10 172 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS January 6 , 2003 The Johnston County Board of Commissioners met in regular session Monday , January 6 , 2003 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Allen L Mims , Jr , Wade M Stewart , Fred Smith , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board approved the minutes of the December 2 , 9 , 2002 board meetings as presented Public Comments 2 Public Comments on Johnston County Veterans Service Agency John King , Jr , veteran with American Legion Post 518 in Clayton , complained of the quality of service extended to minorities at the Johnston County Veterans Service Agency Mr King alleged there have been a number of incidents where minority veterans have had to go to another county to receive help with benefits He also questioned the way scholarships are determined and stated , in his opinion , all veterans and veterans ’ families are not treated equally Timothy Hodges , disabled veteran , stated this has been a problem for Johnston County minority veterans for many years Chairman Langdon thanked Mr King and Mr Hodges for their comments and suggested they contact the County Manager to set up a meeting where this matter can be more thoroughly discussed 3 Chairman’s Comments on Revaluation Chairman Langdon made a brief statement concerning the 2003 Revaluation Process and the recent valuations that were mailed to property owners He explained the County is required by State law to revalue all real property at its current market value at least once every eight years , to ensure that taxation is fair and equitable for all citizens The revaluation has been conducted by the professional , licensed firm of Cole , Layer , Trumble CLT , with assistance from the County Tax Department personnel The County has 75,000 parcels , all of which were visited , however , mistakes were no doubt made on some values For citizens who feel that their value is incorrect , he outlined the appeal process that is in place and urged them to take advantage of the opportunity to appeal Commissioner Langdon noted the important thing to remember is the amount of taxes a person will pay on his property depends on the tax rate that will be set by the Board later in the year That rate cannot be established until the appeal process is nearly complete and an accurate total value of property in the County is determined The Commissioners are required to adopt a budget with a tax rate by the end of June 2003 4 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Broom Sage Drive and Wiregrass Court in Crosspointe Subdivision , Pleasant Grove Township Commissioner Cookie Pope moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Thomas M Moore seconded the motion which carried by unanimous vote Page173 January 6 , 2003 Continued 5 Proposed Agreement with the School Board - Disposition of Champion Products Building The Board considered a proposed agreement between the County and the Board of Education concerning the terms of the transfer of the property adjacent to Clayton High School , known as the Champion property Specifically , the agreement pertains to the demolition of the old Champion Products building , which is currently used by the Board of Education for storage Commissioner Allen L Mims , Jr stated he would like additional language in the agreement that would strengthen the County’s position and give them the final say concerning the time frame for demolishing the building Following discussion , the Board instructed the Attorney to add appropriate language to the agreement th and bring it back before the Board on January 13 6 Award of Contract - Disaster Debris Management Services EMS Director , Dewayne West , reviewed with the Board the following proposals received for Disaster Debris Management Services in the event of a major disaster in the County He explained the proposals were for a cost per cubic yard based on an estimated 2,500,000 cubic yards of debris , and a separate schedule of job specific hourly rates including labor and equipment Company Cost per Cubic Yard Range of Job Specific Hourly Rates Phillips and Jordan , Inc , Robbinsville , NC - 1095 8 - 550 Ralph Hodge Const , Byrd Brothers , Inc of Wilson and DRC in Alabama 1195 25 - 65625 Mr West noted the three - year contract would only be activated if the Board of Commissioners deemed it necessary He recommended award to low bidder , Phillips and Jordan of Robbinsville , NC , and noted their proposal is in line with FEMA reimbursement rates In response to questions from the Board , Mr West stated the contractor is under a performance bond and has experience in managing this type of operation , which includes filling out the required paperwork for FEMA They would most likely subcontract with local companies for the actual collection Following further discussion , Commissioner Wade M Stewart moved the Board award a contract to Phillips and Jordan of Robbinsville , NC for Disaster Debris Management Services , based on the quote listed above Commissioner Cookie Pope seconded the motion , which carried by unanimous vote 7 Proposed Revisions for Fire District Boundaries to 6 Miles - Public Hearings Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board scheduled a public hearing for the February meeting on the proposed revisions to the fire districts in the County to six miles NOTE Following the meeting , it was discovered that a hearing or hearings in February would not allow enough time to fulfill the notification requirements as stated in NC General Statute 153A 303 The date and time for the hearing s will be determined at a later meeting 8 Resolution - Rules and Regulations for Operation of Johnston County Airport Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board adopted the following resolution accepting the rules and regulations for proper maintenance and operation of the Johnston County Airport RESOLUTION CONCERNING THE ADOPTION OF RULES AND REGULATIONS FOR THE JOHNSTON COUNTY AIRPORT WHEREAS The Johnston County Airport Authority the Authority is authorized by statute