10 26 August 5 , 2002 The Johnston County Board of Commissioners met in regular session Monday , August 5 , 2002 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes - June 27 , July 1 , 8 , 10 , 2002 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the June 27 , July 1 , 8 , 10 , 2002 board meetings 2 Resolution - Employee Appreciation Week - August 5 - 9 , 2002 Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Fred Smith and carried by unanimous vote , the Board adopted the following resolution of appreciation for County employees and declared August 5 - 9 , 2002 as Employee Appreciation Week JOHNSTON COUNTY EMPLOYEE APPRECIATION WEEK August 5 - August 9 , 2002 WHEREAS Johnston County Employees represent approximately 850 men and women , working in 30 different service departments and agencies , devoted to making Johnston County a better place to work and live ; and WHEREAS Johnston County employees provide a multitude of services for ALL the citizens of the County - the farmer , the retailer , the industrial businessman , the homeless , the jobless , the homeowner , the veteran , the disaster victim , the victim of violence , the sick , the poor , the educated , the uneducated , the youth , the elderly , the newcomer , and the old - timer ; and WHEREAS Johnston County employees are both skilled and efficient in their jobs , making every effort to expend county tax dollars in the most effective way for the betterment of the County and its citizens ; and WHEREAS Johnston County Government runs smoothly on a day to day basis primarily because of the dedicated employees in each of its departments and agencies NOW , THEREFORE , in appreciation for their dedication to the welfare of the citizens of our County , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS DOES HEREBY PROCLAIM the week of August 5 - 9 , 2002 as COUNTY EMPLOYEE APPRECIATION WEEK Adopted this the 5th day of August , 2002 3 Recognition of Employee Service - Presentation of Service Pins The Board presented “ years of service ” pins to employees who have worked for Johnston County Government for 5 , 10 , 15 , 20 , 25 and 30 years Public Comment - No one spoke at this time 4 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Jasper Drive and Betsy Court in Stephanie Woods Subdivision - Phase 2 - Section 2 in Clayton Township Commissioner Allen L Mims , Jr moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Thomas M Moore seconded the motion which carried by unanimous vote Page27 5 Governance of Mental Health Center Eleanor N Creech , chairman of the Area Mental Health Board , spoke to the Commissioners about the new State Mental Health Reform plan and the need to declare Johnston County’s governance option for local mental health services On behalf of her board and the staff at the Mental Health Center , she requested that Johnston County remain a single county program with citizen input from the Area Board , but with final decisions remaining with the Board of County Commissioners In response to comments about the suggested guideline that a single unit would serve a population of approximately 200,000 , Ms Creech stated the 200,000 is a target , and she has been led to believe the State will honor the recommendation of the Commissioners Commissioner Fred Smith asked if there is any indication the State will make a funding differentiation between the single county units and the multi - county units , therefore putting a larger financial burden on the local government of a single county unit Ms Creech and Mental Health Director , Dan Searcy , both responded that at this point , there is no way to know what the State will do Commissioner Thomas M Moore noted , in his opinion , whichever way the County goes , the State will try to push more and more of the financial responsibility on the local government Chairman James H Langdon , Jr pointed out if the legislature did decide not to sufficiently fund single - county units , the County would most likely have the opportunity to join a multi - county unit at that time Following further discussion , Commissioner Thomas M Moore moved the Board declare Johnston County’s intention to remain a single - county unit under an Area Board appointed by the County Commissioners Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote 6 Youth Services - Approval of Governor’s Crime Commission Grant Debra Bolin , executive director of Johnston County Youth Services , requested the Board approve a Governor’s Crime Commission Grant in the amount of 96,03330 that will be used to implement a new program Youth Services will provide the required match with no cost to the County Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board gave their approval for Johnston County Youth Services to accept a Governor’s Crime Commission Grant in the amount of 96,03330 7 Community Development Block Grant Scattered Housing - Walker of Plainfield , Illinois manufactures the ClariCone that is compatible with our treatment process They have given us a quote for the new ClariCone and related installation of 289,000 , which is less than the contract price for the last ClariCone which was purchased last year He requested the Board award a contract to CBI - Walker for the fourth ClariCone and approve the necessary budget amendment , subject to approval of the NC Division of Environmental Health Subject to approval by the NC Division of Environmental Health , Commissioner W Ray Woodall moved the Board award a contract to CBI - year Clean Water Bond Loan in the amount of 2,875,000 for the expansion of the water treatment plant from 40 to 52 mgd RESOLUTION ACCEPTING THE OFFER FROM THE STATE FOR A STATE CLEAN WATER BOND LOAN AND AUTHORIZING THE EXECUTION AND DELIVERY OF A LOAN AGREEMENT AND PROMISSORY NOTE IN CONNECTION