10 126 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS November 4 , 2002 The Johnston County Board of Commissioners met in regular session Monday , November 4 , 2002 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes - September 30 , October 7 , 14 , 21 , 2002 Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of September 30 , October 7 , 14 , 21 , 2002 , as presented Public Comments 2 Retiring Mental Health Director Recognized The Chairman recognized Dr Daniel Searcy , retiring director of the Area Mental Health Department , and commended him for all he has done for the citizens of Johnston County Dr Searcy thanked the Commissioners and the County Manager for their support over the years , and asked that they continue to support the new director , Dr Janice Nutt 3 New HAPP Director Recognized The Chairman recognized the new HAPP Director , Melody Gates , and welcomed her to Johnston County Government Ms Gates stated she was looking forward to fulfilling her new position 4 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Stockbridge Drive , Dover Circle , and Callaway Lane in Edge Field Subdivision , in Wilders Township Commissioner Cookie Pope moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner W Ray Woodall seconded the motion which carried by unanimous vote 5 Proclamation - Veterans Day - November 11 , 2002 Upon a motion by Commissioner Fred Smith , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board adopted the following proclamation P R O C L A M A T I O N - V E T E R A N S D A Y - 2002 th WHEREAS , for decades America has paused on the 11 of November , the anniversary of the armistice that concluded World War I , to remember and to honor our veterans of military service in proud and grateful recognition of the hardships and sacrifices by the millions of men and women who have defended our land in war and in peace ; and WHEREAS , the freedoms we enjoy have been purchased and maintained at a high price , as Americans have been willing , throughout our history , to fight and die to preserve their individual rights as guaranteed in the United States Constitution and the Bill of Rights ; andPage127 November 4 , 2002 Continued WHEREAS , Americans owe a great debt to all those who have served in defense of this nation throughout the generations ; for their sacrifices , often resulting in permanent injury or death , which have preserved our unique form of government dedicated to human right and respect for the individual , and preserved our freedoms and promise of liberty as an example for oppressed persons of the world ; and WHEREAS , in honor of these dedicated men and women , we pledge our continued defense of our nation so that their sacrifice will stand before all the world as a tribute to the spirit and determination of a people dedicated to the principle of freedom and democracy NOW , THEREFORE , the Johnston County Board of Commissioners does hereby proclaim November 11 , 2002 , as “ Veterans Day ” in Johnston County , and urge our citizens to commend its observance th Proclaimed this the 4 day of November , 2002 Commissioner W Ray Woodall encouraged everyone to support the veterans by attending the ceremony th that will be held on November 11 at 11 00 am in front of the Courthouse He noted without our veterans , we would not enjoy the freedoms we have today 6 Nursing Home Adult Care Home Advisory Committee - Annual Report Steve Strickland , Assistant Health Director , presented the annual report on the activities of the Nursing Home Adult Care Home Advisory Committee He explained that Greg Tanner , who was scheduled to make the report , has resigned as regional ombudsman He noted the strength of the local committee depends on the ombudsman , and voiced hope that the position would soon be filled Mr Strickland recognized the committee members who were present and noted Committee Chairman , Ruth Daniels , recently received an award from Triangle J COG as an outstanding advocate for long - term care facilities in the region Ms Daniels has served on this committee for more than 20 years At present , eighteen of the twenty - five positions are filled , and an effort is underway to recruit new members Committee members visit the various long - term care homes in the County and report any concerns they find to the ombudsman , who investigates the situation Usually complaints can be solved at this level , however , problems that are not corrected are reported to the State He invited the Commissioners to visit the facilities with the committee members Board members thanked the committee for all they do to make sure the residents in long - term care homes are treated well 7 Public Hearing Bond Order for Meadow Water District Advertised October 11 , 2002 in The Smithfield Herald Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board recessed regular session to sit as the Meadow Water District Board The Chairman opened the public hearing and invited anyone who wished to address the Board on the questions of the validity of the bond order and the advisability of issuing general obligation bonds in the maximum principal amount of 7 million for the Meadow Water District Project There being no comments , the Chairman closed the public hearing 8 Adoption of Bond Order and Resolution Calling for Referendum for