10 841 May 6 , 2002 The Johnston County Board of Commissioners met in regular session Monday , May 6 , 2002 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes - April 1 , 8 , 2002 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the April 1 , and April 8 , 2002 board meetings 2 Commissioners Comment on Budget Commissioner Fred Smith complimented County Manager , Rick Hester , Finance Officer , John Massey , and the County Department Heads for the excellent job they have done in holding the proposed budget down to include no increase over the actual expenditures of last year He noted that working with staff has made him aware of the efficiency in County Government , something he was skeptical of prior to becoming a Commissioner A no - increase budget is proposed , while at the same time the population of Johnston County continues to grow , requiring additional services He thanked Sheriff Steve Bizzell and Registrar of Deeds , Cecil Massengill , for agreeing to postpone hiring additional personnel at this time Chairman James H Langdon , Jr mentioned some of the comments that have been in the local papers concerning the school budget He noted the budget would be tight for everyone this year , but stressed the Board will take what funds are available and use them in the best way possible He noted the Board of Commissioners has always put education first Public Comments 3 Citizen Comment - Request for Assistance William Earl Ormond of Princeton , asked for the Board’s assistance in getting the proper inspections for setting up some houses he has relocated to Johnston County He noted his projects would , in his opinion , be under the cost limit required for a general contractor 4 Department of Transportation - Addition to the System The Board agreed to a request from Commissioner Fred Smith to abstain in this matter The Commissioners reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Percheron Drive , Morgan Parkway , Pinto Lane , Hunter Lane , Mustang Lane , Appaloosa Lane in Buffalo Creek Subdivision - Phases 3 - 8 in Wilders Township Commissioner Allen L Mims , Jr moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Cookie Pope seconded the motion which carried by unanimous vote 5 Juvenile Crime Prevention Council - Proposed Budget Judge Addie Rawls , chairman of the Juvenile Crime Prevention Council , stated Johnston County anticipates State funding in the amount of 259,423 from the NC Department of Juvenile Justice and Delinquency Prevention DJJDP for juvenile crime prevention programs in the County She asked the Board to approve the council’s recommended distribution of these funds for the following programs Page842 Johnston County Youth Services - 162,193 Juvenile Restitution Program - 70,730 Lee County Youth & Family Services Residential Facility - 15,000 Court Psychologist Program - 6,500 Administration - 5,000 Judge Rawls noted , in addition , the council will be requesting a County appropriation in the upcoming budget in the amount of 24,849 Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the program budgets listed above for the distribution of State funds , as recommended by the Juvenile Crime Prevention Council 6 Surplus Property - Sheriff’s Department Commissioner Cookie Pope moved the Board declare the following wrecked vehicle surplus and authorize staff to turn the title over to the insurance company for payment of the claim 1997 Chevrolet Lumina - Vin # 2G1WL52M4V9302931 Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote 7 Memorandum of Understanding with Town of Smithfield - 911 Dispatching The Board considered a memorandum of understanding with the Town of Smithfield for 911 dispatching It was noted to provide this service , the County would need four additional dispatchers , three of which would be funded by the Town of Smithfield It is anticipated that the Town of Benson will also request the County provide their dispatching sometime within the next year , in which case Benson would provide funds for the fourth dispatcher Following discussion , Commissioner Wade M Stewart moved the Board approve the following memorandum of understanding Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote MEMORANDUM OF UNDERSTANDING BETWEEN JOHNSTON COUNTY AND THE TOWN OF SMITHFIELD FOR 9 - 1 - 1 POLICE DISPATCHING Whereas , Johnston County operates a 9 - 1 - 1 communications center that serves several towns in Johnston County for police dispatching ; and Whereas , Johnston County and the Town of Smithfield have determined that it is in the best interests of the citizens of the Town of Smithfield and Johnston County for Johnston County 911 communications center to provide dispatch services for the residents of Smithfield Now , therefore it is agreed by all parties 1 On or about September 2002 , the Johnston County 911 communications center will begin dispatching for the Smithfield Police Department This date is contingent upon the successful hiring and training of dispatchers needed to adequately perform the services The Town agrees to pay the full costs of three 3 full - time dispatchers ; said dispatchers will be county employees 2 This Memorandum of Understanding will be reviewed on an annual basis by both parties Any revisions st to the agreement shall be approved by the respective governing bodies , prior to July 1 of each year The Town of Smithfield is expected to vote on this agreement at their meeting on May 7 , 2002 8 Decision on Special Use Permit for Case 573 - Allen Ray Best and Linda Best CASE 573 Special use permit for a go cart track , concession stand on approximately 158 acres located on Grabtown Road SR 2543 in Boon Hill Township for applicants , Allen Ray Best and Linda Best Public Hearing held April 8 , 2002 Based on the following findings of fact , Commissioner Wade M Stewart moved the Board authorize the Planning Department to issue a special use permit for a go cart track , concession stand on approximately 158 acres located on Grabtown Road in Boon Hill Township for applicants Allen Ray Best and Linda Best , with the following conditions attached Page843 Findings of Fact 1 The use