10 118 May 1 , 2000 The Johnston County Board of Commissioners met in regular session Monday , May 1 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer 1 Minutes - April 3 , 10 , 25 , 2000 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the April 3 , 10 , 25 , 2000 board meetings Commissioner Cookie Pope moved the Board approve the minutes as presented Commissioner Allen Mims seconded the motion , which carried by unanimous vote Public Comments 2 Chairman’s Remarks Chairman James H Langdon , Jr thanked everyone for their many expressions of concern during his recent time in the hospital 3 Proclamation - Community Connections George Thomas with Johnston Community College , informed the Board that JCC is one of four community colleges in the State participating in the Community Connections Program sponsored by the Bureau of Educational and Cultural Affairs of the US Department of State The program offers entrepreneurs , local government officials , legal and organization officials from the Independent States of the former Soviet Union the opportunity to spend three to five weeks in the United States learning about our culture , government and the functioning of a free market system This year Johnston County will be hosting ten young professionals from Moldova from May 22 to June 22 Mr Thomas asked the Board to proclaim June 2000 as Community Connections Month Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following proclamation COMMUNITY CONNECTIONS MONTH , 2000 Johnston Community College has been selected to participate in Community Connections , a program of the Bureau of Education and Cultural Affairs of the U S Department of State Community Connections offers home stay - based practical internship opportunities in the U S for entrepreneurs , local government officials , legal professionals and non - governmental organization leaders from Russia , Ukraine , Belarus , Georgia , Moldova , Kazakhstan , and Armenia Internship opportunities are matched with participants based on interest and experience Companies offering these internships run the gamut from small family - run enterprises to major multi - nation “ Fortune 500 corporations Johnston Community College Community Connections program will host ten business and professional entrepreneurs from Moldova from May 22 , 2000 through June 22 , 2000 The goals of the Johnston Community College Community Connections program are to provide professional training and exposure to day - to - day functioning of a fee market system ; encourage public private partnerships by including private sector and government participants ; and , create grassroots linkages between U S and Moldova communities Community Connections Month is about highlighting the importance of recognizing that our economy is global in nature and that Community growth and stability of Eastern Europe NOW , THEREFORE , WE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS , by virtue of the authority vested in us by the Constitution and laws of the State of North Carolina and the ordinances of the County of Johnston , do hereby proclaim June 2000 as Community Connections Month We encourage all JohnstoniansPage119 to observe this month by welcoming program participants from Moldova to Johnston County IN WITNESS WHEREOF , We hereto set our hands this first day of May , in the year of our Lord two thousand 4 Public Hearing - Revised Animal Control Ordinance Advertised The Smithfield Herald 4 18 and 4 25 00 The Chairman opened the public hearing and invited anyone who wished to comment on the proposed revised Animal Control Ordinance Commissioner Jerry F Wood stated several people he talked to asked that the hearing be postponed until an evening meeting so those who work during the day can attend The Chairman and several other Commissioners stated they would have no problem postponing the hearing until a night meeting Commissioner Allen L Mims , Jr stated he would like to see the ordinance enacted at this time He pointed out the revised document is similar to the existing ordinance except for some added provisions that will make it easier for animal control officers to do their job He asked Attorney Mark Payne to outline the major changes Mr Payne stated the overall language in the ordinance has been updated One of the most significant changes is the addition of Section 7 , “ Stray Animals Off - Premises and Not Under Direct Control , ” which states it is unlawful for any person maintaining an animal in the County to permit or negligently allow that animal to be off the owner’s premises and outside the direct control of that person Also added was Section 13 , “ Confinement and Control of Inherently Dangerous Mammals , ” which makes it unlawful for owners to keep such animals except under certain circumstances Penalties have been increased , and higher fees have been added for repeat offenses The section on cruelty to animals has also been strengthened to insure , among other things , that adequate shelter and care is provided Commissioner Wade M Stewart asked if the revised ordinance was really necessary , and whether the enforcement of it would require additional staff Sheriff Steve Bizzell and Captain Danny Allen both stated that , in their opinion , one additional employee is needed in that department now , regardless of whether the new ordinance is adopted They noted that even though the new law would help by cutting down on the number of trips per complaint , it most likely will create more complaints to be answered In response to a question from Commissioner Cookie Pope , Sheriff Bizzell stated that Animal Control was previously under the Health Department , and that he plans to ask the Board to reassign the