10 219 July 3 , 2000 The Johnston County Board of Commissioners met in regular session Monday , July 3 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer 1 Minutes - May 30 , June 5 , 12 , 19 , 2000 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the May 30 , June 5 , 12 19 , 2000 board meetings Commissioner Eleanor N Creech moved the Board approve the minutes as presented Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Public Comments 2 Public Utilities Staff Recognized Chairman James H Langdon , Jr recognized Engineer Tim Broome , Utilities Director , Haywood Phthisic , Water Plant Manager , James Davis , and Water Wastewater Supervisor , Randy Merson , for all their hard work when the Smithfield Water Plant went down Smithfield Manager , Pete Connet , added his thanks to the County for providing assistance during their water crisis 3 Comments on Reported Open Space Proposal Linwood Parker of Four Oaks addressed the Board on an issue which was reported in the news recently The report dealt with the possibility of a proposal that would ask for a non - binding referendum on the November ballot to obtain voter consensus on the use of 03 of the ad valorem tax revenue to acquire land to preserve open space and provide for future parks Mr Parker opposed this proposal and stated , in his opinion , the County has a measure for providing open space through its development ordinance He stressed any use of County tax dollars for this purpose would create severe financial problems for Johnston County , based on the financial model He noted the Board has two main obligations that must take precedence providing education for the children and a safe environment for all its citizens Don Stephenson , biology instructor at Johnston Community College , voiced his support of a proposal to use tax dollars to purchase land to set aside for open space and future parks He noted , in his opinion , the County can do this without compromising the education system or the safety of the citizens He stressed that open space is tied to our water quality , wildlife and the entire ecology He suggested a master plan be developed to show how the County would implement an open space program Also , he recommended the County develop a land trust system with other agencies and apply for state and federal grant funds that are available , and consider hiring a full time employee to head up the program Kate Dixon , executive director of the Triangle Land Conservancy , added her organization’s support for the proposal She stated they would help in any way possible Commissioner Thomas M Moore stated when he first considered bringing this proposal to the Board , he was under the impression the Commissioners had the authority to place a referendum on the ballot He has since found out this would require local legislation by the General Assembly He stated he does support the idea , but will wait to bring this back to the Board until he can get more information 4 Public Hearing - Use of Rural Funds - DOT Advertised 6 16 00 in The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board onPage220 the use of Rural Operation Assistance Program ROAP grant funds from the North Carolina Department of Transportation Steve Strickland , chairman of the Johnston County Area Transportation System JCATS Board , recognized Ray Woodall , the new JCATS Director Mr Strickland briefly went over the grant application package The County would be eligible for a total of 99,677 , which would be allocated to three local programs as follows Elderly Disabled Transportation Assistance Program EDTAP 64,944 Work First - Transitional Employment Transportation Program 13,183 Rural General Public Program RGP 21,550 In response to a question from Commissioner Cookie Pope concerning contracted venders , Mr Strickland noted Johnston County would use the private vans only when necessary in order to prevent disruption in service There being no further comments , the Chairman closed the hearing Board Approves Application for DOT ROAP Grant Funds Upon a motion by Commissioner Jerry F Wood , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board authorized the application for DOT Rural Operation Assistance Program grant funds from the North Carolina Department of Transportation to assist three local transportation programs 5 Department of Transportation - Additions Abandonment to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the old alignment of Old Roberts Road SR1519 be abandoned from maintenance and the following roads be added to the State Secondary System for maintenance Re - Aligned Old Roberts Road in Pleasant Grove Township Desert Pines Drive , Monterey Court and La Vista Court in Desert Pines Subdivision in Pleasant Grove Township Loblolly Court , Aycock Court , Southwick Avenue , Chickasaw Circle , Oakwood Circle , Cottonwood Circle , and Dupree Court in Southwick Farms , Wilders Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to abandon maintenance on the old alignment of Old Roberts Road and add the roads listed above to the State Maintained System Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 6 Report - Fireworks Displays Approved The Chairman reported that during the month he approved the following display of fireworks subject to NCGS § 14 - 410 - 14 - 415 and Chapter 20 of the Standard Fire Prevention Code , with the understanding the applicants obtain the necessary inspection permits PJ’s Community Grocery and Grill on NC 50 North , Willow Springs on Saturday , July 1 , 2000 Boy Scouts of America Tuscarora Council on Scout Road in Four Oaks on July 3 , 2000 7 HAPP - Waiting List to Reopen and Administrative Plan Changes Approved Anne Eason , HAPP Director , requested authorization to reopen