10 685 October 1 , 2001 The Johnston County Board of Commissioners met in regular session Monday , October 1 , 2001 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer 1 Minutes - September 4 , 10 , 2001 Meetings Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the minutes of the September 4 , 10 , 2001 board meetings as presented Public Comments 2 Leadership Johnston - Development Program Chris Johnson of Smithfield , Deirdre Jersey of the Cleveland Community , and Don Johnson of Benson told the Board of a new development program called Leadership Johnston , which was formed by a partnership of the Chambers of Commerce , the public school system and Johnston Community College They explained the program looks at “ smart growth ” as it relates to education , community involvement , health and human services and economic development , with the goal of showcasing Johnston County as a good place to live , and molding future leaders into finding innovative ways to make the County better They provided a list of innovative ideas for improvement , which were developed by the first group of 16 program participants , and encouraged Board members to participate in the next class beginning soon at the Community College 3 Surplus Property Sheriff Steve Bizzell briefly reviewed with the Board the vehicles his department submitted to be declared surplus In response to a question from Commissioner Wade M Stewart , the Sheriff noted this would be the last of the Dodge Intrepids in his fleet , and stated only a few Chevrolet Lumina are still in operation Following discussion , Commissioner Allen L Mims , Jr moved the Board declare surplus the following vehicles and equipment from the Sheriff’s Department and Public Utilities , and authorize they be sold at the next public auction held by the City of Raleigh and handled by Randy Wester of Wester Auction , with the exception of Sheriff’s car # 16 , which was wrecked and declared totaled by the insurance company Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Sheriff’s Department Year Make Model Vin Mileage 1 1978 GMC Truck - P Thieman Lift ST - 2025 T - 11296 attached to vehicle 1369 Chevrolet 1969 GE539P834515 160644 27928 - P 574 Ford 1983 1FTCF10FDNA59642 153,706 81674 - P 4 Presentation - Inventory of Natural Areas in Johnston County Kate Dixon , executive director of the Triangle Land Conservancy TLC , Harry LaGrand with the NC Natural Heritage Program , and Don Stephenson , instructor with Johnston Community College , who is affiliated with the TLC , presented a findings summary of the recently completed inventory of natural areas in Johnston County Ms Dixon pointed out that Mr LaGrand spent most of 2000 and some of 2001 in Johnston County learning all he could about the different natural land sites and the unusual water habitats The initial inventory of land sites is complete , and the final document will be available in a few weeks Further study is planned on the water habitats Mr LaGrand passed out a summary of the significant sites that were identified and stated many are unprotected He noted the County is extremely fortunate to have the Howell Woods property He voiced appreciation for the help he received from several agencies in the County , as well as the number of citizens who allowed him access to their property Don Stephenson thanked the Board for supporting this project and noted it will provide important information in considering a Planning policy concerning open space requirements In discussion , Commissioner Cookie Pope noted she realizes the importance of protecting the natural sites , but pointed out that with the present economic situation , the Commissioners must put education and protecting the economy of the County first on their agenda Mr Stephenson agreed , but noted , in his opinion , this information will affect the long - RD to make up the shortfall Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Brogden Water District Board adjourned , and regular session was resumed 9 Discussion on Water District Billing - Hardship Cases Commissioner Allen L Mims , Jr suggested the County might need to look at its policy concerning continued water district billing in hardship cases Mr Broome noted he is working on some policy revisions and hopes to have them for the Board to review in November 10 Selection of Consultant for GIS Utility Mapping Mr Broome informed the Board that during the month of August , the Public Utilities Department solicited quotes for a surveying mapping consultant to prepare digital maps of the County’s water and sewer facilities Twelve proposals were received , and staff evaluated the five lowest bidders on the basis of qualifications The low bidders were ranked in the following categories proximity to project , experience on similar projects , qualifications of project team , past history of providing timely service , ability to meet schedule , reference , and fees The low bidders and their composite scores were as follows McKim & Creed - Composite Score 39 The Rose Group - Composite Score 36 Withers & Ravenel - Composite Score 35 Gannett Flemming - Composite Score 35 Concord Engineering - composite Score 28 Based on the ranking , he recommended McKim and Creed Engineers for this project As recommended by staff , Commissioner Fred Smith moved the Board retain the firm of McKim and Creed Engineers to provide utility mapping services at a cost of 735 per feature and 1200 per sheet Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 11 Stormwater Manager Program - 9 19 01 Tax refunds - Personal Real Property 1,36481 Tax releases - Personal Real Property 5,27923 Motor Vehicle releases refunds 2,53974 Recommended by Approved Pat Goddard , Tax Administrator John R Massey , County Finance Officer 13 Update on Delinquent Tax Collections Tax Administrator , Pat Goddard , again updated the Board on delinquent tax collections She noted approximately 700,000 in unpaid taxes has been collected in the past few months , and that figure continues to grow as her office continues to aggressively move forward with foreclosure procedures In response to a question from Commissioner Woodall concerning motor vehicle taxes , Ms Goddard noted the County begins garnishing wages and attaching bank accounts sooner than they did in the past which is impacting the collection rate Ms Goddard also spoke of several new tax laws that are going into effect , particularly the changes in the senior citizens exemption law She noted the minimum income for eligibility was increased to 18,000 , and the exclusion of taxation is up to 20,000 or ½ the value of their home , whichever is greater Board Reports and Comments 14 J H Langdon , Jr to Chair NCACC Subcommittee on Public Education Chairman Langdon announced he has been asked by the NC Association of County Commissioners to chair the subcommittee on public education 15 Narrow Bridges on NC Highway 39 North of Selma Commissioner W Ray Woodall spoke of a recent accident at the Buffalo Creek Bridge on NC 39 North He voiced concern that the bridge is a serious safety hazard because it is so narrow that it is difficult to pass an oncoming vehicle He suggested the Board request the North Carolina Department of Transportation NCDOT to widen or replace the structure In discussion , it was noted that several years ago , a previous Board made a similar request concerning this bridge and the one over Little Creek located further north on NC 39 , and were told there were no plans to make any improvements to the structures Following discussion , Commissioner W Ray Woodall moved the Board instruct the County Attorney to draft a resolution to the NCDOT on this matter for the Board’s consideration at their October th 8 meeting Commissioner Fred Smith seconded the motion , which carried by unanimous vote 16 Resolution Rescinded on Lee Road Closing Following discussion on the status of the Lee Road closing , Commissioner Allen L Mims , Jr moved the Board rescind its resolution of January 2 , 2001 requesting the road be closed , and formally asked the NCDOT to erect three - way stop signs at the intersection , place adequate “ stop ahead ” noticesPage1695 and highway markings before the intersection in each direction , and reduce the speed limit to 45 mph on Barber Mill Road , or take whatever other appropriate measures they see fit in order for the intersection to be reopened Commissioner Cookie Pope seconded the motion , which carried by unanimous vote At the suggestion of Commissioner Fred Smith , the Chairman agreed to call Senator Allen Wellons and asked his support in this request Reference Minutes of January 2 , 2001 book 22 , p 418 and minutes of August 13 , 2001 book 22 , p 658 17 Entrance to West Johnston High School Board members voiced concern with the potential traffic safety at the proposed entrance to the new West Johnston High School and discussed various methods of making their concerns known to school personnel and the Department of Transportation 18 Press Asked to Support School and Community Bond Issues Commissioner Fred Smith asked the press to support the upcoming School and Community College bond issues , and let their readers know that even in this period of economic concern nationwide , the County’s financial status is secure Commissioner Thomas M Moore agreed and noted the Board will continue to look at ways to make this government more cost effective 19 Other Comments and Updates The Board briefly discussed the following issues Finance Committee on Refinancing , appointed by the Chairman , to continue to look at finance issues Progress on the Belk Building -
