10 492 March 12 , 2001 Recessed Session - 6 30 pm The Johnston County Board of Commissioners reconvened the March 5 , 2001recessed session , on Monday , March 12 , 2001 , at 6 30 pm in the Commissioners ’ Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice - Chairman , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Fred Smith and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , and J Mark Payne , County Attorney The Chairman called the meeting to order and the following business was transacted 1 Award of Bid - Single Prime Name Base Bid Haren Construction Company , Inc 1,802,00000 Etowah , TN Peters & White Construction Co 2,005,44600 Chesapeake , VA Crowder Construction Company 2,090,50000 Morrisville , NC Mr Broome pointed out the individual bids were lower than the single prime The bids came in more than 400,000 under budget ; therefore , he recommended a belt dewatering filter press at a cost of 300,000 be included in the project since this can be done at the same time The belt filter press will be needed in the near future for dewatering waste byproduct sludge He recommended award of contracts to low bidders as follows Division I General Contract to T A Loving Co of Goldsboro in the amount of 1,544,900 ; and Division II , Electrical Contract to Williams & Lamb Electric Co of Rocky Mount in the amount of 119,700 He also asked the Board to approve the total project budget of 2,650,000 , which would include the belt filter press Following discussion , Commissioner Cookie Pope moved the Board award the Division I contract to low bidder , TA Loving of Goldsboro , in the amount of 1,544,900 ; the Division II contract to low bidder , Williams & Lamb Electric of Rocky Mount in the amount of 119,700 ; and approve the project budget of 2,650,000 , which would include the allowance for the belt filter press Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Page493 2 Presentation from Towns Concerning Criteria for Extra Territorial Jurisdiction ETJ Pete Connet , Smithfield Manager , Steve Biggs , Clayton Manager , and representatives from most of the other towns in the County , asked the Board to consider proposed criteria , which the towns feel should be used in judging the merits of ETJ requests Mr Connet explained that nine of the County’s ten towns participated in a joint effort to come up with these measures Micro was invited to the meetings , but did not attend Most of the town councils have discussed , and several have formally approved the criteria , including Selma and Wilson’s Mills who are the only towns that still have some unresolved issues about a boundary area of mutual interest The Benson Town Council , after discussion , has suggested some of the examples used should be included as requirements Steve Biggs reviewed the proposed set of criteria with the Board and noted the purpose was to provide a tool for orderly growth at urban standards in the areas near the municipalities He and Mr Connet asked the Commissioners to formally adopt the criteria at their April meeting so that those towns who wish to do so can begin the process of making a request for ETJ Benson Mayor , Don Johnson , stated his council supports the proposal but feels the criteria are too broad They would like for the examples under criteria 2 and 3 to be requirements He pointed out the people in the ETJ areas should not be subjected to less than what they have now , and noted there must be cooperation between the Town and County to assure that the areas blend and are aligned with one another Commissioner Fred J Smith stated he basically supports the proposal but has a problem with the wording in # 3 that states , “ The Town has made or is willing to make a commitment to sound planning as necessary to serve the area with municipal services in the future ” He suggested the words “ or willing to make ” should be stricken since , in his opinion , the Town needs to make a firm commitment to fulfill the purpose as stated in the preamble to the Criteria which refers to providing growth at “ urban standards ” He stressed that urbanizing an area requires two things , density and sewer , and stated he would not support an ETJ if all the town is offering is septic tanks and no density Commissioner Thomas M Moore agreed that all municipal services should be in the ETJ area He also asked how this might impact the County’s Growth Management Ordinance , which was adopted to control the number of students coming into the schools He suggested the County and towns need to be consistent Mr Connet and Mr Biggs responded that these points of concern should not be a problem and only need some clarification They agreed the committee needs to meet again to possibly fine - tune the document Four Oaks Councilman , Linwood Parker , pointed out that small towns want to have control over the areas around their boundaries , but can not afford to use town taxes to provide services until an area is annexed In response to Commissioner Moore’s concern about