10 336 November 6 , 2000 The Johnston County Board of Commissioners met in regular session Monday , November 6 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members Present James H Langdon , Jr , Cookie Pope , Jerry F Wood , DDS , Eleanor N Creech , Thomas M Moore , Wade M Stewart , and Allen L Mims , Jr Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer 1 Minutes - October 2 , 9 , 2000 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the October 2 , 9 , 2000 board meetings Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes as presented Public Comments 2 Offer for Old Glendale School Site Cecil Stancil , representing Glendale - Chapel Community Center , Inc , a non - profit organization , informed the Board his organization would like to purchase the Old Glendale school site He noted that plans are to remove the old gym and renovate the cafeteria as a community senior center He asked the Board to accept the organizations ’ offer to purchase the property for 1 with certain conditions , authorize the removal of the old gym and allocate 40,000 to help renovate the cafeteria building for a community senior center In discussion , it was noted that a reversion clause should be added to the agreement stating that if at any time the property is not used for public purpose , it would revert back to the County Following further discussion , Commissioner Jerry F Wood moved the Board accept the following offer for the old Glendale property , subject to upset bid Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 1 Cash payment in the sum of ONE DOLLAR 1 00 ; 2 The Corporation will indemnify and hold harmless the County from and against any liability whatever arising out of or in any way connected to any act or omission or incident occurring after the time of transfer of the title to the Premises ; 3 The Corporation will be a North Carolina non - profit corporation which either has or is in the process of obtaining federal tax exempt status under § 501 c 3 of the Internal Revenue Code ; 4 The Corporation will make available to recognized civic , church and school groups , the use of the ball fields at all times during the year , subject to reasonable scheduling requirements to be imposed , at no charge , and will provide that the costs of insurance , lighting , maintenance , and other fees will be paid from charitable contributions , fund raisers , concessions , or otherwise ; 5 The Corporation will within a reasonable time refurbish the cafeteria and make available the same to the community at large with preference to residents of the Glendale - Chapel Scho ol District for use primarily as a Senior Center or Community Center , open or available for use at all reasonable times , except during national and other holidays as may be set by the Board of Directors , without charge ; provided , how ever , that a reasonable fee for maintenance , insurance , utilities and clean up fees may be charged to groups who use the Premises for special occasions , such as Glendale High School Class Reunions ; 6 The Premises must be put to those uses which are educational and charitable within the intent and meaning of the applicable Treasury Regulations under Section 501 c 3 of the Internal Revenue Code , for the benefit of the citizens of Johnston County at large and particularly the residents of the Glendale - Chapel school district The deed from the County to the Corporation will contain a similar restriction 7 The ground water monitoring wells presently on the property will not be obstructed or taken up and will be maintained for future use 8 Should the property ever be no longer used for public purposes , title in the property shall revert to the coun ty The Board postponed a decision on providing funds to assist in the renovation of the cafeteria project It was suggested a policy needs to be established for contributing to community projects Page337 3 Request to Change Road Name - Truck Stop Road Ernie Brame , general manager of Stallings Oil Company , requested the Board consider changing the name of Truck Stop Road back to its original name , Flowers Road Mr Brame suggested the name Truck Stop does not create a positive image for the motoring public He offered a letter from Wilco , owners of Wilco Travel Plaza , which supported the request Following discussion , Commissioner Thomas M Moore moved the Board schedule a public th hearing for December 4 to consider this proposed road name change Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote The hearing is scheduled for 10 15 am 4 Request for Ordinance to Provide for Enforcement Measures Against Violence in Rental Properties Four Oaks Councilman and restaurant owner , Linwood Parker , asked the Board to research the possibility of an ordinance that would allow enforcement measures on property owners of multi - family rental facilities in situations when the behavior and conduct of the renters constitutes a nuisance and or safety concern for the surrounding community He stated that renters from the trailer park located behind his restaurant have stolen his hog cookers and his delivery van on several occasions in the past six months He maintained the Sheriff’s Department has made numerous calls to the park on drug charges , and last week a man was shot behind his restaurant He called this type of situation a plague to the County that needs to be addressed He asked the County to work with the Institute of Government and Association of County Commissioners to come up with an ordinance that would hold property owners accountable when their renters in multi - unit facilities create a problem for the community Board members agreed this situation needs to be addressed and instructed the County Attorney to check with the IOG and NCACC , as well as other