10 244 August 7 , 2000 The Johnston County Board of Commissioners met in regular session Monday , August 7 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , and Allen L Mims , Jr Absent Wade M Stewart , Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer 1 Minutes - July 3 , 10 , 2000 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the July 3 , 10 , 2000 board meetings Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the minutes as presented 2 Resolution - Employee Appreciation Week - August 7 - 11 , 2000 Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution of appreciation for County employees JOHNSTON COUNTY EMPLOYEE APPRECIATION WEEK August 7 - August 11 , 2000 WHEREAS Johnston County Employees represent approximately 850 men and women , working in 29 different service departments and agencies , devoted to making Johnston County a better place to work and live ; and WHEREAS Johnston County employees provide a multitude of services for ALL the citizens of the County - the farmer , the retailer , the industrial businessman , the homeless , the jobless , the homeowner , the veteran , the disaster victim , the victim of violence , the sick , the poor , the educated , the uneducated , the youth , the elderly , the newcomer , and the old - timer ; and WHEREAS Johnston County employees are both skilled and efficient in their jobs , making every effort to expend county tax dollars in the most effective way for the betterment of the County and its citizens ; and WHEREAS Johnston County Government runs smoothly on a day to day basis primarily because of the dedicated employees in each of its departments and agencies NOW , THEREFORE , in appreciation for their dedication to the welfare of the citizens of our County , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS DOES HEREBY PROCLAIM the week of August 7 - 11 , 2000 as COUNTY EMPLOYEE APPRECIATION WEEK Adopted this the 7th day of August , 2000 3 Presentation of Service Pins The Board recognized employees for their length of service with the County Thirty employees received 5 - year pins ; twenty - one received 10 - year pins ; fourteen received 15 - year pins ; thirteen received 20 - year pins , and eleven employees were recognized for 25 years of service Public Comments 4 Mobile Home Regulations - New Development Ordinance The following persons spoke in opposition to the portion of the new Johnston County Development Ordinance pertaining to regulations for mobile homes John Thompson representing the NC Housing Institute ; mobile home park owners Mac Jones from the McGee’s Crossroads Community and Kenneth Carr of Four Oaks ; and Charles Taylor representing the manufactured home industry A request was made for the Chairman to appoint a committee of interested parties to consider possible amendments to this portion of the ordinance 5 Citizen ComplaintPage245 Earl Beasley who lives on Hwy 242 southeast of Benson , spoke to the Board concerning a problem he is having with his brother dumping trash on the property adjacent to his home Mr Beasley stated he has talked with the Chairman , the Sheriff’s office and Environmental Health officials , but has had no relief He asked the Board to please find some way to help him since a problem with rodents as a result of the trash has created a health hazard for him 6 Public Hearing 10 30 am - Environ Incentive Package Advertised July 14 , 2000 in The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on a proposal to provide certain economic incentives to Environ Products , Inc , which plans to locate in Johnston County Michael de Sherbinin , Economic Development Director , explained the incentive package would consist of a waiver of land use and water assessment fees and a training grant agreement whereby the County will , for a five - year period , assist through annual grants to cover Environ’s employee training expenses not reimbursed by the State or other programs The amount of the grants would not exceed 50 of the Company’s ad valorem tax payment Board members discussed the need to offset the loss in revenue in the enterprise fund for utility fees waived for industry It was agreed this should be discussed at a later date There being no further comments , the Chairman closed the public hearing 7 Environ Incentive Package Approved Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Jerry F Wood and carried by unanimous vote , the Board approved the Environ Incentive Package as proposed 8 Resolution - Changing Lead Transportation Agency from CTS to Council on Aging Donna Creech , Executive Director of Council on Aging , requested the Board adopt a resolution making Council on Aging the lead Community Transportation agency The current lead agency , Coordinated Transportation System CTS , consists of a committee set up under the Department of Transportation , with no actual employees The DOT auditors have indicated the lead agency , which makes application for