10 86 April 3 , 2000 The Johnston County Board of Commissioners met in regular session Monday , April 3 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , Attorney , and John R Massey , Finance Officer 1 Minutes - March 6 , 13 , 2000 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the March 6 , 13 , 2000 board meetings Commissioner Allen L Mims , Jr moved the Board approve the minutes as presented Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 2 Public Comments Request for Assistance for Industry Frank Lee , developer and property owner , asked the Board to provide some financial assistance to help defray the initial expenses for Caterpillar Logistics Services , a new industry that is locating , at least temporarily , in Mr Lee’s facility on Bright Leaf Boulevard in Smithfield He maintained that as the company grows , they will be looking for a permanent site , and this effort would show the County’s desire to keep them in Johnston County The Chairman thanked Mr Lee for his comments and suggested he provide the Board with additional information 3 Resolution - Navy Seabee Recognition Week - April 2 - 8 , 2000 Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board adopted the following resolution recognizing Navy Seabee Recognition Week RESOLUTION NAVY SEABEE RECOGNITION WEEK - APRIL 2 - 8 , 2000 WHEREAS , North Carolina is proud of it’s men and women who have served in our Nation’s armed forces , particularly those who selflessly and bravely answered the call of duty in World War II , the Korean Conflict , Vietnam , the Gulf War , and Bosnia against an enemy opposed to our cherished principles of freedom and democracy ; and WHEREAS , none served more courageously and patriotically than the men and women of the United States Navy Seabees , whose skill , devotion and heroism were crucial to the success of the Allied Forces in helping to restore peace around the Globe ; and WHEREAS , between wars and conflicts the Seabees took on a new mission Seabee Civic Action Teams provided much needed assistance in the wake of a devastating Earthquake in Greece in 1953 to provide construction work and training to underdeveloped countries The Seabees became “ The Navy’s Goodwill Ambassadors ” Seabees built or improved many roads , orphanages , and public utilities in many remote parts of the World ; and WHEREAS , the Seabees have always been ready and willing to fight , often fending off enemy forces alongside their Marine and Army Counterparts ; and WHEREAS , over the past 57 years the Seabees have repeatedly demonstrated their skills as fighters and builders From the Islands of the Pacific to the cold and hardships of Korea , to the jungles of Vietnam , to the sands of Saudi Arabia and to the mountains of Bosnia , they have built and fought for freedom ; and WHEREAS , in peacetime the Seabees have been Goodwill Ambassadors ; and WHEREAS , in peace and war the Seabees have lived up to their Motto “ Can Do ” ; and WHEREAS , the 2000 Annual Mid - Year meeting and Seabee Reunion of the Navy Seabee Veterans of America will be held in Smithfield , North Carolina , Johnston County’s County Seat , attended by Patriots from all across our great Nation ; it is fitting for all North Carolinians to join in paying tribute to those citizens who served America in war and peace as members of the United States Navy Seabees NOW THEREFORE , the JOHNSTON COUNTY BOARD OF COMMISSIONERS do hereby proclaim the week of April 2 - 8 , 2000 , Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Lou Circle in Glenview Acres Subdivision , Wilson’s Mills Township ; Primrose Lane and Charlotte Court in Primrose Place Subdivision , Cleveland Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to add the roads listed above to the State Maintained System Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 5 Audit Contract Approved Finance Officer , John R Massey , reported he requested three - year audit proposals from five accounting firms The only company that responded was Brown McLeod and Johnsen , CPA’s , the County’s current auditors Their proposal was to perform the County’s audit for the next three years at the following costs Year ending 6 30 00 - 74,000 ; Year ending 6 30 01 - 77,500 ; Year ending 6 30 02 - 81,000 At the recommendation of Mr Massey , According to USDA Rural Development , additional loan money is available and would be allowed based on the amount of the bond referendum He recommended the Board award the contract subject to USDA Rural Development approval and award of supplemental loan in the amount of 540,000 Following discussion , Commissioner Thomas M Moore moved the Board award contract to low single prime bidder , Sanford Contractors , Inc , in the amount of 4,096,63725 and approve the project budget of 5,052,500 , subject to USDA Rural Development approval of the bidding process , and the County qualifying for the additional loan in the amount of 540,000 from USDA - RD Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 8 Public Hearing 10 15 am - Bayer Incentive