10 442 February 5 , 2001 The Johnston County Board of Commissioners met in regular session Monday , February 5 , 2001 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Cookie Pope , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Fred J Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , and Mark Payne , County Attorney 1 Minutes - January 2 , 8 , 2001 Meetings Chairman James H Langdon , Jr asked if there were corrections to the minutes of the January 2 , 8 , 2001 board meetings Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ray Woodall and carried by unanimous vote , the Board approved the minutes as presented Public Comment - No one spoke during public comment 2 Department of Transportation - Additions to System The Board reviewed a petition presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Creekstone Drive , Beaver Ridge Way , Sunrise Circle , Willmack Drive , Bay Meadow Lane , Valley View Way and Lazy Branch Drive in Creekstone Subdivision , Pleasant Grove Township Following review , Commissioner Ray Woodall moved the Board concur with the NC Department of Transportations request to add the roads listed above to the State Maintained System Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote The Board then reviewed another petition requesting the following roads be added to the State System Raymond Drive , Freezor Court , Trantham Trail , Linwood Lane , and Marcellus Way in Riverwood Subdivision , Wilders Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportation’s request to add the roads listed above to the State Maintained System Commissioner Ray Woodall seconded the motion , which carried by the following vote Ayes James H Langdon , Jr , Cookie Pope , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart and W Ray Woodall NaysNone Abstaining Fred Smith 3 Recreation Grant Program Revisions Commissioner Allen L Mims , Jr reviewed with the Board a proposed policy to restructure the recreation grant program He explained the recreation grant committee , which was appointed some time ago by the Chairman , met with several municipal and recreation foundation directors in the County to look at ways to improve the program The proposed policy would provide for large , medium and small grants with varying match requirements He noted the committee would like public input on their proposal Randy Pace , representing Corinth Holder Recreation Committee , commented that if priority is given to municipalities and programs where only large numbers of citizens are served , then small communities like Corinth Holder would never have an opportunity to compete , especially for the larger grants He noted the County grants are the sole support for small communities since they are not eligible for any state grants , and missing out on this money would be critical for them He also asked if this would affect the policy on ball field lighting that was put into effect several years ago , which stated the County would participate in upgrading school ball field lighting on a basis of County 40 , town or community 40 and Board of Education 20 Page443 Commissioner Mims responded the larger grants might go to higher growth areas at first since one of the criteria would be the ability to pay the required match , but the policy also indicates the screening committee would consider locality to make sure the entire County is represented He noted he did not feel this policy would affect the existing policy concerning ball field lighting Jeff Hamilton from Archer’s Lodge stated his community has used the fire department facility for years for recreation Because of the growth in the area , however , they are now going to have to build a community building and will need some help He asked that the committee consider smaller unincorporated communities when awarding the large grants Commissioner Fred J Smith pointed out the towns do have tax revenue to help support their programs , which communities like Corinth Holder and Archer’s Lodge do not have He suggested that fact be kept in mind when this policy is implemented Commissioner Mims agreed , but noted the town people also pay County taxes , and towns are providing recreation facilities for many people who live outside their city limits Larry Bailey , Parks and Recreation Director for the Town of Clayton , spoke on behalf of several town parks & recreation directors who were present He noted the municipalities in many cases serve more out - of - town participants than people who live within their town limits He thanked the Board for re - evaluating the recreation grant program and considering different size grants Lumus Woodard with the Clayton Civitan stated the County’s 2000 matching grants have been very helpful over the years since his club has been supporting recreation programs He stressed the need to keep these smaller grants available Larger grants would be nice , but the main issue with all the growth in the area is the need for additional funding Commissioner Fred Smith suggested the Board