10 539 May 7 , 2001 The Johnston County Board of Commissioners met in regular session Monday , May 7 , 2001 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Cookie Pope , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Fred J Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer 1 Minutes - April 2 , 9 , 16 , 23 , 2001 Meetings Chairman James H Langdon , Jr asked if there were corrections to the minutes of the April 2 , 9 , 16 , and 23 , 2001 board meetings Commissioner Fred Smith asked that additional wording be added to th nd the last sentence of the 4 paragraph of Item 21 , page 518 of the April 2 minutes The sentence to read “ He pointed out the County citizens already get a tax break since property is not revalued each year , and with normal increases in income , a smaller portion of a family’s funds is used for property taxes ” Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ray Woodall and carried by unanimous vote , the Board approved the minutes for April with the correction as stated Public Comments - No one spoke at this time 2 Department of Transportation - Additions to System The Board reviewed a petition presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Mohican Trail , Mohawk Trail and Cherokee Drive in Powhatan Glen Subdivision , Clayton Township Following review , Commissioner Cookie Pope moved the Board concur with the NC Department of Transportations request to add the roads listed above to the State Maintained System Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 3 Request for Endorsement of Memorial Sign on Hwy 70 East The Board considered a request from the North Carolina Department of Correction to join them in asking the NC Department of Transportation to erect a memorial sign in memory of Officer Shannon Smith , who was killed in the line of duty Officer Smith was supervising an inmate work squad on the Neuse River Bridge on Hwy 70 East about ½ mile from the Johnston Correctional Institution when she was hit by a motorist Following discussion , Commissioner W Ray Woodall moved the Board endorse the request for the North Carolina Department of Transportation to erect a memorial sign on Hwy 70 East at the site where Officer Shannon Smith was killed on November 9 , 1999 Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 4 Request for Tax Exempt Loan Status Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution approving tax exempt loan status for the 50 210 Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Volunteer Fire Department of 50 - 210 Community , North Carolina the “ VFD ” from Four Oaks Bank & Trust Company , in the principal amount of 180,000 , which loan is for the following purpose Page540 The purchase and construction of an addition to the 50 - 210 firehouse at 50 Greenleaf Road , Angier , NC 27501 The addition includes bays and an office area 5 Fireworks Display Approved Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board approved a fireworks display for Celebrate Cleveland Committee th for their 4 of July celebration at the Cleveland Middle School , subject to NCGS § 14 - 410 , 14 - 415 and Chapter 20 of the Standard Fire Prevention Code 6 Adoption of the Johnston County Hazard Mitigation Plan Emergency Management Director , Dewayne West , informed the Board the Hazard Mitigation Plan , which was originally presented to the Commissioners on August 7 , 2000 , has now been reviewed and approved by the State He requested the Board formally adopt the plan , which is available in both hard copy and on CD Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the Johnston County Hazard Mitigation Plan as presented 7 Surveyor Plats for Harnett - Johnston County Line Monuments Accepted GIS Director , Terry Ellis , informed the Board the State has recently placed boundary monuments along the Harnett Johnston County boundary lines that were approved October 2 , 1995 They have also sent the County official survey maps identifying the location of these markers Staff has reviewed the map and recommends the Board accept the survey plats so they can be properly marked and recorded in the Register of Deeds office Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board accepted the survey maps from the State , which show the location of the boundary line monuments along the Harnett Johnston County lines 8 Award of Bid - Leachate Recirculation System for Phase V Subtitle D Landfill The Board reviewed the following bids received on March 21 , 2001 for a leachate recirculation system for Cell 5 of the Landfill The purpose of the system is to accelerate decomposition of the solid waste and Commissioner Fred Smith , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board awarded a contract to low bidder , J F Wilkerson Contracting , Inc , Morrisville , NC in the amount of 195,400 , for a leachate recirculation system for the landfill 9 Revised Work First Block Grant Plan Social Services Director , Earl Marett , informed the Board the Work First Block Grant plan , which the Board adopted in November , was sent to the State Department of Health and Human Services for their approval Based on the State’s recommendations , several revisions and clarifications have been made He provided a summary of the revisions and recommended the Board approve the revised plan to become effective July 1 , 2001 Page541 Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the Revised Work First Block Grant Plan as presented 10 Budget Amendments At the request of the Board , Mr Marett explained that the DSS budget amendment for 721,207 represents 549,463 in additional Medicaid expenditures for the remainder of the year Over the years , the State’s estimate has traditionally been significantly greater than actual expenses , and Johnston County , like other counties in the State , has not budgeted the entire amount This year , the estimate has turned out to be accurate , and this amendment will add back the 549,463 that was not budgeted He pointed out the County’s total Medicaid match for the fiscal year , including this addition , is 4,149,463 , which represents only 55 of the total Medicaid dollars for the County The remaining portion of the amendment is for 180,783 additional State funding for providing medical transportation with the required County match of 9,039 coming from within his budget In discussion , it was noted the State’s Medicaid estimate for the County for FY 2001 - 02 has increased to 55 million Mr Marett noted the increases can be attributed to more liberal eligibility requirements for the elderly and the disabled , and an increase in prescription drugs Upon a motion by Commissioner Thomas M Moore , seconded by 300,00000 11 Public Hearing 10 30 am - Proposed Increase in 911 Surcharge for Telephone Service Advertised April 13 , 20 , 2001 in The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on a proposed increase in the 911 surcharge on telephone service in the County to pay for and maintain needed radio equipment for fire , rescue and other emergency service providers in the County There being no public comment , the Chairman closed the hearing 12 Radios to be Funded with Loan from County General Fund Commissioner Fred Smith moved the Board approve an interest - free loan from the County General Fund to pay for the radio equipment for fire , rescue and other emergency service providers , with the stipulation the loan will be paid back from excess revenues from the 911 surcharge Commissioner Allen L Mims , Jr seconded the motion Discussion Commissioner Thomas M Moore asked how long it will take to pay the 13 million back to the General Fund County Manager , Rick Hester , noted it could take as long as six years Commissioner Moore noted that although he would support the motion , the surcharge , in his opinion , is a user fee , which is the type of revenue source the Board has supported over the past few years He voiced his belief that the healthy fund balance in the General Fund is a direct result of letting users pay for services when possible Commissioner Allen L Mims , Jr noted with the increasing number of phones in the County , the surcharge should be able to pay off the loan in a relatively short period of time He stated he would support the motion Following discussion , the motion passed by unanimous vote 13 Award of Bids - Wastewater Collection Facilities to Serve West Johnston High School Engineer Tim Broome reviewed with the Board the following bids which were received on March 22 , 2001 for the construction of wastewater collection facilities to serve West Johnston High School The project consists of a wastewater flow equalization and pumping facility and force main from the school site to the County’s force main at the intersection of Old Raleigh Road and NC 210 Thalle Construction , Mebane , NC 345,33900 R & G Construction , Charlotte , NC 356,32300 Ormond Utilities , Kinston , NC 367,07550 Colt Contracting Co , Clinton , NC 372,27860 Construction Supervision Services , Inc , Garner , NC 387,04400 Billings & Garrett , Raleigh , NC 403,43680 Selco , Smithfield , NC 410,92037 TA Loving Co , Goldsboro , NC 432,85400 Mr Broome recommended award of contract to low bidder , Thalle Construction , in the amount of 345,339 , and approval of a total project budget of 380,000 PagePage pageNumber8546 Upon a motion by Commissioner Fred Smith , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board awarded a construction contract to Thalle Construction of Mebane , North Carolina in the amount of 345,339 , and approved a total project budget of 380,000 for the Wastewater Collection Facilities for the West Johnston High School project 14 Discussion Water and Sewer Assessment Capacity Fees for School Construction Commissioner Fred Smith noted the budget for the West Johnston High School wastewater project does not include assessment fees Last year the Board changed the policy to