growth management , he noted growth needs to be encouraged and schools need to be built near the towns where roads are already wide enough to handle traffic Chairman Langdon thanked everyone for their comments He suggested the towns meet again to consider these issues and come back at a later meeting There being no further comments , Commissioner Cookie Pope moved the Board adjourn this session Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote March 12 , 2001 REGULAR ZONING MEETING 7 00 pm The Johnston County Board of Commissioners met in regular session beginning at 7 00 pm with the following members Present James H Langdon , Jr , Chairman , Cookie Pope , Vice - Chairman , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Fred Smith and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , and J Mark Payne , County AttorneyPage494 The Chairman called the meeting to order and the following business was transacted Public Comments 1 Complaint - Johnston Memorial Hospital and Mental Health Frances King from Lumberton spoke to the Board about a problem she had with Johnston Memorial Hospital and the Hospital’s personnel in the in - patient Mental Health Department Ms King stated that a nurse was extremely rude to her and would not allow her access to her adult daughter , who was brain damaged at an early age , and would not allow her to explain her daughter’s situation , even though she has been the daughter’s guardian most of her life She stated the reason she came before this Board with her story was to try to make sure this type of thing doesn’t happen again 2 Public Hearings - 7 00 pm - Rezoning Cases and Special Use Permits Advertised - 03 02 01 and 03 09 01 - In the Smithfield Herald - Certified letters were mailed to adjoining property owners on 03 01 01 and notices posted at the locations on 02 21 2001 The Chairman opened the rezoning public hearing and invited interested persons to make comments on the following cases Case 530 Petition to rezone approximately 1074 acres located on Devil’s Racetrack Road SR 1009 in Bentonville Township from Agricultural Residential to Industrial 2 - Special Use District Owner Johnston Community College Herman Kight ; Agent Allen R King , PE , Southwind Surveying and Engineering , Inc Phyllis Hicks , Zoning Enforcement Officer , pointed out the property on the GIS map and noted it is located near Strickland’s Crossroads The site is approximately 1 ½ miles off the road Surrounding zoning is Agriculture Residential , Industry - 2 Special Use District , and General Business Richie Hines with Southwinds Surveying and Engineering , stated this land is part of the Howell Woods Complex owned by the Community College The College would like to mine an 80 acre area with the end result of expanding their pond to create a natural habitat for wildlife Revenue realized from the mining would be split with 50 to be used for the site and 50 to the college scholarship fund Danny Hayes , who lives on adjacent property , asked which road would be used for the large trucks that would be hauling from the site Mr Hines responded that plans are to use the path that now runs by the Learning Center Mr Hayes voiced concern that this could create a safety issue for local people who use the road , and possible damage to crops due to the dust He suggested that measures need to be taken to assure safety Mr Hines pointed out that trucks already use the road , and the site distance is not a problem As for dust control , he stated a water truck will keep water on the road to help control this The Community College will have some oversight of the project since it has two people who stay at the site at all times Sandra Hicks , who also lives on an adjacent property , stated the road is frequently used by people riding horseback , and there are children who play in the area In response to Commissioner Wade M Stewart , she noted she uses this road , which is partly on her property and partly on the Community College property , to access her land She pointed out there is another road , which the Community College owns , that runs in front of Deer Run Subdivision and accesses the proposed mining site Commissioner Allen L Mims , Jr noted the Community College is currently asking for rezoning only They plan to talk with mining companies to see what their options are before coming back for a special use permit He suggested the Board could deal with conditions of operations at the time they request a permit R M Hayes , brother to Sandra Hicks , voiced concern that this operation would take a number of years to complete and suggested a separate road should be used for the mining Herman Kight with the Community College stated he would check on the possibility of using the other road He noted that regardless of which access is used , the college has a real interest in making sure the road is maintained , and will work to make sure the trucks are safe Page495 Ms Hicks stated the Planning Board recommended approval with