consider setting aside a percentage of the budget for recreation , which would grow as the budget grows from year to year Commissioner Allen L Mims , Jr noted that having applications presented prior to the budget will indicate how much should be allocated each year Commissioner Wade M Stewart thanked the people throughout the County who are providing recreation opportunities He stated he would like to see a united effort between the schools and the communities when new schools are built to make sure community needs are met He pointed out when looking at school sites , it might be wise to purchase additional land for future recreational needs In discussion it was noted this concept of community and school cooperation is already working in several other counties Commissioner Thomas M Moore suggested the open space committee should look at this possibility and work with schools and communities Motion Following discussion , Commissioner Wade M Stewart moved the Board adopt the proposal as presented with the understanding that changes can be made if needed once the program is implemented Commissioner Thomas M Moore seconded the motion Further Discussion Cecil Stancil from the Glendale Community asked the Board to keep in mind that not all communities have school facilities to depend on , and not all recreation needs are for youth He asked the Board to remember the senior citizens who need senior centers Mike Walters from the Town of Pine Level noted that some communities submitted their grant applications late this year and were not funded He asked the Board to consider those communities as it would be very difficult to go another year without some help Dale Bender , Special Olympics Coordinator , thanked the Board for their help She also thanked the school system and community organizations for the use of their facilities for her program Page444 Board members discussed funding options for recreation and agreed this needs further discussion at the upcoming Board retreat Terry Stephenson with the Cleveland Athletic Association noted that funding is critical He stated his area is growing so fast the Association is struggling to find facilities The 2000 grants have been great , but more money is needed in order to provide recreation to the citizens Mark Johnson from Princeton stated his community has been supporting baseball for years and has provided fields , which the schools use He asked the Board not to forget areas like Princeton Vote The motion passed by unanimous vote The Chairman thanked everyone for their comments and noted the Board will provide as much support as possible The goal is to make things better 4 Public Hearing - 11 00 am - Community Development Block Grant - Economic Development CDBG - ED - Close Out for Midstate Mills Advertised Jan 19 , 2001 - The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the County’s CDBG - ED Midstate Mills project Economic Development Director , Michael de Sherbinin , informed the Board this is the last public hearing on the Community Development Block Grant for providing water , wastewater and fire protection for Wilson’s Mills Midstate Flour facility The 120,000 grant was awarded based on the project creating 15 additional jobs and meeting the low income benefit requirement of at least 60 There being no further comments , the Chairman closed the public hearing 5 State ADM Funds Designated for School Projects Dr Jim Causby , Superintendent of Schools explained that ADM funds are state money that comes through the County and require County Board approval before being used Usually this money is used to finish projects that run short of funds He requested the Board approve the designation of State ADM funds in the amount of 177,700 for South Smithfield Primary School addition project , and an additional 367,000 for Smithfield - Selma High School project Commissioner Fred Smith moved the Board approve the use of ADM funds as requested by the Board of Education Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 6 Award of Contract - Scattered Site CDBG Administrator HAPP Director , Anne Eason , informed the Board she received proposals for administering the Scattered Site CDBG , and recommended award of contract to Holland Consulting Planners , Inc of Wilmington , NC in an amount not to exceed 51,508 In response to a question from Commissioner Fred Smith , Ms Eason explained the Scattered Site project will rehabilitate approximately 15 homes throughout the County that need major repair , which the owners can not afford to make The grant includes funds to pay for the administrator who will handle securing the workers and take all responsibility , including the necessary legal work No County match is required Commissioner Cookie Pope asked if local contractors will be given a chance to do this work Ms Eason stated that local people will certainly have an opportunity to bid on all contracts She noted no one from the County submitted a proposal for administrator Following further discussion , Commissioner Wade