state grant funds , should be a staffed agency Council on Aging has been the managing agency since Johnston County Area Transportation System JCATS has been in operation , and would by this resolution become the lead agency as well She noted the COA Board plan to change their structure to include a voting position for a representative of the CTS board Following discussion , Commissioner Thomas M Moore moved the Board adopt the following resolution Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote RESOLUTION Changing lead transportation agency from Coordinated Transportation System , Inc to Johnston County Council on Aging , Inc WHEREAS , the North Carolina Department of Transportation is designated as the agency responsible for administering federal and state public transportation funds ; and WHEREAS , the purpose of these transportation funds is to provide grant monies to local agencies for the provision of rural public transportation services consistent with the policy requirements ; and WHEREAS , the Johnsto n County C ouncil on A ging , Inc assure s and certifies tha t it will comply with the federal and state Statutes , regulations , executive orders , Section 5333 b warranty and all administrative requireme nts which relates to the applications made to and grants received from the Federal Transit Administration , as well as the provisions of Section 1001 of Title 18 , USC ; and WHEREAS , the Coordinated Transportation System , Inc Board of Directors has recom mended said ac tions ; and WHE REAS , the John ston County Council on A ging , Inc Board of Directors has agre ed to said actions ; NOW , THEREFORE , be it resolved that the Johnston County Board of Commissioners approve an adde ndum to the 1995 Johnston County Transportation Development Plan formally changing the applicant from the Coordinated Transportation System , Inc , to the Johnston C ounty Cou ncil on Aging , Inc effective July 1 , 2000 ; and BE IT FUR THER R ESOLV ED that the Johnston County Board of Commissioners approve an addendum to the FY2000 01Community Transportation Program Grant Application formally changing the applicant from thePage246 Coordinated Transportation System , Inc , to the Johnston County Council on Aging , Inc th Adopted this 7 day of August , 2000 9 Community Development Block Grant Amended Resolutions Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following revised plan and policy resolutions in order to comply with revised state guidelines and HUD regulations A RESOLUTION TO AMEND POLICIES AND GUIDELINES FOR SMALL CITIES COMM UNITY DEVELOPMEN T BLOCK GRANT PR OJECTS Where as , Johnston County participates in Community Development Block Grant Programs administered by the US Department of Housing and Urb an Development HUD and the State of North Carolina , and Where as , Johnston County adopted policies and guidelines on September 8 , 1998 for County CDBG Econo mic Development projects that continued policies and guidelines adopted on June 3 , 1991 for the Small Cities Community Development Block G rant Program CDBG administered by the State of North Carolina , and Where as , Johnston C ounty followe d US D epartmen t of Housing and Urb an Deve lopment g uidelines for procedures used in its Hurricane Fran Disaster Assistance Grant , and Where as , Johnston County desires to amend its CDBG Economic Development policies and guidelines to include disaster recovery assistance and cu rrent State of North Caro lina guidelines NOW THEREFORE BE IT RESOLVED BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERS THAT 1 Johnston County discontinues the use of the following CDBG - ED Program policies and guidelines adopted on September 8 , 1998 - Citizen Participation Plan - Procurement Policy - Small & Minority Firm Policy 2 Johnston Coun ty adopts the use of the attached po licies and guidelines - Citizen Participation Plan - Procurement Policy - Equal Opportunity and Procurement Plan - Section 3 Plan Adopted August 7 , 2000 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CITIZEN PARTICIPATION PLAN FOR THE COUNTY OF JOHNSTON , NORTH CAROLINA I INTRODUCTION AND STATEMENT OF INTENT In accordance with Section 1002 of the North Carolina CDBG Regulation the County of Johnston County has adopted the following procedures to ensure that citizens have a written citizen participation plan , including a complaint procedure for its Small Cities Community Development Block Grant program II SCOPE OF PARTICIPATION Citizen participation shall include involvement in the identification of community needs that can be addressed by the CDBG program ; the development of CDBG applications ; any amendments to the CDBG program ; and assessing the performance of a CDBG p rogram upon its completion III STANDARDS OF CITIZEN PARTICIPATION All public hearings shall be conducted with freedom of access for all citizens If citizens require technical assistance to understand any aspect o f the CDB G