10 146 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS December 2 , 2002 The Johnston County Board of Commissioners met in regular session Monday , December 2 , 2002 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of November 4 , 12 , 2002 board meetings as presented 2 Organization of the Board Chairman James H Langdon , Jr turned the meeting over to Vice Chairman Cookie Pope for the election of chairman for the next year Commissioner Pope called for nominations Commissioner W Ray Woodall nominated Commissioner James H Langdon , Jr to remain as chairman for the coming year Commissioner Allen L Mims , Jr moved the nominations be closed By acclamation , James H Langdon , Jr was elected Chairman of the Board for a one - year term Chairman Langdon called for nominations for vice chairman Commissioner W Ray Woodall nominated Commissioner Cookie Pope Commissioner Wade M Stewart seconded the nomination and Commissioner Pope was elected Vice Chairman of the Board for a one - Request to Close Waiting List HAPP Director , Melody Gates , requested the Board’s approval to close her agency’s waiting list as of January 1 , 2003 She stated that currently there are over 700 families on the list Once the majority of the families are served and the list gets down to about 200 names , she will come back with a request to reopen Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved HAPP closing its waiting list effective January 1 , 2003 7 Award of Contracts - 10 30 am - Financing Agreement for Water Treatment Plant Expansion Advertised - 11 19 02 and 11 22 02 in the Smithfield Herald The Chairman opened the public hearing and invited anyone who wished to address the Board on the proposed installment financing agreement for the Water Treatment Plant expansion project No one spoke during this time and the Chairman closed the public hearing 9 Resolution Approving Installment Financing Agreement for Water Treatment Plant Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board adopted the following resolution accepting the bid from First Citizens Bank & Trust for a 20 - year Installment Financing Agreement , in the principal amount of 33 million , at an interest rate of 521 , for the Water Treatment Plant Expansion project RESOLUTION APPROVING INSTALLMENT FINANCING AGREEMENT IN THE PRINCIPAL AMOUNT OF 33 MILLION FOR EXPANSION OF A WATER TREATMENT PLANT AND AUTHORIZING THE EXECUTION AND DELIVERY OF DOCUMENTS IN CONNECTION THEREWITH WHEREAS , pursuant to the North Carolina General Statutes , The County of Johnston , North Carolina , the “ County ” is authorized to acquire real or personal property or to construct or repair fixtures or improvements on real property ; and WHEREAS , the County desires to enter into a financing agreement for expansion of a water treatment plant the “ Project ” to better serve the citizens of Johnston County ; and WHEREAS , the County desires to finance the Project by the use of an installment contract authorized under North Carolina General Statutes Chapter 160A , Article 3 , Section 20 ; and WHEREAS , the County Finance Officer requested and received bids for a twenty - year loan from several financial institutions to provide financing for the Project ; and WHEREAS , the County Finance Officer has recommended that the Board accept the bid from First - Citizens Bank & Trust Company the “ Bank ” , which provides for a 20 - year loan , in the principal amount of 33 million , at an interest rate of 521 , secured by a deed of trust on the Project ; and WHEREAS , there has been presented to the Board in substantially final form an Installment Financing Agreement between the County and First - Citizens Bank & Trust Company the “ Agreement ” ; and NOW , THEREFORE , BE IT RESOLVED that the Board of Commissioners of Johnston County , North Carolina , meeting in regular session on December 2 , 2002 , do the following Page149 December 2 , 2002 Continued 1 The Board hereby approves First - Citizens Bank & Trust Company as the lender for the water treatment plant expansion on the terms presented to the meeting 2 The Chairman or Vice Chairman of the Board is hereby authorized and directed to execute and deliver the Agreement and the Deed of Trust , which shall be in substantially the form presented to the Board , which is hereby approved , and other documents in connection therewith , with such completions , omissions , insertions , and changes as may be approved by the Chairperson or Vice Chairman , including such changes as may be required by the North Carolina Local Government Commission , their execution to constitute conclusive evidence of his approval of any such completions , omissions , insertions and changes The Clerk of the Board shall attest and seal such documents as require the Clerk’s attestation and the seal of the County 3 The officers and employees of the County are hereby authorized and directed to deliver all certificates and instruments and to take all such further action as they may consider necessary or desirable in connection with execution of the Agreement and the undertaking of the Project 4 To the extent permitted by law , the officer or employee of the County as may be responsible from time to time for the preparation of the annual budget of the County , is hereby authorized and directed to carry out the obligations imposed by the Agreement on such officer or employee 5 All other actions of the officers of the County which are in conformity with the purposes or intent of this resolution and in furtherance of the execution of the Agreement and the undertaking of the Project are hereby ratified , approved and confirmed The representations of the County made in the Agreement and the other related documents are hereby confirmed 6 This resolution shall take effect immediately 10 Award of Contracts - 128 - 2 concerning minority business participation Non - compliance could jeopardize the SRF loan for the project Therefore , subject to approval of