Grant Advertised The Smithfield Herald on March 21 , 2000 The Chairman opened the public hearing and invited anyone who wished to make comment on the use of funds under the Bayer Incentive Grant agreement Economic Development Director , Michael de Sherbinin , explained that during the next four years , Bayer plans a major expansion project in excess of 300,000,000 , creating approximately 250 additional jobs Due to the expansion , they will require a larger allocation of wastewater capacity Bayer has asked that incentive grant funds be used to pay a portion of the costs associated with obtaining the additional capacity According to the incentive agreement , expenditure of these funds requires a public hearing if the use would only benefit Bayer Attorney Allen Tew , resident of Clayton , questioned whether the County should honor this request He stated , in his opinion , Bayer has not been a good corporate citizen in the Clayton area He indicated the company has basically kept isolated from the community by choice , and noted that requests for civic and community support seldom get any further than the receptionist Terry Sasser of Four Oaks Bank & Trust in Clayton agreed with Mr Tew’s comments He noted that even though Bayer uses the Chamber of Commerce’s facility when needed , they have not donated to the Chamber’s building project He , too , stated is it difficult to reach anyone with authority at Bayer He suggested that Clayton has promoted Bayer , but the corporation has not supported the town Lyn Austin , Clayton resident , compared Bayer unfavorably to other corporate citizens in the Clayton area She commented that when Congressman Bob Etheridge asked to meet with area corporations , and when other public officials have held meetings , Bayer has not participated Chairman Langdon responded that he has seen a much different picture of Bayer over the years Based on his experience , the Corporation has been very supportive of school programs , especially in the areas of science and bio - technology He stated the plant manager was always available to him and providedPagePage pageNumber792 outstanding support when he was in charge of the County School’s vocational programs In response to a question by Commissioner Thomas M Moore , Mr Sasser agreed that Bayer does generously support United Way Commissioner Wade M Stewart suggested the Chairman , Mr de Sherbinin and the County Manager , Rick Hester , meet with the head of Bayer and make him aware of the sentiment expressed by Clayton leaders There being no further comments , the Chairman closed the public hearing 9 Public Hearing 10 30 am - Ambulance Franchise Advertised The Smithfield Herald on 3 17 00 ; 3 24 00 The Chairman opened the public hearing and invited anyone who wished to address the Board on an ambulance franchise application from Johnston Ambulance Service , based on the recent sale of a portion of their business to another party Jeff White , assistant chief of operations for Johnston Ambulance Service , offered to answer questions anyone might have He noted that since this request was submitted , they have made a tentative agreement to sell another 40 of their company to stockholders They will be returning to the Board on this matter at a later date There being no further comments , the Chairman closed the public hearing First Vote Upon a motion by Commissioner Jerry F Wood , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board approved an ambulance franchise for Johnston Ambulance Service A second vote at a later meeting will be required before the franchise is granted 10 Request for Award of Bid - Hopewell Pisgah Water District Loop Main and Gordon Road Transmission Main Tim Broome reviewed with the Board the following bids received March 16 , 2000 for the Hopewell - Pisgah Water District 12 Loop Main and Gordon Road 16 Water Transmission Main projects McMahan Brothers Pipeline , Inc , Cayce , SC 1,744,19180 WEBCON , Smithfield , NC 1,898,01150 Sanford Contractors , Sanford , NC 1,949,44381 T A Loving , Goldsboro , NC 2,025,73500 Onsite , Inc , Smithfield , NC 2,110,39870 J F Wilkerson is broken down for the two projects as follows HPWD project - 1,318,75780 project budget of 1,523,000 , and the Gordon Road project - 425,434 project budget of 807,000 These projects will be funded by High Unit Cost State Clean Water Bond grants in the amount of 1,523,000 for HPWD and 807,000 for the Gordon Road project , which includes 274,000 for additional line extensions Staff is recommending the surplus funds for the Gordon Road project be applied to a related project consisting of a 12 loop main to connect the existing dead - end lines at Novo Nordisk and at the entrance to Glen Laurel Subdivision Mr Broome also noted that McMahan is building several other projects in the County , including the Southeast Lowgrounds project At present , there is an outstanding change order that the company has not accepted , which is needed in order to complete that project He asked the Board to make this award ofPagePage