employees to that department in the new fiscal year Commissioner Stewart asked if this would create a problem since the employees would no longer be sworn officers The Sheriff agreed there would need to be at least one sworn officer There being no further comments , the Chairman closed the hearing Vote on Revised Animal Control Ordinance Following further discussion , Commissioner Allen L Mims , Jr moved the Board adopt the new revised animal control ordinance Commissioner Thomas M Moore seconded the motion The vote was six to one in favor of adoption , but failed to carry since it must be unanimous in order to pass at the meeting when an ordinance is first introduced A second vote will be taken at the next regular meeting 5 Archer’s Lodge Water District - Authorization for Anticipation Notes Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board recessed to sit as the Archer’s Lodge Water District Board The following resolution was discussed and its title was read RESOLUTION AUTHORIZING THE ISSUANCE AND SALE OF GENERAL OBLIGATIONPage120 WATER BOND ANTICIPATION NOTES OF THE ARCHER’S LODGE WATER DISTRICT OF JOHNSTON COUNTY , NORTH CAROLINA IN THE AGGREGATE PRINCIPAL AMOUNT OF 3,774,000 FOR THE PURPOSE OF FINANCING A WATER SYSTEM IN THE DISTRICT WHEREAS , the Bond Order hereinafter described was authorized and adopted by the Board of Commissioners of Johnston County the “ Board ” , acting as the governing body of the Archer’s Lodge Water District the “ District ” on June 8 , 1998 , and approved by a majority of the qualified voters of the District voting thereon at a referendum held on August 4 , 1998 ; and WHEREAS , the Board desires to provide for the issuance of 3,774,000 Water Bond Anticipation Notes the “ Notes ” pursuant to said Bond Order ; NOW , THEREFORE , the Board of Commissioners of Johnston County , acting as the governing body of the Archer’s Lodge Water District of Johnston County , meeting in regular session in Smithfield , North Carolina , on May 1 , 2000 , does the following BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF JOHNSTON COUNTY , ACTING AS THE GOVERNING BODY OF THE ARCHER’S LODGE WATER DISTRICT 1 The District shall issue its General Obligation Water Bond Anticipation Notes in an aggregate principal amount of 3,774,000 pursuant to and in accordance with the Bond Order entitled BOND ORDER AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OF THE ARCHER’S LODGE WATER DISTRICT IN THE MAXIMUM AGGREGATE PRINCIPAL AMOUNT OF 4,000,000 FOR THE PURPOSE OF FINANCING , IN PART , THE ACQUISITION , CONSTRUCTION AND EQUIPPING OF A WATER SYSTEM IN THE DISTRICT 2 The Notes shall be dated May 30 , 2000 or such later date as may be directed or approved by the LGC and the Board , shall be in denominations as specified by the purchaser thereof , shall be numbered appropriately and shall be substantially in the form of note attached hereto as Exhibit A The Notes shall mature and bear interest payable on February 21 , 2001 , or such later date as may be approved by the LGC and the Board , so long as the maturity for the Notes does not exceed one 1 year The Notes shall bear interest at such rate as shall be determined by the Chairman and the North Carolina Local Government Commission the “ LGC ” , as hereinafter defined , at the time of sale , provided such interest rate does not exceed seven percent 70 Principal and interest shall be payable to the holders upon surrender of the Notes as they become due at the principal corporate trust office of such institution as may be designated as paying agent for the Notes by the purchaser Principal and interest shall be payable in lawful money of the United States of America 3 The Notes will not be subject to redemption prior to maturity 4 The Notes shall be signed by the manual signature of the Chairman , shall be countersigned by the manual signature of the Clerk and the District’s own seal shall be affixed thereon The Notes shall not be valid until they have been endorsed by the signature of the authorized representative of the LGC 5 The full faith and credit and taxing power of the District are hereby irrevocably pledged for the payment of principal of and interest on the Notes Unless other funds are lawfully available and appropriated for timely payment of the Notes , the Board shall levy and collect taxes and raise other revenues for payment of the principal of and interest on the Notes , as the same become due and payable 6 The LGC is hereby requested to sell said 3,774,000 Notes 7 The Board covenants on behalf of the District that so long as any of the installments of principal and interest on the Notes are outstanding and unpaid , the District shall not take or omit to take any action the taking or omission of which will cause the Notes to be “ arbitrage bonds ” within the meaning of Section 148 of the Internal Revenue Code of 1986 , as amended the “ Code ” , or otherwise cause interest on the Notes to be includable in the gross income of the holders thereof 8 The Board hereby covenants that it will not permit the gross proceeds of the Notes to be used in any manner that would result in either a 5 or more of such proceeds being considered as having been used directly or indirectly in any trade or business carried on by any person other than a governmental unit as provided in Section 141 b of the Code , b 5 of such proceeds being used with respect to any “ output facility ” other than a facility for the furnishing of water , within the meaning of Section 141 b 4 of the Code , or c 5 or more of such proceeds being considered as having been used directly or indirectly to make or finance loans to any person other than a governmental unit as provided in Section 141 c of