prog ram they are to contact the C ounty As a part of this assistance the County sha ll maintain a list of individuals to serve as translators for any non - English speaking resident requiring a translator to understand or comment on the CDBG program IV CITIZEN PARTICIPATION Citizens shall be involv ed in the dete rmination o f priorities and commun ity needs The views and proposals of citizens concerning community needs and priorities , especially the views of low and moderate income persons and members of minority groups shall be solicited through public notifications and or hearings held prior to the submission of a CDBG project During public notification activities citizens shall be encouraged to submit views and propos als regarding commun ity needs Th e County sha ll respond in writing to written comments within ten 10 calendar days after the receipt of the comments The response shall outline the action taken regarding the comments and the reasons for the action All comments should be addressed to Rick Hester , Manager County of Johnston Post Office Box 1049 Smithfield , North Carolina 27577 Citizen participation for a CD BG – N on - Disaster project shall include the follow ing public hearings Page247 REQUIRED PUBLIC HEARINGS – NON - DISASTER 1 Planning Stage Prior to the preparation of an application a public hearing shall be held to explain the CDBG program and obtain views and prop osals of citizens in regard to comm unity development need s 2 Application Stage Prior to the su bmission o f a CDB G applic ation a pub lic hearing shall b e held to exp lain the CDBG proposed applications activities , design , impact and costs Citizen views and comments obtained at this public hearing will be considered for incorporation into the final CDBG application 3 Amen dment P rocess A public hearing will be held in accordance with North Carolina Department of Commerce , CDBG Rule 0910 of Subchapter 13L prior to the submission of an amendment if it is required by the Commerce Finance Center 4 Project Closeout During the grant closeout period the County will hold a public hearing to access the programs performance Adequate notice of public hearings shall be provided in a timely manner and in such a way as to make them accessible and understandable to all citizens Notices for required public hearings shall appear in the nonlegal section of a local newspaper at least once prior to the date of the public hearing Notices shall be published not less than ten da ys nor more than twenty - five da ys before the d ate fixed for the hearing Suc h notices shall indicate the time , date , place and a brief description of the topic of the public hearing Citizen participation requirements for a CDBG – Disaster projects follow REQUIRED PUBLIC HEARINGS – DISASTER 1 Planning Stage Prior to the p reparation of a Small Cities Community Development Block Grant application or a proposed Disaster Recovery Action Plan furnish citizens information concerning the amoun t of funds availab le for proposed H UD activities and the range of activities that may be undertaken , including the estimated amount proposed to be used for activities that will benefit persons of low and moderate income This activity may be in the form of a public hearing and or the posting of information within the Johnston Cou nty Courthouse at prominent locations as permitted by State o r Federal program regulations 2 Application Stage Prior to the submission of a proposed CDBG application or a Disaster Recovery Plan a notice shall be published that contains the proposed applications or Disaster Recovery Plan’s activities , design , impact and costs This activity may include a public hearing if required by specific State or Fede ral program regulations 3 Amen dment P rocess Provide citizens with reasonable notice of , and opportunity to comment on , any substantial change proposed to be made in the use of funds received from one eligible activity to another or in the method of distribution of such funds This activity may include a public hearing if required by specific State or Federal program regulations 4 Project Closeout During the grant closeout period the County will hold a public hearing to access the p rog ram s performance V AVAILABILITY OF COMMUNITY DEVELOPMENT RECORDS As provided in Rule 0911 of Subchapter 13L , North Carolina Community Development Block Grant Program Regulations , the County shall make public Community Developm ent record s and inform ation consiste nt with applicab le State and local laws regard ing person al privacy and obligations o f confidentiality D ocumen ts shall be on file for pub lic inspection in th e County TYPES OF DOCUM ENTS AVAILABLE FOR REVIEW 1 Mailings and pro motional materials ; 2 Records of pub lic hearings ; 3 Key documents including the application , letters of approval , grant agreement , written Citizen Participation Plan , performance reports , othe r reports req uired by the