July 2 , 9 , 30 , 2001 Meetings Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the July 2 , 9 , and 30 , 2001 board meetings as presented 2 Resolution of Employee Appreciation and Presentation of Service Pins Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board adopted the following resolution of appreciation for County Employees JOHNSTON COUNTY EMPLOYEE APPRECIATION WEEK August 6 - August 10 , 2001 WHEREAS Johnston County Employees represent approximately 850 men and women , working in 29 different service departments and agencies , devoted to making Johnston County a better place to work and live ; and WHEREAS Johnston County employees provide a multitude of services for ALL the citizens of the County - the farmer , the retailer , the industrial businessman , the homeless , the jobless , the homeowner , the veteran , the disaster victim , the victim of violence , the sick , the poor , the educated , the uneducated , the youth , the elderly , the newcomer , and the old - timer ; and WHEREAS Johnston County employees are both skilled and efficient in their jobs , making every effort to expend county tax dollars in the most effective way for the betterment of the County and its citizens ; and WHEREAS Johnston County Government runs smoothly on a day to day basis primarily because of the dedicated employees in each of its departments and agencies NOW , THEREFORE , in appreciation for their dedication to the welfare of the citizens of our County , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS DOES HEREBY PROCLAIM the week of August 6 - 10 , 2001 as COUNTY EMPLOYEE APPRECIATION WEEK Adopted this the 6th day of August , 2001 Public Comments 3 Request to Place “ Sale of Malt Beverages in Rural Johnston County ” on the November Ballot Deirdre Jersey from the Cleveland Community presented a petition with over 1400 signatures requesting the Board call for a referendum at the November 2001 election on the issue of the sale of malt beverages in rural Johnston County Mark Creech , with the Christian Action Coalition , opposed the request He pointed out the problems related to alcohol abuse , and noted , in his opinion , the County would be sending the wrong kind of message to have this on the same ballot with the school and community college bond issues Later in the meeting , a motion by Commissioner Moore to put this issue on the November ballot th failed for lack of a second Board members agreed to wait until the September 4 meeting to make a decision 4 Bill in General Assembly Concerning Authority for Additional Tourism Tax Bud Andrews , chairman of the Tourism Authority , requested the Board vote to leave Johnston County on a local bill in the General Assembly that would authorize an additional 3 cents in tourism tax He explained the Authority first became interested in the possibility of an occupancy tax increase to buildPage645 a convention center for the County about three years ago when the Town of Selma asked for a tax increase that would benefit the town only A study was initiated with over 300 people involved Those in the study agreed that the Board of Commissioners would not be approached unless the results of the study were positive The initial report is in and the results look promising for a possible future endeavor He stated the Tourism Authority is not asking the Board to approve an occupancy tax to build a convention center at this time , but is asking the Board to support including Johnston County in the General Assembly’s local option bill for the future Also speaking in support of leaving Johnston County in the bill were Rick Childrey with the Smithfield Selma Chamber of Commerce , Joe Moore , Mayor of Selma , Deirdre Jersey from Cleveland Community , Pete Connet , Smithfield Manager , and Hank Daniels , motel owner and member of the Tourism Authority Ms Jersey stated she would like to see some modification of the language of the bill concerning how any future tax funds would be distributed Speaking in opposition were motel owner operators , Becky Brannon with the Royal Inn in Selma , Jimmy Patel with the Holiday Inn Express and Charles Patel with the Kenly Best Western They voiced concern that this added tax would hurt their business Senator Allen Wellons stated he would appreciate direction from the Board as to whether to leave Johnston County in or remove them from the local option bill Commissioner Allen L Mims , Jr stated he would not vote for a tax increase , but would have no problem with leaving Johnston County in the bill for the future , should it ever be needed Commissioner Wade M Stewart noted he also would not vote for an additional occupancy tax , and feels the Commissioners should not be asked to make a decision on whether Johnston County stays in or comes out of the local bill since the initial request to the General Assembly did not come from this Board Commissioner W Ray