10 676 September 10 , 2001 The Johnston County Board of Commissioners met in regular session on Monday , September 10 , 2001 at 7 00 pm in the Commissioners ’ Room , Johnston County Courthouse Annex , Smithfield , North Carolina with the following members Present James H Langdon , Jr , Chairman , Cookie Pope , Vice - Chairman , Thomas M Moore , Allen L Mims , Jr , Fred Smith and W Ray Woodall Absent Wade M Stewart Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , , and J Mark Payne , County Attorney Due to a power outage , the meeting was moved to the Emergency Operations Center in the Law Enforcement Center , Johnston County Courthouse The Chairman called the meeting to order and the following business was transacted Public Comments - No one spoke at this time 1 Public Hearing 7 00 pm - Changes to Zoning Map - MTD Boundaries Advertised The Smithfield Herald - August 17 , 2001 The Chairman opened the public hearing and invited anyone who wished to make public comment on the proposed boundaries for Municipal Transition Districts MTD’s The proposed boundaries , which are recommended for approval by the Planning Board , would extend approximately one mile from the existing municipal ETJ boundaries Steve Biggs , Clayton Town Manager , applauded the Board for their overall progressive stance on planning issues in the County He noted that Clayton endorses the concept of MTD’s , but feels that the boundaries should not be approved for them until ETJ issues are dealt with He asked JD Solomon , Planning Consultant for the Town , to further explain Clayton’s position on this matter Mr Solomon stated the greatest concern for Clayton is extra - territorial jurisdiction ETJ area He pointed out that Clayton currently is without a Planning Director , and until this position is filled and they have time to look at the overall plan for orderly growth and development in and around the town , they would prefer not to have the MTD boundaries set He asked the Board , if they approve the MTD’s throughout the County , to delay the effective date for Clayton for at least a year Commissioner Fred Smith noted the County does not want to put any undue pressure on the Town and suggested Clayton might want a two year delay before this becomes effective for them Commissioner Allen L Mims , Jr noted that Clayton is different from other towns in that it already has water and sewer in place outside the town limits Mayor Don Johnson , Town of Benson , expressed concern about whether the MTD’s would be applied uniformly , and noted some of the towns have different ideas for how they want to see growth occur in their area The Town of Benson wants their community to maintain the same character it has had over the years He also questioned the 5 foot setback that was referenced in the material sent to the towns from the Planning Department Staff explained the 5 setback was a typographical error that should have been 25 There being no further comments , the Chairman Closed the Public Hearing Decision On Changes To Zoning Map - MTD Boundaries Upon a motion by Commissioner Fred Smith , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the proposed changes to zoning maps to include MTD Boundaries , with the understanding the boundaries around the Town of Clayton will not become effective until September , 2003 Page677 2 Public Hearing - 7 00 pm - Rezoning Cases and Special Use Permits Advertised - August 28 , 2001 and September 4 , 2001 - In the Smithfield Herald - Certified letters were mailed to adjoining property owners on 08 30 2001 and notices posted at the locations on 08 28 2001 The Chairman opened the rezoning public hearing and invited interested persons to make comments on the following cases Case 558 Petition to rezone approximately 1 acre located on Sanders Road SR 1517 in Pleasant Grove Township from Agricultural Residential to Community Business - Special Use District Owners and Applicants Donald Ray Lee and Annie Lois Lee Dave Roesler , Assistant Planning Director stated the property is located on Old Sanders Road near the I - 40 Interchange The surrounding zoning is Agricultural Residential , Mobile Home Park District and Community Business Property owner and applicant , Donald Lee , stated he owns the convenient store adjacent to the property and wants to provide additional parking This property would also have a driveway from Sanders Road so customers could enter without going through the NC 50 intersection He plans to use an existing mobile home on the property as an office Mr Roesler stated the Planning Board recommended approval due to it being a logical extension of the business The Chairman Recessed the Rezoning Public Hearing Decision on Rezoning Case 558 Case 558 Petition to rezone approximately 1 acre located on Sanders Road SR 1517 in Pleasant Grove Township from Agricultural Residential to Community Business - Special Use District Owners and Applicants Donald Ray Lee and Annie Lois Lee Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved rezoning case 558 for Donald Ray Lee and Annie Lois Lee of approximately 1 acre located on Sanders Road SR 1517 in Pleasant Grove Township from Agricultural Residential to Community Business - Special Use District The Chairman Opened the Public Hearing on Special Use Permit Request Those wishing to speak on Case 558 were sworn in by the Clerk to the Board Case 558 Special use permit application for parking overflow from his convenient store ; structure to be used for an office on approximately 1 acre located