C ommerc e Finance C enter , or othe r State and Federal agencies ; 4 Copies of the regulations , notices , transmittals , and issuances governing the CDBG program ; and 5 Docum ents regarding other important program requirements such as contracting procedures , environmental policies , fair housing , and other equal opportunity requirements , relocation provisions , and the A - 95 review process Copies of these documents are subject to a copy fee of 25 cents per page All information contained in CDBG files other than the preceding listed information , NAMEL Y information pertaining to the employment , income , bank deposits and other assets , martial status , and total assets of beneficiary ies employees seeking employment , hired and or retained and the economic development beneficiary ies , will be maint ained in accordance with the requirements of GS 160A - 3707 The State or the U S Department of Housing and Urban Development will respond only to written com ments within ten calendar days of the receipt of the co mments All complaints received by the County and all responses shall be maintained in a complaint file Adopted August 7 , 2000 COUNTY OF JOHNSTON FEDERAL PROGRAM GENERAL FEDERAL GRANT LOAN PROGRAM PROCUREMENT POLICY AND SELECTION STANDARDS The County of Johnston County shall use the following guidelines in the procurement of services and supplies , which will be finan ced who le or in part b y Federal fun ds as app licable by pr ogram re gulations 1 OFFICE SUPPLIES AND EQUIPMENT The County will use the Small Purchase Procedure for the procurement of supplies aggregate shall not exceed 10,000 The County shall prepare a list of the supplies which are anticipated to be needed during the startup and course of the project This list will be given to at least three vendors in the general area The County shall select the supplier vendor based upon the low bid for the total purchase 2 PROFESSIONAL SERVICES The County shall use the Competitive Negotiation Procedure for the procurement of professional services The following guid elines will apply a A notice soliciting professional service proposals will be placed in a newspaper with local circulation at least 14 days prior to the selection date b A Request for Proposal will be developed and sent to at least three interested firms o r individuals kn own to provide the solicited p rofessional se rvices The Request will follow the procurement guidelines as expressed by Federal program guidelines and set forth clearly the requirements that the offeror shall be expected to fulfill c Proposals must contain cost of service expressed as a lump sum cost or a not to exceed cost with hourly rates Note Engineering firms are exempt from having to include a lump sum or not - to - exceed statement in their proposals d An adequate num ber of responses from qualified sources must be receive d in order to proceed with the selection process If this is not the case , then the County must follow the above - described procedure for a second time and expand the area of circulation of the advertisement On the second solicitation , any response may be reviewed fo r selection , bu t the County ne ed not be obligated to accept the sin gle proposal and may elect to begin the p rocess aga in e Awards w ill be made to the respon sible firm person having the ability to perform successfully under the terms and conditions of the proposed procurement Factors to be considered in the award of contract include contractor integrity ; record of past performance , experience ; education ; familiarity with the subject matter and with the Coun ty , etc Contract award cann ot be based upo n evaluation of cost of service alone Once a candidate has been selected , the County at its option may negotiate the cost of service Proposa ls will be reviewe d on the follow ing bases 1 CONTENT REVIEW Each proposal received will be evaluated to determine how the respondent addressed the scope of services Review should include a look for clarity , project understanding , feasibility and staffing qualifications to administer the service The proposal which most clearly meets this review should be ranked highest and should receive a 20 point score The average proposal should receive a 10 point score Propo sals which contain poor contents should receive a 1 point score If no proposal is assessed to have superior co ntents or exce ptionally po or contents , th e rankings sho uld be co nsistent at 5 points 2 PERFORMANCE REVIEW Proposals should be reviewed and re ference calls should be ma de to assess past performance The individual firm determined to have the most superior performance based upon successfully working on similar projects will receive a 20 point score Average performance should receive a 10 point score Poor performance should receive a 1 point score If no proposal is assessed to have superior co ntents or exce ptionally po or contents , th e rankings sho uld be co