Woodall stated he would oppose any increase in the tax at this time , and noted the information he received shows the 3 - cent increase , even if approved , would not cover the cost and operation of the proposed facility He questioned from where the 15 million shortfall would come Commissioner Cookie Pope commented the County should not be asked to make a decision for the legislators The County may at some point need to look at a convention center , but not at this time , especially without the support of the hotel motel operators She noted she would oppose any additional taxes on the citizens of Johnston County Commissioner Thomas M Moore stated he would have no problem with the County having the authority for the future , but in his opinion , the bill needs to be modified , and other resources possibly looked at , such as a prepared food tax to take the entire burden off the motel owners He stated he would oppose a convention center that would not be self - supporting Commissioner Fred Smith stated if this authority is needed in the future , the General Assembly can address it at that time He suggested there has been no demonstrated need , and to consider other taxes at this point would , in his opinion , cloud the School and Community College Bond issues , which are critical to Johnston County He voiced his belief that there are too many questions regarding the preliminary feasibility report and the nature of the bill to make any recommendation without further study Chairman Langdon pointed out the reason this has come up at this time is because of the initial Selma request He suggested that since Senator Wellons and others present have heard the Board’s comments , it would not be necessary to take any action on this matter 5 Public Hearing 10 15 am - Expansion of County Landfill - New Subtitle D Cell Advertised July 6 , 2001 in The Smithfield Hearld The Chairman opened the public hearing and invited public comment on the proposed expansion of the County Landfill to include a new Subtitle D Cell and remediation improvements Haywood Phthisic , Director of Operations , showed a map of the existing landfill He noted this project includes a new cell that will be located between cells 3 and 4 , which have been capped and closed for several years The project also will provide remediation of the closed cells This expansion is expected to provide space for the County until approximately 2012 Deirdre Jersey from the Cleveland area asked about the overall life of the existing landfill , and if there are plans to use the methane gas generated Mr Phthisic responded the County is considering uses of the methane gas , and the projected life of the existing facility is between 35 and 40 years There being no further comments , the Chairman closed the public hearing Page646 6 Change in Service Level - Archer Lodge Fire Department Upon a motion by Commissioner Fred Smith , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution for tax exempt status for the Archer’s Lodge Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Archers Lodge Volunteer Fire Department , Inc the “ VFD ” from Four Oaks Bank & Trust Company , in the principal amount of 450,000 , which loan is for the following purpose The construction of a fire department building , which will be operated and maintained by the VFD and will be located at 6483 Covered Bridge Road , Clayton , NC 27520 9 Introduction of Bond Order and Call for Public Hearing - Request for Matching Funds for DOT Grant - JCATS Facility Donna Creech , executive director of Council on Aging , and Ray Woodall , director of JCATS , requested a commitment of 25,000 from the County as matching funds for a 225,000 building grant from the NC Department of Transportation The money will be used to purchase land and build a new JCATS facility in Selma Ms Creech noted the County could recoup its cost if they decide to sell the property on which JCATS currently is located In response to a comment from Commissioner Woodall , Ms Creech stated the 250,000 would pay for both the property and the new facility Following discussion , Commissioner Cookie Pope moved the Board approve the following budget amendment from contingencies in the amount of 25,000 as a match for the DOT grant for JCATS with the understanding this would be reimbursed when the current property is sold Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote FUND BUDGET LINE ITEM REQUESTED CHANGE CODE CLASSIFICATION EXPENDITURE INCREASE DECREASE 10 58556230 Council on Aging 25,00000 10 58555710 Contingencies 25,00000 13 Purchase of Two - Ton Truck for Public Utilities Haywood Phthisic , Director of Utilities Operations , requested the Board approve the purchase of a Mack Midliner truck for his department from Tom Bailey Motors , Inc in Rocky Mount in the amount of 36,069 The 2 - ton diesel truck with cab over engine and short turn radius is on the