to adopt rules and regulations for the proper maintenance and operation of the Johnston County Airport ; and WHEREAS , the Authority has adopted Rules and Regulations for the proper maintenance and operation of the Johnston County Airport ; said rules currently in full force and effect ; and ;Page174 January 6 , 2003 Continued WHEREAS , in order to qualify for state grant funding pursuant to the North Carolina Airport Plan NCASP , the Board must recognize and adopt valid rules and regulations governing the operation of the Johnston County Airport NOW , THEREFORE , BE IT RESOLVED BY the Johnston County Board of Commissioners , meeting in regular session at Smithfield , North Carolina , on January , 2003 , do the following 1 The Board recognizes and adopts the Rules and Regulations adopted by the Authority as lawfully enacted and as having full force and effect ; 2 The Board hereby authorizes the Johnston County Airport Authority to make such modifications and amendments to the Rules and Regulations as it deems appropriate so long as such modifications and amendments are lawfully enacted and an updated current version of the Rules and Regulations are made accessible to the public , and adopts by reference any validly enacted modifications and amendments ; the Authority is hereby required to keep an updated set of Rules and Regulations in effect so long as the Johnston County Airport is in operation 3 This resolution will become effective upon adoption Commissioner Cookie Pope moved the passage of the foregoing resolution and Commissioner Thomas M Moore seconded the motion , and the resolution was passed by the following vote Ayes James H Langdon , Jr , Cookie Pope , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Fred Smith , and W Ray Woodall Nays None Not voting None 9 Request for Matching funds for Federal Grant - Wastewater Facilities Improvement Project Mr Broome explained the County has received State permits for the next wastewater facilities improvements program , which includes the treatment plant expansion , the Cleveland Diversion TransmissionPagePage pageNumber5176 January 6 , 2003 Continued System , parallel lines in Smithfield and rehabilitation of aging sewer lines Staff hopes to proceed with the bidding process as soon as possible NCGS 133 - 3 now requires public disclosure at a meeting of the Board of Commissioners of alternate bid items for owner preferred equipment In the bid specifications , Staff is requesting certain equipment by a preferred manufacturer , and in accordance with the new legislation , wishes to request alternate equipment bids if the base bid does not include the preferred manufactured product He presented the following list of the preferred equipment that would require an alternate bid , and requested the Board authorize staff to proceed with the bidding process , including the alternate bid request Schedule of Preferred Equipment for the 2003 Wastewater Treatment Facilities Improvements Project Equipment Item s Preferred Justification Comment Manufacturer Submersible raw waste Fairbanks - Residential Wastewater Allocation Requests As requested by the Chairman at the December board meeting , Commissioners Allen Mims , Wade Stewart and Tom Moore served on a committee to further consider the requests from John Aman and Teddy Hines for residential wastewater allocation for their proposed developments Commissioner Mims reported the committee looked at the two requests and agreed they could not recommend Mr Aman’s request since two - thirds of the development would be in Wake County He noted too many people in Johnston County want the limited capacity for the Board to consider providing out - of - county service at this time Concerning the request from Teddy Hines for a mixed use development entirely within the County , Commissioner Mims stated the committee was divided He noted that Mr Hines appeared before the Planning Board in December for rezoning to a mixed use special use district , and asked Planning Director , Steven Finn , to update the Commissioners on what transpired at that meeting PagePage pageNumber6177 January 6 , 2003 Continued Mr Finn reported the Planning Board discussed at length the question of what constitutes “ exceptional value ” as it relates to the County’s policy on residential wastewater allocation The policy provides for wastewater allocation for mixed use developments of exceptional value and benefit to the County He noted that after discussion , the Planning Board did approve the rezoning , contingent upon the County Commissioners approving the sewer allocation He pointed out that in addition to land for a fire station and recreational facilities , the applicant agreed to provide land for a school site ; however , this has not been favorably received by the Board of Education The conceptional plan offered by the applicant exceeded the County requirements in several areas , including open space and environmental protection In response to a comment from Commissioner Mims about the potential impact on traffic , Mr Finn noted that NCDOT would require a traffic impact analysis and would place specific requirements on the developer for turning lanes and other road improvements Commissioner Fred Smith pointed out the Commissioners only question at this time is whether or not to approve the sewer allocation It will be up to the Planning staff to make sure all the issues connected with the development are addressed properly Commissioner Mims disagreed and noted , in his opinion , the County must consider the overall affect of the development before making the decision on the wastewater He pointed out he still has a question as to the number of dwellings planned Originally he was told there would be 650 housing units , but now , according to the newspaper , the number is 850 He questioned whether the road system and schools in the area could handle this type of development , and stated he would like to know more before he makes a decision on the matter Commissioner Wade M Stewart agreed and stated , in his opinion , it would be to