nsistent at 5 points 3 BONUS POINTS Bonus points may be assigned to the scores as applicable for the following PagePage pageNumber6249 a Disadvantaged firms minority ownership at least 51 of business 1 point b Small Business lt; 100,000 annually 1 point c Local Business Section 3 Area 1 point 4 COST OF SERVICE Cost of service shall be negotiated with the firm selected on the basis of the above criteria The County shall negotiate price with the firm having the highest ranking In the event that a price cannot be negotiated with the highest - ran king firm , the Co unty will negotiate with the firm having the next highest ranking This process will continue until a reasonable price has been negotiated with the professional firm having the highest point total At this time the firm will be awarded the contract The County has the right to reject any o r all proposals 3 CONTRACTUAL SERVICES OVER 2,000 These services , including but not limited to contractors for public works activities and housing reha bilitation , shall be secured through the bidding procedure as outlined in OMB Circular A - 102 , Attachment O PROCUREMENT IN RESPONDENCE TO DISASTERS Applicab le Federal p rocurem ent requirem ents will be used when respo nding to em ergency disaster related activities Adopted August 7 , 2000 County of Johnston Equal Employment and Procurement Plan The County of Johnston maintains the policy of providing equal employment opportunities for all persons regardless of race , colo r , religion , sex , national o rigin , handica p , age , po litical affiliation , or any o ther non - me rit factor , except where religion , sex , national origin , or age are bona fide o ccupation qualifications fo r employm ent In furtherance of this policy the County prohibits any retaliatory action of any kind taken by any employee of the County against any other employee or applicant for employment because that person made a charge , testified , assisted or participated in any manner in a hearing , proceeding or investigation of employment discrimination The County shall strive for greater utilization of all persons by identifying previously under utilized groups in the work forc e , such as mino rities , women , a nd the hand icapped , and makin g special effor ts toward their recruitment , selection , development , and upward mobility and any othe r term , cond ition , or privileg e of emplo yment Respon sibility for implementing equal opportunities and Affirmative Action measures is hereby assigned to the Manager and or other persons designated by the Bo ard of Co mmissione rs to assist in the implementation of this policy statem ent The County shall develop a self - evaluation mechanism to provide for periodic examination and evaluation Periodic reports as requested o n the progress of Equal Employment opportunity and Affirmative Action will be presented to the Bo ard of Comm issioners by persons designated by the Board o f Commissioners The County is co mmitted to this p olicy and is aw are that with it implemen tation , the Co unty will receive positive benefits through the greater utilization and the de velopment of all it human resources Adopted August 7 , 2000 COUNTY OF JOHNSTON SECTION 3 POLICY It shall be the policy of the County of Johnston County , in conducting its Sm all Cities Com munity Development Block G rant CD BG p rogram , to take all possib le affirmative actio ns to assure tha t minority firms , wom ens business enterprise and labor surplus area firms are used when po ssible To achieve this , the County w ill do the following 1 Include on all mailing lists for goo ds and serv ices disadva ntaged firms lo cated within a reasonable area of the work to be performed 2 When advertising for goods o r services , plac e an adver tisement in a pape r with general c irculation in the area and include a specific reference requesting that disadvantaged firms apply for the work 3 Make available plans and specifications at locations such that disadvantaged firms may have reasonab le opportunity to review same during the hours specified for review 4 Require tha t the prime co ntractor on public facility work include this policy as a requirement for it and its subcontracts 5 Retain on file d ocumen tation all efforts made in regard to this policy and assure that such information will be made available for the purpose of determining whether the County has met these policy goals in connection with this grant Adopted August 7 , 2000 10 Department of Transportation - Additions to System The Board reviewed a petition presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Wyndfall Lane , Jacobs Court , Allison Way , Kirkland Court and Carrie Drive in Wyndfall Subdivision , Wilders Township Following review , Commissioner Eleanor N Creech moved the Board concur with the NC Department of Transportations request to add the road listed above to the State Maintained System Commissioner Cookie Pope