M Stewart moved the Board approve the contract for administering the Scattered Site CDBG to Holland Consulting Planners , Inc in an amount not to exceed 51,508 Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Page445 7 Public Hearing - 11 15 am - CDBG Scattered Site Funding Application Advertised Jan 23 , 2001 in The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on determining priorities for community development and housing needs of the County Jesse Myers with Holland Consulting Planners , stated this hearing is the first of two required hearings in order to apply for a Community Development Block Grant She reviewed the procedures for obtaining a scattered site grant and noted the houses to be rehabilitated are not identified until after the County receives the grant agreement The houses chosen will be based on owner income and will all be owner occupied This program is not for minor repairs or remodeling , but will be used for houses in need of major , plumbing , electrical , heating airconditioning and or structural repair In response to a question from Commissioner Fred Smith , Ms Myers stated that owners must sign a deed of trust or promissory note before this work is done , and they can not sell their houses for a number of years afterwards If they do not sell , they will not have to repay the money If they sell within the time period , they would have to reimburse the County a prorated amount of the funds used on their repairs There being no further comments , the Chairman closed the public hearing 8 Criminal Justice Partnership Advisory Board - Request for Approval of State Grant Renewal Joy Jones , chair of the Criminal Justice Partnership CJP Advisory Board , requested the Commissioners authorize her committee to apply for Continuation of Implementation Funding from the NC Department of Correction to keep the Criminal Justice Partnership program active in the County It was noted this will be the third year for the program that rehabilitates and educates adult probationers Ms Jones thanked Commissioner Pope , who serves on the CJP board , for her support Following discussion , Commissioner Allen L Mims , Jr moved the Board authorize the CJP Advisory Board to make application for continuation of implementation funding from the NC Department of Corrections Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 9 Tax Request - Appeal on Penalties and Interest on Tax Discovery Interim Tax Administrator , Jack Williford , informed the Board that J Mark Williams with Jerry G Williams & Sons , Inc is appealing the penalties on a tax discovery of additional property taxes for his business The discovery was based on incorrect recording that was unintended on the part of the company The Company has paid the taxes due , but is asking the Board to compromise the penalty and associated interest on the penalty Commissioner Fred Smith questioned the wisdom of not charging any interest on a tax discovery as it would seem to be an incentive for people to under report and wait to see if a discovery is made The Board agreed to discuss this matter further at their upcoming retreat Following further discussion , Commissioner Thomas M Moore moved the Board compromise the penalty and associated interest on the penalty of a tax discovery for Jerry G Williams & Sons , Inc Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote 10 Report on Delinquent Taxes for Year 2000 Mr Williford presented a report to the Board on delinquent taxes for 2000 He noted to date there is a total of 15,989,30969 in taxes and 320,000 in interest owed the County in delinquent taxes He asked the Board to set the month of March to advertise these taxes due In response to a question from Commissioner W Ray Woodall , Mr Williford stated the tax collection rate is approximately 94 in Johnston County The reason it is not higher is because of the problem with collecting motor vehicle taxes Upon a motion by Commissioner Fred Smith , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board accepted the delinquent tax report from the Tax Department and set the month of March 2001 to advertise delinquent taxes in the County PagePage pageNumber5446 11 Resolution Authorizing Issuance and Sale of 3,774,000 GO Water Bonds for Archer’s Lodge Water District Upon a motion by Commissioner Fred Smith , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board recessed regular session to sit as the Archer’s Lodge Water District Board The following resolution was discussed and its title was read RESOLUTION AUTHORIZING THE ISSUANCE AND SALE OF 3,774,000 GENERAL OBLIGATION WATER BONDS OF THE ARCHER’S LODGE WATER DISTRICT OF JOHNSTON COUNTY , NORTH CAROLINA , PURSUANT TO A BOND ORDER HERETOFORE APPROVED AND PROVIDING FOR THE FORM , DETAILS AND PAYMENT THEREOF WHEREAS , the Bond Order hereinafter described was authorized and adopted by the Board of Commissioners of Johnston County the “ Board ” , acting as the governing body of the Archer’s Lodge Water District of Johnston County the “ District ” on