everyone’s advantage if the entire Board looks at the overall question of sewer allocation and decides on what direction the County should take County Manager , Rick Hester , suggested the Board might want to place a 90 - day moratorium on wastewater allocation in order to give them time to look closely at the issue Commissioner Thomas M Moore stated the County already has a policy , and he has no problem with changing it if needed , but this request came in under the existing policy If the development meets the existing requirements , the County should approve the allocation He pointed out the wastewater treatment plant is being expanded to treat 2 million more gallons per day , and the reclaimed land application program will also increase the available capacity In his opinion , the County has the capacity and granting this request should not be a problem Commissioner Fred Smith moved the Board approve the Hines Project , subject to the Planning staff continuing to make sure the project does provide all the discussed elements such as land for a fire station , recreational facilities , environmental protection , etc Commissioner Thomas M Moore seconded the motion Further Discussion Commissioner Smith stressed , for the record , that he has no interest , financial or otherwise , in this project , and noted his motion was based on what he believes is in the best interest for Johnston County He suggested it is not good for development to be septic tank driven , especially in the heavily populated western portion of the County He voiced support for mixed use development and stated the County should encourage this by providing the necessary infrastructure , including sewer service Commissioner W Ray Woodall voiced concern about whether the school system could support this type of heavy development in this area He also suggested the County might be open to law suits if this request is approved and other similar developments are denied He agreed the issue needs more study Commissioner Smith stated the issue of liability would be invalid since there is no obligation for the County to provide more than we have As for schools , he noted the question is not whether students will come , but rather a question of what type of place they will live in He stressed the need to have available quality housing for those people who move into the County Commissioner Mims noted that his concern is not so much for the people who move in , but on making sure the people who are already in the area continue to enjoy quality living He noted that traffic is already an issue , and until he knows more about how this development would impact the area , he would prefer to wait on a vote PagePage pageNumber7178 January 6 , 2003 Continued Chairman Langdon suggested the question is really about sewer capacity - how much we have , and how we allocate it He agreed this type of development is great , but the County doesn’t have enough for everyone , and that creates an issue of fairness He suggested the County needs to look at the available capacity and consider what can be done to make allocation fair for all those who have similar requests Commissioner Smith stated he believes the County has adequate sewer capacity and will have more in the near future with the expansion project He noted he has no problem with reserving some for industry ; however , the rest should be made available for qualified development on a first come , first serve basis Commissioner Cookie Pope stated the Board represents all the citizens and must consider what is best for everyone Developer Linwood Jones , speaking on behalf of Mr Hines , stated his client has already invested money on this project , which will die if they do not get sewer allocation He asked the Board to approve the request so he can go forward with the plans , which will have to meet all the requirements of the County and State Dennis Blackman , surveyor and consultant for John Aman , spoke about his client’s request for sewer allocation He pointed out the County would get revenue from the large portion of the development in Wake County , and those dwellings would not impact the County’s schools or other infrastructure He noted they would like approval now , but would be willing to wait if necessary Commissioner Smith stated that any decision on out - of - county sewer would require additional study In his opinion , however , Mr Hines request should be dealt with He asked the Board to vote on his motion , which if approved would only make it possible for the applicant to move forward enough to bring something back to the Planning Board Motion Restated Motion by Commissioner Fred Smith and seconded by Commissioner Thomas M Moore to grant the requested allocation of wastewater capacity for Mr Hines mixed use development , contingent upon the developer continuing to make the same offers of land for a fire station , school and recreation area , and continuing to meet all requirements of the Planning Board Vote The motion failed by the following vote Ayes Thomas M Moore , Fred Smith , Nays James H Langdon , Jr , Cookie Pope , Wade M Stewart , Allen L Mims , Jr , and W Ray Woodall In response to comments from the audience , the Chairman and several other Board members agreed that after looking at the sewer policy , the Board might consider looking at this request again 17 Public Hearing Scheduled for Proposed Annexation of Buffalo Water District Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board scheduled a public hearing on a proposed extension of the Buffalo Water District 18 Presentation of the County Audit Ending June 2002 Eddie Burke with Cherry Bekaert and Holland Accounting Firm presented the County audit for the year ended June 30 , 2002 Mr Burke reviewed with the Board the audit report and noted , as required by law , this year the County successfully implemented GASB Standard 34 , which represents a significant change in financial reporting He stated that following the audit , the County was given an unqualified opinion from his firm , which is the highest level of assurance