10 708 November 5 , 2001 The Johnston County Board of Commissioners met in regular session Monday , November 5 , 2001 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer 1 Minutes - October 1 , 8 , 2001 Meetings Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the October 1 , 8 , 2001 board meetings as presented Public Comments - No one spoke at this time 2 Proclamation - Veterans Day November 11 , 2001 Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board adopted the following proclamation declaring November 11 , 2001 as Veterans Day in Johnston County P R O C L A M A T I O N - V E T E R A N S D A Y - 2001 th WHEREAS , for decades America has paused on the 11 of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in the United States Constitution and the Bill of Rights ; and WHEREAS , Americans owe a great debt to all those who have served in defense of this nation throughout the generations ; for their sacrifices , often resulting in permanent injury or death , which have preserved our unique form of government dedicated to human right and respect for the individual , and preserved our freedoms and promise of liberty as an example for oppressed persons of the world ; and WHEREAS , in honor of these dedicated men and women , we pledge our continued defense of our nation so that their sacrifice will stand before all the world as a tribute to the spirit and determination of a people dedicated to the principle of freedom and democracy NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim November 11 , 2001 , as “ Veterans Day ” in Johnston County , and urge our citizens to commend its observance th Proclaimed this the 5 day of November , 2001 3 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Hillside Lane in Hillside Subdivision , O’Neals Township Sunray Drive and Starbright Lane in Sunray Village Subdivision , Section I & II , Wilson’s Mills Township Carrington Drive , Nightshade Lane , Waterlily Circle , Heron Circle , Buttercup Court , and Juniper Court in Carrington Place Subdivision , Clayton Township Commissioner Cookie Pope moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Wade M Stewart seconded the motion which carried by unanimous vote Page709 4 HAPP - Request to Close Waiting List and Revise Administrative Plan Anne Eason , Housing Assistance Payment Program HAPP Director , requested approval to close her agency’s waiting list as of December 1 , 2001 She explained the waiting list would be reopened when most of the current 600 families are either served or purged from the list at the annual purge date In addition , Ms Eason asked the Board to approve a revision to the HAPP Administrative Plan to include required changes by HUD as follows ? Remove references to “ One Strike Policy ” in terminations from the program ? Increase the length of time since a family was evicted from federal housing from 3 years to 5 years before he can be admitted to the program ? Make available a copy of the criminal record that is used to deny application or continuation of HAPP assistance A notice will be put on the bottom of the person’s letter stating the criminal record check was used and a copy is available for them in the HAPP office Commissioner Fred Smith remarked on the number of people on the waiting list Ms Eason responded that one of the problems is the high rents in Johnston County , especially in the western portion She noted a few years ago she could serve two or three families for what it costs for one family today , and unfortunately , the funding from HUD has not increased proportionately Following discussion , Commissioner Fred Smith moved the Board approve HAPP closing the waiting list effective December 1 , 2001 and approve the changes to the administrative plan as requested Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 5 Highway Safety Project Grant Resolution - Sheriff’s Department Sheriff Steve Bizzell stated his Department has the opportunity again this year to apply for a Highway Safety Project Grant The grant funds , in the amount of 28,800 , would be used to provide the computer and communication equipment Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution authorizing the Sheriff’s office to apply for a Highway Safety Project Grant in the amount of 28,800 RESOLUTION WHEREAS , the Johnston County Sheriff’s Office , herein called the “ Applicant , ” has thoroughly considered the problem , addressed in the application entitled Application for Highway Safety Project Grant , and has reviewed the project described in the application ; and WHEREAS , under the terms of Public Law 89 - NCDENR Requirements Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board adopted the following resolution outlining the County’s compliance with State rules of the Solid Waste Management Act PagePage pageNumber5712 JOHNSTON COUNTY RESOLUTION TO MERGE EXISTING SOLID WASTE UNITS and APPROVE PHASE 4A OF THE JOHNSTON COUNTY LANDFILL WHEREAS , T15A , NCAC 13B 1618 c 5 A requires approval of a proposed landfill site by the governing Board of County Commissioners ; and , WHEREAS , existing and adjacent solid waste units currently permitted under North Carolina Solid Waste Permits # 51 - 01 and # 51 - 02 will be joined under a new North Carolina Solid Waste Permit ; and , WHEREAS , the proposed Phase 4A landfill is a Subtitle D municipal solid waste MSW facility consisting of approximately 314 acres of lined waste footprint between and partially overlying existing Phases 3 and 4 existing permit # 51 - 01 ; and , WHEREAS , the proposed Phase 4A landfill unit meets all County zoning requirements and is consistent with the current Johnston County Solid Waste Management Plan ; and , WHEREAS , the proposed Phase 4A will provide up to 2,100,000 cubic yards of net volume of waste which is projected to last up to 11 years ; and , WHEREAS , this increases the total lined cell acreage and volume of air space in the Johnston County Solid Waste Management Plan to 1493 acres and 8,600,000 cubic yards respectively ; and , WHEREAS , this provides Johnston County , at current and projected County MSW disposal rates , approximately 30 - 02 and the proposed Phase 4A landfill cell th Adopted by the Johnston County Board of Commissioners during regular session on this 5 day of November 2001 9 Award of Bid - Utility Pipeline Crossing of Neuse River th The Board reviewed the following bids which were opened on October 25 for the construction of utility pipeline water main crossing of the Neuse River near the Regional Wastewater Treatment Plant The pipelines consist of a reclaimed water main , a force main and a biosolids transfer main Park Construction , Morrisville , NC 417,78913 T A Loving , Goldsboro , NC 546,85000 Billings & Garrett , Inc , Raleigh , NC 588,00000 J F Wilkerson Contracting , Morrisville , NC 597,00000 Engineer Tim Broome stated that staff is recommending award of contract to low bidder , Park Construction Co of Morrisville in the amount of 417,78913 He noted the bid is under the engineer’s estimate and will be funded by a combination of a Clean Water Management Trust Fund grant and a State low interest loan Upon a motion by Commissioner Fred Smith , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board awarded a contract to low bidder , Park Construction of Morrisville , NC , in the amount of 417,78913 for the construction of a utility pipeline water main crossing of the Neuse River , subject to approval of the State Department of Environment and Natural Resources , Division of Water Quality , Construction grants and loan section 10 Proposed Changes in Water Service Cutoff Policy Tim Broome reviewed with the Board the following proposed changes to the County’s water and wastewater billing and collections policies External lt; Allow more time between the due date and cutoff date by handling cutoffs at the time meters are read This should increase the period billing date from 10 days after due date 25 days after billing date to 15 - Delinquent Tax Collections and Revaluation Tax Administrator , Pat Goddard , updated the Board on the delinquent tax collections She provided information on the number of garnishments , bank attachments and levies for the year and stated the foreclosure procedure is going well She noted all accounts through 1998 have now been turned over to the attorney’s office for foreclosure The total delinquent taxes collected to date are 1,026,65830 with an unpaid balance of 1,346,23897 Concerning the progress of the revaluation , Ms Goddard stated that overall she is pleased with th the way it is going The new board of equalization and review will be meeting on November 19 to consider motor vehicle appeals and discovers She stated she would be sending a copy of the minutes of E & R board meetings to the Commissioners Board Reports and Comments 15 Report on Transportation Committee Commissioner Fred Smith reported the Transportation Committee met to discuss the projects to be recommended for the State Transportation Improvement Program TIP He noted the 70 by -