June 8 , 1998 , and approved by a majority of the qualified voters of the District voting thereon at a referendum held on August 4 , 1998 ; and WHEREAS , the Board desires to provide for the issuance of 3,774,000 in general obligation water bonds , in part , to refund anticipation notes in the amount of 3,774,000 previously issued to finance the acquisition , construction and equipping of a water system in the District pursuant to said Bond Order ; NOW , THEREFORE , the Board of Commissioners of Johnston County , acting as the governing body of the Archer’s Lodge Water District of Johnston County , meeting in regular session in Smithfield , North Carolina , on February 5 , 2001 , does the following BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR JOHNSTON COUNTY , ACTING AS THE GOVERNING BODY OF THE ARCHER’S LODGE WATER DISTRICT OF JOHNSTON COUNTY , NORTH CAROLINA 1 The District shall issue its general obligation water bonds in an aggregate principal amount of 3,774,000 pursuant to and in accordance with the Bond Order entitled BOND ORDER AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OF THE ARCHER’S LODGE WATER DISTRICT IN THE MAXIMUM AGGREGATE PRINCIPAL deliver in exchange , a new bond or bonds having an equal aggregate principal amount , in authorized denominations , of the same form and maturity , bearing interest at the same rate , and registered in names as requested by the then registered owner or exchange shall be at the expense of the District , except that the District may charge the person requesting such exchange the amount of any tax or other governmental charge required to be paid with respect thereto The District shall treat the registered owner as the person exclusively entitled to payment of principal and interest and the exercise of all other rights and powers of the owner , except that interest payments shall be made to the person shown as owner on the registration books on the fifteenth day of the month preceding each interest payment date 8 The LGC is hereby requested to sell said Water Bonds to the United States of America by private sale on February 20 , 2001 9 The Board covenants on behalf of the District that so long as any of the installments of principal and interest on the Bonds are outstanding and unpaid , the District shall not take or omit to take any action the taking or omission of which will cause the Bonds to be “ arbitrage bonds ” within the meaning of Section 148 of the Internal Revenue Code of 1986 , as amended the “ Code ” , or otherwise cause interest on the Bonds to be includable in the gross income of the holders thereof , including the calculation and payment of such rebate amounts , if any , as may be required by the code 10 The Board hereby covenants that it will not facility ” other than a facility for the furnishing of water , within the meaning of Section 141 b 4 of the Code , or c 5 or more of such proceeds being considered as having been used directly or indirectly to make or finance loans to any person other than a governmental unit as provided in Section 141 c of the Code ; provided , however , that if the Board receives an opinion of bond counsel acceptable to the registered owners of the Bonds that any such restriction is not required to prevent the interest on the Bonds from being includable in the gross income of the registered owners thereof under existing statutes , the Board need not comply with such restriction 11 The Bonds are hereby designated as “ qualified tax - exempt obligations ” for purposes of Section 265 b 3 of the Code a The Board will in no event designate more than 10,000,000 of obligations as qualified tax - exempt obligations in 2001 , including the Bonds , for the purpose of such Section 265 b 3 ; b The District and all its “ subordinate entities ” within the meaning of Section 265 b 3 of the Code have not issued more than 10,000,000 of tax - exempt obligations in 2001 not including “ private would , when aggregated with all other tax - exempt obligations theretofore issued in 2001 by the District and such subordinate entities , result in the District and such subordinate entities having issued a combined total of more than 10,000,000 of tax - exempt obligations in 2001 not including private activity bonds other than qualified 501 c 3 bonds , including the Bonds ; and d The Board has no reason to believe that the District and such subordinate entities will issue tax - exempt obligations in 2001 in an aggregate amount that will exceed such 10,000,000 limit ; provided , however , that if the Board receives an opinion of bond counsel acceptable to the registered owners of the Bonds that compliance with any restriction set forth in b or c above is not required for the Bonds to be qualified tax - exempt obligations , the Board need not comply with such restriction 12 The Chairman and the Clerk are hereby authorized and directed to take all proper steps to have the Bonds 2001 , by and between JOHNSTON COUNTY , NORTH CAROLINA , a body corporate and politic and a political