counties , to see if similar ordinances exist 5 GIS - Appointment of Special Representative for County Boundaries GIS Director , Terry Ellis , informed the Board the NC Geodetic Survey has requested the County appoint him as Special Commissioner for County Boundaries This would allow him to act as liaison between the County and State concerning County lines when questions of boundaries occur The position carries no decision making authority , however , in cases of dispute or determination of survey markers on County lines , Mr Ellis would research the matter and provide necessary information for the Board’s approval Following discussion , Commissioner Jerry F Wood moved the Board appoint GIS Director , Terry Ellis , as the Special Commissioner for County Boundaries Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 6 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Southfort Drive in Southfort Subdivision , Cleveland Township ; Seth’s Way , Connor Drive and Weathersby Lane in Huntersway Subdivision , Clayton Township ; Grant’s Way , Skylar Lane , and Hunter Court in Cedar Cove Subdivision , Elevation Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to add the road listed above to the State Maintained System Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 7 Department of Transportation - Closing of a Portion of SR 1561 and Paving of Ivey Road Board of Transportation member , Durwood Stephenson , addressed the Board on the following two matters concerning roads in the County A Closing of Portion of SR 1561 - Lee RoadPage338 Mr Stephenson stated he and Commissioner Thomas M Moore have visited this site and agree that where Lee Road intersects with Barber Mill Road is unsafe due to the extreme limited sight distance He recommended the Board concur with DOT’s request to abandon approximately 550 feet of SR 1561 at the intersection and redirect traffic over to Jack Road to intersect with Barber Mill Following discussion , Commissioner Thomas M Moore moved the Board concur with NC DOT in abandoning 550 feet of Lee Road at the intersection of Barber Mill Road Commissioner Jerry F Wood seconded the motion , which carried by unanimous vote B Paving of Ivey Road Mr Stephenson asked the Board’s to approve DOT’s decision to move outside of the paving priority list and pave Ivey Road near Four Oaks as soon as possible due to the serious lung related health conditions of several citizens on the road Following discussion , Commissioner Jerry F Wood moved the Board concur with the NC DOT in their decision to pave Ivey Road near Four Oaks as soon as possible Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote 8 Public Hearing - Utilities Primacy Review Ordinance Advertised 10 20 and 10 27 - The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on a proposed ordinance to allow the Johnston County Public Utilities Department to conduct primacy review and issue approval on water and sewer pipe line extensions There being no comments , the Chairman closed the hearing Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board adopted the following ordinance allowing primacy review by the Johnston County Public Utilities Department ORDINANCE CONCERNING PERMITS FOR CONSTRUCTION , OR OPERATION OF , OR CHANGE TO WATER DISTRIBUTION SYSTEM OR WASTEWATER COLLECTION SYSTEM 1 Authority Under North Carolina General Statutes 130A - 317 d and 143 - 2151 f which provides for a local government to establish and administer its own approval program in lieu of the State approval of the construction or alteration of the distribution portion of a public water supply system or a wastewater collection system 2 Intent The intent of this ordinance is to 21 Establish a local plan approval program to authorize Johnston County to approve and permit the construction , or change to , or operation of water distribution systems hereafter “ water system ” or wastewater collection systems sometimes hereafter “ sanitary sewer system ” 22 Establish authority for the enforcement of the local plan approval program through misdemeanor sanctions , civil penalties and injunctive relief 23 Establish County ownership of any private water and sanitary sewer system , which is extended and constructed under the provisions of this ordinance 3 General 31 No person shall undertake any activity listed in subsections 311 - 313 below concerning a water system or wastewater collection system sometimes hereafter “ sanitary sewer system ” which is , or is proposed to become , a part of the County water system or wastewater collection system , and is located within the County’s utility service area , as such term is defined in North Carolina General Statute 143 - 2151 f , unless such person shall have applied for and shall have received from the County a permit therefore , and shall have complied with such conditions , if any , as are prescribed by such permit The term “ water system ” shall mean and include , but shall not be limited to , water distribution pipes , including required fittings , hydrants , valves , air release valves and manholes The term “ water system ” shall mean and include , but shall not be limited to , water distribution pipes , including required fittings , hydrants , valves , air release valves and manholes The term “ sanitary sewer system ” shall mean and include , but not be limited to , sanitary sewer pipes , valves , air release valves and manholes 32 Activities prohibited without a permit include 321 Construction or operation of any water system or sanitary sewer system ; 322 Alteration , extension , or change of the construction or method of operation of any existing or proposed water or sanitary sewer system ; or 323 Entering into a contract for the construction and installation of any water or sanitary sewer system , or for