special use to be discussed at a later date The Chairman recessed the Rezoning Public Hearing Decision on Rezoning Case 530 Case 530 Petition to rezone approximately 1074 acres located on Devil’s Racetrack Road SR 1009 in Bentonville Township from Agricultural Residential to Industrial 2 - Special Use District Owner Johnston Community College Herman Kight ; Agent Allen R King , PE , Southwind Surveying and Engineering , Inc Applicant will apply for Special Use Permit at a later date Commissioner Thomas M Moore moved the Board approve rezoning case 530 for Owner , Johnston Community College Herman Kight and Agent , Allen R King , PE , Southwind Surveying and Engineering , Inc of approximately 107 4 acres located on Devil’s Racetrack Road SR 1009 in Bentonville Township from Agricultural Residential to Industrial 2 - Special Use District Commissioner Allen L Mims seconded the motion , which carried by the following vote Ayes James H Langdon , Jr , Cookie Pope , Fred Smith , Allen L Mims , Jr , Thomas M Moore and W Ray Woodall Nays Wade M Stewart The Chairman re - opened the Rezoning Public Hearing Case 531 Petition to rezone approximately 153 acres located on T - Bar Road SR 1115 in Meadow Township from Agricultural Residential to Agricultural Residential - Special Use District Owners and Applicants James M Davis and Deborah S Davis Ms Hicks pointed out this property on the GIS map and noted it is located near NC 50 South on T - Bar Road close to its intersection with Holly Grove Road The surrounding zoning is Interstate Highway District , Community Business and General Business James Davis , 91 T - Bar Road , offered to answer any questions the Board might have He stated the business will be fully licensed Commissioner Wade M Stewart asked how close this property is to the nearest neighbor , Mr Davis responded there is a home within approximately 300 feet He noted the neighbors are aware of the plans for the business Ms Hicks stated the Planning Board recommended approval of rezoning The Chairman closed the Rezoning Public Hearing Decision on Rezoning Case 531 Case 531 Petition to rezone approximately 153 acres located on T - Bar Road SR 1115 in Meadow Township from Agricultural Residential to Agricultural Residential - Special Use District Owners and Applicants James M Davis and Deborah S Davis Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved rezoning case 531 for Owners & Applicants , James M Davis and Deborah S Davis of approximately 153 acres located on T - Bar Road SR 1115 in Meadow Township from Agricultural Residential to Agricultural Residential - Special Use District The Chairman opened the Public Hearing on Special Use Permit Request Those wishing to speak on Case 531 were sworn in by the Clerk to the Board Case 531 Special use permit for a commercial kennel on approximately 153 acres located on T - Bar Road SR 1115 in Meadow Township Owners and Applicants James M Davis and Deborah S Davis PagePage pageNumber5496 Ms Hicks explained the owners plan to build a new road that will lead only to the kennel She presented the following summary of evidence on this case , showing that the Planning Board recommended approval based on findings of fact with conditions as outlined A pre - application hearing was held with the applicant on December 27 , 2000 At that time the applicant was informed of the following If approved , applicant must provide to the Planning Office a Site Plan for their review and approval Applicant must comply with the requirements of the Johnston County Development Ordinance regarding landscaping , buffering and fencing or any additional requirements as approved by this Board Applicant will be notified in writing of the Board’s decision If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of Commissioners Applicant’s Special Use Permit will expire at the end of twelve 12 months if it is not used as permitted within that time period _ _ When necessary , staff informed the applicant of further Planning Office requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements Subsequent to the pre - application conference , all required notices were mailed to property owners within 500 feet , the property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On January 16 , 2001 , the Johnston County Planning Board held a public meeting regarding this case and by unanimous vote recommended approval of rezoning to Agricultural - Special Use District and a special use permit based on the following findings of fact with the following conditions attached Findings 1 Would be located , designed and proposed to operate so as to maintain or promote the public health , safety , and general welfare 2 Would comply with all required regulations and standards of the Development Ordinance , and all applicable provisions of Article 445 , Article 6 , Article 8 , and with all other applicable regulations 3 Would be located , designed , and operated so as to maintain or enhance the value of contiguous property ; and 4 Would conform to the general plans for the physical development of the County as embodied in the Comprehensive - Strategic Plan and the County’s Design Guidelines Conditions 1 Special Use Permit Approves a Gross Land Area 153 acres b Operation of commercial kennel c Days of operation Monday through Sunday d Hours of operation 7 00 am to 6 00 pm e Not more than 50 dogs in the facility at one time f No outside storage of dogs before 7 00 am or after 6 00 pm 2 That prior to submitting an application for Site Plan approval , the approved Special Use Permit be recorded in the Register of Deeds of Johnston County 3 That a detailed Site Plan be approved by the Planning Department prior to the issuance of a Land Use Permit 4 That a Stormwater Management Plan , if applicable , shall be submitted with the application for a Site Plan Approval and approved by the County Stormwater Administrator prior to the issuance of a Land Use Permit 5 That plans for a driveway connection s , or for improvements to State maintained roads s , be approved by NCDOT prior to the issuance of a Land Use Permit 6 That all outdoor storage of materials and or construction type vehicles be placed behind a solid fence at least eight 8 feet in height 7 That construction start within twenty - Office & Institutional District - David Earl Cobb , Elevation Road Amendment 3 - Industrial 1 - Indispensable Drinks , Rock Pillar Road Amendment 4 - Interstate 95 - Interstate 40 Interchanges - Billy Dean Johnson , US 301S Amendment 5 - Community Business - David Thomas Pace , Covered Bridge Road Amendment 6 - Industrial 2 - Kenneth D Sauls , US 70 W Amendment 7 - Community Business - W Paul Stephenson , Wayne T Stephenson , NC 50N Amendment 8 - General Business - Charlie & Tammie Anderson Amendment 9 - Industrial 1 - Wray & Ruthie BrewerPagePage pageNumber7498 Ms Hicks asked the Board to consider postponing action on Amendment # 6 for Kenneth D Sauls on US 70 West She explained this property is a salvage yard and she has been working with Mr Sauls about several areas in which he is out of compliance He has been asked to put up an appropriate sign and a fence , both of which he agreed to do some time ago ; however , he has failed to comply Now it appears that automobiles have been moved onto another piece of property that is neither grandfathered or appropriately zoned for this She stated she would need to look at this case as a possible zoning violation As for the other proposed amendments , Ms Hicks explained that many of the properties were grandfathered when zoning began , and now they wish to expand The zoning needs to be correct before this can take place Commissioner Wade M Stewart asked about Amendment # 4 for Billy Dean Johnson It was noted that most of this property is in the Interstate Highway District Overlay with only this small portion outside of that zoning Ms Hicks stated it has been the policy to use the property lines when possible when only a small portion of a property is left out of an overlay district Commissioner Allen L Mims , Jr asked what permitted use under the overlay district would Mr Johnson’s business fall He noted that Contractor offices and storage yards would have to be a special use district Following discussion , it was agreed it would be best to postpone action on amendment # 4 in order to determine whether Mr Johnson might need to apply for a special use rezoning There being no further comments , the Chairman closed the public hearing Upon a motion by Commissioner Fred Smith , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved the following Zoning Map Amendments Amendment 1 - Office & Institutional District - David Earl Cobb , Elevation Road Amendment 3 - Industrial 1 - Indispensable Drinks , Rock Pillar Road Amendment 5 - Community Business - David Thomas Pace , Covered Bridge Road Amendment 7 - Community Business - W Paul Stephenson , Wayne T Stephenson , NC 50N Amendment 8 - General Business - Charlie & Tammie Anderson Amendment 9 - Industrial 1 - Wray & Ruthie Brewer Board Reports and Comments 4 Resolution To Set Up Equalization and Review Board Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following resolution setting up the Board of Equalization and Review RESOLUTION TO APPOINT SPECIAL BOARD OF EQUALIZATION AND REVIEW WHEREAS , the Johnston County Board of Commissioners is authorized by North Carolina General Statutes Section § 105 - 322 to appoint a Special Board of Equalization and Review to examine and review the listings and valuations assigned to property located in Johnston County , hear property owners ’ appeals concerning property listings and valuations , and make adjustments and necessary changes to insure that valuations meet standards established by State law ; and WHEREAS , the Board of Commissioners is authorized by North Carolina General Statutes Section § 105 - 312 to delegate its authority to compromise , settle or adjust the County’s claim for taxes arising from discovered property to