the Code ; provided , however , that if the Board receives an opinion of bond counsel acceptable to the registered owners of the Notes and that any such restriction is not required to prevent the interest on the Notes from being includable in the gross income of the registered owners thereof under existing statutes , the Board need not comply with such restriction 9 The Notes are hereby designated as “ qualified tax - exempt obligations ” for purposes of Section 265 b 3 of the Code a The Board will in no event designate more than 10,000,000 of obligations as qualified tax - exempt obligations in 2000 , including the Notes , for the purpose of such Section 265 b 3 ; b The District and all its “ subordinate entities ” within the meaning of Section 265 b 3 of the Code have not issued more than 10,000,000 of tax - exempt obligations in 2000 not including “ private activity bonds , ” as defined in Section 141 of the Code , other than “ qualified 501 c 3 bonds , ” as defined in Section 145 of the Code , including the Notes ; c Barring circumstances unforeseen as of the date of delivery of the Notes , the Board will not approve the issuance of tax - exempt obligations of the District or such subordinate entities if the issuance of such tax - exempt obligations would , when aggregated with all other tax - exempt obligations theretofore issuedPage121 in 2000 by the District and such subordinate entities , result in the District and such subordinate entities having issued a combined total of more than 10,000,000 of tax - exempt obligations in 2000 not including private activity bonds other than qualified 501 c 3 bonds , including the Notes ; and d The Board has no reason to believe that the District and such subordinate entities will issue tax - exempt obligations in 2000 in an aggregate amount that will exceed such 10,000,000 limit ; provided , however , that if the Board receives an opinion of bond counsel acceptable to the registered owners of the Notes that compliance with any restriction set forth in b or c above is not required for the Notes to be qualified tax - exempt obligations , the Board need not comply with such restriction 10 The Board hereby represents and covenants as follows a The District and all its “ subordinate entities ” within the meaning of Section 148 f 4 D ii of the Code have not issued more than 5,000,000 of tax - exempt obligations in 2000 not including private activity bonds , including the Notes ; b Barring circumstances unforeseen as of the date of delivery of the Notes , the Board will not approve the issuance of tax - exempt obligations of the District or such subordinate entities if the issuance of such tax - exempt obligations would , when aggregated with all other tax - exempt obligations theretofore issued in 2000 by the District and such subordinate entities , result in the District and such subordinate entities having issued a combined total of more than 5,000,000 of tax - exempt obligations in 2000 not including private activity bonds , including the Notes ; c The Board has no reason to believe that the District and such subordinate entities will issue tax - exempt obligations in 2000 in an aggregate amount that will exceed such 5,000,000 limit ; d At least 95 of the proceeds of the Notes shall be used for “ local government activities ” of the District within the meaning of Section 148 f 4 iii of the Code ; provided , however , that if the Board receives an opinion of bond counsel acceptable to the registered owners of the Notes that compliance with any restriction set forth in b or d above will not prevent the District from having to rebate to the United States any part of the earnings derived from the investment of the gross proceeds of the Notes , the Board need not comply with such restriction 11 The Chairman and the Clerk are hereby authorized and directed to take all proper steps to have the Notes prepared and , when they shall have been duly sold by the LGC , to execute the Notes and to deliver the Notes to the State Treasurer of North Carolina for delivery to the purchaser or purchasers to whom they may be sold by the LGC 12 All other actions of officers of the District in conformity with the purposes and intent of this resolution and in furtherance of the issuance and sale of the Notes are hereby approved and confirmed 13 Such officers of the District as may be requested are hereby authorized and directed to execute appropriate closing papers including a certificate setting forth the expected use and investment of the proceeds of the Notes in order to show that such expected use and investment will not violate the provisions of Section 148 of the Code and regulations issued pursuant thereto , applicable to “ arbitrage bonds ” Such papers and certificates shall be in such form as may be requested by bond counsel for the District 14 This resolution , in particular Section 2 hereof , constitutes a system of registration for the Notes pursuant to NCGS § 159E - 4 15 All resolutions or parts of resolutions in conflict herewith are hereby repealed 16 This resolution shall take effect immediately Commissioner Jerry F Wood moved the passage of the foregoing resolution and Commissioner Thomas M Moore seconded the motion , and the resolution was passed by the following Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the following requests for fireworks displays and authorized the Chairman to grant approval and report back to the Board on similar requests that are made between Board meetings The approvals were made subject to compliance with NCGS § 14 - 410 , 14 - 415 and Chapter 20 of the Standard Fire Prevention Code , along with necessary permits from the applicable Inspections Department South