thePage339 alteration or extension of such a system 33 Any person proposing to undertake any activity described in subsections 31 and 32 of this section shall make timely and proper application on such form s as may be prescribed by the Director of Infrastructure and Engineering , or his or her designee , hereafter “ Director ” and provide such information as may be required by the Director A copy of all applications for permits subject to this section and of all approved permits and plans shall be provided to the State Department of Environment , Health and Natural Resources DEHNR pursuant to applicable law 34 All water or sanitary sewer systems proposed for connection to the County water or sanitary sewer system and all proposed modifications to any existing portion of the County water or sanitary sewer system shall be designed , constructed and installed in conformance with applicable provisions of the then current County water and sewer design and construction standards hereafter “ County standards ” and any other County rules , policies and procedures hereafter “ County requirements ” Any engineering reports , plans , specifications , calculations and profiles submitted by applicants for new water or sanitary sewer systems and modifications to existing facilities shall be prepared by or under the direct supervision of an engineer licensed to practice in the state , shall bear the seal of such engineer , and shall be subject to approval by the Director Such reports , plans , specifications , calculation , and profiles shall be prepared at the expense of the applicant The Director shall maintain a copy of the current County standards and County Requirements for public inspection 35 The denial of an application for a permit shall be made in writing and shall contain each reason for the denial and the County’s detailed summary of the changes in the applicant’s proposed activities or plan which will be required in order that the applicant may obtain a permit Nothing in such summary shall preclude or otherwise bar the County from denying a permit , which incorporates such changes , based upon changed circumstances or information not previously known by the County 4 Permit 41 Each application subject to Section 3 shall be accompanied by a fee , which shall be set forth in the County’s schedule of charges and fees , an engineer’s report , plans , specifications , calculations , and other necessary project data A copy of the current fee schedule shall be maintained by the Director and made available for inspection upon request The fee shall e subject to adjustment by the Board of County Commissioners which shall not constitute an amendment to this ordinance Any application that is not accompanied by a fee in the proper amount and an engineer’s report may be considered incomplete and shall be returned to the applicant 42 The Director shall review the fee , engineer’s report , plans , specifications , calculations , and other project data accompanying an application , and shall determine if the application and accompanying material are complete and in a form acceptable to the Director 43 The Director shall endeavor to take final action on all permit applications no later than thirty 30 days following receipt of a complete application ; however , no permit shall be issued until final approval has also been given by the Director for any related development plan All permits issued shall be in writing ; provided , however , in the event construction has not begun pursuant to an issued permit within one 1 year of the date of the permit , the permit shall expire and a new permit must be applied for and obtained by the applicant in accordance with Sections 3 through 7 Construction and operation shall strictly conform to the permit requirements A permit may contain such conditions as the Director determines to be reasonably necessary , considering the factors on which final action on a permit can be based Final action on any permit shall be based upon the design , capacity and manner of operation of the appropriate County water or sanitary sewer system ; effectuating the purposes of all applicable rules , regulations , statutes and ordinances of the County , the State , and the United States of America ; and on the County standards and County requirements 44 If the application is not complete , the application shall be returned to the applicant The Director shall advise the applicant in writing 441 How the application can be modified to make it complete and acceptable ; and 442 That the time for the Director to take final action on an application does not begin until receipt of a complete , corrected application 45 Any permit issued by the Director , pursuant to sections 3 through 7 , is subject to revocation , suspension , or modification , in whole or in part , upon fourteen 14 days ’ written notice to the applicant by the Director for good cause , including , but not limited to 451 Violation of any terms or conditions of this ordinance or the permit ; 452 Obtaining a permit by misrepresentation or failure to disclose fully all relevant facts ; 453 Refusal of or by the permittee or its contractors , agents or employees to allow authorized officers , employees or agents of the County , upon presentation of credentials , to inspect or observe any activity , system , or other work required by the permittee’s permit 5 Enforcement 51 Any person that violates , fails to comply with , or continues to violate any provision of Sections 3 through 7 or any permit issued hereunder shall be liable to the County for a maximum civil penalty of up to ten thousand dollars 10,00000 per violation per day for as long as the violation s continues Each day on which a violation shall occur or continue shall be deemed a separate and district