- 24 2001 Meetings Chairman James H Langdon , Jr asked if there were corrections to the minutes of the February 5 , 12 , 15 , 23 - 24 , 2001 board meetings Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ray Woodall and carried by unanimous vote , the Board approved the minutes as presented Public Comment - No one spoke during public comment 2 Department of Transportation - Additions to System The Board reviewed a petition presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Marianna Place , Christine Drive , Sumpter Drive , Mary Lane , Laura Lane , Alice Drive and Louise Drive in Lancaster Place Subdivision , Cleveland Township Drew Drive , Zachary Way , Charlotte Drive and Kodi Court in South Hills Subdivision , Cleveland Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to add the roads listed above to the State Maintained System Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 3 Refund of Excise Tax Approved Attorney Joseph M Kosko has requested a refund of excise tax in the amount of 50 , which was paid in error to Johnston County for papers that should have been recorded in Nash County Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board authorized the refund of excise tax in the amount of 50 to Attorney Joseph M Kosko , for tax paid in error 4 Recreation Grant - Change in Project Commissioner Fred J Smith moved the Board approve a request for a change in recreation grant project for the Clayton High School Comet Booster Club to include the repair to the turf on the soccer , softball and baseball fields Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Commissioner Allen L Mims , Jr stated he had no problem approving this request ; however , he did point out that several grant applications were denied last year because they came in too late 5 Surplus Property - Sheriff’s Vehicles Sheriff Steve Bizzell requested the Board declare the following vehicles surplus and authorize they be sold at public auction on May 19 , 2001 at the City of Raleigh’s surplus property sale held by Wester Auction & Realty at 4120 New listed vehicles surplus and authorized they be sold by Wester Auction and Realty at public auction on May 19 , 2001 at the City of Raleigh’s surplus property sale at 4120 New Bern Avenue , Raleigh , NC 6 Sheriff Authorized to Order Vehicles for 2001 - 2002 Upon a motion by Commissioner Fred J Smith , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board authorized the Sheriff to order the following vehicles , to be delivered after July 1 , 2001 and paid for in the Sheriff’s 2001 - 2002 budget Eighteen 2001 Crown Victorias at a cost of 19,63717 for a total of 353,469 and one 2001 Ford F - 150 truck for the Animal Control Division at a cost of 18,041 , for a grand total of 371,510 7 County to Seek Informal Quotes for Gasoline Commissioner Wade M Stewart stated he would like to see the County seek informal bids for providing gasoline for County vehicles He pointed out the need to give everyone an equal opportunity to provide this service , and at the same time get the best price for the County Other Board members agreed , and staff was instructed to pursue this immediately 8 Public Hearing - 10 15 am - CDBG - Scattered Site Funding Advertised February 16 , 2001 - The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the County’s intent to apply for a CDBG Scattered Site Grant of approximately 400,000 to undertake improvements to substandard housing within the County Jessie Myers with Holland Consulting Planners , who would administer the grant , briefly reviewed with the Board a proposed citizen participation plan She noted the approximately 12 to 15 units to be rehabilitated would be determined based on a number of factors Consideration will be given to the elderly , the disabled , large families , and wage earners with dependent children Other factors will include rehabilitation needs and income , which must be 50 of the median county income or less All rehabilitation work will be in accordance with CDBG standards In response to comments from Commissioner Ray Woodall about the amount of money to be spent on so few houses , Ms Myers pointed out these homes are traditionally in very poor condition needing costly repairs According to recent studies , in order to get these residences fully to state standards , it is costing between 22,000 and 28,000 per unit A title opinion and deed of trust is recorded , and if the owners sell the property or refinance within a certain number of years , they must repay the County for a prorated portion of the funds expended Commissioner Fred Smith stated he would have preferred to see these federal funds made available to the County through one of the other existing housing programs so that it could benefit more people ; however , since the option is to either accept it the way it is structured or lose the funds and consequently hurt 12 to 15 families , he would support it Other Board members agreed and stated these concerns need to be made known to our Congressmen in Washington There being no further comments , the Chairman closed the public hearing Page481 9 Public Hearing - Johnston County Cable TV Franchise Advertised - 2 16 01 , 2 23 01 in The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the County’s intent to revoke Johnston County Cable’s franchise to operate cable service in Johnston County Janice Roach , who lives in Riverwood Subdivision , stated she recently moved to the area She has contacted Johnston County Cable a number of times about her poor cable service and has always had to talk to personnel at the Maryland office She noted she wrote a letter and a man did come to her house ; however , he arrived with no equipment to fix the problem , and never returned The company only gives a deduction on their bill when service is down for 24 hours Unfortunately , no compensation is made for the numerous short term outages that happen on a regular , almost daily basis She noted she has a satellite dish , which was on the house when she moved there ; however she prefers cable and would like to get what she is paying for Nancy Ruffner , who lives on South Shiloh Road in Cleveland Township , stated she too has not been able to get a local response , reaching only the Maryland office Even though they are polite , nothing gets done , and the service is constantly going down She noted most people in her neighborhood have become disgusted and purchased satellite dishes , however , she prefers cable She stated she is not getting what she is paying for from Johnston County Cable Paul Hirtle , who lives in the Cleveland Community at 303 James Place , stated he , too , has had problems with Johnston County Cable , and is disappointed that the company is not only failing to provide good service now , they apparently have no plans to move forward in technology He suggested the future for all cable companies is in providing high - speed access to the internet , and the franchise needs to have foresight enough to plan for the future by providing cable modem capability Chairman James H Langdon , Jr stated he is a personal customer of Johnston County Cable and has experienced numerous problems relating to quality and service Cable boxes have been left open with cable running across people’s yards and driveways Roy Hayes , president of Bay Cable , the parent company that owns Johnston County Cable , admitted his company has some service issues He maintained , however , that the problems have been made more difficult by the construction of water lines by McMahan Pipeline Construction , who in laying pipe cut many of their cable lines During the water line construction , cable service calls went from approximately 300 per month to around 1600 per month The Company suffered huge loses Chairman Langdon stated the water lines were built in his community , and he was aware of the problems the cable company was having ; however , the phone company did not seem to have the same problems He suggested Johnston County Cable’s problems began long before the water lines were built , and obviously the construction company was giving the legal amount of notification required or Johnston County Cable would have them in court He stressed that if JC Cable wants to be in business in Johnston County , they must provide the service Commissioner Wade M Stewart noted that water lines were being built all over the County , mostly by McMahan Company , and other cable companies did not have a problem Mr Hayes pointed out the majority of the water line construction was in JC Cable’s areas , and Sprint has indicated they had some damage also He went on to mention that the cable system they purchased from Channel Master is 100 underground , and one of their problems is that the system they bought is not the system they thought they were getting He stressed that he took full responsibility for not checking out the full facts before he bought the company , but the fact is they have had to spend an incredible amount of money to correct the problems He noted his company at present is in a reassessment mode - looking at where they are and trying to get over last year At present they have no plans to upgrade their system to include internet access Commissioner Fred J Smith informed Mr Hayes that making excuses and blaming others was unacceptable The bottom line is that Johnston County Cable is charging people for a service that they are not providing He maintained if the company plans to keep their franchise , they need to live up to the standard , provide good cable service , and quit ignoring the citizens ’ complaints Page482 Commissioner Smith , developer of Riverwood Subdivision , went on to say the cable company started out providing pretty good service in the early phases of his development ; now , as later phases are built and the home buyers have been told that cable is available , the cable company is saying they have no plans to expand and are telling customers they should purchase a satellite dish He asked what plans JC Cable has for capital expansion Mr Hayes responded he did not know that his people were saying this , however the company is doing all they can at this time trying to deal with the problems they have They are spending money to make corrections to the existing system , and at present , they have no plans to expand Commissioner Cookie Pope stated she has had more complaints about Johnston County Cable than any other issue since she has been a Commissioner She noted people would rather have cable than a satellite dish , however , they want service and quality cable vision Commissioner Allen L Mims , Jr suggested that if JC Cable is not going to give the citizens their money’s worth in service , and if they can not pay their franchise fees in a timely way , they should sell out to someone with enough capital to do it right Chairman Langdon stated he would appoint a committee of Commissioners to work with staff to determine what steps need to be taken There being no further comments , he closed the public hearing Committee Appointed to Study Issues Concerning Johnston County Cable Company The Chairman appointed Commissioners Cookie Pope , Ray Woodall and himself to work with staff on this matter Attorney Mark Payne suggested the committee might have a stakeholders meeting to listen to other customer