Meadow Water District After consideration of a public hearing held pursuant to NC General Statutes § 159 - Build Contract for Water Treatment Plant Expansion - POSTPONED At the request of the Public Utilities Department , the Board removed this item from the agenda and noted it will be considered at a later meeting 12 Resolution Authorizing the Filing of Application with the LGC - Financing Agreement for Water Treatment Plant Expansion Project The following resolution was discussed and its title was read RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR APPROVAL OF A FINANCING AGREEMENT AUTHORIZED BY NORTH CAROLINA GENERAL STATUTE 160A - 20 WHEREAS , The County of Johnston , North Carolina the “ County ” desires to enter into a financing agreement for expansion of a water treatment plant the “ Project ” to better serve the citizens of Johnston County ; and WHEREAS , the County desires to finance the Project by the use of an installment financing contract authorized under North Carolina General Statute 160A , Article 3 , Section 20 ; and WHEREAS , findings of fact by the governing body of the County must be presented to enable the North Carolina Local Government Commission to make its findings of fact set forth in North Carolina General Statute 159 , Article 8 , Section 151 prior to approval of the proposed contract ; NOW , THEREFORE , BE IT RESOLVED that the Board of Commissioners of Johnston County , North Carolina , meeting in regular session on the 4th day of November 2002 make the following findings of fact 1 The proposed contract is necessary or expedient due to the need for expansion of a water treatment plant 2 The proposed contract is preferable to a bond issue for the same purpose because the amount of funding needed is not of significant size to warrant the issue of bonds , and the County will pay relatively low issuance expenses relating to the contract method of financing 3 The County has substantial debt capacity to enter into said financing contract without any increase in the current property tax schedule 4 The County is not in default in any of its debt service obligations 5 The sums to fall due under the contract are adequate and not excessive for the proposed purpose because of the competitive bidding to be received for the Project 6 The County’s bond counsel has rendered an opinion that the proposed project is authorized by law and is a purpose for which public funds may be expended pursuant to the Constitution and laws of North Carolina BE IT THEREFORE RESOLVED that the Finance Officer is hereby authorized to act on behalf of the County in filing an application with the North Carolina Local Government Commission for approval of the Project and the proposed financing contract and the other actions not inconsistent with this resolution ; and BE IT FURTHER RESOLVED , that the Board of Commissioners of Johnston County will hold a public hearing with respect to the proposed installment financing contract on December 2 , 2002 This Resolution is effective upon its adoption this 4th Day of November 2002 Commissioner Thomas M Moore moved the passage of the foregoing resolution and Commissioner Wade M Stewart seconded the motion , and the resolution was passed by the following vote Ayes James H Langdon , Jr , Cookie Pope , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Fred Smith , and W Ray Woodall Nays NonePagePage pageNumber6131 November 4 , 2002 Continued 13 Award of Contract - Additional Funding for Operation of Johnston County Area Transit System JCATS County Manager , Rick Hester , informed the Board that he and several Commissioners met with Donna Creech from Council on Aging and representatives from agencies who are served by JCATS Based on the information from the meeting , it is recommended the County appropriate 12,500 additional funding to Council on Aging to assist them in administering the JCATS program for the remainder of the fiscal year Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the following budget amendment in the amount of 12,500 from the undesignated fund balance to provide assistance to Council on Aging for the administration of JCATS Special Appropriation - 10 15 02 Tax refunds - Personal Real Property 68404 Tax releases - Personal Real Property 1,91342 Motor Vehicle releases refunds 5,48706 Recommended Approved Pat Goddard , Tax Administrator John R Massey , County Finance OfficerPage2137 November 4 , 2002 Continued 18 Delinquent Tax Collection Report for the Month of October Tax Administrator , Pat Goddard , presented the monthly report on delinquent tax collections In enforced collections , the County collected 134,38135 through garnishments , bank attachments and levies The County also sent out 62 demand letters , filed 12 complaints and collected 45,447333 through foreclosure th proceedings She announced there would be a foreclosure sale on November 20 for four properties , two of which have delinquent taxes back to 1992 Commissioner Fred Smith congratulated Ms Goddard and Attorney Mark Payne for the excellent job they have done in collecting more than 2 million in delinquent taxes over the past 18 to 19 months Now that the total unpaid taxes is significantly lower , he asked Mr Payne if it would be feasible to bring the foreclosure process back in - house , rather than