10 776 February 4 , 2002 The Johnston County Board of Commissioners met in regular session Monday , February 4 , 2002 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes - January 7 , 14 , 2002 Board Meetings Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the January 7 , 14 , 2002 board meetings as presented Public Comments 2 Clerk of Superior Court Compliments County Manager Clerk of Superior Court , Will R Crocker , complimented County Manager , Rick Hester , for the excellent working relationship and open communication he has with the court system He stated it is a pleasure working with him 3 Clarification on Conditions Attached to Special Use Permit - Case 570 - Joe and Max Denning Bill McLamb , adjacent property owner to the trucking and warehousing operation of Joe and Max Denning on Denning Road in Banner Township , asked the Board for clarification of the conditions placed on the special use permit approved at the January 14 , 2002 board meeting He stated he talked with a member of the Planning Staff , and there was a difference of opinion concerning the conditions He also asked how long the owner would be given to have the Class C buffer in place The Chairman stated the minutes of the Board’s meeting state correctly the three conditions that were placed on the permit Planning Director , Steven Finn , stated it is his understanding the owner has contracted with a landscape architect and is making a good faith effort to comply with the conditions 4 Department of Transportation - Addition to the System The Board reviewed a petition presented by the North Carolina Department of Transportation requesting the following road be added to the State Secondary System for maintenance Critcher Farm Road in Critcher Farm Subdivision , Elevation Township Commissioner Allen L Mims , Jr moved the Board concur with the NC Department of Transportation’s request to add the above listed road to the State Maintained System Commissioner Cookie Pope seconded the motion which carried by unanimous vote 5 Annual Report - Nursing Home Adult Care Home Community Advisory Committee Gregory Tanner , ombudsman with Triangle J Council of Governments , updated the Board on the work of the Nursing Home Adult Care Home Community Advisory Committee He noted at this time , there are 18 members of the committee who share the responsibility of visiting , at least once a quarter , the 22 long term care facilities within the County The volunteers spend many hours making sure these facilities provide quality care to the residents He pointed out the visitation sheets with the committee’s comments will be made available on the web , which should be extremely helpful when families are deciding on a facility for a loved one Page777 Steve Strickland , who works with the committee and screens applicants for the Board , agreed He recognized the volunteer members that were present , and noted that currently the committee has 18 of the 25 positions filled There is a real need to find other citizens that will serve ; however , this is not always easy Serving on the committee requires a great deal of time and commitment , and even though potential applicants are made aware of the responsibilities that go with the appointment , they often let their desire to serve override their understanding of the situation It is only after they get involved that they realize they do not have enough time to serve effectively , and subsequently end up resigning In response to a question about the homes in the County , Mr Strickland stated the quality of care varies Some are excellent , and some need to do better The committee reports their findings and then it is up to the ombudsman and the Department of Social Services to follow up The committee plays a very important role in assuring that long - term care facilities provide the best care possible Board members thanked the committee members for taking on this very important role 6 Request for Refund of Excise Taxes Paid In Error Mary S Wilson & Associates , Attorneys at Law , have requested a refund of excise tax in the amount of 52600 , which was paid in error to Johnston County for a deed that should have been recorded in Wake County Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board authorized the refund of excise tax in the amount of 52600 to Mary S Wilson & Associates for tax paid in error 7 Town of Clayton - Request to Purchase Portion of Old Champion Property Clayton Manager , Steve Biggs , and Fire Chief , Lee Barbee , were present to answer any questions the Board might have concerning the town’s request to purchase a small portion of the old Champion property The Town has offered 30,000 for 175 acres on the back side of the property as a site for a new fire station Mr Biggs explained the new station would include training space and living kitchen quarters for future growth Commissioner Wade M Stewart referenced the recent attempts by the Town to combine fire and rescue