their waiting list and amend the Administrative Plan for her agency She noted the waiting list was closed last year due to the large number ; however , it is now down to a manageable list , which needs to be reopened In order to comply with HUD’s requirements , she asked the Board to approve changes to the Administrative Plan to add the following de - concentration and expanded housing opportunities , incorporation of HUD’s regulations merging the Certificate and Voucher programs into the Housing Choice Voucher Program , and final admissions and occupancy rule Page221 Following discussion , Commissioner Jerry F Wood moved the Board authorize Johnston County HAPP to reopen its waiting list as of August 1 , 2000 and made the requested changes to their Administrative Plan Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 8 Resolution Authorizing Application for Crisis Housing Assistance Funds CHAF Attorney Mark Payne stated the Emergency Management office has now discovered there are some strings attached to this grant money that might not make application as appropriate as was once thought For that reason he suggested the Board amend the recommended resolution by removing the th words , “ and directed ” and add the words “ if appropriate ” from the 5 paragraph , which will give staff some flexibility in choosing whether to pursue this or not Following discussion , Commissioner Eleanor N Creech moved the Board adopt the following resolution as amended Commissioner Cookie Pope seconded the motion , which carried by unanimous vote RESOLUTION OF THE COUNTY OF JOHNSTON AUTHORIZING THE FILING OF APPLICATIONS FOR CRISIS HOUSING ASSISTANCE FUNDS WHEREAS , the NC Division of Community Assistance has made Crisis Housing Assistance Funds CHAF available to counties and cities across the state for the support of flood recovery mitigation activities as the result of Hurricane Floyd in September 1999 ; and WHEREAS , the County of Johnston is authorized to accept Federal and State grants and to appropriate and expend funds for community improvement programs and activities , including hazard mitigation and flood recovery projects for flood damaged areas ; and WHEREAS , the County of Johnston desires to undertake certain hazard mitigation and flood recovery activities and to prepare applications for CHAF Funds ; NOW , THEREFORE , BE IT RESOLVED , by the Board of Commissioners of the County of Johnston , THAT , the Chairman of the Board of Commissioners and the County Manager be authorized and directed to submit an amendment to the application to the N C Division of Community Assistance for CHAF Funds under the Replacement and Repair Categories in the amount of 1,575,000 if appropriate ; THAT , if CHAF Funds are received , the County will carry out various hazard mitigation and flood recovery activities , including the acquisition of flood damaged properties , clearance of acquired properties and relocation of families outside the floodplain ; and THAT , the Chairman and County Manager be authorized and directed to act in connection with the application , to provide such additional information as may be required , and to execute any and all documents related to said application including the grant agreement upon successful funding of the project application ; and FINALLY THAT , the County of Johnston will comply with all applicable federal and state laws , regulations , rules and Executive Orders rd ADOPTED , This _3 day of July , 2000 , Johnston County , North Carolina 9 Recreation Grant Applications Tabled The Board considered fifty - three recreation grant applications for 2000 - 2001 Discussion ensued about the nature of the grants and areas of the County they represent Following discussion , Commissioner Allen L Mims , Jr moved the Board table the approval of recreation grants until the Recreation Grant Committee appointed by the Chairman last year can properly screen the applications Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 10 Appointments A Planning Board - one position to fill unexpired term Commissioner Allen L Mims , Jr nominated Jeffrey P Carver to fill the position on the Planning Board Commissioner Thomas M Moore nominated Thomas M Merle Hall for the position The Chairman called for a vote on the two nominees By a vote of six to one , Jeffrey P CarverPage222 was appointed to the Planning Board to fill the unexpired term , which will expire May 2002 B O’Neals Fire Protection District Commission Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board waived the length of service policy and reappointed Stan Creech to the O’Neals Fire District Commission for a two - year term to expire July 2002 11 Feasibility Reports for Ingrams Township and Buffalo Water Districts Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board recessed regular session to sit simultaneously as the Ingrams Township and the Buffalo Water District Boards A Sitting as the Buffalo Water District Board Engineer Tim Broome informed the Board he has completed a preliminary analysis on the feasibility of construction for a water distribution system for the Buffalo Water District He showed a map of the district and stated the report indicates 697 of the 924 subscribers can be served A number of areas within the boundaries did not have enough participation to justify the cost , and mobile home parks chose not to participate , which also affected the outcome He noted that some of these areas may be added if enough people sign up at a later date The district would be eligible for a USDA - RD grant The projected cost of the project would be 5 million , and the estimated monthly bill would range from 32 to 3450 , dependent on the grant received He recommended the County participate in the project