10 760 January 7 , 2002 The Johnston County Board of Commissioners met in regular session Monday , January 7 , 2002 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes - December 3 , 10 , 2001 Board Meetings Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the December 3 , 10 , 2001 board meetings as presented 2 Commissioners Comment on the Challenges for the Future Commissioner Cookie Pope voiced her feelings that with the nation at war , unemployment higher than in recent history , and state government with serious budgetary problems , the County needs to look at new ways to do things and make sure we are operating as economically as possible Later in the meeting , Commissioner Thomas M Moore agreed with Commissioner Pope’s comments and suggested the County must look for more cost effective ways to provide services Public Comments - No one spoke at this time 3 Resolution of Appointment - Deputy Map and Plat Review Officer Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board adopted the following resolution appointing Tammy Blackmon as a Deputy Map and Plat Review Officer for the County RESOLUTION OF APPOINTMENT th WHEREAS , NC Senate Bill 875 , ratified the 8 day of July , 1997 , revised Article 2 of Chapter 47 of the NC General Statutes by adding section 47 - 302 to require the Board of Commissioners of each county to designate by name one or more persons as a Review Officer to review each map and plat required to be submitted for review before recordation by the Register of Deeds ; and WHEREAS , the Johnston County Board of Commissioners has reviewed the requirements for this position and discussed the qualifications needed to perform this duty NOW , THEREFORE , the Johnston County Board of Commissioners does hereby appoint Tammy Blackmon in the County Environmental Health Department as a Johnston County Deputy Map and Plat Review Officer th Adopted this the 7 day of January , 2002 4 Nursing Home Adult Care Home Advisory Committee Report - Postponed Due to the fact that Greg Tanner , regional ombudsman with Triangle J COG , was unable to attend th the meeting , the Board agreed to reschedule his presentation for the February 4 meeting 5 Johnston Community College - Request Partnership on State Recreation Grant Johnston Community College wishes to apply for a state recreation grant to provide additional recreational facilities at Howell Woods The grant requires that local government participate as the primary applicant so it can be the repository for the funds Also , according to the college , the application will be more favorably received if accompanied by an endorsement by the County Commissioners There would be no cost to the County as the College would provide , in full , the required match Dr Don Reichard , president of the Community College was available to answer any questions Page761 Following discussion , Commissioner Allen L Mims , Jr moved the Board formally endorse the project to provide additional recreational facilities at the Rudolph Howell and Son’s Environmental Learning Center , and agree to partner with Johnston Community College in applying for a State Recreation Grant to fund the project , with the understanding that the required local match will be provided by the college Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 6 Request for Additional Positions - Department of Social Services DSS Joseph Avery , chairman of the Social Services Board of Trustees , and DSS Director , Earl Marett , addressed the Board concerning the need for three additional Social Worker III positions for the Child Protective Services Unit The positions would be funded by Work First Block Grant TANF federal funds at an estimated cost , including benefits , of 200,154 Commissioner Wade M Stewart , who represents the Commissioners on the DSS Board of Trustees , suggested there is a need for more information and a better understanding of the issues facing the Department of Social Services He asked the Chairman to appoint a committee , including several Board members , to meet with DSS staff to look carefully at this matter He thanked Mr Avery and Mr Marett for bringing this request to the Board’s attention and noted that appointing a committee is not saying no to the request It is , however , saying that every possible avenue needs to be explored to see if there is a way to avoid increasing the size of government Following further discussion , Commissioner Stewart moved the Chairman appoint a committee to study the request for additional personnel for the Department of Social Services Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Committee Appointed to Study Personnel Needs at DSS The Chairman appointed the following members to serve on this committee Earl Marett , Joseph Avery , Joe Lansinger , Commissioner Wade Stewart , Commissioner Fred Smith , Commissioner Ray Woodall and County Manager Rick Hester Mr Hester was asked to make arrangements for the committee to meet in the near future 7 Appointments A Johnston - Lee - Harnett Community Action Board Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board reappointed Paula McFarland to the Johnston - Lee - Harnett Community Action Board to serve a two year term to expire January 2004 Commissioner Ray Woodall to represent Board of Commissioners on Community Action Board Chairman James H Langdon , Jr appointed Commissioner W Ray Woodall to serve as Johnston County’s Commissioner on the Johnston - Lee - Harnett Community Action Board B Board of Health Commissioner Cookie Pope moved the Board make the following appointments to the Johnston County Board of Health to serve three year terms to expire January 2005 Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Reappointed