10 1 July 1 , 2002 The Johnston County Board of Commissioners met in regular session Monday , July 1 , 2002 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes - June 3 , 10 , 24 , 2002 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the June 3 , June 10 , and June 24 , 2002 board meetings Public Comment - No one spoke at this time 2 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Red Star Lane , Pay Day Lane , Impressive Lane & Mocha Lane in Ranch Acres Subdivision - Phases I and II in Clayton Township Commissioner Allen L Mims , Jr , moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Cookie Pope seconded the motion which carried by unanimous vote 3 Report on Fireworks Displays Approved by the Chairman rd The Chairman announced that since the June 3 meeting , he has approved the following requests for fireworks displays th th Triple “ S ” Ranch , 535 Barnes Lakes Road , Middlesex - for July 4 Rain Date July 5 th Celebrate Cleveland , at Cleveland Middle School Baseball Field for July 4 th Town of Pine Level at Sam Godwin Recreation Park for July 4 th Clayton Parks & Recreation at Clayton Municipal Park for July 4 4 Request for Endorsement for State Funding - Civil War Preservation Trust The Board considered a request from the Civil War Preservation Trust CWPT for endorsement of their application for Transportation Enhancement Funding from the NC Department of Transportation Enhancements Unit The money would be used over a three year period to purchase up to 600 acres of battlefield land at Bentonville , more than doubling the size of the park The funds would also be used to preserve signage for Civil War sites and scenic viewsheds in the County There would be no County funds involved Donald Taylor , manager of the Bentonville Battleground Historic Site , was present and offered to answer any questions the Board might have In response to a comment from Commissioner Allen L Mims , Jr , Mr Taylor stated that purchased property would remain as farmland or woodland Following further discussion , Commissioner W Ray Woodall moved the Board offer the County’s endorsement of the Civil War Preservation Trust’s application for NC Department of Transportation Enhancement Funding Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote Page2 5 Acceptance of Bid - Old Cleveland School Property Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board accepted the bid from Son - Lan Shipwash , LLC of 255,000 for the old Cleveland School Property and instructed staff to prepare the deed 6 Approval of Purchase Price for Smithfield Area Elementary School Site Postponed The Commissioners considered a request from the Board of Education for approval of the purchase price of 450,000 for 2778 acres on Galilee Road 16,19870 per acre as a site for the new Smithfield area elementary school Commissioner Thomas M Moore asked if there was any appraisal information that would support this per acre price School Board Chairman , Kay Carroll , stated the property was appraised at a value of 17,086 per acre based on comparables and recent land use sales Commissioner Allen L Mims , Jr noted that projected enrollment information indicates the school would be operating at only 65 capacity for the next 10 years Mr Carroll agreed but pointed out the site is located in the area where growth is projected In response to questions about locating the school close to other campuses on or near Buffalo Road , Mr Carroll responded there is too much traffic Brogden Road was also considered , but the demographics indicate the new school should be located in the western portion of the district Commissioner Wade M Stewart asked if the School Board considered the County’s property , which is located across the road from this site He pointed out the County just purchased approximately 600 acres in the vicinity at a much lower purchase price , and it would seem that 27 acres of that land could be found that would be suitable Mr Carroll stated that staff did look at the County property and felt there would be traffic safety issues in locating a school on Hwy 210 He noted it is already heavily traveled with garbage trucks and will become a 4 - lane main road in the future Commissioner Fred Smith , who serves on the Transportation Committee , assured Mr Carroll that there is no plan to widen Hwy 210 in the foreseeable future He asked if the School Board would consider the County’s land if it was free Mr Carroll responded the School Board would look at the County’s property again ; however , there are reasons they believe it would not be as suitable as the property on Galilee Road Commissioner Thomas M Moore stated the County’s property , which is only a few hundred feet from the School’s proposed site , has good soil and would require a minimum amount of grading He maintained that traffic should not be an overriding factor considering the financial concerns facing the County When you speak of using 450,000 of the bond money for this site , you are really talking about close to 15 million when you factor in interest over the years Mr Carroll stated the only question before the Commissioners is whether the purchase price for the property is reasonable Commissioner Smith responded the question of reasonableness depends on the facts and circumstances If there is a free purchase price in the vicinity , it may no longer be reasonable to use the people’s money for the Galilee Road property Board members agreed to postpone a decision on this matter until these questions can