pageNumber893 bid contingent upon McMahan accepting the change order and proceeding with the Southeast Lowground project immediately Board members asked the County Attorney , Mark Payne , if they could add this condition to their award of bid Mr Payne stated the County is not obligated to accept the low bid if there is justification , and it would seem reasonable to say that if the company is unable to finish another project , this could be considered justification Following further discussion , Commissioner Thomas M Moore moved the Board award contract to McMahan Brothers of Cayce , South Carolina in the amount of 1,744,19180 , [ 1,318,75780 for the Hopewell Pisgah Water District project , and 425,434 for the Gordon Road project ] , approve the project budgets of 1,523,000 for the HPWD project and 807,000 for the Gordon Road project , with the understanding the 274,000 surplus funds will be used to connect dead - end lines at Nova Nordisk and the entrance to Glen Laurel Subdivision Commissioner Moore further moved the Board stipulate that the award of bid is subject to McMahan accepting the outstanding change order on the Southeast Lowgrounds project and completing that work immediately Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Note The Hopewell Pisgah Water District Board concurred with the bid on April 10 , 2000 11 Public Hearing Scheduled on Revised Stormwater Ordinance Engineer Tim Broome informed the Board the County is required to revise our stormwater ordinance to be similar to the state adopted model ordinance This will be significantly different and will replace the County’s current document A stakeholders meeting is being scheduled for later in April Mr Broome and Stormwater Manager , Marty Anderson , summarized the changes and noted the new ordinance will place additional responsibilities on the County Staff is recommending the Board hold a public hearing on the first Monday in May Following discussion , Commissioner Allen L Mims , Jr moved the Board schedule a public hearing on the revised Stormwater Ordinance for the May 1 , 2000 meeting Commissioner Cookie Pope seconded the motion , which carried by unanimous vote The hearing is scheduled for 11 00 am 12 Reclaimed Effluent Irrigation Project Users Agreements Mr Broome informed the Board that staff is developing a policy for the Reclaimed Effluent Irrigation Project He noted farmers have been reluctant to sign long contracts because of the state of the farming economy , however , there is a considerable amount of interest from nursery owners and turf growers to participate in a later phase At present , the County is exploring the possibility of additional grant money to build more pipeline He presented the following sample agreement for users who participate by signing a multi - year contract in the first phase of the project This would be done to encourage initial participation ; after the first phase , users would receive no compensation and would be charged a modest fee RECLAIMED WATER USERS AGREEMENT FOR INITIAL PROGRAM PARTICIPANTS This agreement , between Johnston County , hereinafter called “ County ” and hereinafter called “ User ” , Phone Number , Address 1 Physical , Zip Address 1 Mailing , Zip Tax Parcel No s W I T N E S S E T H WHEREAS , the User desires to receive and use reclaimed water from the County and enter into a users agreement as required by the County , and WHEREAS , the User acknowledges he she is the land owner and agrees to comply with the provisions of the terms and conditions adopted by the County pertaining to said reclaimed water system NOW THEREFORE , in consideration of the mutual covenants , promises , and agreements herein contained , it is hereby understood and agreed A The County agrees 1 The County will produce transmission pipelines for conveyance of reclaimed effluent to the User’s property line 3 The County shall install a cut off valve and a water meter in each main service lateral at the User’s property line 4 For agreements with a term of ten years or longer , upon request of the User , the County will install laterals with service “ hydrants ” on the User’s property in the vicinity of the approximate points of application , not to exceed one service hydrant per 10 acres of irrigated or wetted area This provision shall not apply to golf course or residential development 5 The County will provide reclaimed water to the point s of delivery at a pressure of approximately 150 psi , and an average flow rate of approximately gpm Delivery rate to be negotiated based on User’s needs Typical rates shall be 350 gpm , 700 gpm or 1,050 gpm 6 The County will provide reclaimed water under the foregoing conditions and will compensate the User for the term of the initial contract , excluding contract extensions , as follows Annual Usage Compensation - per 1,000 gal Inches 5 yr contract 10 yr contract 20 yr contract Up to and including 4 000 000 010 Over 4 up to and including 42 ” 005 010 020 Over 42 ” 005 010 010 For irrigation users under a 20 years contract , for