THEREWITH TO FINANCE CLEAN WATER IMPROVEMENTS AND PROVIDING CERTAIN TERMS IN RESPECT THEREOF BE IT RESOLVED by the Board of Commissioners of Johnston County Section 1 The Governing Body does hereby find and determine as follows a The State of North Carolina the “ State ” , pursuant to the Clean Water and Natural Gas Critical Needs Bond Act of 1998 , being Chapter 132 of the 1998 Sessions Laws the “ Act ” , has authorized the issuance by the State of Clean Water Bonds for the purpose of making loans to local government units for water supply systems , wastewater collection systems , wastewater treatment works , and water conservation and water reuse projects PagePage pageNumber631 b The Borrower has determined to borrow moneys from the State under the Clean Water Bond Loan Program established pursuant to the Act for the purpose of providing funds , together with any other available funds , to pay the costs of certain clean water bond projects as more particularly described in the Agreement hereinafter mentioned the “ Project ” - Interim Water Treatment Plant Expansion c Pursuant to the Act , the Borrower has made application to the Department of Environment and Natural Resources for approval of a clean water bond loan to finance the Project and has received a loan commitment in the principal amount of 2,875,000 to finance such capital improvements d The North Carolina Local Government Commission has approved the loan in an amount not to exceed such principal amount in accordance with the provisions of the Act e There has been presented to the Governing Body at this meeting forms of the following 1 Loan Offer from the State containing various assurances required by the State in connection with the loan and the Project ; and 2 Loan Agreement the “ Agreement ” between the Borrower and the State , together with a form of the promissory note of the Borrower attached as Exhibit A thereto the “ Note ” , evidencing the obligation of the Borrower to repay the loan from the State f The Borrower has determined that the borrowing from the State in the manner provided in this Resolution and the Agreement is in the best interest of the Borrower Section 2 Capitalized terms used in this Resolution and not otherwise defined herein shall have the same meanings given such terms in the Agreement Section 3 The Borrower hereby accepts the Loan Offer from the State , including all the assurances associated therewith Section 4 Pursuant to the provisions of Act , the Borrower hereby authorizes the borrowing of a principal amount not to exceed 2,875,000 from the State under the State Clean Water Bond Loan Program The terms and provisions of the borrowing shall be as set forth in the Agreement and the Note , subject to the provisions of this Resolution Section 5 The interest rate on the Note shall not exceed 575 per annum and the latest installment of principal on the Note shall not exceed May 1 , 2021 Section 6 The proceeds of the loan shall be applied to pay the costs of the Project as provided in Section 203 of the Agreement Section 7 Except as provided in Section 8 , the Note shall be secured solely by the Net Revenues and any Designated Non - Tax Revenues as provided in the Agreement , and the Borrower shall pledge the Net Revenues and the Designated Non - Tax Revenues for the payment of the principal of and interest on the Note shall not be secured by the general funds of the Borrower nor shall the Note constitute a legal or equitable pledge , charge , lien , or encumbrance upon any of the property or upon any of the income , receipts or revenues of the Borrower , except the Net Revenues , the Designated Non - Tax Revenues and any other moneys and securities pledged under this Resolution , the Agreement and the Note Neither the credit nor the taxing power of the Borrower are pledged for the payment of the principal of or interest on the Note , and the State shall not have the right to compel the exercise of the taxing power by the State of North Carolina or the Borrower or the forfeiture of any of their property in connection with any default with respect to the Note or this Agreement Section 8 The Borrower authorizes the State to include in the Agreement provisions authorizing the State to withhold from the Borrower any State funds that would otherwise have been distributed to the Borrower in accordance with North Carolina law in amount sufficient to pay all sums than due and payable to the State as a repayment of the loan ; provided , however , that such funds shall not be withheld if a prior to the execution of the Agreement and the Note , such funds have been pledged to secure special obligation bonds or other obligations of the Borrower or b after execution of the Agreement and the Note , such funds are legally pledged to secure special obligation bonds or other obligations of the Borrower Section 9 The forms , terms and provisions of the Loan Offer , the Agreement and the Note are hereby approved , and the Chairman of the Board of Commissioners , the County Manager , and the Clerk to the Board of Commissioners are hereby authorized and directed to execute and deliver the Loan Offer , the Agreement , and the Note in substantially the forms presented , together with such insertions , modifications and deletions as they may deem necessary and appropriate , and to take such other action and to execute and delivery such other certificates , agreements , instruments or other documents as they , with the advice of counsel , may deem necessary or appropriate to effect the transactions contemplated by this Resolution , the Loan Offer , the Agreement or the Note The officers , agents , and employees of the Borrower are hereby authorized and directed to do all acts and things required of them by the provisions of this Resolution , the