be answered 7 Public Hearing - QZAB Financing Advertised The Smithfield Herald on June 14 , 21 , 2002 The Chairman opened the public hearing and stated the purpose of the hearing is to solicit public comment on the application for 33 million in Qualified Zone Academy Bond QZAB funds to be used for the renovation of Selma Elementary School Page3 School Board Chairman , Kay Carroll , stated the renovation of Selma Elementary School fits the criteria for QZAB interest - free money There being no further comments , the Chairman closed the public hearing 8 Resolution Authorizing QZAB Financing Adopted Commissioner Fred Smith introduced the following resolution the title of which was read RESOLUTION AUTHORIZING THE EXECUTION AND DELIVERY OF AN INSTALLMENT FINANCING AGREEMENT , A DEED OF TRUST , A REHABILITATION AGREEMENT , A LEASE AGREEMENT AND RELATED DOCUMENTS IN CONNECTION WITH AN INSTALLMENT FINANCING FOR SCHOOL IMPROVEMENTS BE IT RESOLVED by the Board of Commissioners the “ Board ” of the County of Johnston , North Carolina the “ County ” Section 1 The Board does hereby find and determine as follows a The Johnston County Board of Education the “ Board of Education ” , the governing board of the Johnston County local school administrative unit , has determined that a need exists for renovating and modernizing Selma Elementary School and has requested capital funding therefor the “ Project ” b The Project is hereby approved © The Board and the Board of Education applied to , and have been approved by , the North Carolina Department of Education for allocation of qualified zone academy bond authorization under Section 1397E of the Internal Revenue Code of 1986 , as amended , and the regulations promulgated thereunder collectively , the “ Code ” d After a public hearing and due consideration , the Board has determined that the most efficient manner of financing the Project will be for the County to enter into an Installment Financing Agreement the “ Agreement ” , in a principal amount not to exceed 3,300,000 with Bank of America , NA the “ Bank ” pursuant to Section 160A - 20 of the General Statutes of North Carolina , as amended , and Section 1397E of the Code Pursuant to the Agreement , the Bank will advance moneys to the County in an amount sufficient to pay , together with other available funds , the costs of the Project , and the County will repay the advancement by making annual installment payments the “ Installment Payments ” , without interest , for the term of the loan The term of the loan will be the maximum term shown on the web page of the United States Department of State Treasurer relating to QZAB rates on the date of closing of the loan , and is anticipated to be 13 - 14 years the “ Term ” e The Installment Payments will be invested pursuant to a Forward Delivery Agreement the “ Forward Delivery Agreement ” , among the County , the Bank and a custodian acceptable to the County at a rate calculated to provide sufficient funds at the end of the Term to pay the full amount of the loan that is due f In order for the County to enter into the plan of finance , the sites of the Project will be conveyed by the Board of Education to the County g In order to secure the performance of the County’s obligations under the Agreement , the County will execute and deliver a Deed of Trust the “ Deed of Trust ” , granting a lien on the site of the Project and all improvements and fixtures located and to be located thereon the “ Mortgaged Property ” h In order to facilitate the construction of the Project , the County will enter into a Rehabilitation Agreement the “ Rehabilitation Agreement ” with the Board of Education providing for the supervision of construction of the Project by the Board of Education i The Mortgaged Property will be leased back to the Board of Education pursuant to a Lease Agreement the “ Lease Agreement ” between the County and the Board of Education , which Lease Agreement will be subordinate to the lien created by the Deed of Trust j There has this day been presented to the Board forms of the following documents relating to the transaction hereinabove described 1 the Agreement ; 2 the Deed of Trust ; 3 the Rehabilitation Agreement ; 4 the Lease Agreement ; and 5 the Forward Delivery Agreement Page4 Section 2 The Board hereby approves the Agreement , the Deed of Trust , the Rehabilitation Agreement , the Lease Agreement and the Forward Delivery Agreement in substantially the forms presented at this meeting The Chairman or Vice Chairman of the Board or the County Manager is hereby authorized to execute and deliver on behalf of the County each such document in substantially the form presented at this meeting , containing such insertions , deletions and filling in of blanks as the person executing such document shall approve , such execution to be conclusive evidence of approval by the Board of any such changes The Clerk to the Board is hereby directed to affix the corporate seal of the County to each such document and to attest the same Section 3 No deficiency judgment may be rendered against the County in any action for breach of any contractual obligation under the Agreement or the Deed of Trust , and the taxing power of the County is not and may not be pledged directly or indirectly to secure any moneys due under the Agreement or the Deed of Trust Section 4 The Chairman , Vice Chairman , County Manager , Finance Officer , County Attorney and the Clerk to the Board , and any other officers , agents and employees of