services in Clayton He noted he was in favor of the request to sell the land to the Town for the fire department , but wondered if there was space available nearby for the rescue squad to build a facility should they decide to remain a separate entity He suggested it would be good to at least have the two facilities in close proximity to one another He pointed out the rescue squad recently purchased land in Clayton , which was considerably higher in cost , and as a means of helping them save money , he would like for them to have the option of selling that land and purchasing some of this property at the lower cost Mr Biggs stated the Town minimized the size of their request so it would not affect future school expansion He noted they would still like to bring the two services together , and should they be able to do so , the lot would accommodate a combined facility He was unsure if there was another suitable lot that could be carved from the property for a separate rescue squad facility Commissioner Allen L Mims , Jr suggested it might be an advantage for the two facilities to be at different locations Then , if in the future they combined services , they could operate from both sites Following further discussion , Commissioner Stewart stated he would like more time to consider this and asked the Board to postpone a vote until next Monday night 8 Proposal for Final Plans & Specifications for Agricultural Center The Chairman stated the committee organized to consider a proposed new agricultural center has met and reviewed preliminary plans for a facility that would include office space for the Cooperative Extension Service , Soil Conservation and Federal Farm Services Agencies , as well as an auditorium The Wooten Company has presented a proposal to proceed with final plans and specifications for the project Commissioner Cookie Pope stated she would like to see the auditorium seat 750 instead of 500 so that Johnston County could host regional events Page778 Tom Trowbridge with The Wooten Company stated the site would accommodate a larger auditorium , up to 1000 seats In response to comments from Board members , he noted the floor plan would be similar to a agricultural center his company designed for Lee County The total estimated cost of the project is 4 million Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board authorized The Wooten Company to proceed with final plans and specifications for a new Johnston County Agricultural Center 9 Budget Amendments Approved Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried OBLIGATION PUBLIC IMPROVEMENT BONDS OF JOHNSTON COUNTY , PURSUANT TO BOND ORDERS HERETOFORE APPROVED AND PROVIDING FOR THE FORM , DETAILS AND PAYMENT THEREOF WHEREAS , the Bond Orders hereinafter described were authorized and adopted by the Board of Commissioners of Johnston County the “ Board ” on September 7 , 1999 and September 4 , 2001 and approved by the voters on November 2 , 1999 and November 6 , 2001 ; and WHEREAS , the Board desires to provide for the issuance of general obligation Public Improvement Bonds to finance the costs of school and community college facilities pursuant to such Bond Orders ; and WHEREAS , under North Carolina law , such bonds are to be sold at public sale by the North Carolina Local Government Commission after circulation of an official statement with respect to such bonds which describes the terms thereof and the security therefor , including information concerning the County and its financial resources , and the Board has been provided a draft of such official statement ; NOW , THEREFORE , the Board of Commissioners of Johnston County , meeting in regular session at Smithfield , North Carolina , on February 4 , 2002 , does the following BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR JOHNSTON COUNTY 1 The County shall issue its general obligation Public Improvement Bonds in an aggregate principal amount of 43,000,000 the “ Bonds ” , pursuant to and in accordance with the Bond Orders entitled “ BOND ORDER AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION PUBLIC IMPROVEMENT BONDS OF JOHNSTON COUNTY IN THE MAXIMUM AGGREGATE PRINCIPAL AMOUNT OF 80,000,000 FOR THE PURPOSE OF FINANCING , IN PART , THE ACQUISITION , CONSTRUCTION AND EQUIPPING OF SCHOOL FACILITIES ” ; BOND ORDER AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION PURPOSE OF FINANCING , IN PART , THE ACQUISITION , CONSTRUCTION AND EQUIPPING OF SCHOOL FACILITIES ” 2 The Bonds shall be designated “ General Obligation Public Improvement Bonds , Series 2002 ” and shall be dated March 1 , 2002 The Bonds shall mature in annual installments on March 1 in the years and amounts as shall be determined by the County Finance Director , the County Manager and the LGC , as hereafter defined Each Bond shall bear interest at such rate as shall be determined by the County Manager and the LGC at the time of sale , provided no interest rate on any Bond shall exceed