10 382 December 11 , 2000 Regularly Scheduled December 4 , 2000 Meeting Postponed due to Inclement Weather The Johnston County Board of Commissioners met in regular session Monday , December 11 , 2000 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Cookie Pope , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , retiring Commissioners Jerry F Wood and Eleanor N Creech , and newly elected Commissioners , Fred J Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The retiring Commissioners sat for the purpose of approving the minutes 1 Minutes - November 6 , 13 , 14 , 20 , 2000 Chairman James H Langdon , Jr asked if there were corrections to the minutes of the November 6 , 13 , 14 , 20 , 2000 board minutes Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the minutes as presented 2 Comments from Commissioner Eleanor N Creech and Commissioner Jerry F Wood Commissioner Eleanor N Creech made the following comments to the Board and the citizens of Johnston County “ As I leave this seat on the Board , I am humble , grateful and thankful for the opportunity to serve the people of Johnston County I have been committed in addressing issues that have enhanced life in Johnston County Johnston County has grown tremendously , and will continue to grow , progressively with the leadership and dedication we are fortunate to have To each of you on this Board , you must be committed to the needs of every citizen You must unselfishly strive to provide a safe and good quality of life Please be ever mindful of those that cannot protect and provide for themselves I have been privileged and honored to work and serve with faithful , dedicated leaders in Johnston County and throughout the State My statement is not what I leave on paper here today , but what I have done through service and commitment ; care and concern for fellow citizens , friends and neighbors here in my beloved home - Johnston County To the citizens of Johnston County - thank you again for this most rewarding experience May God bless each of you ” Commissioner Jerry F Wood also voiced his appreciation to the citizens of Johnston County for the privilege of serving as County Commissioner for the past 12 years He expressed confidence that the new Board will continue to serve the needs of the citizens of Johnston County The Chairman recessed the meeting briefly to seat the new Board members 3 Organization of the Board - Election of Chairman , Vice Chairman and Board Appointments Chairman Langdon turned the meeting over to the vice chairman for the election of chairman of the Board Vice Chairman Cookie Pope called for nominations for Chairman of the Board Commissioner Wade M Stewart moved the Board elect James H Langdon , Jr as chairman of thePage383 Board Commissioner Allen L Mims , Jr seconded the motion There being no further nominations , the Board voted on the motion , which passed unanimously and Commissioner Langdon was elected to serve as chairman for a one year term Chairman Langdon called for nominations for Vice Chairman of the Board Commissioner Allen L Mims , Jr moved the Board elect Commissioner Cookie Pope as vice chairman for a one year term Commissioner Thomas M Moore seconded the motion There being no further nominations , the motion passed by unanimous vote Concerning appointments , Chairman Langdon stated he will continue to serve on the Hospital Board of Trustees and the Firemen’s Association He appointed fellow Commissioners to represent the Board on the following boards and committees Health Board and Heritage Commission - Commissioner Fred J Smith 4 Resolutions of Appreciation Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board adopted the following resolutions of appreciation for retiring Commissioners , Eleanor N Creech and Jerry F Wood Resolution of Appreciation WHEREAS Eleanor N Creech has faithfully served the citizens of Johnston County for thirty - Proposals HAPP Director , Anne Eason , asked the Board for their approval on the following proposals concerning her agency C Change Family Self - Sufficiency Action Board from a combined board with Cooperative Extension to a seven member independent board made up of representatives from the other Human Resources Agencies and a public housing resident Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved HAPP’s proposal to make the Family Self - Sufficiency Action Board an independent seven member board made up of representatives from the other Human Resources Agencies C Authorize application of a 400,000 County CDBG Scattered Site Grant from the NC Department of Commerce , Division of Community Assistance The grant , which the County is eligible for , would be administered by a consultant , and would be supervised by Ms Eason and Finance Officer , John Massey The funds would be used to bring houses in both the municipalities and rural areas up to standard Following discussion , Commissioner Cookie Pope moved the Board authorize the HAPP agency to apply for a 400,000 CDBG Scattered Site Grant from the NC Department of Commerce , Division of Community Assistance , and advertise for a consultant to administer the program Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote C Transfer of 3000 from administrative reserve to Community Action’s Security Deposit Fund to be used for housing security deposits only Ms Eason explained that in the past , the County has received funds which were ear - marked for assisting clients in paying security deposits HAPP contracted with Community Action to implement this program The County no longer receives these funds ; however the agency has been encouraged by HUD to use some of their administrative reserve to assist with other housing problems Her agency wishes to transfer 3000 to the existing Community Action’s Security Deposit revolving fund to be use only for housing security deposits Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board authorized the HAPP agency to transfer 3000 from their administrative reserve to Community Action’s Security Deposit Fund to be used for housing security deposits 10 Award of Contract - 2000 - 2001 Elevated Water Tank Repainting Project The Board considered the following bids received November 17 , 2000 by the Public Utilities Department for surface preparation and repainting of three