state that the cost of water and sewer facilities to serve a school , including capacity fees , would be a part of the school construction cost He stated , in his opinion , this policy needs to be revisited He suggested if the schools pay these fees , they will most likely be using borrowed money , for which they will have to pay interest He maintained this is not necessary since there is sufficient money in the Utilities enterprise fund to cover this cost He suggested that if , in the future , there is a shortfall in the enterprise fund and assessment fees have to be increased , the homebuilders , who are the primary users , would be willing , in his opinion , to absorb the cost as they recognize the importance of schools to their industry He noted , however , he does not believe there will be a need as the enterprise fund is healthy and would probably not miss this money Commissioner Thomas M Moore disagreed and stated , in his opinion , it is not fair for the users of utility services to pay for something that benefits the entire population He noted he would , however , have no problem if the Board decided to pay for this by transferring the money from the general fund to the enterprise fund He maintained that establishing realistic user fees is the reason the General Fund is healthy today Motion Commissioner Smith moved the Board change the policy to exclude school construction from paying assessment fees Commissioner W Ray Woodall seconded the motion Further Discussion Commissioner Allen L Mims , Jr agreed with Commissioner Moore and questioned whether the enterprise fund could absorb this cost considering all the water and sewer needs in the County He noted he too would have no problem if the Board wants to pay the assessment for the schools out of the general fund , but feels strongly that the enterprise fund should not be shorted this money The County will have to pay , regardless , if we do not collect the fees in the enterprise fund , and whether it comes from bond money or the general fund , everybody would be paying for something that benefits everyone Chairman James H Langdon , Jr voiced mixed feelings on this matter He noted he favors doing the same for everyone , which is the reason the policy to hear public comment on the proposed State loan application for the Water Treatment Plant Expansion Project 21 Public Hearing - 201 Wastewater Facilities Plan Amendment # 3 Advertised March 23 , 2001 in The Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the 201 Facilities Plan Amendment # 3 on the expansion of the Central Johnston County Regional Wastewater Treatment Plant , construction of the Cleveland Area Diversion wastewater transmission facilities , construction of the parallel Neuse River force main , rehabilitation of the Buffalo Creek Interceptor , and construction of phase 2 of the water reclamation project Engineer Tim Broome introduced Bob Berndt , with Hazen and Sawyer Engineers , who has worked with staff on the 201 amendment He noted the original 201 Wastewater Facilities Plan was adopted in 1975 and has to be updated and amended when the County applies for grants and loans , as well as new permits for discharge He offered the following overview of the proposed amendment Overview of 201 Wastewater Facilities Plan Amendment No 3 Introduction The 201 Wastewater Facilities Plan Amendment No 3 is a study to identify the County’s wastewater collection treatment and disposal needs for the next 20 years , through 2021 Completion of the amendment in strict conformance with EPA DWQ requirements and the SEPA qualifies the County for grant and more likely low interest loan funding Existing Studies The County’s sewer service area includes Smithfield , Selma , Pine Level , Four Oaks , and the areas of I - 40 NC 42 , Cleveland schools , McGee’s Crossroads , Wilson’s Mills , and the US 70 US 70 Bus corridor between Clayton and Smithfield Page4552 The County provides bulk service to five municipalities and retail service to approximately 200 commercial and residential customers The Central Johnston County Regional Wastewater Treatment Plant has a current capacity of 45 mgd with advanced secondary treatment , but construction for expansion to 50 mgd with very high level treatment to recycle quality and nutrient removal is currently underway The average hydraulic loading on the plant is approximately 38 mgd However , unused capacity allocations plus current flow total approximately 475 mgd The capacity allocations include the Clayton 06 mgd “ pass through ” inter - transfer flow and 0075 mgd net contract allocations for Clayton The Study The engineering study consists of detailed analyses to determine problems and needs and detailed evaluations of alternatives to solve problems and meet needs Following are the needs and challenges facing the Johnston County wastewater system 1 Removal of infiltration inflow sources from interceptors in the Smithfield and Selma