Loan Offer , the Agreement and the Note for the full , punctual and complete performance of the terms , covenants , provisions and agreements of the same PagePage pageNumber732 Section 10 This Resolution shall take effect immediately upon its passage TH ADOPTED THIS THE 5 DAY OF AUGUST , 2002 11 Resolution to Participate in the Lower Neuse Basin Compliance Association Haywood Phthisic , Public Utilities Operations Director , informed the Board that under the new Neuse River Rules , dischargers are allowed to form a “ compliance association ” to work together as a group in meeting the required reduction in levels of total nitrogen and related monitoring and reporting He recommended the County join the Lower Neuse Basin Compliance Association , which he anticipates will have 30 to 35 members eventually He stated our County should meet the short - term requirements with little trouble ; however the real challenge will be seven to ten years from now when , along with the anticipated growth in population throughout the Neuse River Basin , it may become very expensive to treat our wastewater Being a part of an association will allow members to be considered for compliance as a group instead of individually In response to a question from Commissioner Fred Smith , Mr Phthisic stated the only cost to participate would be a possible small administrative charge Commissioner W Ray Woodall asked how much of the nitrogen problem comes from fertilizer , and whether the nitrogen could be reused Mr Phthisic noted the treatment plant only contributes 15 to 30 percent of the nitrogen The rest is from ground run - off and from the nitrogen in the air Engineer Tim Broome noted the nitrogen - heavy sludge byproduct at the wastewater plant could be treated and used again ; however , at present it is not cost effective and the sludge is being buried at the Landfill Following further discussion , Commissioner Fred Smith moved the Board adopt the following resolution to participate in the Lower Neuse Basin Compliance Association Commissioner Cookie Pope seconded the motion , which carried by unanimous vote RESOLUTION TO JOIN THE NEUSE RIVER COMPLIANCE ASSOCIATION WHEREAS , the Lower Neuse Basin Association LNBA , formerly the Neuse Basin Association was created in 1994 to establish a formal , voluntary agreement between itself and the North Carolina Division of Water Quality DWQ , by which the LNBA is responsible for surface water monitoring , reporting , and other cooperative efforts by NPDES dischargers within the Lower Neuse River Basin to obtain water quality information in the basin AND WHEREAS , in addition to such ongoing cooperative surface water monitoring activity and other joint efforts , the LNBA and DWQ jointly support other additional strategies to ensure overall Total Nitrogen reduction at the mouth of the Neuse River in the Pamlico Sound as required by the wastewater discharge requirements of the Neuse River Basin Nutrient Sensitive Waters Management Strategy AND WHEREAS , the formation of another body , the Neuse River Compliance Association Association is necessary to obtain a group NPDES permit for Total Nitrogen , as an alternative framework in which interested point source dischargers in the lower Neuse River Basin can work cooperatively to reduce their individual and collective discharge of that nutrient pollutant and comply with applicable limits THEREFORE , the Johnston County Board of Commissioners agrees with the overall intent of the cooperative arrangements set out in the By - Laws of the Neuse River Compliance Association and , at this time , intends to join the Association and to participate according to said By - Laws th Adopted this the 5 day of August , 2002 12 Public Hearing - Extension of Boundaries for the Brogden Water District Advertised July 5 , 19 , 2002 in The Smithfield Herald Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board recessed regular session to sit as the Brogden Water District Board The Chairman opened the public hearing and invited anyone who wished to address the Board on the proposed extension of territory to the Brogden Water District There being no comments , the Chairman closed the public hearing 13 Resolution Providing for Expansion of Boundaires of Brogden Water District Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following resolution providing for the expansion of boundaries of the Brogden Water PagePage pageNumber833 RESOLUTION PROVIDING FOR EXPANSION OF THE BOUNDARIES OF THE BROGDEN WATER DISTRICT OF JOHNSTON COUNTY WHEREAS the Johnston County Board of Commissioners the Board at its regular meeting on November 2 , 1998 passed a resolution creating the Brogden Water District the District in accordance with N C General Statutes § 162A - 86 , et seq ; and WHEREAS , the Board has determined , after receiving petitions from residents of property lying near the District , that these parcels of land contiguous to the District may be annexed into the District ; and WHEREAS , pursuant to NC General Statutes § 162A - 871 , the Board has determined to extend the boundaries of the District to include the petitioned parcels ; WHEREAS the Board resolved to hold a public hearing with respect to such extensions on August 5 , 2002 , and directed that the appropriate representatives of the County take the necessary actions to properly notice such public hearing as provided by law ; and WHEREAS , pursuant to N C General Statutes Section 162A - 871 e a notice of public hearing was prepared stating the date , hour and place of the hearing and its subject and stating that the report containing a map of the District and the areas to be annexed were available for public inspection in the office of the Clerk to the Board , and that such annexation fit the requirements of § 162A -