at a cost of 13 million for a 12 water main on NC 42 , which will allow for proper circulation of this district and the surrounding districts B Sitting as the Ingrams Township District Board Mr Broome stated the preliminary study on the Ingrams Township District indicated 822 of the 988 subscribers can be served This district would also be eligible for a USDA - RD grant , and the cost of construction is projected at 52 million The average monthly bill should range from 3150 to 3800 , depending on the amount of grant received The recommended cost to the County would be 350,000 for upsizing lines Mr Broome recommended that both District Boards proceed with these projects The District Boards concurred Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Ingrams Water District Board and the Buffalo Water District Boards adjourned , and regular session was resumed 12 Water Plant to Require Expansion to Meet Short - Term Needs Engineer Tim Broome discussed with the Board the need to plan now for additional water supply capacity at the Water Plant due to current data which shows this will be needed by the spring of 2002 He explained Hazen and Sawyer , who was retained to perform an enhanced coagulation study for the plant , has completed the first phase of the study Staff is looking at the possibility of changing from conventional filters to membrane filters , as they would provide cleaner water and have now become cost effective He recommended the plant expansion be done in two phases ; first going from the current 4 mgd capacity to 52 mgd , followed by a second phase which would take the plant to 8 mgd He stressed the key is to have the first phase operational by the spring of 2002 when the demand is expected to peak at our current supply He asked the Board to approve the strategy , and stated he would like to bring a pilot plan and funding information back to the Board in August Commissioner Allen L Mims , Jr asked Smithfield Manager , Pete Connet , about capacity at the Smithfield Plant Mr Connet noted the Town is currently using close to their capacity , and would not feel comfortable committing additional supply to the County Following discussion , Commissioner Thomas M Moore moved the Board approve the strategy and phase plan as outlined by the engineer Commissioner Cookie Pope seconded the motion , whichPagePage pageNumber5223 carried by unanimous vote 13 Wastewater Treatment Plant Improvements to Achieve Recycle Quality Effluent Mr Broome reported that McKim and Creed was retained to design tertiary filters and other improvements to the Wastewater Treatment Plant to expand capacity to 499 mgd , to produce recycle quality effluent The design was necessary to get the 3 million State High Unit Cost grant to pay for the filters and related work After reviewing the plans , the State Division of Water Quality informed the County that an additional stage of de - nitrification is needed to guarantee the limits are met when the plant flow reaches 499 mgd In evaluating the options , it was concluded that deep bed filters would be less expensive , however , they would still require additional capital of 27 million Staff has applied for a low interest State Revolving Loan to cover the extra expense , and believes the impact and user fees should cover the debt service on a 20 year , 3 1 2 loan He recommended the Board amend the agreement with McKim & Creed Engineers for design and bidding phase for the deep bed de - nitrification filters with the understanding they will work with Hazen & Sawyer , who have had experience in this type of work and will be working on related projects for the County He noted the deep bed filters will produce a higher quality effluent which should enhance the reclaimed effluent irrigation system program In response to a question about any additional cost of maintaining the deep bed filters , Mr Broome stated the only expense would be for the chemicals , which should only be needed occasionally on a seasonal basis Following discussion , Commissioner Wade M Stewart moved the Board approve the amendment to McKim & Creed’s Engineering Agreement to include the design and bidding phase for deep bed de - nitrification filters for the Wastewater Treatment Plant to achieve recycle quality effluent It was understood that McKim and Creed would confer with Hazen & Sawyer on the project when needed Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 14 Reclaimed Effluent Land Application Program Mr Broome explained that Hazen & Sawyer has completed the investigation phase of the reclaimed effluent land application project and determined the scope for the first phase facilities The first phase would provide effluent to the Country Club , the landfill , and one farm that is under long term contract It is anticipated that other area farms will be served on a year to year basis Staff is recommending the Board approve an engineering services agreement with Hazen & Sawyer to move forward with the design and bidding phase of the system In response to a question from Commissioner Cookie Pope , Mr Broome noted the second phase of the project would move the system out far enough to serve three nurseries that have shown considerable interest Following discussion about various aspects of the agreement , Commissioner Allen L Mims , Jr moved the Board approve an engineering agreement with Hazen and Sawyer to cover the design and bidding phases of the reclaimed effluent system Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 15 Award of Contract - Wastewater Facilities to Serve the New West Johnston K - 5 School The Board reviewed the following three proposals from engineering firms for the design of the wastewater collection facilities to serve West Johnston K - 5 School at the intersection of Cleveland and Josephine Roads Mr Broome explained the proposals include design , preparation of plans and specifications , permitting and assistance in the advertisement and bid phases The Public Utilities Department will handle construction administration and inspection Dennis R Blackmon , RLS , Smithfield 19,91000 McKim & Creed Engineers , Smithfield & Cary 21,00000 Southwind Surveying & Engineering , Garner 22,50000 He recommended award of contract to Dennis R Blackmon , who submitted the low proposal PagePage pageNumber6224 Commissioner Cookie Pope moved the Board award a contract to Dennis R Blackmon of Smithfield in the amount of 19,910 for the design of the wastewater collection facilities to serve West Johnston K - 5 School Commissioner Wade M Stewart seconded the motion Discussion The Chairman pointed out there is a question whether the schools will pay for this as a part of their construction cost , or the County will cover the cost separately Discussion ensued about the funding source It was pointed out at the May 1 , 2000 meeting , the Board stipulated the cost of construction for water wastewater facilities to the school would be part of the school construction cost The School Board has responded they were not told this in time to include the expense in their funding plans Motion Amended Following further discussion , Commissioner Cookie Pope who made the motion , and Commissioner Wade M Stewart who seconded , agreed to amend the motion to state that the issue of funding would be considered at a later date Vote - the motion carried by unanimous vote 16 County to Issue Change Order to Existing Contract to Save Money on Water Main for West Johnston K - 5 School Mr Broome noted the School Facilities Consultant , Ray de Bruhl , has asked the County to consider issuing a change order on a current open contract with McMahon Brothers Pipeline , Inc on the Hopewell Pisgah Water Transmission Mains , to include the construction of a water main for the West Johnston K - 5 School McMahon has agreed to add the project to their contract at a cost saving of approximately 5,000 over the next lowest quote In addition to the cost saving , MaMahon can expedite the project to provide needed water to the site Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board authorized a change order on a contract with McMahon Brothers Pipeline , Inc to include construction of the water main to the West Johnston K - 5 School for a cost savings of approximately 5,000 17 Stormwater Program - Policy and Procedure Manual to be Submitted to State Engineer Tim Broome explained that along with the new proposed stormwater ordinance which the Board agreed to have submitted to the State , the County is also required to submit a policy and procedure manual for State approval He asked Stormwater Administrator , Marty Anderson , to briefly summarize for the Board the material which staff is proposing to send the NCDENR Division of Water Quality Marty Anderson , Stormwater Administrator , stated the Environmental Management Commission is requiring the County submit plans for mapping and identifying existing stormwater facilities , address illegal discharge and provide information about how these facilities could be retrofitted for best management practices , and information about the County’s plans for public stormwater education programs In response to comments from Board members , Mr Anderson noted at present the County will only have to identify illegal discharges It remains to be seen what requirements will be sent down from the State for implementing and enforcing new best management practices Following discussion , the Board concurred with staff’s plans to submit the Johnston County Stormwater Policies and Procedures Manuel to the proper State officials for review and approval 18 Award of Bid - Bulldozer for Solid Waste Operations Bid Opening May 9 , 2000 Haywood Phthisic , Director of Utilities , reviewed with the Board the following single bid received May 9 , 2000 for a bulldozer for solid waste operations The equipment was budgeted in last year’s budget and the funds have been encumbered awaiting award of bid He stated he advertised forPagePage pageNumber7225 bids and three bid packages were received ; however , only one company submitted a bid Gregory Poole Equipment Co of Raleigh - Caterpillar D6R XL 209,56200 Additional Warranty 60 - month 7,500 hours 14,18100 Recommended Attachments 1,62918 Guaranteed Buy Back after 5 years 7,500 hours 55,00000 Total Bid 225,37218 Commissioner Allen L Mims , Jr asked Mr Phthisic if he knew why other companies did not bid on the equipment Mr Phthisic stated no reason was given ; however , in his opinion , the price for the Caterpillar equipment was very competitive Commissioner Mims noted that he has no problem with the Caterpillar equipment , but stated he would still like to see competitive bids in the future In response to a comment from Commissioner Wade M Stewart , Mr Phthisic stated the additional warranty is in addition to the 12 month factory warranty Following discussion , Commissioner Thomas M Moore moved the Board award bid to Gregory Poole Equipment Company of Raleigh for a Caterpillar D6R XL in the amount of 225,37218 Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 19 Board of Equalization and Review 2 00 pm Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board recessed regular session to sit as the Board of Equalization and Review to hear appeals concerning Use Value denials Tax Administrator , Sterling Hancock , stated each of the fourteen cases to be heard concern Farm Use Value , and most failed to return their application form to the County by the required deadline The County sends