the County , are hereby authorized and directed to execute and deliver such closing certificates , opinions and other items of evidence as shall be deemed necessary to consummate the transactions described above , including a the execution of any necessary financing statements relating to fixtures located on the Mortgaged Property and b the execution of any documents necessary for the conveyance of the site of the Project to the County Section 5 The Board hereby designates its obligations under the Agreement to be a qualified zone academy bond pursuant to Section 1397E of the Internal Revenue Code of 1986 , as amended , and the regulations promulgated thereunder Section 6 This resolution shall take effect immediately upon its passage Upon motion of Commissioner Fred Smith , seconded by Commissioner Cookie Pope , the foregoing resolution entitled “ RESOLUTION AUTHORIZING THE EXECUTION AND DELIVERY OF AN INSTALLMENT FINANCING AGREEMENT , A DEED OF TRUST , A REHABILITATION AGREEMENT , A LEASE AGREEMENT AND RELATED DOCUMENTS IN CONNECTION WITH AN INSTALLMENT FINANCING FOR SCHOOL IMPROVEMENTS ” was passed by the following vote Ayes James H Langdon , Jr , Cookie Pope , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Fred Smith , and W Ray Woodall Nays None 9 Public Hearing - Request for Change in Level of Service - Four Oaks Rescue Squad Advertised The Smithfield Herald on June 14 , 21 , 2002 The Chairman opened the public hearing and stated the purpose of the hearing is to consider a request from the Four Oaks Rescue Squad to change their franchise agreement to upgrade their level of service from EMT - Intermediate Level to EMT - Paramedic Level There being no comments , the Chairman closed the public hearing Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the request for change in level of service for Four Oaks Rescue Squad from EMT - Intermediate Level to EMT - Paramedic Level A second vote at a subsequent regular meeting is required before the franchise can be changed 10 Second Vote on EMS Proposal - Consideration of Change of Franchise for Rescue Squads rd EMS Director , Dewayne West , pointed out the Board gave a first vote of approval at the June 3 meeting on the new EMS proposal as amended to include the Micro and Kenly Squads ’ request for merging to become the Northern Johnston Rescue Squad In addition , the Board approved on a first vote changes in franchise to upgrade the level of service for Benson , 50 - 210 and Princeton Rescue Squads to paramedic level A second vote is required on both of these issues Attorney Mark Payne explained the change in franchise to paramedic level for the three squads will require certification from the State He recommended the Board postpone a second vote on the change of franchise until the squads receive their initial State approval PagePage pageNumber55 Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board approved , on second reading , the new EMS proposal as amended to include the Micro and Kenly Squads ’ request for time to work out the arrangements before merging to become the Northern Johnston Rescue Squad A second vote on the change in franchise to upgrade Benson , 50 - 1 position to fill unexpired term Commissioner Allen L Mims , Jr nominated Rich Cregar for appointment There being no further nominations , the Board appointed Rich Cregar to the Johnston County Board of Adjustment to fill an unexpired term to expire March 2003 D Nursing Home Domiciliary Home Advisory Board Commissioner Cookie Pope nominated Frances L Creech for appointment There being no further nominations , the Board appointed Frances L Creech to the Nursing Home Domiciliary Home Advisory Board for a term to expire July 2005 13 Public Hearing Scheduled - Extension to Brogden Water District Upon a motion by Commissioner Fred Smith , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board scheduled a public hearing for Monday , August 5 , 2002 on the proposed extension of boundaries for the Brogden Water District The hearing will be held at 11 00 am 14 Water Plant Expansion Project Engineer Tim Broome explained that following a meeting with the NC Division of Environmental Health , Public Water Supply Branch , staff has revised its opinion concerning the most efficient and cost saving program for expanding the water treatment plant from 52 mgd to 80 mgd It appears the best way to solve the problem with algae is to eliminate or at least significantly minimize it instead of continuing to treat with chemicals This can be accomplished by covering the raw water basins with floating covers , which would then allow the County to expand the plant as originally designed using additional spiral upflow reactors ClariCones PagePage pageNumber66 This would be less expensive and the system would be easier to operate Initially , only one of the reservoirs would be covered , one spiral upflow reactor added and additional filters installed If there are still problems with algae , the dissolved air flotation process could be installed between the ClariCones and the filters Staff is recommending the project be divided into different elements reservoir covers , ClariCones , metal building expansion , chemical feeds upgrade & additional filters , pumping improvements , and additions to the plant SCADA system Dissolved air flotation process would be added only if needed By dividing the project into different categories , the County can retain the most qualified engineering consultants for each element Following discussion , Commissioner Fred Smith moved the Board approve the revised scope of the project with the recommended division of project elements , and authorize the following engineering agreements with outside firms , with the understanding that staff will be responsible for the overall project management and remaining elements of the project lt; Agreement with G N Richardson Associates on an hourly fee basis for the design and bidding of the reservoir cover s lt; Agreement with Hazen & Sawyer Engineers for design and bidding of the chemical system , filter addition and building improvements and authorize the County Manager and Engineer to negotiate a lump sum fee for this service lt; Agreement with McKim & Creed Engineers on an hourly fee basis for design and implementation of the plant SCADA system improvements 15 Public Hearing - Amendment to County Code of Ordinances - Chapter 24 , Article III Advertised The Smithfield Herald - June 14 , 21 , 2002 The Chairman opened the public hearing and stated its purpose was to solicit public comment on an amendment to bring the County’s Sewer Service Ordinance into compliance with State requirements House Bill 1160 that was ratified last June states that the civil penalties in the County’s ordinance can be “ no less stringent than any set forth in the National Pretreatment Standards , which is now 25,000 per day per violation Currently our ordinance is at 10,000 There being no comments , the Chairman closed the hearing Amendment to County Code Adopted Upon a motion by Commissioner Fred Smith , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following amendment to the Johnston County Code of Ordinances Amendment to Johnston County Code - 06 15 02 Tax refunds - Personal Real Property 8 5461 Tax releases - Personal Real Property 1,05424 Motor Vehicle releases refunds 5,21473 Recommended Approved Pat Goddard John R Massey Tax Administrator County Finance Officer 17 Report on Delinquent Tax Collections Tax Administrator , Pat Goddard , reported a total of 213,08550 was collected through garnishments , bank attachments and levies during the month of June 2002 Concerning foreclosures , a total of 177 demand letters were sent , 15 complaints filed and 139,89559 collected As of June 30 , 2002 , the total delinquent real estate taxes collected for years 1992 - 2000 was 1,814,43102 Unpaid taxes for 2001 were 1,080,63910 Ms Goddard reported the overall collection rate is now at 957 , up 3 This represents an increase of 6 in real estate collections and a decrease in motor vehicle collections of 189 Commissioner Fred Smith pointed out that due to growth , there was an increase in taxes levied in the past year that corresponds to a gross income for the County of 3 million He stated it was his understanding the new budget uses none of this additional money for general government , and asked where this money is going County Manager , Rick Hester , confirmed that the additional tax money was not allocated for general government , in fact , general government will be operating on less than last year The entire additional tax levy is being used to help fund the increase in school current expense and the debt service for school construction Board Reports and Comments 18 Re sp ons e to Sc hoo l Bo ard ’ s Chall eng e o f Funding The Board discussed the School Board’s decision to challenge the school funding for FY 2002 - 03 Commissioner W Ray Woodall voiced concern that the citizens are being told that the County does not support the school system He pointed out the schools were approved with more than a 10 increase in funding over last year , while the rest of government has been told they will have to operate on less With the strain on the budget , the Board has had to make difficult decisions , due largely to the State withholding anticipated funding He suggested the people need to complain to the legislators in Raleigh since the County has done all it can do He noted if the Board continues to take from the County’s fund balance , it will end up in the same shape as the State Considering the recent events , Commissioner Allen L Mims , Jr moved the Board freeze the recreation grants and non - profit funding until we get this problem with the schools resolved The motion died for lack of a second Commissioner Moore noted the citizens need to hear the County’s perspective on this issue The County has greatly increased the current expense funding to the schools over the past few years , and has provided additional funds for teacher supplements Board members agreed and pointed out the County has each year exceeded the recommended increase that was agreed upon by both boards when the financial model was put in place Following further discussion , Commissioner Thomas M Moore moved the Board authorize the Chairman to prepare a report outlining what the County has done for schools in the past few years and explaining the County’s position on funding Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Page010 Commissioner Fred Smith stated that in business , it is essential to be both effective and efficient It takes both ingredients to have a positive result For many years , the County Board of Commissioners has been committed to providing for effective education , but it must also be efficient with the County’s resources He referenced the request made earlier in the meeting for approval of the price of a school site for Smithfield Elementary , and noted it is the Commissioners ’ responsibility to look at the whole long -