complaints before bringing a report with recommendations back to the Commissioners at next month’s meeting 10 Tax Foreclosure Policy Adopted Attorney Mark Payne discussed with the Board their recent comments about the need for a more aggressive policy for collecting taxes , including foreclosures He offered a draft Tax Foreclosure Policy that would provide staff with clear , concise foreclosure procedures , including the authorization for him to act as tax attorney or to associate other attorneys for this work In response to comments from Board members , Mr Payne explained that in the past nine or ten years , the County has not been aggressive on foreclosure when other enforcement , such as garnishment and bank attachment , has not worked Interim Tax Administrator , Jack Williford , explained that most of the cases are situations where property has been left through an estate to multiple beneficiaries , and no one has taken the responsibility to pay the taxes These properties need to be foreclosed on and sold to get them back on the tax books He praised the Tax staff and pointed out they have done a good job in the past in using other tools such as garnishment and bank attachments ; however foreclosure needs to be added to the process Following further discussion , Commissioner Fred J Smith moved the Board adopt the following policy Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote JOHNSTON COUNTY TAX FORECLOSURE POLICY It is the policy of Johnston County to provide governmental services as effectively and efficiently as possible In order to do so , revenue collection must be done in such a way to ensure , to the maximum extent possible , that all citizen’s pay all taxes required by law and that no one be allowed to avoid paying their full share under the law Therefore , it is appropriate for Johnston County to adopt this tax foreclosure policy so that all Johnston County citizen’s pay their full and fair share of county taxes At the beginning of each tax year , the Johnston County Tax Department shall generate a list of all delinquent property tax accounts Johnston County will initiate foreclosure proceeding on all delinquent accounts beginning with those accounts that include the oldest delinquencies , without regard to the amount due Highest priority will be placed on accounts with delinquencies 9 or 10 years old PagePage pageNumber5483 The Johnston County Attorney is authorized to initiate and carry out all foreclosures In addition , the County Attorney may associate other attorneys , who are members of the Johnston County Bar , to prosecute these matters with all the authority , duties and responsibilities of the Johnston County Attorney The County Attorney shall retain additional attorneys to perform foreclosure in his own discretion , upon advice of the Tax Collector , the County Manager and the Board of Commissioners The County Attorney may retain additional counsel to handle foreclosure over a period of time up to one year All foreclosure actions will include a demand for all costs , including attorneys ’ fees , authorized by N C Gen Stat § 105 - 374 Attorneys will be paid a fee equal to 25 of the total tax due on each account being handled by the attorney The County Attorney and any attorneys associated with the County attorney in a foreclosure action has authority to settle actions upon advice and consent with the County Tax Collector and the County Manager However , no settlement can be made for less than the full amount of taxes owed or 25000 , which ever is less , plus all costs , once a Complaint has been filed All payments pursuant to a foreclosure action not made to the Court must be made to the Johnston County Tax Collector 11 Request for Minimum Housing - NAACP Joseph Avery , vice president with the NAACP , met with the Board concerning the need for minimum housing He stated that at the time his organization asked to be on the agenda , they were not aware that the Board was going to address this issue at their retreat He stated the NAACP strongly supports a minimum housing code for Johnston County He mentioned several situations where houses have no sewer service , and have holes in the floor and roof In response to a question from Commissioner Allen L Mims , Jr concerning the possibility that landlords , if forced to make repairs , would go up on their rent , Mr Avery stated that if everyone has to follow the same rules , this should not happen He pointed out in most cases , the people with the worst situations are charging the highest rents In discussion it was noted the Environmental Health Department can step in when sanitation is an issue ; however , often they are not notified of the problem Anne Eason , HAPP Director , pointed out that in many cases , the tenants are afraid that if they complain , the houses will be condemned and they will have no place to go Chairman Langdon thanked Mr Avery for his comments and informed him the Board will be looking at minimum standards in the very near future 12 Board of Education - Request for Approval of ADM Funds Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board approved the use of 230,644 State ADM funds by the Board of Education for the following projects Four Oaks Elementary , Addition of Classroom Wing and Roof Renovation Project - 61,122 Benson Middle , Roof Repair Renovation on Building 5 project - 115,322 Clayton High School , Addition Renovation of Classrooms , Media Center , Furniture Equipment and Roof Renovation Industrial Development Commission for two year terms to expire March 2003 C Local Emergency Planning Commission Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board made the following