violation In determining the amount of the civil penalty , the Director shall take into account all relevant circumstances , including , but not limited to , the extent of harm caused by the violation , the magnitude and duration of the violation , efforts to correct the violation , the compliance history of the person against whom the violation is assessed , cost of enforcement to the county , whether the violation was committed willfully or intentionally , and any other factor as justice requires 52 If any person violates the provisions of this ordinance or the terms or conditions of any permit issued hereunder , a civil action may be commenced in the general court of justice in the name of the County for such legal and equitable relief as may be appropriate 53 The remedies provided herein are not exclusive The County may take any one , all , or any combination of these actions against any person in violation of the provisions of this ordinance or the terms or conditions of any permit issued hereunder , or any other action allowed pursuant to NC General Statute 5153A - 123 6 HearingPagePage pageNumber5340 61 Persons entitled to hearing Any person whose application for a permit under this ordinance is denied , any person whose application for a permit is issued subject to conditions the applicant finds unacceptable , any person whose permit is revoked or suspended , and any person against whom a penalty is assessed pursuant to this ordinance each of whom is hereafter referred to as “ aggrieved person ” is entitled to a hearing in Superior Court in the Nature of Certiorari pursuant to this section 62 Demand for hearing 621 The aggrieved person shall exercise such right to a hearing by making a written demand in Superior Court for a Writ of Certiorari for a hearing in accordance with this subsection A copy of the Petition must be forwarded to the Director 622 Any person making a demand or Petition shall file its Petition demand to the Director within thirty 30 days of 6221 The date of the contested permit ; 6222 The date of the notice of denial of a permit application ; 6223 The date of the notice of a revocation or suspension of an issued permit ; or 6224 The date a penalty was assessed , as the case may be 63 Contents of demand The written demand or Petition must identify separately and with particularity 631 The aggrieved person ; 632 The specific permit provisions or conditions or other issues contested or to be considered ; and 633 The reasons for the objection 64 Judicial review Any person against whom a final order or decision of the Director is made , pursuant to the hearing conducted under Section 6 , may seek judicial review of the order or decision by filing a written petition within thirty 30 days after the date of notice of the order or decision , but not thereafter , with the Superior Court of the County by means of a Writ in the nature of certiorari If not previously requested , such person shall request in writing that a transcript be prepared for every part of the hearing that was recorded Such request shall be made at or before the time that the petition is filed A copy of the petition shall be served on the County in the manner required by law Within thirty 30 days after service of a copy of the petition upon the County or such other time as may be ordered by the court , the County shall prepare and transmit to the court the original or a certified copy of the official record of the hearing as hereinafter set forth The official record of the hearing shall consist of all notices , motions and other similar documents ; all documentary and tangible evidence tendered at the hearing ; and the final order or decision A transcript of each part of the hearing that was recorded shall be included in the official record as an exhibit , if available at the time the remaining portion of the official record is transmitted to the court If the transcript is not available at that time , it shall e transmitted to the court as soon as reasonably possible after the transcript has been prepared If testimony is taken and not recorded , a narrative summary of any testimony taken shall be prepared and transmitted to the court as an exhibit to the official record 65 Request for Review of Decision A person is entitled to a Review of Decision Any person whose application for a permit under this ordinance is denied , any person whose application for a permit is issued subject to conditions with the applicant deemed unacceptable , any person whose permit is revoked or suspended and any permit against whom a penalty is assessed pursuant to section 5 of this ordinance may seek a review of the decision pursuant to this section 652 A Request for a Review of this decision of the Director must be made within thirty 30 days of the action of the Director for which review is sought The Request for review must set out such additional and further information as the applicant for review as the applicant for review deems appropriate or necessary 653 The Director shall complete his her review within forty - five 45 days of receipt of written Request for Review The Request for Review and any response from the Director in response to the Request for Review may become part of the record in any hearing of the Directors decision 654 The time required in section 64 of this ordinance for a hearing of a final order or decision of the Director is told upon the filing of a Request for Review until such time as a written decision issued by the Director on the Demand for Review 7 Changes to permitting program 71 The County permitting program , as set forth herein , has been established pursuant to authority contained in North Carolina General Statutes , Sections 130A - 317 and 143 - 2151 f and rules promulgated thereunder Amendments to