is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare 2 The use complies with all required use and intensity regulations and the applicable specific standards and with all applicable regulations 3 The use is located , designed and proposed to be operated so as to maintain or enhance the value of contiguous property 4 The use conforms with general plans for the physical development of the County’s planning jurisdiction Conditions 1 A fifty 50 wide principal means of ingress and egress 2 Any outdoor lighting must be of a fixture type and so located so that lighting intensities are controlled to assure that excessive light spillage and glare are not directed off the property 3 No sale or consumption of alcoholic beverages can be conducted on the subject property 4 Hours of operation are to be from 5 00 pm until 9 00 pm on Fridays , and from 1 00 pm until 6 00 pm on Sundays Commissioner Cookie Pope seconded the motion , which 25 , 2002 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following proclamation Proclamation - Johnston County Emergency Medical Services - May 19 - 25 , 2002 Whereas , emergency medical services is a vital public service ; and Whereas , the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day , seven days a week ; and Whereas , access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury ; and Whereas , emergency medical services providers have traditionally served as the safety net of America’s health care system ; and Whereas , emergency medical services teams consist of emergency physicians , emergency nurses , emergency medical technicians , paramedics , firefighters , educators , administrators , and others ; and Whereas , approximately two - thirds of all emergency medical services providers are volunteers ; and Whereas , the members of emergency medical services teams , whether career or volunteer , engage in thousands of hours of specialized training and continuing education to enhance their lifesaving skills ; and Whereas ; Americans benefit daily from the knowledge and skills of these highly trained individuals ; and Whereas , it is appropriate to recognize the value and the accomplishments of emergency medical services providers by designating Emergency Medical Services Week ; and Whereas , injury prevention and the appropriate use of the EMS system will help reduce national health care costs ; and Now , therefore , the Johnston County Board of Commissioners , in recognition of this event , does hereby proclaim this week of May 19 - 25 , 2002 as EMERGENCY MEDICAL SERVICES WEEK And encourages the community to observe this week with appropriate programs , ceremonies and activities 10 Public Hearing Scheduled - Changes in EMS Franchises The Board discussed recommendations from the Emergency Medical Services Advisory Committee regarding EMS services in the County A reorganization plan is proposed whereby the County would fund eight rescue squads , which would combine the administration of Kenly and Micro into a North Johnston Rescue Squad In addition , three squads , Benson , 50 210 and Princeton , are asking for changes in their franchises from EMT - Intermediate to EMT - Paramedic level Page844 Patrick Harris , vice - chairman of the advisory council , briefly outlined the reorganization proposal and offered to answer any questions the Board might have He noted this was a difficult decision , and all options were considered The option that was recommended would be for a combined administration with paramedics at Micro and an ambulance in Kenly , staffed with EMT - Basics during the day and volunteers for nights and weekends Ed Temple from the Town of Kenly spoke briefly about the concerns of the people of Kenly , who have always had their own rescue squad He suggested the two communities of Kenly and Micro need some time to work together on how services for each area can be best met Also speaking on behalf of Kenly was Patsy Ward , who currently works with the Kenly Rescue She suggested there would be a drop in the level of service in Kenly , and asked the Board to reconsider Following discussion , Commissioner Wade M Stewart moved the Board schedule a public hearing for the June 3 , 2002 Board meeting to consider the proposed reorganization of the EMS System of the County , and requested changes in franchise for the Benson Rescue Squad , 50 - 210 Rescue Squad , and Princeton Rescue Squad 11 Resolution Declaring Real Property Surplus and Authorizing Sale Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution Resolution Authorizing the Sale by Auction of Certain County - owned Property WHEREAS , Johnston County owns certain property located on Cleveland School Road SR 1010 and consisting of a 328 acre tract and being part of tax parcel no 06F04012 ; said tract being that parcel known as the old Cleveland School property and consisting of the old Cleveland School and associated buildings and is described as follows Property description for the tract commonly known as the Old Cleveland School site The property is located at the intersection of state roads NCSR 1010 and NCSR 1509 The property contains approximately 328 acres exclusive of right of way The property is delineated by metes and bounds as follows Starting at an IPS corner located along the right of way of NCSR 1010 S 86 01 18 W 2678 thence S 86 44 40 W 10008 ; thence N 89 35 14 W Engineers for the SCADA project , interviewed three firms who have experience in design and startup of similar SCADA systems in the region The three firms Piedmont Automation of Winston - Salem , The Lord Company of Fort Mills , South Carolina , and InstruLogic Corporation of Round Hill , Virginia , were evaluated based on a number of criteria including their approach , personnel , technology , timeliness , quality of documentation , and project cost InstruLogic was selected in the interview process and have subsequently submitted a proposal based on hourly billing plus out - of - pocket expenses with a fee not to exceed an estimated 99,261 Staff has recommended acceptance of the technical services agreement with InstruLogic Corporation for the first phase of the SCADA program Upon a