the Public Water Supply Branch of the NC Department of Environment and Natural Resources , he recommended the Board award a contract forPagePage pageNumber5150 December 2 , 2002 Continued the Distribution Lines to second low bidder , TA Loving of Goldsboro in the amount of 847,991 , and award a contract for the Elevated Tank to low bidder , Caldwell Tanks , Louisville , Ky in the amount of 560,484 He also recommended the approval of the capital project budget in the amount of 1,667,975 Following discussion , Commissioner Allen L Mims , Jr moved the Board award the following contracts , subject to approval by the State , on the second phase of construction on the Brogden Water District , and approve the project budget in the amount of 1,667,975 lt; Distribution Line Contract to T A Loving in the amount of 847,991 lt; Elevated Tank Contract to Caldwell Tanks , Louisville , Ky in the amount of 560,484 Commissioner Cookie Pope seconded the motion , which carried by unanimous vote Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Brogden Water District Board adjourned and regular session resumed 11 Request for Residential Wastewater Capacity Allocation Mr Broome informed the Board that Developers John Aman and Teddy Hines have requested wastewater capacity for properties they are planning to develop primarily as residential Mr Aman’s request is for 71,280 gallons per day to serve the 198 lots in phase two of Hillington Estates Subdivision The majority of the new development would be in Wake County Mr Hines is planning a mixed use development entirely within Johnston County He would require 310,000 gpd , of which 282,000 gpd would be for residential Commissioner Allen L Mims , Jr noted the two requests would amount to approximately 20 of the added capacity from the wastewater treatment plant expansion project He asked about the County’s policy concerning how long a property owner can hold the capacity before he develops the land Mr Broome explained there is a one - year time frame for sewer infrastructure , with another one - year extension possible He noted with the Cleveland diversion line and the plant expansion , the County would have sufficient capacity available for these projects if the Board chooses to approve them Commissioner Fred Smith voiced some reservations about serving lots in Wake County , but noted he is a strong proponent of providing wastewater to developers for in - county property as this service pays for itself and does not affect the property tax dollars He suggested the Board might want to consider a surcharge on use in other counties , and for that reason he requested the Board vote on the two requests individually Commissioner Mims suggested a subcommittee be appointed to consider a policy for allocating residential wastewater capacity Commissioner Wade M Stewart agreed and stated he would like an opportunity to discuss the proposed projects with the two developers before making a decision He pointed out the existing policy states that residential allocation will only be made when there is a failed or failing septic system , or with mixed development that will provide an exceptional benefit to the County Commissioner Smith disagreed and stated , in his opinion , the Board should go ahead and approve the mixed development of Mr Hines that is entirely within the County He noted every time a septic tank goes in the ground , we are using up our most valuable resource , our land He pointed out that growth affects everything in the County ; sewer pays for itself and the value of the property increases , which brings in more tax revenue The County’s policy allows for mixed development , which is what Mr Hines is proposing , and it is only right to go ahead and approve this request as it is in the best interest of Johnston County for land use Following further discussion , Commissioner Allen L Mims , Jr moved the Board set up a subcommittee to consider these requests and look at the overall policy for residential wastewater allocations Commissioner Cookie Pope seconded the motion , which carried by the following vote Ayes James H Langdon , Jr , Cookie Pope , Wade M Stewart , and Allen L Mims , Jr , Nays Thomas M Moore , Fred Smith , and W Ray Woodall Wastewater Work Group Appointed Later in the meeting , the Chairman appointed Commissioners Allen L Mims , Jr , Wade M Stewart and Thomas M Moore to consider the two existing requests and look at the overall policy for residential wastewater allocations PagePage pageNumber6151 December 2 , 2002 Continued 12 Board of Education - Request to Shift Funds for Bond Facilities Projects Dr Jim Causby , Superintendent of Schools explained the School Board is requesting amendments to the County’s project ordinances for the 75 million bond money to allow funds to be shifted from projects that have apparent overages to projects that need additional allocations The Project Ordinance Revision Request would reduce the budgets for River Dell Elementary 1,000,000 , McGee’s Crossroads Elementary 300,000 , Polenta Elementary 300,000 and Smithfield Elementary 1,000,000 This money would be shifted to Clayton High 662,000 , Meadow Elementary 1,300,000 , Princeton High 162,000 and South Johnston High 476,000 The money for the South Johnston project is to partially cover a shortfall in the anticipated ADM funds from the State Dr Causby explained the reasons for the shortfalls on the four projects He noted the Clayton High , Meadow Elementary and Princeton High projects , need additional money to cover unanticipated problems such as bids coming in higher than expected , problems with the proposed sites , and additional work that has been uncovered since the initial scope of projects was determined On the South Johnston High project , the Board of Education had planned to use 2 million in State ADM money Over the past years , the County has received approximately 11 million annually from this fund This year , however , the General