on Sanders Road SR 1517 in Pleasant Grove Township Owners and Applicants Donald Ray Lee and Annie Lois Lee Mr Roesler , Assistant Planning Director presented the following summary of evidence on Case # 558 A pre - application hearing was held with the applicant on June 11 , 2001 At that time the applicant was informed of the following If approved , applicant must provide to the Planning Office a Site Plan for their review and approval Applicant must comply with the requirements of the Johnston County Development Ordinance regarding landscaping , buffering and fencing or any additional requirements as approved by this Board Applicant will be notified in writing of the Board’s decision If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of Commissioners Applicant’s Special Use Permit will expire at the end of twelve 12 months if it is not used as permitted within that time period When necessary , staff informed the applicant of further Planning Office requirements and thePage678 requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements Subsequent to the pre - Opened the Rezoning Public HearingPage679 Case 559 Petition to rezone approximately 40 acre located on Covered Bridge Road SR 1700 in Wilders Township from Agricultural Residential to Community Business - Special Use District Owners and Applicants Frank J Stokes and Cynthia L Stokes Commissioner Fred Smith asked to abstain from discussion and voting on rezoning case 559 Mr Roesler stated the property is located on Covered Bridge Road near the Clayton City limits The surrounding zoning is Agricultural Residential and commercial George Smith , 3874 Covered Bridge Road , Clayton , stated he was speaking on behalf of a group of people in his neighborhood who presented a petition of opposition at the Planning Board He noted the primary concern is one of public health and environment since this is such a small area near private dwellings with wells He also expressed concern about the noise level with 30 - 40 dogs barking He noted they have a close knit community with mostly retirees and feel it will affect our quality of life Jake Austin of Riverwood Drive , representing the owners and developers of the Riverwood Athletic Club , agreed with the comments from Mr Smith and added an additional concern that this rezoning would adversely effect property values in the area He noted the Board of Directors of the Riverwood Athletic Club unanimously agreed not to support this rezoning Mr Roesler stated the Planning Board recommended denial based on the proximity to the Riverwood property and the fact that the existing barn is almost on the line which would create setback problems The Planning Board also felt that so many dogs would be a noise factor in such a small area The Town of Clayton , whose town limits are adjacent to the property , has also requested the rezoning be denied The Chairman Recessed the Rezoning Public Hearing Decision on Rezoning Case 559 Case 559 Petition to rezone approximately 40 acre located on Covered Bridge Road SR 1700 in Wilders Township from Agricultural Residential to Community Business - Special Use District Owners and Applicants Frank J Stokes and Cynthia L Stokes Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board denied rezoning case 559 for owners and applicants , Frank J Stokes and Cynthia L Stokes of approximately 40 acres located on Covered Bridge Road SR 1700 in Wilders Township from Agricultural Residential to Community Business - Special Use District The Chairman Re - opened the Rezoning Public Hearing Case 560 Petition to rezone approximately 675 acre located on Faith Church Road SR 1151 in Ingrams Township from Agricultural Residential to General Business - Special Use Permit Owner and Applicant Pablo Sergio Alonso Mr Roesler noted the property is located on Faith Church Road near the southwest intersection of Mill Church Road The applicant has operated as a non - conforming use on the property since the County was zoned , however he now wishes to expand his operation The surrounding zoning is mostly agricultural residential Pablo Sergio Alonso , 30 Faith Church Road , stated that concerns were voiced at the Planning Board meeting of antifreeze and other contaminants in the soil The soil has been tested and no contaminants were found He noted that he has operated a small mechanic shop on the property for ten years and has done everything that the Planning Department has asked him to do Mr Alonzo presented a petition from neighbors stating they were not against the rezoning Mr Roesler stated the Planning Board recommended denial due to the location being in a rural residential area The business could continue under current stipulations , but they felt that additional vehicles could cause an appearance issue as well as environmental concerns The Chairman Recessed the Rezoning Public HearingPagePage pageNumber5680 Decision on Rezoning Case 560 Case 560 Petition to rezone approximately 675 acre located on Faith Church Road SR 1151 in Ingrams Township from Agricultural Residential to General Business - Special Use Permit Owner and Applicant Pablo Sergio Alonso Commissioner Fred Smith stated he would like to hear from Commissioner Wade Stewart since this property is located in his district , and suggested this decision be tabled until next month Following discussion , Commissioner Cookie Pope moved the Board table rezoning Case 560 for Pablo Sergio Alonso of approximately 675 acre located on Faith Church Road SR 1151 in Ingrams Township th from