North Carolina General Statutes , Sections 130A - 317 and 143 - 2151 f and rules promulgated thereunder that affect the County permitting program shall be incorporated in to the County permitting program within sixty 60 days of the effective date of such amendments , or as otherwise required by law 8 Requirements for connection to public water and sanitary sewer systems 81 Upon completion of construction or alteration of the water and or sanitary sewer system the applicant shall submit certification , which shall bear the seal of a registered professional engineer licensed to practice in the state , that construction is completed in substantial accordance with approved plans 82 Both the water and sanitary sewer system of any private development will be one hundred percent 100 completed , tested , sterilized and approved for use before any connection to the County systems will be performed 9 Ownership of Mains All mains extended and constructed under this article shall be of such size and material and shall be installed in such manner as contained in the County’s standards All mains so constructed or extended shall be and remain the property of the County Adopted November 6 , 2000 9 Emergency Ambulance Services - Exclusive Convalescent Contract The Board , having postponed this matter last month , again discussed the recommendation fromPagePage pageNumber6341 the Emergency Services Advisory Committee for an exclusive convalescent ambulance service contract in the County with First Health of the Carolinas Terry Heuser with Mid South Transport opposed the idea of an exclusive contract being awarded to First Health , or any other company He noted his company has operated in Johnston County since 1988 , and this would put him out of business He suggested that if there have been complaints with the service that he and Johnston Ambulance Service have provided , someone should have come to them and discussed the matter When he received notice the County was taking bids for exclusive ambulance service , his company responded by asking for continuation of their non - exclusive franchise He suggested the Commissioners should not be determining ambulance service in the County Jeff White with Johnston Ambulance Service stated his company does agree that an exclusive contract would be best for the County , and feels JAS should have that contract In the past , JAS has operated in conjunction with Mid South providing service every other day He noted , in his opinion , this has been a problem and JAS has had to carry the load , taking calls on days when they were not supposed to be responsible He maintained that one service that is guaranteed would be better for the citizens of the County Randy Kerns with First Health pointed out the County can control ambulance service by limiting the term of the exclusive contract and having a quality - of - care clause in the contract Companies can compete for the contract when it comes up for renewal He noted his company operates in Harnett and Chatham Counties , as well as other places in the State They have 62 ambulances and would place seven in the County if they get the contract , at least five of which would be staffed on a regular basis Teams could be called in if needed to man the other two units In response to questions from Board members , Jeremy Beal , EMS Coordinator , explained this attempt to establish an exclusive contract came from complaints from the hospital and care facilities in the County concerning convalescent ambulance service As a result of the problems , people were calling 9 - 1 - 1 and requesting County rescue vehicles to transport patients , which prevented EMS from always being available for the emergency services they are supposed to provide If an exclusive contract is awarded , the EMS office would be monitoring the program Also , the service would be audited and reviewed through the hospital audit review process Following further discussion , Chairman Langdon stated a vote on ambulance service was postponed until Monday , November 13 , 2000 , and noted in the mean time , there would be a group meeting with interested persons to look further at some of the issues of concern th 10 Proclamation - Veterans ’ Day November 11 Upon a motion by Commissioner Eleanor N Creech , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following proclamation P R O C L A M A T I O N - V E T E R A N S D A Y - 2000 th WHEREAS , for decades America has paused on the 11 of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in the United States Constitution and the Bill of Rights ; and WHEREAS , Americans owe a great debt to all those who have served in defense of this nation throughout the generations ; for their sacrifices , often resulting in permanent injury or death , which have preserved our unique form of government dedicated to human right and respect for the individual , and preserved our freedoms and promise of liberty as an example for oppressed persons of the world ; and WHEREAS , in honor of these dedicated men and women , we pledge our continued defense of our nation so that their sacrifice will stand before all the world as a tribute to the spirit and determination of a people dedicated to the principle of freedom and democracy NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim November 11 , 2000 , as “ Veterans Day ” in Johnston County , and urge our citizens to commend its observance th Proclaimed this the 6 day of November , 2000 11 Second Vote - Adelphia Cable TV Franchise On second reading , Commissioner Eleanor N Creech moved the Board approve a cable TV franchise for Adelphia Communications Corporation , the company which is purchasing Benchmark Media , Inc Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote PagePage pageNumber7342 12 