Assembly used this money to help cover the State General Fund shortfall Fortunately , the County had available 1,524,000 in accumulated ADM funds from previous allocations , leaving the shortfall on the project of 476,000 Upon a motion by Commissioner Fred Smith , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the following project ordinance revision on the 75 Million School Bond Issue Project Ordinance Revision - 0 - 13 County Property - Old Champion Property in Clayton to be Transferred to Board of Education The work group that has been discussing the Champion property in Clayton has met and has recommended the County deed the rest of the old Champion property over to the Board of Education , subject to an agreement between the two entities stipulating that the building be totally demolished within a specific period of time Dr Causby noted the building has been used for school storage , however , staff is looking for somewhere to move the stored items as soon as possible Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board agreed to transfer the deed to the old Champion property , located adjacent to the Clayton High School campus , to the Board of Education , subject to an agreement between the County and the Board of Education concerning a time frame for the total demolition of the old building The motion included approval for the School Board to proceed with their plans for Clayton High School , which includes the use of some of this property The Board further instructed Mark Payne , County Attorney , to work with the School’s attorney on an agreement to bring back before the Board 14 Food Establishment Plan Review Fee Schedule Approved Larry Sullivan , supervisor of the Environmental Health Department , reviewed with the Board the recent legislation enacted by the General Assembly that allows counties to charge up to 200 per plan review for non -PagePage pageNumber7152 December 2 , 2002 Continued prototype food establishments Mr Sullivan noted this fee would give the County a way to recoup some of the costs for the approximately 30 plan reviews his department has to do each year The fee would become effective on January 1 , 2003 , and the money would stay in the County to be used for the Environmental Health Department’s food and lodging program He recommended the following plan review fee schedule for Johnston County lt; Food stands , meat markets , limited food establishments , commissaries and catering operations to be assessed at a rate of 50 per 250 sq ft , but not to exceed 200 lt; Restaurants with 50 or less seats to be assessed at a rate of 100 lt; Restaurants with a seating capacity of 51 to 100 to be assessed at a rate of 150 lt; Restaurants with a seating capacity of greater than 100 to be assessed at a rate of 200 Following discussion , Commissioner Fred Smith moved the Board approve the proposed plan review fee schedule to become effective for applications received on or after January 1 , 2003 Commissioner Thomas M Moore seconded the motion , which carried by unanimous vote 15 EMS Medical Director Appointed Emergency Management Director , Dewayne West , informed the Board that Dr Michael Dickerson , the County’s EMS Medical Director , has resigned his position with Johnston Memorial Hospital and is now at Cape Fear Valley in Fayetteville On behalf of the rescue squads , he recommended the Board appoint Dr Ben Winters , the new ER Director at JMH as EMS Medical Director for the County Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board appointed Dr Ben Winters as EMS Medical Director for the County 16 Surplus Property - Communications Department Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board declared surplus the Global Telephone Interconnect device , which is no longer used by the County , and authorized that it be sold to Greenville Utilities at a price of 2,01250 , as allowed by NCGS § 160 A - 11 15 02 Tax refunds - Personal Real Property 71995 Tax releases - Personal Real Property 2,86005 Motor Vehicle releases refunds 4,34885 Recommended Approved Pat Goddard John R Massey 20 Delinquent Tax Report Tax Administrator Pat Goddard reported on the enforced collections and foreclosures for the month of November She noted the County processed 202 garnishments and 194 bank attachments for a total collection of 86,00934 Concerning the foreclosure proceedings , six demand letters were sent out and 15 complaints filed The total delinquent real estate collected since April 2001 when the current aggressive collection program began is 2,037,28968 Page3158 December 2 , 2002 Continued In response to a question from Commissioner Fred Smith , Attorney Mark Payne explained that over the past year , outside counsel has been successful in collecting the outstanding delinquent taxes It is now time to review the matter to determine the best way to handle these collections in the future 21 2003 Revaluation Ms Goddard provided updated information on the 2003 revaluation She explained with 74,064 taxable parcels revalued , the overall increase is 62 The largest increase is in vacant land values at an average of 153 , with single family residences increasing an average of approximately 50 The new real estate value for the County is 7,709,596,360 , which is an increase of approximately 3 billion This figure , however , will change after the appeals are heard She provided the Board members a packet of information to help them in answering any questions they might receive from the taxpayers The packets include a video tape that explains the revaluation process , a copy of the newspaper insert that went out in all local newspapers , informational brochures , and business cards that can be given out with the names and numbers to call for further assistance She noted there has been an appeal to the Property Tax Commission that will , hopefully , be satisfied within a few days , after which the notices of value can be sent out to the citizens 22 Closed Session -