years when rainfall exceeds the annual average and the expected minimum volume of reclaimed water cannot be applied , compensation will be based on the minimum expected amount Credits will be made against compensation due for actual usage over the following two years Payments will be made monthly 7 After the initial contract period , the User will be charged for the reclaimed effluent in the amount of the actual energy cost to deliver the effluent for use The energy cost is expected , but not guaranteed , to be below 015 per 1,000 gallons The charge shall be subject to adjustment annually in direct proportion to actual energy cost charges to the County 8 The County shall set the schedule and duration of reclaimed water usage on a weekly basis and advise the User accordingly Users with the earliest dated agreement and the larger irrigated acreage will receive priority of scheduling and supply B The User agrees as follows 1 The User will provide the County annually a crop planting plan for crops to be irrigated , approximate acreage of each crop , and estimated volume of reclaimed water required each month This information shall be submitted to the County by March 1 of each year 2 The User agrees to receive and use at least 60,000 gallons of reclaimed water per irrigated acre per year User may raise his her priority for usage by increasing volumes used up to a maximum of 250,000 gallons per acre per year Minimum usage requirements will be waived in years where normal annual rainfall exceeds 54 inches 3 If the User requests the County to install laterals and hydrants on his property , the User shall grant the County and its successors or assigns , a temporary easement in , over , and under the User’s land for the installation , startup , and the first year’s maintenance of the laterals and service hydrants The User shall be responsible for operation of the lateral s and service hydrants on the User’s property Following a one year construction warranty period , the User shall be responsible for all maintenance , repair , replacement , etc of the laterals and service hydrants on the User’s property , at the User’s expense 4 The User shall be responsible for providing the equipment , piping , etc from the service hydrant or the service lateral connection to the areas of irrigation as necessary to meet the User’s specific irrigation needs 5 In event the User continues to receive service beyond the initial year contract period , the User shall pay for reclaimed water in the actual volume used at the applicable unit cost monthly , within 20 days from receipt of the bill from the County Billings shall be based on metered usage , or in event of a meter failure , estimates of monthly usage Non - payment of charges shall be cause for the County to terminate service Specify 5 , 10 or 20 years 6 User shall comply with the requirements of State regulations NCAC T15A 02H 0200 , attached as Exhibit A concerning application of reclaimed water Users shall not apply reclaimed effluent to food crops and shall not over apply or otherwise allow reclaimed water to reach surface waters of the state In event User violates any provisions of these State regulations , the User will be responsible for any fines assessed by the State against the County More than two violations of State regulations shall be cause for termination of service 7 In the event of breach of contract or termination of service for cause within the contract period , the User agrees to reimburse the County for the actual cost of the service laterals and hydrants , if any , constructed on User’s property , less depreciation based on a 20 year straight line basis 8 User agrees to hold the County harmless in event of interruption of service or reduction in reclaimed water capacity or delivery pressure , resulting from mechanical failure or circumstances beyond the direct control of the County 9 User agrees to establish a minimum 30 ft vegetative buffer on all streams on the irrigated property which are defined as “ perennial streams ” by the Division of Water Quality , NC Department of Environment and Natural Resources Excluded from this requirement are perennial streams which have pre - existing stabilized natural cover such as grass , sod , or ornamental vegetation C General Requirements 1 The effective date of this agreement shall be June 1 , 2001 or the date reclaimed water is available for use User shall be notified of the effective date by certified mail 2 Term The term of this agreement shall be years and shall be automatically renewed in one 1 year increments A one year written notice is required for termination Termination prior to the first five years of the contract period shall result in assessment of liquidated damages in the amount of 3,00000 Such damages may be assessed against the property Specify 5 , 10 , or 20 years through the Johnston County Heritage Center , to own certain portions of the collection and to have full use of the remaining portions of the collection for exhibit , research and other educational