contracting with an outside legal firm He suggested a decision could be made beginning with the 2001 accounts Mr Payne agreed that this is an appropriate time to re - evaluate this matter 19 Revaluation 2003 - Inserts in Local Newspapers and Community Meetings Ms Goddard provided the Board members with a copy of an insert that will go in all local newspapers within the next few days concerning Revaluation 2003 The supplement will provide citizens with the following information lt; general information about assessment equalization lt; outline of the appeals process lt; list of scheduled community meetings where taxpayers can learn more lt; schedule of dates when new valuations will be mailed , deadlines for appeals , when actual tax bills will be sent out , and the deadline for paying 2003 tax payments lt; information about how tax dollars are spent in Johnston County Ms Goddard noted that citizens are encouraged to attend one of five community meetings , which have been scheduled throughout the County , to learn more about the revaluation process 20 County to Discontinue the Listing of Dogs on Tax Forms in 2003 Ms Goddard recommended the County delete the listing for dogs on the 2003 tax forms She noted it costs more for her staff to deal with the appeals and answer complaints about this issue than is realized in revenue The tax , which is not enforced , also creates a lot of public relations problems for her office She pointed out , however , that if the Board agrees to remove this from the County form , she will have to talk with the towns of Clayton , Pine Level and Four Oaks since the County also collects this tax for them In response to a question by Commissioner Allen L Mims concerning where this money has been going , County Finance Officer , John Massey , stated the dog tax revenue went into the Animal Control Account and was used for facility operation , vaccine and veterinary fees Upon a motion by Commissioner Fred Smith , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board agreed to accept the recommendation of the Tax Administrator and discontinue the listing of dogs on County tax forms in 2003 21 Public Hearing - Brogden Fire District Expansion Advertised The Smithfield Herald - October 22 , 29 , 2002 Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board recessed regular session to sit as the Brogden Water District Board The Chairman opened the public hearing and invited anyone who wished to address the Board on the proposed extension of territory to the Brogden Water District Commissioner W Ray Woodall noted these properties are in Selma’s ETJ , however , Selma had no plans to extend water to them as it would require running pipeline under Interstate 95 There being no further comments , the Chairman closed the public hearing Page3138 November 4 , 2002 Continued 22 Resolution Providing for the Expansion of the Boundaries of the Brogden Water District of Johnston County The following resolution was discussed and its title was read RESOLUTION PROVIDING FOR EXPANSION OF THE BOUNDARIES OF THE BROGDEN WATER DISTRICT OF JOHNSTON COUNTY WHEREAS the Johnston County Board of Commissioners the Board at its regular meeting on November 2 , 1998 passed a resolution creating the Brogden Water District the District in accordance with N C General Statutes § 162A - 86 , et seq ; and WHEREAS , the Board has determined , after receiving petitions from residents of property lying near the District , that these parcels of land contiguous to the District may be annexed into the District ; and WHEREAS , pursuant to NC General Statutes § 162A - 871 , the Board has determined to extend the boundaries of the District to include the petitioned parcels ; WHEREAS the Board resolved to hold a public hearing with respect to such extensions on November 4 , 2002 , and directed that the appropriate representatives of the County take the necessary actions to properly notice such public hearing as provided by law ; and WHEREAS , pursuant to N C General Statutes Section 162A - 871 e a notice of public hearing was prepared stating the date , hour and place of the hearing and its subject and stating that the report containing a map of the District and the areas to be annexed were available for public inspection in the office of the Clerk to the Board , and that such annexation fit the requirements of § 162A - 871 ; and WHEREAS , pursuant to N C General Statutes § 162A - 871 e , the notice of public hearing was published once in newspapers that circulate in the proposed District , and pursuant to 162A - 871 b the County has received petitions for annexation signed by 100 of the real property owners in the areas to be annexed ; and WHEREAS , a public hearing was held at 11 00 am on November 4 , 2002 , in the Commissioner’s Room , Courthouse Annex , Smithfield , North Carolina at which time taxpayers and all other interested persons appeared and were heard concerning the question of expanding the boundaries of the Brogden Water District of Johnston County ; and WHEREAS , at such meeting the Board determined that it was appropriate to extend the boundaries of the District to include the parcels of land Exhibits A ; and WHEREAS , the Board , following the public hearing finds that 1 The areas to be annexed are contiguous to the District , with at least one -