Request for Fireworks Display Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved a fireworks display for Christina Hughes at her wedding on December 9 , 2000 behind Banner Chapel Advent Christian Church near Benson Approval was made subject to compliance with NCGS § 14 - 410 , 14 - 415 and Chapter 20 of the Standard Fire Prevention Code , along with the necessary permits from the applicable Inspections Department Chairman Authorized to Approve Fireworks Display Request Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board authorized the Chairman to approve fireworks display requests between Board meetings and report back to the Board 13 Extension of Incentive Subscription Campaigns for Meadow and Elevation Water Districts Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board recessed regular session to sit simultaneously as the Meadow Water District Board and the Elevation Water District Board Sitting as the Meadow Water District Board , Commissioner Jerry F Wood moved the 150 incentive subscription campaign for the Meadow Water District be extended to December 8 , 2000 Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote Sitting as the Elevation Water District Board , Commissioner Cookie Pope moved the Board extend the 150 incentive subscription campaign for Elevation Water District until December 8 , 2000 Commissioner Eleanor N Creech seconded the motion , which carried by unanimous vote Upon a motion by Commissioner Cookie Pope Fee Policy Change Approved Engineer Tim Broome discussed with the Board a proposed change in the Bulk Water Supply Capacity Fee Policy Bulk users currently pay a one - time capacity fee of 200 per gpd based on their estimated usage In order to provide an option for users who exceed their original capacity , he recommended the County establish a 050 per 1,000 gallon commodity surcharge fee for all water used over the original allocation This could be an alternative to purchasing additional capacity or could serve until the bulk user is ready to purchase a larger allocation If approved , he suggested this be implemented with the January billings Kenly Town Manager , Ed Temple , stated he had no problem with this proposed policy change On a related item , however , he suggested the school system , instead of the town , should be responsible for the water used to flush the lines out to the school during the summer months He also requested a meter be installed at the County’s elevated tank to measure overflow so the town will not be overcharged Marla Ashworth , Princeton Town Clerk , voiced concern with the policy being effective in January since it will be difficult to get a true reading on the town’s usage while the Princeton Kenly Water District is under construction Mr Broome agreed and noted the policy should not go into effect for Princeton until the water district Value 500,000 - Reason for Appeal Age and condition of the facilities Recommended Value 1,108,003 reduced in the meeting to 1,010,713 Jerry Young , representing Valero Energy , stated the company purchased the refinery and terminal from Philbro Refining in 1997 The tanks , which were built in 1965 , lack cathodic protection which prevents corrosion As a result , the tanks and underground pipes need extensive repairs , and the rest of the refinery needs to be updated The cost to repair and update the facility would be extremely expensive Efforts have been made to find a buyer , and Valero has been negotiating with a company for several years He requested the value be reduced to the market value of 500,000 In response to a question from Commissioner Allen L Mims , Jr , Mr Young noted the 200,000 gallon storage tanks have been in continuous operation since 1965 Interim Tax Administrator , Jack Williford , stated he visited the site and found some errors were made in valuing the property Staff has reviewed the valuation , corrected the errors and have reduced the recommended value to 1,010,713 He noted the County adopted certain standards for the 1995 revaluation to insure fairness to all property owners Based on those standards , the valuation seems to be fair and equitable when compared with properties of similar use DECISION Commissioner Thomas M Moore moved the based on their belief that in 1995 the County had no properties comparable to Amelia Village by which to establish a value He introduced owner Steve Kenny who stated he is appealing the County’s 47,643 value per apartment unit , maintaining the value should be between 31,915 and 33,968 per unit , based on assessed value , actual cost and comparable properties Mr Kenny introduced appraiser , Duke Boykin , who reviewed with the Board his assessment of the property He suggested a fair value would be 32,802 per unit , based on 29 per sq ft for a total valuation of 6,035,650 Interim Tax Administrator , Jack Williford , stated he too looked at comparables including Manor House , Carolina House and Greenwood Apartments He noted the 2000 valuation of 2,560,650 was based on the percentage of construction that was complete on January 1st and was a fair value in his opinion The value has not been determined for 2001 In response to a question from Commissioner Wade M Stewart , Mr Kenny explained he was not concerned with the 2000 figure , but is concerned with the 100 complete value that was used to find the partial figure In discussion , Mr Williford noted the Tax Department applied the schedule of values they have , but agreed the schedule does not address properties like this He noted this year is an incomplete value , and if the owners can live with this , the Tax Department will look further at the figure for 100 complete Mr Kenny replied that would not be fair to him Following discussion , the Board agreed to postpone a decision on this case until