six percent 65 , payable on September 1 , 2002 , and semiannually thereafter on March 1 and September 1 Initially , one bond certificate for each maturity of each series of the Bonds will be issued to The Depository Trust Company , New York , New York “ DTC ” , and immobilized in its custody So long as DTC is securities depository for the Bonds , a book - entry system will be employed , evidencing ownership of the Bonds in principal amounts of 5,000 or multiples thereof , with transfers of ownership effected on the records of DTC and its participants pursuant to rules and procedures established by DTC and its participants Interest on the Bonds will be payable to DTC or its nominee as registered owner of the Bonds Transfer of principal and interest payments to participants of DTC will be the responsibility of DTC ; transfer of principal and interest payments to beneficial owners by participants of DTC will be the responsibility of such participants and other nominees of beneficial owners The County will not be responsible or liable for maintaining , supervising or reviewing the records maintained by DTC , its participants or persons acting through such participants In the event that a DTC determines not to continue to act as securities depository for the Bonds or b the County Manager determines that continuation of the book - entry system of evidence and transfer of ownership of the Bonds would adversely affect the interests of the beneficial owners of the Bonds , the County will discontinue the book - entry system with DTC If the County fails to identify another qualified securities depository to replace DTC , the County will authenticate and deliver replacement Bonds in the form of fully registered certificates , and registration of transfer of the Bonds will be poultry vaccine manufacturer located near the Harnett County Line , is requesting water service from the Elevation Water District The company would build the line with the understanding the water distict would reimburse them when the district is built He introduced Judy Ivey , representative from Merial Select , who offered to answer any questions the Board might have In discussion it was noted the unit cost might be different for the water district and the individual company If the company’s cost is higher , the Board agreed to reimburse them up to 110 of the district’s actual cost Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the request from Merial Select , Inc for water service from the soon to be built Elevation Water District with a 10 leeway in reimbursement cost 14 Award of Contracts Phase I Cleveland & McGee’s Crossroads Area Wastewater and Phase I Reclaimed Water Transmission releases refunds 3,03951 Recommended Approved Pat Goddard , Tax Administrator John R Massey , County Finance Officer 18 Report on Collection of Delinquent Taxes Tax Administrator , Pat Goddard , updated the Board on the collection of delinquent taxes for the month of January 2002 Methods used for collections were garnishments , bank attachments , levies , and foreclosure As of January 21 , 2001 , the County had a total of 964,02692 in delinquent real estate taxes due representing years 1992 through 2000 Ms Goddard also presented a report in accordance with NCGS 105 - 369 a and b1 on the total amount of unpaid tax on real estate for 2001 and asked the Board for authorization to advertise these in the local newspapers The total amount of 2001 taxes due is 3,796,53047 on 8,373 accounts Notices will be sent by mail to both the listing owner as of January 1 , 2001 and the current owner as of December 31 , 200l Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board instructed Ms Goddard to advertise the liens as the first step toward the collection of delinquent 2001 tax bills Board members thanked Ms Goddard for the excellent job she is doing with the Tax Department 19 Three Additional Social Worker III Positions Approved for the Department of Social Services Commissioner Fred Smith moved the Board approve the request by the Department of Social Services for three new Social Worker III positions to be funded with TANF funds Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote In discussion it was noted that prior to approving this request , a committee made up of Commissioners Woodall , Stewart and Smith met with DSS Director , Earl Marett , and Child Services Supervisor , Joe Lansinger , concerning these positions The committee has also asked DSS to develop a graph to indicate prior history and future estimated growth in their programs so the Board can have a better idea on the number of employees it takes to administer DSS services Board Reports and Comments The Board commented briefly on the following issues lt; Meeting in the Cleveland Community on February 12 , 2002 at 7 00 pm on the future of the old Cleveland School building lt; State reimbursements to Counties may be withheld due to State Government deficit It was noted this
