10 194 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS February 3 , 2003 The Johnston County Board of Commissioners met in regular session Monday , February 3 , 2003 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman , Thomas M Moore , Wade M S tewart , Jeffrey P Carver and W Ra y Woodall Absent Allen L Mims , Jr Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board approved the minutes of the January 6 , 13 , 2003 board meetings as presented 2 Plaque of Appreciation to Former Commissioner Fred Smith Chairman James H Langdon , Jr presented a plaque to Senator Fred Smith in appreciation for his service to the citizens of Johnston County as a County Commissioner from December 2000 to January 2003 Senator Smith thanked the Board and noted it was a pleasure to serve the citizens of Johnston County as a commissioner He pledged to continue to do his best as a member of the NC Senate to serve the needs of the people Public Comments - No one spoke at this time 3 Department of Transportation - Additions to System The Board reviewed petitions presented by the North Carolina Department of Transportation requesting the following roads be added to the State Secondary System for maintenance Northfort Drive , Moultrie Court , and Benning Circle in Northfort Subdivision , Sections , 1 , 2 , 3 , & 4 , Wilders Township Commissioner Cookie Pope moved the Board concur with the NC Department of Transportation’s request to add the above listed roads to the State Maintained System Commissioner Wade M Stewart seconded the motion which carried by unanimous vote 4 Certificates of Canvass for Referendums Held in Elevation and Meadow Water Districts Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board accepted the certificates of canvass for the two referendums held in Elevation and Meadow Water Districts on January 21 , 2003 with respect to 7,000,000 General Obligation Bond for each of the districts The Elevation Water District Referendum passed with a vote of 162 for and 21 against The Meadow Water District Referendum passed with a vote of 244 for and 31 against 5 Resolutions Certifying and Declaring Results of Referendums in Elevation and Meadow Water Districts Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board recessed regular session to sit simultaneously as the Elevation and Meadow Water 21 , 2003 , with respect to the proposed 7,000,000 General Obligation Bonds of the Elevation Water District was 162 votes “ For ” approval of the Bond Order and 21 votes “ Against ” approval of the Bond Order , and delivered a copy of the Certificate of Canvass to the Board Commissioner Wade M Stewart then introduced the following resolution the title of which was read RESOLUTION CERTIFYING AND opportunity to start an endowment fund for primarily middle and high school age foster children The money would be used to enhance the life of these young people who often can not participate in activities such as band and sports because they can not afford the associated costs which are usually paid for by parents He noted the fund would be gifted by money raised through a fund - raiser along with a matching pledge from former Commissioner Frank Holding He requested the Board adopt a resolution to authorize and establish the Endowment Fund to be owned and managed by the North Carolina Community Foundation , Inc Commissioner Wade M Stewart commended Mr Marett and the Department of Social Services for their outstanding foster children program , and noted this is an excellent way for the community to help these young people He moved the Board adopt the following resolution authorizing the establishment of a designated endowment fund Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Page197 February 3 , 2003 Continued RESOLUTION BE IT RESOLVED that the Johnston County Board of Commissioners , a governmental unit , does hereby request and authorize establishment of a Designated Endowment Fund on its behalf and for its benefit and the benefit of the citizens of Johnston County , by the North Carolina Community Foundation , Inc NCCF , pursuant to the Agreement signed by Donor and NCCF The Designated Endowment is to be owned and managed by the NCCF as provided by said Agreement and held by the NCCF as a component fund thereof ; and BE IT RESOLVED that the Johnston County Board of Commissioners hereby authorizes NCCF and its officers and agents to accept contributions to the said Designated Endowment Fund on its behalf , and further authorizes its own officers and directors to execute and deliver to NCCF any instruments or documents necessary or useful to effect the authorization , establishment , use and continued maintenance of such Designated Endowment Fund rd ADOPTED this the 3 day of February 2003 , by the Johnston County Board of Commissioners at a meeting duly called and held , at which a quorum was present and acting throughout 8 Health Insurance Portability and Accountability Act HIPAA Compliance Resolution Assistant Health Director , Steve Strickland , asked the Board to adopt a resolution designating Johnston County as a “ Hybrid - covered Entity ” for purposes of HIPAA compliance He explained that HIPAA stands for Health Insurance Portability and Accountability Act , and it was enacted by Congress to protect the privacy of individually identifiable health information The first component of HIPAA is the regulation of transaction standards By October 2003 , all covered health care providers are required to use the same billing codes and billing procedures The second component governs the patient’s rights concerning the release of identifiable health information Providers must be in th compliance with this phase of the Act by April 14 of this year The third component , which is still being finalized at the federal level , will dictate the procedures that must be in place to ensure confidentiality and integrity of protected health information This will include such things as encryption of electronic data and electronic locks on doors into areas where this type if information can be found All healthcare providers who bill patients electronically are under HIPAA regulations At present , Johnston County has only four agencies that are covered under the Act Health , Mental Health , Social Services and Emergency Management Hence , we will be considered a hybrid covered entity Emergency Management Director , Dewayne West , voiced his concern that these regulations will be passed down to the volunteer rescue squads since they , too , handle sensitive medical information He noted , in his opinion , this would be a tremendous burden on them Commissioner Wade M Stewart asked how much this was going to cost the County Mr Strickland responded that the Federal Government thinks the program will eventually save money , however , that remains to be seen Many agencies have hired consultants to come in and set everything in place Johnston County , however , felt the consultant fees were too high and decided to implement the program in - house Staff has been working diligently for more than nine months , attending many meetings and workshops to make this work at a minimal cost to the County County Manager , Rick Hester , commended Mr Strickland for taking a leadership role on this very complicated matter Following further discussion , Commissioner Cookie Pope moved the Board adopt the following resolution approving the designation of Johnston County as a “ hybrid covered entity ” for purposes of HIPAA compliance Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote Resolution Approving Designation of County as a “ Hybrid Covered Entity ” for Purposes of HIPAA Compliance The Johnston County Board of Commissioners Finds a The Health Insurance Portability and Accountability Act of 1996 HIPAA , and implementing regulations , impose a variety of requirements on public and private entities to protect the privacy of individually identifiable health information PagePage pageNumber5198 February 3 , divisions and programs fall outside HIPAA’s scope c To develop and implement a compliance plan , the County must designate in writing which County functions are within HIPAA’s scope and which are not d The County has determined that it should be designated a “ hybrid covered entity ” for purposes of HIPAA implementation e The departments , divisions and functions that would be considered “ health care components ” under HIPAA and , therefore , are part of the County’s “ hybrid covered entity ” are 1 Johnston County Health Department 2 Johnston County Mental Health Department 3 Johnston County Department of Social Services 4 Johnston County Emergency Management Department f Amendments to the “ covered hybrid entity ” organizational chart will be needed from time to time as realignments occur within the county structure The Johnston County Board of Commissioners Resolves 1 Johnston County is designated as a “ hybrid covered entity ” for purposes of HIPAA compliance 2 The County Manager , the Johnston County HIPAA Compliance Officer , or his designee are authorized to amend the listing herein as required over time to maintain ongoing HIPAA compliance rd ADOPTED this 3 day of February , 2003 9 Public Hearing - Proposed Extension of Boundaries - Buffalo Water District Advertised The Smithfield Herald - January 17 , 24 , 2003 The Chairman opened the public hearing and invited anyone who wished to speak on the proposal to expand the Buffalo Water District to include some additional properties north of the existing boundaries along NC 96 Highway There being no comments , the Chairman closed the hearing 10 Resolution Providing for Expansion of the Boundaries of the Buffalo Water District Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope and carried by unanimous vote , the Board recessed regular session to meet as the Buffalo Water District Board Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board adopted the following resolution RESOLUTION PROVIDING FOR EXPANSION OF THE BOUNDARIES OF THE BUFFALO WATER DISTRICT OF JOHNSTON COUNTY WHEREAS the Johnston County Board of Commissioners the Board at its regular meeting on August 2 , 1999 passed a resolution creating the Buffalo Water District the District in accordance with N C General Statutes § 162A - 86 , et seq ; and WHEREAS , the Board has determined , after receiving petitions from residents of property lying near the District , that these parcels of land contiguous to the District may be annexed into the District ; and WHEREAS , pursuant to NC General Statutes § 162A - 871 , the Board has determined to extend the boundaries of the District to include the petitioned parcels ; WHEREAS the Board resolved to hold a public hearing with respect to such extensions on February 3 , 2003 , and directed that the appropriate representatives of the County take the necessary actions to properly notice such public hearing as provided by law ; and WHEREAS , pursuant to N C General Statutes Section 162A - 871 e a notice of public hearing was prepared stating the date , hour and place of the hearing and its subject and stating that the report containing a map of the District and the areas to be annexed were available for public inspection in the office of the Clerk to the Board , taxpayers and all other interested persons appeared and were heard concerning the question of expanding the boundaries of the Buffalo Water District of Johnston County ; and WHEREAS , at such meeting the Board determined that it was appropriate to extend the boundaries of the District to include the parcels of land Exhibits A & B ; and WHEREAS , the Board , following the public hearing finds that Services - Temporary Social Worker Positions Made Permanent Commissioner Wade M Stewart , who also sits on the Social Services Board of Trustees , recommended the Board make permanent the three temporary social worker positions , which were recently approved for the Child Protective Services division of DSS He noted he is usually the last to recommend growth in government , but he has seen the work load in that particular area , and the difficult job these people have with the growing incidents of child abuse in the County This is a very time - consuming and sometimes dangerous job that requires specialized training and certification At present , the County has eight of its nine permanent positions and only one of the three temporary positions filled Due to the shortage of qualified persons across the State , it is especially difficult to get trained people to take the temporary positions with no benefits Commissioner Thomas M Moore asked Earl Marett , DSS Director , where he could put these people with the shortage of space in his facility Mr Marett noted it is a problem , but he has rearranged the building and his staff is having to make the best of a difficult situation In response to a question from Commissioner W Ray Woodall about the possibility of putting these workers under a contract to assure they would not leave Johnston County employment for a period of time , Mr Marett stated that DSS employees are under the State Personnel Act , which does not permit this Following further discussion , Commissioner Stewart moved the board approve permanent status for the three temporary social worker positions for the Child Protective Services Division of the Johnston County Department of Social Services Commissioner Thomas M Moore seconded the motion Discussion Board members discussed the rise in child abuse in the County and the fact that in many cases , drugs are a factor It was noted the issue of space for DSS is being addressed with the general plan to build a new facility on the County property on NC 210 for Cooperative Extension , ASCS , Soil Conservation and USDA Rural Development This would free up two additional buildings on the DSS campus providing much needed office space The existing Cooperative Extension building has an auditorium , which it is hoped can be turned into a courtroom facility for DSS related cases Commissioner W Ray