Kevin Bruce Koebley , Bryan Blake and Pauline Jones Appointed Linda M Allen C Criminal Justice Partnership Advisory Board Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board appointed Sharon Ocean - Delinquent 135,00000 9 Three Party Agreement for Sewer Service to New School Site and Surrounding Area - Flowers Plantation Commissioner Fred Smith moved the Board postpone any action on this matter until the Monday , January 14 , 2002 meeting Commissioner Cookie Pope seconded the motion , which carried by unanimous vote PagePage pageNumber5764 10 State Tax Refund Debt Setoff Program The NC General Assembly has enacted legislature that allows local governments to participate in the State’s income tax debt setoff program The program permits local governments to submit any outstanding delinquent debt of 50 or more through a clearinghouse to the Department of Revenue to match the debt against individual income tax refunds The NC Association of County Commissioners and the League of Municipalities have organized a joint setoff clearinghouse to make this available to local governments The cost to the County for participation is 15 for each successful match of debt This charge can not be charged against the debtor Staff has recommended the Board adopt the necessary resolution to participate in the program , designate Mark Payne as the person to hold hearings and conduct necessary proceedings , and authorize the County Manager to sign the required memorandum of understanding between the County and the Clearinghouse NCACC and LCLM The program would initially be used for delinquent motor vehicle and personal property taxes , and civil penalties owed the County Upon a motion by Commissioner Fred Smith , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following resolution to participate in the State Tax Refund Debt Setoff Program North Carolina Local Government Debt Setoff Program Whereas , NCGS Chapter 105A , Setoff Debt Collection Act , authorizes the North Carolina Department of Revenue to cooperate in identifying debtors who owe money to local governments and who qualify for refunds from the Department of Revenue ; and Whereas , the law authorizes the setting off of certain debts owed to local governments against tax refunds ; and Whereas , the North Carolina Association of County Commissioners and the North Carolina League of Municipalities have jointly established a clearinghouse to submit debts on behalf of Johnston County , as provided by law Now Therefore , the Johnston County Board of Commissioners does hereby resolve that Johnston County will participate in the debt setoff program , and hereby designates County Attorney , Mark Payne , as the person to hold hearings and conduct necessary proceedings Further , the Board authorizes the Chairman and or County Manager to execute such documents and agreements as necessary to participate in the debt setoff program th Adopted this the 7 day of January , 2002 11 Tax Releases and Refunds from 11 20 01 to 12 14 01 Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board approved the following tax releases and refunds Motor Vehicle Release Refund Report for Period 11 20 2001 thru 12 14 2001 Year Bill # Acct # Name Tran Type Paid Interest 2001 0109 - 12 14 01 Tax refunds - Personal Real Property 1,30484 Tax releases - Personal Real Property 5,02729 Motor Vehicle releases refunds 3,83487 Recommended Approved John R Massey Pat Goddard , Tax Administrator County Finance Officer 12 Delinquent Tax Collection Report Pat Goddard , Tax Administrator , reported on the collection of delinquent taxes for the month of December , 2001 and provided year - end totals for collections through garnishments , bank attachments , levies , and foreclosures As of December 31 , 2001 , the total delinquent real estate collected was 1,284,489 13 Citizen Complaint - Driveway Restrictions Ricky Godwin from O’Neals Township addressed the Board about a recent decision limiting driveways onto public roads for major subdivision development Mr Godwin asked the Board to reconsider , and stated , in his opinion , this is not necessary in rural areas It hurts the farmers and other landowners as it lowers the value of road front property He stated he could understand the need to have these restrictions on heavily traveled roads and in high growth areas , but not in rural farming communities Page0769 Commissioner Thomas M Moore who opposed the restrictions agreed and stated , in his opinion , it would have been better to identify future arterial and collector roads , and place restrictions on those roads only Commissioner Fred Smith stated the original request from the Planning Board was amended by the Commissioners to provide for any hardship provision where there is no corresponding public benefit He suggested this should , in his opinion , take care of Mr Godwin’s concerns Commissioner Allen L Mims , Jr pointed out that only major subdivisions of three or more lots would be affected by the restrictions Mr Godwin stated he was unaware of the amendment for hardship cases ; however , he would still like for the Board to reconsider this action Board members thanked Mr Godwin for his comments Board Reports and Comments 14 Committee Appointed to Study Flood Ordinance The Chairman asked Commissioners Cookie Pope and Tom Moore to look further at the Flood Plain Ordinance and report to the full Board whether any changes need to be made There being no further business , Commissioner Wade M Stewart moved the Board adjourn Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote __________________________________________ James H Langdon , Jr , Chairman ______________________________ Joyce H Ennis , Clerk to the BoardPage