seconded the motion , which carried by unanimous vote PagePage pageNumber7250 11 Resolution - Education Foundation Week Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Eleanor N Creech and carried by unanimous vote , the Board adopted the following resolution proclaiming Education Foundation Week RESOLUTION JOHNSTON COUNTY EDUCATION FOUNDATION WEEK WHEREAS , the importance of quality public education in Johnston County has been the focus of government , business and community leaders as well as parents and students in Johnston County ; and WHEREAS , the Johnston County Education Foundation has clearly demonstrated its effectiveness in supporting public education through numerous Special Focus Grants and Creative Project Grants as well as the administration of private scholarships throughout Johnston County schools ; and WHEREAS , the Johnston County Education Foundation will observe its ten - year anniversary in 2000 with activities designed to recognize and honor citizens throughout the county ; and WHEREAS , the Johnston County Board of Commissioners , in an effort to further promote the ongoing accomplishments of the Foundation and those local citizen volunteers associated with it , desires to join the various municipalities in Johnston County in establishing a special recognition proclamation to honor and support the Johnston County Education Foundation NOW , THEREFORE , BE IT RESOLVED , that the Johnston County Board of Commissioners , through common consent , shall and herein does , proclaim the week of September 3 - 9 , 2000 as JOHNSTON COUNTY EDUCATION FOUNDATION WEEK , and urge all citizens to join the various towns in honoring and recognizing the Foundation and its efforts th Adopted this the 7 day of August , 2000 12 Designation of State ADM Funds for Senior High Projects Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the use of State ADM funds for the following projects 450,000 for North Johnston High renovation project 90,000 for Smithfield - Gross Receipt Tax on Short Term Leased Motor Vehicles Advertised - 7 14 00 and 7 21 00 in The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on a proposed ordinance authorizing the County to enact a gross receipt tax on short term leased motor vehicles Sterling Hancock , Tax Administrator , explained the NC General Assembly recently appealed the property tax on vehicles leased or rented under short - term retail arrangements At the same time , they enacted another law allowing counties , if they so desire , to offset the subsequent loss of revenue with a local tax on gross receipts derived from short - term leases or rentals Mr Hancock stated that staff has determined there are 10 companies in Johnston County that do lease or rent vehicles on a short term basis It is uncertain exactly how much revenue will be lost in property tax , but all indications are that it would not be a great deal of money It is staff’s belief that the administrative cost to enact this new tax would make it counterproductive ; therefore he recommended the County not pursue this matter at this time If additional leasing agencies move into the County , the Board can revisit the issue at a later date There being no further comments , the Chairman closed the public hearing Following discussion , it was the consensus of the Board that no action be taken at this time on the proposed ordinance to enact a gross receipt tax on short term leased motor vehicles 16 Hazard Mitigation Grant Program Resolutions - Hazard Mitigation Plan Dewayne West introduced Kirk Hinton and Lori Key with Geographic Technologies Group , who developed the Hazard Mitigation Plan for Johnston County Mr Hinton explained this document has been in development for approximately one year , involving many County departments , as well as the municipalities It is very unique in that it is a “ living document , ” created in digital form that interacts with the County’s GIS system , keeping it always up toPage2255 date He noted , to his knowledge , this has never been done before and will most likely draw widespread attention from around the Country He demonstrated how the different layers of information available on the GIS program can be used to provide current and accurate information during emergencies From this site , citizens can also go directly to state or FEMA web sites Mr West stated the next step is to get State approval , after which the document will be brought back to the Board for final approval Commissioner Cookie Pope asked if any efforts are being made to provide a better way of notifying people of impending dangerous weather Mr West responded that weather radios are available through FEMA ; however , Johnston County is at present in a void zone that can not pick up weather transmissions A new tower is being erected on the Wayne - Johnston county line that will change that 19 Request to Extend Elevation and Meadow Water District Boundaries Benson Manager , Keith