a Special Board of Equalization and Review ; and WHEREAS , the Board of County Commissioners has determined that it is reasonable and desirable to appoint a Special Board of Equalization and Review to exercise those powers and perform those duties allowed by law ; NOW THEREFORE , BE IT RESOLVED that the Board of Commissioners for the County of Johnston does hereby establish a Special Board of Equalization and Review as follows 1 EFFECTIVE DATE AND DURATION This resolution shall be effective upon its adoption by the Board of Commissioners and shall continue in effect until revised or rescinded by the Board of Commissioners This resolution supersedes any previous resolutions adopted by the Board of County Commissioners regarding the establishment of a Special Board of Equalization and Review in Johnston County 2 MEMBERSHIP a The Board shall consist of seven members , each having one vote b Four members shall constitute a quorum PagePage pageNumber8499 3 QUALIFICATIONS Except for the initial members , each member of the Special Board of Equalization and Review shall a Be a real property owner in Johnston County ; b Be a resident of Johnston County for at least 2 years ; c Be in current payment of all applicable property taxes ; and d Be familiar with the powers and duties of the Board of Equalization and Review as set forth in North Carolina General Statutes Section § 105 - 322 g 4 TERM OF OFFICE The term of office for each member of the Special Board of Equalization and Review shall be four years , except for the initial appointment where three of the initial appointees shall be appointed for a term of five years 5 APPOINTMENT OF MEMBERS Each Commissioner shall have the opportunity to recommend one member of the Special Board of Equalization and Review Members shall be appointed consistent with the Johnston County Board of Commissioners policy on appointments 6 POWERS AND DUTIES a The powers and duties of this Board shall be as specified in N C General Statutes § 105 - 322 and Article 21 of the Machinery Act b The power and duty of the Board of Commissioners to adjust , settle , or compromise tax billings and receipts issued and delivered to the tax collector pursuant to the provisions of N C General Statutes § 105 - 312 is hereby delegated to the Special Board of Equalization and Review c At the conclusion of its duties , the Board shall render a report to the Board of Commissioners containing its recommendations for the composition , terms of office , and compensation for future Board’s of Equalization and Review d The Special Board of Equalization and Review may appoint committees , composed of its own members or other persons , to assist it in making any investigation necessary in its work It may also employ expert appraisers in its discretion The expense of the employment of committees or appraisers shall be borne by the County ; provided , that the Board may in its discretion , require the taxpayer to pay the cost of any appraisal by experts demanded by him when said appraisal does not result in material reduction of the valuation of the property appraised and where such valuation is not subsequently reduced materially by the Special Board of Equalization and Review or by the North Carolina Property Tax Commission e The Special Board of Equalization and Review may subpoena witnesses , books , records , tapes and documents reasonably considered to be pertinent to the decision of any matter pending before it ; and any of the Board may administer oaths to witnesses in connection with the taking of testimony The chairman of the Board shall sign the subpoena and such subpoena shall be served by an officer qualified to serve subpoenas 7 COMPENSATION The Special Board of Equalization and Review members shall be compensated fifty dollars 5000 per session a session equals four hours or less The Chairman of the Special Board of Equalization and Review shall be compensated seventy - CDBG Scattered Site Grant The Chairman appointed Commissioner Allen L Mims , Jr to be the Commissioner Representative on the CDBG Scattered Site Grant 8 Discussion On Needs of Handicapped Commissioner Cookie Pope expressed concern for all the mentally and physically handicapped citizens in the County She stressed the importance for all County agencies and service providers to be very responsible in dealing with those with special needs It was pointed out that often these citizens and the people who are trying to help them have a problem with communication 9 Deed To Clayton School Property Commissioner Allen L Mims , Jr asked County Attorney , Mark Payne , to make sure the County gets the deed to the Clayton School transferred so that Clayton can proceed with their renovation project There being no further business , Commissioner Cookie Pope moved the Board adjourn Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote _______________________________________ James H Langdon , Jr , Chairman _____________________________ Joyce H Ennis , ClerkPage