Johnston High School for graduation exercise on Friday , June 2 , 2000 th th Archer’s Lodge Community Center for July 4 celebration on July 4 with rain date of July 8 ,PagePage pageNumber5122 2000 7 Johnston Ambulance Service - Request for Temporary Service Last month a public hearing was held on a new franchise for Johnston Ambulance Service JAS based on the sell of a portion of the business The Board took a first vote and was scheduled to give final approval at this meeting Since that hearing , however , JAS has sold the remaining portion of the company and will have to begin again the process for obtaining a new franchise The EMS Advisory Board is requesting approval for JAS to continue operating under the terms of the previous franchise until this process can be carried out Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board gave approval for Johnston Ambulance Service to continue operating under the terms of the previous franchise until they can obtain a Johnston Community College Approved County Manager , Rick Hester , explained the Community College is incurring some preliminary expenses on their construction projects The 3 million general obligation bonds , which were approved in a referendum last year , are not scheduled to be sold until February 2001 Staff is recommending the County advance needed funds to the Community College with the understanding the money will be reimbursed in full at the time of the bond sale In response to a question concerning the amount that would need to be advanced , Finance Officer , John Massey , stated he anticipates only a portion of the funds will be spent prior to the sale of the bonds He noted if the amount becomes too large , the County will proceed with action to sell anticipation bonds Following discussion , Commissioner Wade M Stewart moved the Board authorize the advancement of funds to Johnston Community College for construction projects , with the understanding the County will be reimbursed in full when the general obligation bonds are sold in 2001 Commissioner Jerry F Wood seconded the motion , which carried by unanimous vote 10 Appointments A Fire Protection District Commissions Elevation Fire Protection District Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board reappointed Jerry T Allen , James Estel Johnson and Jimmy R Stanley to the Elevation Fire District Commission for two year terms to expire May 2002 McLemore Fire Commission Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board reappointed John T Hill and appointed Mark McLeod and Elmer Wallace to the McLemore Fire DistrictCommission for two year terms to expire May 2002 Nahunta Fire Commission Upon a motion by Commissioner Jerry F Wood , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board appointed Donald B Edwards to fill an unexpired term on the Nahunta Fire District Commission , which will expire June 2001 Strickland’s Crossroads Fire Commission Upon a motion by Commissioner Jerry F Wood , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board waived the length of service policy and reappointed Mark Thornton and Raymond Massengill to the Strickland’s Crossroad’s Fire of Trustees Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board reappointed Birchel Byrd , James R Smith , Norman Hunter Aiken and Charlie Watson , and appointed E Raeford Parrish to the Pleasant Grove Community Building Board of Trustees for two year terms to expire May 2002 11 Approval of Price for Purchase - Site for K - 5 School in Western Johnston County The Board considered a request from the Board of Education to purchase a 25 acre site , at a cost of 13,000 per acre , for a K - 5 school on Josephine Road , Cleveland Township in western Johnston County Commissioner Jerry F Wood stated he was originally opposed to this purchase of property because of the nearby existing site of the old Cleveland Elementary School His opinion changed , however , when he realized that building on the old site would eliminate the athletic fields used by so many in the community Following his comments , Commissioner Wood moved the Board approve the cost per acre for the new K - 5 school site on Josephine Road near the Cleveland Road intersection Commissioner Allen L Mims , Jr seconded the motion Discussion Commissioner Thomas M Moore stated that after much consideration he would reluctantly support this motion because he could not favor any action that would take away the athletic fields from the people in the community He noted he hoped the County can find some way to recoup some of the cost involved in purchasing the new site Commissioner Cookie Pope stated she has talked with concerned citizens , and after meeting with the Athletic Association and seeing what they contribute to the community , she would support the motion Commissioner Eleanor N Creech noted that she had reservations Chairman opened the public hearing Marty Anderson , Stormwater Coordinator explained the State Environmental Management Commission has mandated that every county must by August 2000 submit to them for review and approval a proposal for a stormwater ordinance consistent with the State model The new proposed document would replace the current Stormwater Ordinance adopted in March 1998 Mr Anderson reviewed with the Board the major differences in this document and the existing ordinance He noted that a stakeholders meeting was held with twenty - one people in attendance Steven Sanderson with Southwind Surveying and Engineering , stated he was at the meeting and had three concerns ? Minimum land disturbance - The current ordinance has 1 acre minimum - the state wants that reduced to ½ acre He asked the Board to oppose this and seek to keep the 1 acre requirement ?
