday night 16 Request for Retail Water and Wastewater - Hermitage PUDPagePage pageNumber969 William R Henderson spoke to the Board concerning his request for retail water and wastewater for the Hermitage Planned Unit Development he has designed for a 900 acre tract on Pritchard Road north of Archer’s Lodge community Water would be provided by connecting to the Archer’s Lodge Water District The State has recommended that sewer service be provided by an on - site treatment plant using the effluent to irrigate the golf course and greenway areas planned for the development He requested the Board consider an agreement whereby the developers would build the system to State and County standards , including the treatment plant , then turn this over to the County to own , operate and maintain Commissioner Allen L Mims , Jr asked if the developers have worked out details concerning the amount of open land area for land application , and the size and number of holding ponds needed , especially during wet weather Mr Henderson responded this has all been taken into consideration in the design with approximately 140 acres designated for application , and holding ponds sufficient for 60 to 150 days of holding The developers are also now looking at the possibility of taking lines for irrigation to each of the estimated 1600 homes planned Chairman Langdon stated the Board would make a decision on the proposed residential sewer policy as soon as possible , which will give guidelines for any agreement that could be worked out on this matter 17 Request for Wastewater Transmission and Treatment Agreement - River Dell Company The Board discussed a request from River Dell Company for bulk wastewater service to her Flowers Plantation Planned Unit Development Tim Broome went over the cost analyses showing the present worth net revenue , based on three agreement scenarios with varying terms Service provided under current policies 15,279,000 Terms consistent with Carolina Water Services Agreement 14,572,000 Agreement terms requested by River Dell Company 16,554,000 Mr Broome noted the terms requested by River Dell Company , which includes the dedication of two school sites to the County consisting of approximately 40 acres of land , would be most beneficial to the County However , this scenario would require up - front capital in the amount of approximately 125 million He suggested this agreement would be satisfactory to the Utilities Department provided the developer agreed to front the County’s capital cost , which would be reimbursed , at no interest , over the first few years of development Mr Broome pointed out that River Dell Company has a discharge permit for 500,000 gpd into the Buffalo Creek , however , they anticipate a need for a capacity of 11 mgd by the end of their 10 year build out of their development If an agreement can be reached , the discharge permit would be transferred to the County In discussion , Board members agreed the County should not put up - front money into the project They suggested Mr Broome continue to negotiate with River Dell and bring more information back to the Board It was also suggested the County needs to hear from school officials concerning their response to the school sites that have been offered 18 Public Hearing Scheduled for Proposed Meadow Water District Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board called for a public hearing at their regular meeting on April 3 , 2000 on the establishment of a Meadow Water District The hearing is scheduled for 11 30 am or as soon thereafter as possible 19 Minimum Monthly