area , some of which are 35 to 40 years old 2 Construction of parallel force mains along the Neuse River and US 70 Bus west of Smithfield to convey future increased flows into the new 36 ” Neuse River interceptor 3 Construction of the Cleveland area wastewater diversion facilities to accommodate increased commercial wastewater flows and limited residential flow from the I - 40 NC 42 and I - 40 NC 210 interchange areas 4 Upgrading wastewater treatment processes and construction of reclaimed water recycle facilities to meet extremely restrictive effluent limits 5 Expansion of the Wastewater Treatment Plant from 50 to 70 mgd to meet the projected increases in wastewater flows through the year 2010 , and further expansion from 70 to 86 mgd to meet the flow increase projected by 2021 Environmental Assessment Direct and indirect impacts of the project on the environment have been evaluated Areas of special study include the following Topography Air Quality Soils Noise Land Use Water Resources Wetlands Forest Resources Prime Agricultural Lands Aquatic Habitats Public Scenic and Recreational Lands Wildlife and Natural Vegetation Areas of Historic Value Introduction of Toxic Substances The principal impacts of the project involve the short term impacts of construction operations and secondary impacts resulting from growth facilitated by sewer capacity and sewer facilities The impacts of construction will be mitigated by special construction techniques and adherence to erosion control standards The effect of growth will be mitigated by the County’s land use policies , the zoning ordinance , the County’s new development ordinance that encourages open space , the stormwater ordinance , and the County’s residential sewer use policy Capital Cost The estimated capital cost for the improvements required through 2011 are Wastewater Collection Facilities 1 Cleveland Area Diversion 32 2 Interceptor Rehab 23 3 Neuse River & US 70 Force Main 08 63 Project Cost 206 Note - All in millions Page5553 Financing of the net local cost would be by SRF low interest loans Projected Increase in User Costs Current retail user charges are 500 per month minimum plus 355 per 1,000 gallons The proposed rate would be 750 minimum and 095 per 1,000 gallons The current average residential service bill of 2735 would increase to 3000 Bulk wastewater charges would increase by approximately 067 per 1,000 gallons In response to a question from Commissioner Woodall about how the new rates would affect citizens , especially the seniors on fixed incomes , Mr Broome noted the County customers will be paying a little more than average , but the town customers will remain very competitive He noted there are only about 200 retail customers , and most of them are new homeowners Commissioner Fred Smith pointed out there are two problems the County must deal with 1 new increased requirements from the State to treat wastewater , and 2 growth In this case , everyone will share in the cost of dealing with the new requirements , but those involved in growth will be paying for that growth He noted the cost of these projects , while it might seem high at approximately 20 million , is really not when you consider the magnitude of the projects , which are needed Commissioner Thomas M Moore agreed and noted that without these improvements , the County would not be prepared for an industry with large wastewater treatment needs coming to the County Mr Broome pointed out a third element the County is facing is the matter of discharge permits , which the State is reluctant to increase He noted the County received verbal agreement that elimination of the White Oak Creek permit would be offset with an increase in our existing discharge permit ; however , that has not been approved Commissioner Allen L Mims , Jr asked about the capacity that has been allocated but not used at this point Mr Broome responded there is approximately 950,000 gpd ; however this should not continue to be a problem since the Board adopted a policy last year that established time frames for use of capacity There being no further comments , the Chairman closed the public hearing Johnston County 201 Wastewater Facilities Plan Amendment No 3 Approved Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the 201 Wastewater Facilities Plan Amendment # 3 as presented 22 Design Contract on the Wastewater Treatment Plant Expansion Project - Hazen & Sawyer Mr Broome informed the Board the Division of Water Quality DWQ has indicated they are in a position to fund the next expansion of the wastewater treatment plant from 50 to 70 mgd in conjunction with other projects under Amendment No 3 of the 201 Plan The 20 year loan would be at an interest rate of 257 In order to qualify for the loan , DWQ requires the County to submit the design and construction documents for all the projects involved by August in order to get the loan by Christmas On this timetable , bids would be let in the