County elevated water tanks Municipal Tank Coating and Sandblasting , Inc , Hamlet , NC 87,00000 Utility Service Company , Inc , Perry , GA 98,89000 Southern Corrosion , Inc , Roanoke Rapids , NC 143,37000 Carver Tank Company , Inc , Dallas , NC 207,80000 Mr Broome explained the project includes repainting the exteriors of the South Johnston and Bayer tanks , and repainting the interior of the Bethesda tank In response to a question concerning the considerable difference in the highest and lowest bids , Mr Broome stated the high bidder appeared to be concerned about liability to automobiles in the Bayer parking lot PagePage pageNumber5386 He recommended award of contract to low bidder , Municipal Tank Coating and Sandblasting of Hamlet in the amount of 87,000 , and noted funds for this project were budged in the FY 00 - 01 budget Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board awarded the bid to Municipal Tank Coating and Sandblasting of Hamlet in the amount of 87,000 11 Local Water Supply Plan Mr Broome submitted for the Board’s consideration the Local Water Supply Plan , which in accordance with State regulations , the County prepared in 1998 After a lengthy review , the NC Division of Environmental Health , Public Water Supply Branch , has approved the plan He requested the Board officially adopt a resolution approving the plan as presented Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution approving the Local Water Supply Plan RESOLUTION FOR LOCAL WATER SUPPLY PLAN WHEREAS , North Carolina General Statute 143 - 355 1 requires that each unit of local government that provides public water services of plans to provide such services shall , either individually or together with other such units of local government , prepare and submit a local water supply plan ; and WHERE AS , as required by the statute and in the interests of sound local planning , a water supply plan for Johnston County has b een deve loped an d submitted to the Johns ton Coun ty Board of Comm issioners for ap proval ; and WHEREAS , the Johnston County Board of Commissioners finds that the water supply plan is in accordance with the provisions of North Carolina General Statute 143 - 355 1 and that it will provide appropriate guidance for the future develo pment of w ater supplies for Johnsto n County as w ell as useful informa tion to the Department of Environment and Natural Resources for the development of a state water supply plan as required by statute ; NOW , THERE FORE , BE IT RESOL VED by the Johnston County Board of Commissioners that the water supply plan entitled , Johnston County 1997 Local Water Supply Plan dated 9 14 98 is hereby approved and shall be submitted to the Department of Environment and Natural Resources , Division of Water Resources ; and BE IT FURTHER RESOLV ED that the Johnston County Board of Commissioners intends that this plan shall be revised to reflect changes in relevant data and projections at least once every five years or as otherwise requested by the Department , in accordance with the statute and sound planning practice th This the 11 day of December , 2000 12 Award of Bids - J Incorporated , Columbia , SC 557,86045 The Airport Authority has recommended award of contract to McCoy Contracting , Inc , of Princeton , NC in the amount of 449,33680 , with a total project budget of 562,000 Existing Airport capital reserve funds in the amount of 230,000 are available for this project The remaining funds would be a County loan to the Airport Authority at an interest rate of 6 for a period of four years Mr de Sherbinin requested the Board approve the contract subject to the Economic Development Office receiving a letter of credit supporting the requested Industrial Revenue Bonds At the request of Commissioner Allen L Mims , Jr , the Board was shown the plans for the property It was noted the goal was to fit the Environ project on the property in such a way as to allow flexibility in future development of the remaining lots The driveways line up with corresponding drives on Swift Creek Road , and the one driveway on US 70 will allow entrance from the east only with exit traffic being directed down US 70 to a crossover All improvements on Swift Creek , including widening and turn lanes , will be done by DOT The Airport Authority will pay for moving the existing crossover on Hwy 70 PagePage pageNumber6387 Following discussion , Commissioner Thomas M Moore moved the Board concur with the award of bid and approve the following budget amendment in the amount of 562,000 , subject to the receipt of a letter of credit in the Economic Development Office supporting the requested Industrial Revenue Bonds Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote Department Airport - New Policy Approved In order to make County government more efficient , Interim Tax Administrator , Jack Williford , recommended the Board consider taking action on the following two issues , which are allowed by the NC General Statutes C Authorize the Finance Officer , County Attorney or County Manager , at the recommendation of the Tax Administrator , to approve tax releases and refunds under 100 , with a monthly report to the Board This would cut down on the number of releases refunds that would come to the Board each month C Authorize the Tax Office to waive tax bills of less than an amount , not to exceed 5 The Board would determine the amount , which he noted in his experience is usually from 2 to 4 He noted it is not worth the cost of preparation and mailing on very small amounts In response to a comment from Commissioner Wade M Stewart , Mr Williford noted this would only pertain to initial bills , not partial payments Following discussion , Commissioner Fred J Smith moved the Board , effective January 1 , 2001 , authorize the Tax Department to waive tax bills under five dollars 5 and authorize the Finance Officer , on the recommendation of the Tax Administrator , to approve releases and refunds under one hundred dollars 100 , with a monthly report to the Board of Commissioners Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote Tax Releases and Refunds for 10 27 00 to 11 20 00 Approved Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board approved the tax releases and refunds as presented Motor Vehicle -