on a financial statement He presented the following highlights from the audit report lt; The assets of the County exceeded its liabilities at the close of the fiscal year by 53,884,598 net assets PagePage pageNumber8179 January 6 , 2003 Continued lt; The government’s total net assets decreased by 25,575,974 , primarily due to the County’s continued commitment to adequately fund the County Board of Education lt; As of the close of the current fiscal year , the County’s governmental funds reported combined ending fund balances of 68,271,341 , a decrease of 6,355,723 in comparison with the prior year Approximately 40 of this total amount , or 27,604,782 is available for spending at the government’s discretion unreserved fund balance lt; At the end of the current fiscal year , unreserved fund balance for the general fund was 26,693,157 or 24 of total general fund expenditures for the fiscal year Of this amount , 7,450,982 has been designated for subsequent year expenditures bringing the undesignated general fund balance to 19,242,175 or 18 percent of general fund expenditures lt; The County’s total debt increased by 40,359,728 during the current fiscal year The key factors in this increase are the 43,000,000 in general obligation bonds that were issued for school capital needs and the bond anticipation notes that were issued to construct and equip the Little Creek and Brogden Water District lt; The County maintained its Aa3 rating with Moody’s Investors and it’s a + rating with Standard and Poor’s Rating Services In summary , Mr Burke stated that Johnston County has survived the transition mandated by GASB Standard 34 , survived the State withholding anticipated revenue and overall is in good fiscal condition Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board accepted the audit report for year ended June 30 , 2002 as presented 19 Tax Releases and Refunds - 014274 2000020970 Chestnut , Stanley c 47034 # REMT 20 Delinquent Tax Report and Update on Revaluation Tax Administrator , Pat Goddard , reported that during the month on December , the County collected 48,058 in delinquent taxes through garnishments , bank attachments and levies Concerning foreclosures , the county has completed sending demand letters for tax year 2001 , and collected 44,148 during the month of December Her office will begin working on delinquent 2002 taxes very soon Ms Goddard noted she and Attorney Mark Payne have discussed the way the foreclosure program is being handled With the number of enforced collections that are still being handled in house , and the fact that the Tax Collection office is short staffed at this time , the County will continue to use the outside attorney for foreclosures , with the understanding that complaints will be filed monthly Concerning the Revaluation , Ms Goddard stated that new valuation notices were mailed on December th 28 with multiple listings going out a few days later Her office received 2,789 telephone calls , of which 1,094 nd were concerning revaluation during the four day week beginning January 2 Approximately 1500 mail - in appeals have also been received Informal appeals are being heard by CLT’s six hearing officers and at least one County staff member She thanked several of the County departments and agencies who have offered assistance in one way or another during this process In response to a question from Commissioner Allen L Mims , Jr , Ms Goddard stated the Board of Equalization and Review will be given some training before they start hearing the formal E & R cases 21 Commissioner Fred Smith Resigns to take his Seat in the NC Senate Commissioner Fred Smith thanked everyone for the opportunity to serve as a Commissioner in Johnston County He stated it has been a privilege to be a part of Johnston County Government , and praised its efficiency under the leadership of County Manager , Rick Hester He noted as a Board member , he has enjoyed the opportunity to debate issues and still maintain a close friendship with other Board members Upon leaving office , he offered the following suggestions to the Board Page5186 January 6 , 2003 Continued lt; Continue to realize the need to provide for the necessary infrastructure as the County grows He noted that solid waste and water are in good shape , and he encouraged the Board to continue working on the school system and the wastewater needs of the County lt; Congratulated the Chairman on his leadership and suggested the possibility of some standing committees to meet regularly in the areas of finance , infrastructure , education and general government lt; Begin the meetings with a prayer and or the Pledge of Allegiance lt; Remember that the County is spending the people’s money - money paid to the government to be used for the public purpose Commissioner Smith resigned his seat and wished everyone good luck for the future Board members individually expressed their appreciation for having served with Mr Smith They agreed they would miss working with him as a Board member and wished him well in his new position as NC Senator 22 Jeffrey P Carver Appointed to Fill the Unexpired Term of Fred Smith as Johnston County Commissioner Commissioner Allen L Mims , Jr stated it was a privilege for him to appoint Jeffrey P Carver to fill the unexpired term of County Commissioner created by the resignation of Fred Smith Commissioner Wade M Stewart seconded the motion , which carried by unanimous vote Board members welcomed Mr Carver to the Board effective upon his taking the oath of office It was suggested he decide when and where he would like this to take place , as long as it is done prior to the meeting scheduled for Monday evening , January 13 , 2003 23 Landfill Cell 4A - Phase I Completed Engineer Tim Broome informed the Board the County has completed the first phase of the new Landfill cell 4A , which will be open for use within the next few days 24 Closed Session - 143 - 31811 5 Acquisition of Real Property Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board recessed regular session to meet in closed session under NCGS § 143 -
