10 418 January 2 , 2001 The Johnston County Board of Commissioners met in regular session Tuesday , January 2 , 2001 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Cookie Pope , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Fred J Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer th 1 Minutes - December 11 , 2001 Dec 4 Postponed Meeting and Regular Scheduled Meeting Chairman James H Langdon , Jr asked if there were corrections to the minutes of the December 11 , 2000 board meetings December 4 , 2000 postponed meeting and December 11 , 2000 regular meeting Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ray Woodall and carried by unanimous vote , the Board approved the minutes as presented 2 Public Comment - No one spoke during public comment 3 Department of Transportation - Additions to System The Board reviewed a petition presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Charter Oak Drive and Cambridge Elm Drive in Weston Woods PUD subdivision , Cleveland Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to add the roads listed above to the State Maintained System Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 4 Request to Close Portion of Lee Road at Intersection of Barber Mill Road Commissioner Thomas M Moore informed the Board the Department of Transportation is requesting the Commissioners change their motion of November 6 , 2000 in which they concurred with the DOT in closing a portion of Lee Road at the intersection of Barber Mill Road , and make the motion a formal request for this road to be closed Following discussion , Commissioner Thomas M Moore moved the Board rescind the previous motion on November 6 , 2000 and further moved the Board adopt the following resolution RESOLUTION WHEREAS The Johnston County Board of Commissioners are cognizant of the traffic safety hazards and the accident history at the intersection of Barber Mill and Lee Roads ; and WHEREAS The County wishes to see an improvement to the traffic safety at this intersection NOW , THEREFORE , the Johnston County Board of Commissioners do hereby request the North Carolina Department of Transportation to close this intersection by abandoning the 500 feet section of Lee Road nd Adopted this 2 day of January , 2001 Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote Commissioners Allen Mims and Cookie Pope noted they questioned whether a hearing should be held prior to this motion in November , but were assured by DOT that the people on the road favored the closing , and this would not impact fire and rescue efforts Reference Minutes of November 6 , 2000 - Book 22 , page 338 - Item 7 - A Page419 5 Public Hearing - Road Name Change - Truck Stop Road - Continued from December 11 , 2000 The Chairman recommended the hearing be continued since the County has still not heard from the NC Department of Transportation concerning this matter 6 Moratorium on Road Name Changes Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board placed a one year moratorium on road name changes 7 MIS - Presentation on New Web Site MIS Director , Leslie Stanfield , gave a brief presentation on the new County website that is under development She noted the new site will be customer oriented and will open up new opportunities for dealing with County agencies through the web She introduced Ellen Beck from her department who is the new web master for the County Ms Stanfield stated the new site will allow citizens to access information through four different channels depending on their needs as either citizens , businesses , visitors or children The goals in developing the site were to provide citizens easy access for both information and services By opening up two way communication and providing self service in many areas , including the ability to apply for permits and submit payments , the web will offer an alternative to coming to the courthouse for many It is hoped the new site will be ready for the public sometime in February The Board thanked Ms Stanfield for what she is doing in helping meet the Board’s challenge to make government more customer oriented , friendly and helpful to its citizens 8 Presentation on Old Health Department Building Architect Wesley Coble reviewed with the Board his evaluation of the old Health Department building He noted he looked at the facility from an architectural standpoint , and considered environmental and safety issues as well as accessibility requirements The roof has been replaced recently , however , there is water damage to the ceiling tiles and carpet which would need to be addressed The Heating AC system also needs upgrading He estimated the construction cost to renovate the 10,940 sq ft building for office space at 556,000 In response to Commissioner Wade M Stewart , he stated , in his opinion , the building is structurally sound and worth saving Commissioner Thomas M Moore asked if it would be more energy efficient to replace the old windows Mr Coble offered to check further into that matter Commissioner Fred J Smith suggested the Board consider whether it is an effective and efficient use of taxpayers ’ money to renovate an old building rather than build a new one He noted that even after renovation , the building would still be an old building with potential for problems in the future Chairman Langdon agreed , but pointed out the County needs office space now , which was the reason this analysis was done Hopefully this information will help the Board make a better decision on how to address this problem 9 Request for Refund of Excise Tax The Board considered a request from Attorney Eva F Stein for a refund of excise tax , in the amount of 126 , that was paid in error In filing a deed , Ms Stein’s office gave the County the wrong transfer price for a home Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board authorized the refund of excise tax in the amount of 126 to Attorney Eva F Stein , for excise paid in error Page420 10 FY 2002 Community Transportation Program CTP Grant Applications - ETJ Members Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board appointed Gene Sullivan and Bob Harvey as ETJ regular members to the Pine Level Planning Board , as recommended by the Pine Level Board of Commissioners Town of Selma Board of Adjustment and Planning Boards - ETJ Members Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board made the following appointments , as recommended by the Selma Town Council C Linda Bailey to the Selma Board of Adjustment as an ETJ alternate member for a 3 year term to expire 11 01 03 C Betty Barnes to the Selma Planning Board as ETJ member for 3 year term to expire 11 01 03 13 Water Treatment Plant Improvements Engineer Tim Broome requested the Board approve , without bidding the project , the purchase from CB & I - Walker of a third ClariCone unit , identical in size , configuration and operation as the two existing units at the County Water Treatment Plant Mr Broome stated it is essential to the integrity of the plant operation to install an identical unit , and this is the only manufacturer that can provide this When there is a sole source for a product , the General Statutes allow an exemption from the bidding process requirements He noted he has obtained comparable pricing for similar products and feels the purchase price from CB & I Walker for the ClariCone unit and installation at a cost of 298,500 is fair and reasonable Following discussion , Commissioner Wade M Stewart moved the Board approve the purchase , without bidding , of a ClariCone unit for the County Water Treatment Plant from CB & I Walker at a cost of 298,500 , based on the “ sole source ” allowance in the General Statutes Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 14 Amendment to County Development Ordinance - Article 9 - Stormwater Management Tim Broome explained the County has revised the portion of the development ordinance that deals with Stormwater Management Article 9 in accordance with the requirements under the Neuse River Nutrient Sensitive Strategy The Commissioners held a public hearing on May 1 , 2000 and reviewed the proposed amendment prior to sending it to the State for their approval On December 13 , 2000 , the Environmental Management Commission gave their approval to the County’s Stormwater Program He requested the Board officially approve the revised document and amend the County Development Ordinance replacing the existing Article 9 with the proposed amended Article 9 , effective March 9 , 2001 Mr Broome and Marty Anderson , Stormwater Manager for the County , offered to answer any questions the Board might have Commissioner Fred J Smith asked for clarification on the use of stormwater fees and payments Mr Broome explained that fees in - lieu on impervious acreage at 10,000 per acre are placed in a special account for the land dedication program Payments made to offset an excess level of nitrogen go to the State At present there has been no determination where that money will be spent , and staff would like to see State elected officials take an interest in making sure it is spent correctly He noted he would keep the Board informed and let them know if there is anything they can do to help Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the amendment to the County Development Ordinance , Article 9 -