subdivision of the State of North Carolina the “ County ” , and the TOWN OF CLAYTON , NORTH CAROLINA , a body corporate and politic and a political subdivision of the State of North Carolina the “ Town ” collectively , the “ Parties ” ; WITNESSETH WHEREAS , the County owns and operates the Central Johnston County Regional Wastewater Treatment Facility the “ Facility ” , which discharges into the Neuse River under NPDES Permit No NC0030716 ; and WHEREAS , the County has obtained an Authorization to Construct an 049 million gallons per day “ mgd ” expansion of the Facility from the Division of Water Quality , North Carolina Department of Environment and Natural Resources ; and WHEREAS , the Town has need for and has requested an additional capacity allocation of 0075 mgd in the expanded Facility ; and WHEREAS , the County has agreed to provide the Town with an additional capacity allocation of 0075 mgd in the expanded Facility , subject to the terms and conditions of this Agreement NOW THEREFORE , in consideration of the foregoing agreement and mutual covenants and benefits contained herein , and for other good and valuable consideration , the receipt and sufficiency of which are hereby acknowledged , the Parties agree and covenant as follows 1 The County shall construct the authorized 049 mgd upgrade and expansion of the Facility on an expeditious schedule 2 The County shall reserve for the exclusive use of the Town a wastewater treatment capacity allocation in the expanded Facility in the amount of 0075 mgd in addition to any wastewater treatment capacity allocated to the Town under any existing contracts , agreements or arrangements , or under general law Said allocation shall be available to the Town for its use following start - up and successful operation of the planned upgrade and expansion of the Facility 3 The County shall transport the 0075 mgd of wastewater referenced in Paragraph 2 of this Agreement from the Town’s utility service area to the Facility by diversion through the County’s Bayer wastewater pump station and 12 force main 4 The County shall allocate an additional 0175 mgd of wastewater treatment capacity in the Facility in addition to the wastewater treatment capacity referenced in Paragraph 2 of this Agreement , subject to the approval of the North Carolina Department of Environment and Natural Resources Division of Water Quality “ DWQ ” , and the County’s receipt from DWQ of Authorization to Construct aPage3454 subsequent planned upgrade and expansion of the Facility The terms of the agreement for the 0175 mgd wastewater treatment capacity allocation referenced in this Paragraph 4 shall be similar or equal to the terms provided for in Paragraphs 2 - 3 of this Agreement , and shall be confirmed only upon execution of an amendment to this Agreement 5 The Town shall reimburse the County for the pro rata cost of the 0075 mgd capacity referenced in Paragraphs 2 - 3 of this Agreement The Town’s pro rata cost shall be calculated based on the following formula Pro rata cost for 0075 mgd capacity Total plant expansion & upgrade cost - 1,500,000 State Grant x 0075 mgd 49 mgd Total plant expansion and upgrade cost shall include construction cost , engineering services cost , permitting cost , administrative cost , and SRF loan closing cost for of the 049 mgd upgrade and expansion of the Facility The Town shall pay the County 50 of the Town’s estimated pro rata cost prior to the County’s awarding a construction contract for the upgrade and expansion of the Facility One - half of the remaining balance of the Town’s pro rata cost shall be paid when the construction project is 75 complete The final payment shall be made when construction is 95 complete 6 The County shall charge the Town a bulk rate for wastewater transmission and treatment under this Agreement equal to the rate the County charges other bulk wastewater users The Town’s wastewater shall be metered through the Bayer force main meter , and the County shall bill the Town on a monthly basis The Town shall pay the County all amounts due under this Paragraph 6 within twenty - five 25 thirty 30 days from receipt of the County’s monthly bill 7 Upon the mutual agreement of the parties , the County may temporarily discharge wastewater into the Town’s wastewater treatment system in connection with a capacity or flow reconciliation For any amount of wastewater discharged by the County into the Town’s wastewater treatment system , the Town shall charge the County the same cost per 1,000 gallons as the County charges the Town pursuant to Paragraph 6 of this Agreement 8 The term of this Agreement shall be thirty 30 years , unless sooner terminated or modified as provided herein This Agreement shall be automatically renewable in unlimited one 1 year increments unless either party requests the Agreement to be terminated upon at least one 1 year’s advance written notice 9 The County’s Board of Commissioners shall review this Agreement and by resolution adopt this Agreement to remain in full