Agricultural Residential to General Business until the October 8 meeting Commissioner W Ray Woodall seconded the motion which carried by the following vote Ayes James H Langdon , Jr , Thomas M Moore , Cookie Pope , W Ray Woodall and Fred Smith Nays Allen L Mims , Jr The Chairman Re - opened the Rezoning Public Hearing Case 562 Petition to rezone approximately 300 acres located on Brogden Road SR 1007 in Boon Hill Township from Agricultural Residential to Industrial 1 - Special Use District Owner James Paul Edwards , Inc ; Agent Cinda Moore , Jimmy Barbour Land Surveying Mr Roesler stated the property is located on Brogden Road about ½ mile from I - 95 and 500 feet from the Smithfield Planning District The area is mostly agricultural residential with no commercial zoning There is one small subdivision , Green Meadows , near the location Dan Simmons with TRC Triangle , Inc , spoke on behalf of the owner , J P Edwards , Inc He noted the company wishes to relocate its maintenance facility to this site next to Zack Whitley’s residence in order to provide needed space , a better location , and more security The facility would be well off the road and away from residential development Mr Roesler stated the Planning Board recommended approval The Chairman Recessed the Rezoning Public Hearing Decision on Rezoning Case 562 Case 562 Petition to rezone approximately 300 acres located on Brogden Road SR 1007 in Boon Hill Township from Agricultural Residential to Industrial 1 - Special Use District The Chairman Re - opened the Public Hearing on Special Use Permit Request Case 562 Special use permit application for a construction business , office , storage of equipment on approximately 300 acres located on Brogden Road SR 1007 in Boon Hill Township Owner James Paul Edwards , Inc ; Agent Cinda Moore , Jimmy Barbour Land Surveying Those wishing to speak on rezoning case 562 were sworn in by the Clerk to the Board Dan Simmons stated the owners have agreed with the conditions suggested by the Planning Board , but question the request to move the driveway to the other side of the property since the adjoining open land is owned by Mr Whitley , who is a family member and part of the company Mr Roesler responded that this suggestion was added in an effort to eliminate possible problems for future property owners He presented the following summary of evidence on this case PagePage pageNumber6681 A pre - Special Use District Ardieth Lupton , an employee of W E Blackmon , stated Mr Blackmon is moving his business from the downtown area of Wilson’s Mills at the request of the town council , so they can proceed with plans for downtown revitalization Margaret Small , who lives near the site , opposed the rezoning She noted the neighborhood has a number of young children and voiced concern about the increase in traffic that will be generated by the company She also pointed out that Powhatan Road at this location has blind areas from both directions , which would make it a dangerous place for a driveway Mr Roesler stated the Planning Board recommended approval due to the site being well buffered with trees and the railroad being located along the southern border of the property A letter was received from the Town of Wilson’s Mills supporting the rezoning The Chairman Recessed the Rezoning Public Hearing Decision on Rezoning Case 564 Case 564 Petition to rezone approximately 800 acres located on Powhatan Road SR 1901 in Wilson’s Mills from Agricultural Residential to Industrial I - Amendment to Development Ordinance - Cell Towers Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board scheduled a public hearing for October 8 , 2001 at 6 30 pm on an amendment to the County Development Ordinance , Article 6 , Section 712 concerning telecommunication cellular towers in the County Board Reports & Comments 4 Report on Memorial Monuments Commissioner W Ray Woodall reported he contacted the Johnston County Veterans Council members and was told the dates chosen for the war monument in question represent not the beginning and ending dates , but the era of the three conflicts , World War II , the Korean War and the Vietnam War , as they relate to the service of war veterans These dates were officially established by a Congressional Act and are recorded as Title 38 of the US Code J P George of Smithfield again questioned the use of these dates instead of the official dates the wars ended It was suggested if Mr George wished to pursue this further that he contact the Johnston County Veterans Council members 5 Update on Lee Road Closing In answer to a question from Commissioner Cookie Pope concerning the status of the Lee Road closing , Mr Langdon stated that NCDOT has indicated the road will not be reopened unless something can be done to make the intersection safe They recently investigated the possibility of having a 3 - way stop sign ; however , it was determined this would not be effective They are now looking at other possibilities 6 Upcoming Vote on Bond Issues Board members briefly discussed the upcoming vote on the 75 million School Bond Issue and the 2 million Community College Issue It was noted that Board members will probably be asked to participate in public community meetings in support of the referendum There being no further business , Commissioner Allen L Mims , Jr moved the Board adjourn Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote ____________________________ James H Langdon , Jr , Chairman _____________________________ Joyce H Ennis , ClerkPage