the forms by certified mail , return receipt requested Two additional cases were scheduled ; however , one withdrew and another asked to be rescheduled Board members asked County Attorney , Mark Payne , for an interpretation of the Machinery Act concerning what the County has the authority to do in these types of cases Mr Payne stated he interprets the law to say the Board of Commissioners does not have the authority to accept the applications late and forgive the deferred taxes Mr Hancock provided a background on how these cases were identified He noted the State requires the County each year to conduct a compliance review of 1 8 of its Use Value applications This allows review of all cases during the eight year revaluation cycle Even though in the past Johnston County has not implemented the review process , this was begun in earnest two years ago Certified letters are mailed to existing claimants in late December or early January stating the applications are st due by January 31 Also new applications are sent where property has been transferred If people do not qualify according to the law , taxes with interest are due immediately The law stipulates the County is to collect the deferred taxes from the current year as well as the past three years It was noted these are deferred taxes , not exemptions It is the taxpayers responsibility to make application for use value , and do so in the time allowed by law If a person is denied , they may apply to get back into the program the following year A Lavee W Holt Bailey - Parcel # 04011020 Mrs Bailey stated she misplaced here original letter dated in early January and tried to call the County Tax Office , but the lines were busy When she was unable to get through , she forgot about it until she found the letter in February and sent it to her tenant , who mailed it back to the County in April After discussion and hearing the information provided by Mr Hancock and Mr Payne , Mrs Bailey stated she would like to apply to be reinstated for the future The Board noted she could reapply for 2001 B Valton Coats - Parcel 08J14037APagePage pageNumber8226 Mr Hancock stated this property owner also failed to return the application on time He offered th the signed return receipt as evidence the certified letter was received on January 7 C J P Edwards - Parcels 04N12022 , 04N12021L Mr Hancock stated Mr Edwards did not return the application on time , and when it was received , he is not eligible for use value James Paul Edwards stated he lives out of town and his daughter has been taking care of this He noted all his property has been put in one company name for tax reasons , including some rental property in Smithfield , but the farm land is the same as always and is still being farmed D Sharon Daughtry Harris , Ted W Daughtry , Ned W Daughtry - Parcel 15M14011 Ned Daughtry stated his wife signed for the letter then forgot to give it to him He stated the land is still farm land E James Fredrick Herring - Parcel 14N08042A Mr Herring stated he brought his form to the Tax Office in January , but was referred to a tax lister sitting outside the office door When he tried to turn in information on 1996 , 1997 , and 1998 , he was told he would have to bring in 1998 and 1999 information also He was informed the information th was not due until April 15 , when he had all of his tax information Mr Hancock stated he could not verify this , but noted it could have happened There could have been some confusion because a Federal Tax Form , Schedule F , is also required , and it is not due until April 15th Sheila Garner of the Tax Office stated this was a new application since the property had changed hands Mr Herring inherited the parcel from his mother A transfer from a parent allows the child to continue in the farm use value program without penalty , however a new application is necessary F Robert C Hines - Parcel 15L11024B Mr Hines , who lives in Wilson , stated the land was transferred to him from his mother in July 1997 , with no change in the use He did not know about the use value forms , and did not know he was in the program He tried to call the Tax Office , but was unable to get through When he got the second notice , he stated he came to Smithfield but was told he was too late Mr Hines asked what his deferred taxes would be and if he could get back in the program for next year Staff noted they would provide all the information needed G Lucretia Murphy Hocutt - Parcels 11M03036 , 11M03036A , 16L02034 Mr Hancock stated the application was returned on time but was incomplete Staff was not able to determine eligibility from the information supplied New information has been sent that indicates some of the land was planted in corn , oats and soybeans , and some is planted in fescue under a highly erodible soil program with Soil Conservation The fescue has been verified by Ken York , Soil Conservationist , however , staff has not been able to substantiate that crops were planted as they do not show up in the ASCS records It is also not clear whether 10 acres are in cultivation Jimmy Hocutt , Lucretia Hocutt’s son , stated the land is planted by a tenant , and the rest is in fescue under the conservation program The tenant only indicated on the form the land he tends H Doris Lee Hodges - Parcels 01E09083 , 01E09083A Mr Hancock stated this application was not returned on time and did not indicate enough income to make it eligible Information has now been received showing it would meet the income qualifications Attorney Thomas Hodges of Benson stated his mother gave the information to the tenant who failed to send it in on time He asked the Board to have compassion on his mother who is in her 70 s I Clarence C Honeycutt , Janice Honeycutt -