appointments to the Local Emergency Planning Committee for two year terms to expire March 2003 Reappointed Jeff Parrish , Robert Tripp , Equalization and Review Following discussion about the structure of this new board , the Commissioners agreed to look at a draft resolution that would establish certain criteria for membership They agreed to take this under advisement and discuss it further at their March 12 , 2001 meeting H Nursing Home Domiciliary Home Advisory Board Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board appointed Brenda Johnson to the Nursing Home Domiciliary Home Advisory Board for a three year term to expire March 2004 PagePage Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board recessed regular session to sit simultaneously as the Elevation Water District Board and the Meadow Water District Board A Sitting as the Elevation Water District Board Engineer Tim Broome presented the following feasibility analysis on the Elevation Water District Number of initial subscribers 925 Estimated number of additional subscribers 75 Estimated total subscribers following completion of construction 1,000 Estimated project cost for service to all subscribers 6,100,000 Estimated County “ upsizing ” cost 700,000 Capital cost per service with no USDA - RD grant 6,100 Minimum monthly bill required with no USDA - RD grant 2650 Average monthly bill with no USDA - RD grant 4000 Net local cost with maximum USDA - RD grant 3,800,000 Net capital cost per service with USDA - RD grant 3,800 Minimum monthly bill required with maximum USDA - RD grant 1600 Average monthly this money would come from the Utilities Reserve Fund He noted if the district did not receive any grant money , the project would need to be scaled back He recommended the Board authorize staff to proceed with the preliminary engineering report and make application to USDA Rural Development Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board authorized staff to proceed with the preliminary engineering report and make application to USDA Rural Development for the Elevation Water District B Sitting as the Meadow Water District Board Mr Broome presented the following feasibility analysis on the Meadow Water District Number of initial subscribers 767 Estimated number of additional subscribers 53 Estimated total Commissioner Allen L Mims , Jr and carried by unanimous vote , the Elevation Water District Board and the Meadow Water District Board were adjourned , and regular session was resumed 16 Award of Bid - Woodall and carried by unanimous vote , the Board scheduled a public hearing for May 7 , 2001 on the 201 Wastewater Facilities Amendment # 3 The hearing is scheduled for 11 30 am Page3491 Board Reports and Comments 19 Non - Recurring Mid - Year Appropriation to School Board Approved The Board again discussed an additional one - time appropriation to the School Board for capital th projects and bonuses for County teachers Since the previous discussion on February 5 , the Board of Education had given the Commissioners some information on how they would spend the extra money Commissioner Fred J Smith moved the Board approve a one - time , non - recurring appropriation to the School Board of 1,072,780 in capital outlay and 625,000 in current expense for a total of 1,697,780 Commissioner W Ray Woodall seconded the motion Discussion Commissioner Allen L Mims , Jr asked if teachers would be required to sign a contract for next year before receiving the bonus School Board member , Fred Bartholomew , stated his Board could not make this a requirement ; however , he stated , in his opinion , the bonuses would be a message to the teachers that the County Commissioners and the Board of Education are education - minded and want to help them Commissioner Thomas M Moore maintained the one - time small bonus would be a slap in the face for teachers , who are looking for a long term commitment He suggested this money , given to teachers at this time of the year , would not help with recruiting teachers for the new year , and would not keep good teachers from leaving the system As for the list of uses for the capital outlay allocation provided by the Board of Education , he suggested not one item is , in his opinion , a matter of urgency He stated he did not understand why the Board couldn’t wait for a few months and look at the entire budget before making an appropriation Commissioner Moore stated he fully supports teachers and would support a 3 percent increase in teacher supplements for next year , but feels that any extra money this year needs to be put in the classrooms Commissioner Wade M Stewart mentioned that teachers are having to buy classroom supplies out of their own pocket He cited an incident where one teacher spent 1200 last year Commissioner Allen L Mims , Jr stated he did not understand this since the Board of Education promised during budget sessions last year that they would supply the classroom He noted from Commissioner Stewart’s example , apparently this had not happened Commissioner W Ray Woodall stated the School Board and the teachers are expecting this appropriation , which in his opinion , is a good faith thing Commissioner Moore responded by asking where is the good faith to the taxpayers and County employees He urged the Board to wait on this matter until budget time Commissioner Fred J Smith called the question The motion passed by the following vote Ayes James H Langdon , Jr , Cookie Pope , , Wade M Stewart , Allen L Mims , Jr , W Ray Woodall and Fred Smith Nays Thomas M Moore There being no further business , Commissioner Cookie Pope moved the Board recess until 6 30 pm Monday , March 12