spring of 2002 All the projects involved have been designed except the Plant expansion project Planning and analysis has been done ; however , the design has not been completed Hazen & Sawyer has worked with the County on the project and , in staff’s opinion , is the most qualified firm to complete the design and meet the schedule He recommended the Board approve a proposed design contract agreement with Hazen & Sawyer Engineers and Scientists Upon a motion by Commissioner Fred Smith , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board approved a design contract agreement , as proposed , with Hazen & Sawyer Engineers and Scientists of Raleigh for the Wastewater Treatment Plant Expansion Project Page6554 23 Revised Resolution to Apply for State Revolving Loan for the Wastewater Treatment Plant Improvements Mr Broome explained that over the past few months , the Board has adopted two similar resolutions , one authorizing application for a High Unit Cost Grant , and one authorizing application for a State Revolving Fund Loan - both for the Wastewater Treatment Plant Improvements Project The only difference in the resolutions was that in one the Chairman was designated as the official representative , and in the other , the County Manager was the official representative The Division of Water Quality staff is requesting the Board designate a single representative since both are for the same project He recommended the Board adopt a revised resolution for the loan funds and designate the County Manager as representative Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board adopted the following resolution RESOLUTION BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERS FOR APPLICATION OF STATE LOAN FUNDS FOR PUBLIC WASTEWATER TREATMENT WORKS IMPROVEMENTS WHEREAS , The Federal Clean Water Act Amendments of 1987 , and the North Carolina Clean Water Revolving Loan and Grant Act of 1987 have authorized the making of loans and grants to aid eligible units of government in financing the cost of construction of wastewater treatment works , and WHEREAS , Johnston County has need for and intends to construct a wastewater treatment works project consisting of an expansion and upgrade of its Central Regional Wastewater Treatment Plant , and WHEREAS , Johnston County intends to request state loan assistance for the project NOW THEREFORE BE IT RESOLVED , BY THE BOARD OF COMMISSIONERS OF JOHNSTON COUNTY That Johnston County will arrange financing for all remaining costs of the project , if approved for a State loan award That Johnston County will adopt and place into effect on or before completion of the project a schedule of fees and charges which will provide adequate funds for proper operation , maintenance , and administration of the system and the repayment of all principal and interest on the debt That the Board of Commissioners of Johnston County agrees to include in the loan agreement a provision authorizing the State Treasurer , upon failure of Johnston County to make scheduled repayment of the loan , to withhold from Johnston County any State funds that would otherwise be distributed to Johnston County in an amount sufficient to pay all sums then due and payable to the State as a repayment of the loan That Johnston County will provide for efficient operation and maintenance of the project on completion of construction thereof That the County Manager , and successors so titled , is hereby authorized to execute and file an application on behalf of Johnston County with the State of North Carolina for a loan to aid in the construction of the project described above That the County Manager , and successors so titled , is hereby authorized and directed to furnish such information as the appropriate State agency may request in connection with such application for the project to make the assurances as contained above ; and to execute such other documents as may be required in connection with the application That Johnston County has substantially complied or will substantially comply with all Federal , State , and local laws , rules , regulations , and ordinances applicable to the project and to Federal and State grants and loans pertaining thereto Adopted this the 7th day of May , 2001 at Smithfield , North Carolina 24 School Board Presentation - Teacher Recruitment and Retention Kay Carroll , chairman of the Board of Education , thanked the Commissioners for the opportunity to discuss the issue of teacher recruitment and retention He recognized other School Board members , Fred Bartholomew , Dorothy Johnson , Jack O’Hale and Joan Price , which were present , and also acknowledged School Superintendent , Dr Jim Causby Page7555 Mr Carroll stated the problem of recruiting and retaining qualified teachers involves more than additional supplement pay Providing more teacher assistants and reducing class sizes are also very important The shortage of teachers is a National and