Langdon , asked the Board to consider extending the boundaries of Elevation and Meadow Water Districts to more closely conform to Benson’s extraterritorial jurisdiction boundaries Mr Langdon stated the Town originally believed it could , within a reasonable length of time , serve these citizens with town water , but the families have asked to be included in the water district in order to get public water as quickly as possible Engineer Tim Broome showed a map of the existing districts and the areas that would be included in the proposed extensions Following discussion , Commissioner Jerry F Wood moved the Board call for a public hearing on extending the boundaries of Elevation and Meadow Water Districts as soon as all requirements for notification and advertisement can be met Commissioner Cookie Pope seconded the motion , which nd carried by unanimous vote The hearing will be held at the October 2 meeting of the Board 20 Town of Clayton - Ingrams Townships Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Jerry F Wood and carried by unanimous vote , the Board recessed regular session to sit as the Ingrams Water District Board The following resolution was introduced WATER PROJECT PRELIMINARY FINDINGS AND DESIGNATION OF REPRESENTATIVES WHEREAS , it has been proposed that the Ingrams Township Water District issue general obligation bonds to provide funds for a water system ; and WHEREAS , this Board is in general agreement with the necessity of such bond issue and has tentatively decided to pursue the issuance of general obligation bonds in the maximum aggregatePage6259 principal amount of 5,700,000 under the Local Government Bond Act the Act to finance , in part , the acquisition , construction , installation and equipping of a water system ; and WHEREAS , this Board desires to more accurately described the proposed project and make appropriate provisions for its pursuit ; NOW , THEREFORE , the Board of Commissioners of Johnston County , acting as the governing body of the Ingrams Township Water District , meeting in regular session on August 7 , 2000 , does the following THE BOARD OF COMMISSIONERS FOR JOHNSTON COUNTY , ACTING AS THE GOVERNING BODY OF THE INGRAMS TOWNSHIP WATER DISTRICT , MAKES THE FOLLOWING FINDINGS OF FACT 1 The project can be adequately described as follows Approximately 330,000 lf of 2 ” through 12 ” water mains , 800 to 1,100 water services , and related appurtenances 2 The project is necessary and expedient because it completes another part of the County’s plan to provide water service to all of Johnston County 3 The amount of bonds is adequate for the proposed purpose because a preliminary engineering report prepared for this project has estimated total project costs to be 5,700,000 4 Facts supporting the conclusion that debt management policies have been carried out in compliance with the law and reasonable assurances that compliance with the law will henceforth be carried out are as follows a The Local Government Commission has taken no action against the District , nor found the District to have acted improperly in debt management b The District has not defaulted on any debt obligation c The District follows the debt management guidelines of the North Carolina Local Government Commission 5 No estimated increase in the property tax rate is necessary to raise the debt service requirements 6 The average water bill will range from 37 to 39 per month THEREFORE , BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR JOHNSTON COUNTY , ACTING AS THE GOVERNING BODY OF THE INGRAMS TOWNSHIP WATER DISTRICT , THAT 1 The Chairman and Clerk , or either of them , are hereby designated as the representatives of the District to file an application for approval of the bonds with the Local Government Commission 2 This resolution shall take effect immediately Commissioner Cookie Pope moved the passage of the foregoing resolution , Commissioner Thomas M Moore seconded the motion , and the resolution was passed by the following vote Ayes James H Langdon , Jr , Cookie Pope , Jerry F Wood , Thomas M Moore , Eleanor N Creech , and Allen L Mims , Jr Nays None Not Voting None The following resolution was discussed and its title was read RESOLUTION PROVIDING FOR PUBLICATION OF NOTICE OF INTENT TO FILE APPLICATION WITH RESPECT TO UP TO 5,700,000 GENERAL OBLIGATION BONDS WITH THE LOCAL GOVERNMENT COMMISSION WHEREAS , the Board of Commissioners of Johnston County acting as the governing body the “ Board ” of the Ingrams Township Water District the “ District ” has decided to pursue the issuance of general obligation bonds in the maximum aggregate principal amount of 5,700,000 the “ Bonds ” under the Local Government Bond Act the “ Act ” to finance , in part , the acquisition , construction and equipping of a water system in the District ; and WHEREAS , under the Act the issuance of such bonds must be approved by the Local Government Commission and pursuant to GS § 159 -