State contract list , and falls within the provision of NCGS § 143 - 129 g , which states that formal bid procedure does not apply where equipment has been subject to a valid bid in another jurisdiction within the last 12 months He asked the Board to allow his office to piggyback on the State Contract and purchase the truck in accordance with this statute Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the purchase of the Midliner truck as requested based on the provisions of NCGS § 143 - 129 g 14 GIS Technical Services Engineer Tim Broome explained the Utilities Department wishes to hire a consultant with professional skills and experience to prepare the layers of unmapped water and sewer utilities for the County GIS system This work would include field surveying and computer aided drafting to create the layers NCGS § 143 - 64 does not allow the County to seek competitive fee - based quotes for professional services unless the Board exempts itself in writing from this statute for reasons deemed appropriate He requested the Board formally exempt Johnston County from NCGS § 143 - 64 so outside technical services can be obtained Following discussion , Commissioner Fred Smith moved the Board exempt Johnston County from NCGS § 143 - 64 , and authorize staff to obtain outside technical services for the GIS mapping project described above Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 15 Selection of Engineering Consultants for Ingrams Township and Buffalo Water Districts Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board recessed regular session to sit simultaneously as the Ingrams Township and Buffalo Water District Boards PagePage pageNumber7650 Mr Broome explained the Utilities Department received proposals from the following engineering consultants for design and bidding services for these two water districts McKim & Creed , Cary and Smithfield , NC The Rose Group , Raleigh , NC Dewberry & Davis , Raleigh , NC TRC Triangle , Raleigh , NC The Wooten Company , Raleigh , NC Taylor , Wiseman & Taylor , Raleigh , NC Withers and Ravenel , Cary , NC Draper Aden , Apex , NC Buffalo District Only WK Dickson , Raleigh , NC KCI , Raleigh , NC Municiapl Eng Services , Garner , NC He noted the firms were evaluated by staff and ranked according to proximity to project , experience in similar projects , project team qualifications , past performance history , and ability to meet schedules The list was shortened to the following five firms , whose references were contacted and a final ranking was determined FIRM FINAL RANKING McKim & Creed , Cary and Smithfield , NC 478 Dewberry & Davis , Raleigh , NC 423 The Wooten Company , Raleigh , NC 413 Withers and Ravenel , Cary , NC 375 WK Dickson , Raleigh , NC 363 Based on the scope and time frame of the projects , staff recommended award of contract to Dewberry & Davis of Raleigh for the Ingrams Township Water District project , and McKim and Creed Engineers of Cary and Smithfield for the Buffalo Water District project Final agreements would be negotiated based on USDA - 7 19 01 Tax refunds - Personal Real Property 57993 Tax releases - Personal Real Property 2,65019 Motor Vehicle releases refunds 1,53010 John R Massey , County Finance Officer 23 Tax Collection Report Pat Goddard , Tax Administrator , reported her office has turned over to the Attorney for collection 130 accounts , which represent 23 million in over due taxes from 1996 until present Demand letters have been sent out , and 27 complaints have been filed with the court system with more scheduled in the near future In response to comments from Board members , Ms Goddard explained if the County forecloses on the property , they can either have a public auction or take negotiated offers Concerning the upcoming revaluation , Ms Goddard stated the process is moving forward as expected with some things slightly behind schedule , and others slightly ahead of schedule She noted that approximately 80,000 tax bills for 2001 are being mailed within the next few days Tax Administrator Authorized to Collect Taxes Following further discussion , Commissioner Fred Smith moved the Board authorize the Tax Administrator to use whatever means are necessary to collect County taxes Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Board Reports & Comments 24 Residency Requirement for Supervisory Level Employees Commissioner W Ray Woodall suggested the Board consider adopting a policy whereby persons hired at a supervisory level or higher be required to move into the County within 12 months There being no further business , Commissioner W Ray Woodall moved the Board recess until 6 30 pm Monday , August 13 , 2001 Commissioner Cookie Pope seconded the motion , which carried by unanimous vote __________________________________________ James H Langdon , Jr , Chairman ______________________________ Joyce H Ennis , Clerk to the BoardPage