State problem , and obviously those who pay the highest and offer a good place to work will get the most qualified teachers Johnston County is doing all they can to provide a good working environment for teachers , and the turnover rate for the County is slightly less than the State average , however , we still have to compete with other school systems such as Wake , Durham , Orange and Chapel Hill who pay higher supplements He noted that by the same token , we also compete with counties to our east and south such as Wilson , Wayne , Sampson , Harnett and Nash , most of which we compare favorably with in regard to teacher pay Concerning the effort to provide a good working environment , Johnston County has spent over 230,000,000 since 1990 on replacing older facilities , building new facilities to meet growth and renovating schools that were built in the 1960 s and 70 s The School Board is requesting the Board of Commissioners call for another bond referendum in November 2001 for 78,000,000 , which will finally replace all the old three - story schools in the County and hopefully provide new elementary and middle schools in growth areas Mr Carroll noted the School Board has also undertaken a strong facilities maintenance program to make sure the new facilities are kept up - to - date for the future In addition to better facilities , a number of programs have been put into effect to encourage good teachers to stay in the County Mentor programs and support staff for new and beginning teachers , the new student code of conduct and appearance policies , employment incentive packages , and strong staff development programs help keep good teachers from leaving for higher pay The County is now recruiting nationwide through recruiting teams , job fairs , and over the Internet In addition , financial assistance is offered for advanced study , and housing assistance and discounts are available Mr Carroll stated the Board of Education considered three proposals for increasing teacher supplements over the next five years His Board finally adopted a program that would increase supplements in FY 01 - 02 to a range of 6 to 9 , depending on years of experience , and would increase yearly until FY 2005 - 06 when the range would be 10 to 13 The total cost for the upcoming year would be 1,192,299 , with additional cost for the remaining years of 4,131,883 In response to a question from Commissioner Allen L Mims , Jr , it was explained the supplements would be for all certified personnel Commissioner Thomas M Moore stated he would support this and would even like to see the County able to do more He noted by necessity , the focus in the past few years has been on building facilities , but more emphasis needs to be put on the classroom In response to Commissioner Wade M Stewart’s comment that Wake and other western counties will also be raising their supplements , Mr Carroll pointed out that Johnston County does have some advantages over the larger systems Commissioner Fred Smith pointed out that even though the supplement is less , the cost of living in Johnston County is also less ; which helps to offset the situation Commissioner Smith noted that Johnston County schools are doing a good job , thanks to Superintendent Jim Causby and the efforts of the School Board and the County Commissioners over the past few years He pointed out the County is in the process of trying to get a higher bond rating , and stressed the importance of this as it would provide significant savings on all future debt While he voiced understanding that the School Board needs additional funding , he asked them to remember what the County is up against with the declining economy , the State withholding our revenues and the additional cost of services The Commissioners must look at the whole picture and decide on how to balance the short term and long term needs of all three groups of constituencies the school system , other governmental agencies , and the taxpayer Chairman Carroll stated that comment has been made in the past that the County must stay within the scope of the financial model He suggested the model was never intended to keep budgets down or be a strap applied to anyone , but was put into place to predict how revenues and expenditures would affect what the County could or could not do He questioned the revenue figures and stressed we all need to deal with both sides of the model In response , Commissioner Smith suggested the model might need some review in the near future Page8556 Chairman Langdon noted , in his opinion , the model has done what is was created to do The Commissioners have been able to give the Board of Education more each year He thanked Mr Carroll for his presentation 25 Davenport Report - Financial Analysis Chairman Langdon asked David Rose with Davenport and Company to update the Board on the financial analysis he has been working on for the County He noted Mr Rose accompanied him and
