10 259 MEETING OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS April 7 , 2003 The Johnston County Board of Commissioners met in regular session Monday , April 7 , 2003 , at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina , with the following members present Present James H Langdon , Jr , Chairman , Cookie Pope , Vice Chairman arrived at 10 40 am , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Jeffrey P Carver , and W Ray Woodall Absent None Also Present Rick J Hester , County Manager , Joyce H Ennis , Clerk to the Board , Mark Payne , County Attorney , and John R Massey , Finance Officer The Chairman called the meeting to order and the following business was transacted 1 Minutes Approved Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the minutes of the March 3 , 7 , 10 , 2003 board meetings as presented Public Comment - No one spoke at this time 2 Board of Education - Request to Purchase School Buses for FY 2003 - 04 Dr Jim Causby , Superintendent of Schools , requested the Board authorize him to go ahead and order school buses for next year with the understanding they will be invoiced and paid for after July 1 , 2003 He noted the primary responsibility for student transportation belongs to the State , which provides for operation and replacement of existing buses ; however , they do not buy new ones For the past few years , the School Board has found ways to avoid purchasing a large number of buses by staggering bell times and scheduling second routes , but this year they will need twenty 66 - passenger buses , three service trucks , two truck utility bodies , and four activity buses , two of which to be outfitted with air conditioning and handicap lifts for a total cost of 1,531,015 Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board authorized the School Board to order the vehicles listed above with the understanding they will be invoiced and paid for after July 1 , 2003 out of the 34 million capital outlay allocation from the County 3 Community College - Surplus Property - Analog Radio Equipment & Vehicle Sheriff Steve Bizzell asked the Board to declare surplus the analog radio equipment that is no longer in use in his office Once he and the County Attorney work out an appropriate method of selling the equipment , he will come back to the Board for their approval He also asked the Board to declare surplus a 1999 Ford th Mustang SVT Cobra Convertible and authorize its sale at the next public auction to be held on April 26 by Wester Auction Company The sale will begin at 10 00 am at the County’s gas pump facilities off Hwy 301 North in Smithfield Sheriff Bizzell noted the mustang was confiscated during an undercover drug investigation and has been used as an undercover vehicle The proceeds from the sale will go to his department to purchase another undercover vehicle Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Wade M Stewart and carried by unanimous vote , the Board declared surplus the following radio equipment with the understanding an appropriate method of sale will be brought back to the Board for approval at a later date , and declared surplus the following vehicle to be sold at the next public auction on April 26 , 2003 as requested 61 Ericsson model PM82SN MDX mobile radios 9 Ericsson model PM82SP MDX mobile radio 4 Ericsson model MDX handset - Amendment to Scattered Site CDBG Program Advertised The Smithfield Herald on March 21 , 2003 The Chairman opened the public hearing and invited anyone who wished to comment on a proposed amendment to the CDBG Scattered Site Program Jessie Miars , program administrator with Holland Consulting Planners , stated that any budget amendment that changes a program line item more than 10 requires a public hearing This proposal would simply switch money from rehabilitation to the relocation and clearance line items with no additional money involved She noted the original budget was established before the units were identified , and there was no way to know how many units could be refurbished and how many would need replacing There being no further comments , the Chairman closed the public hearing Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the following proposed budget revision Activity Original Budget Proposed Revision Rehabilitation 200,000 98,000 Relocation 130,000 225,000 Clearance 30,000 37,000 Administration 40,000 40,000 TOTAL 400,000 400,000 6 HAPP Annual Plan HAPP Director , Melody Gates , asked the Board to approve her agency’s annual plan that must be sent to HUD She noted the plan is essentially the same as in previous years Page261 April 7 , 2003 Continued Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board approved the annual plan for the HAPP agency 7 Department of Social Services - Revised Work Plan Betty Barnes from the Department of Social Services stated that when the State reviewed the Work First Block Grant Plan for 2003 - 05 , they recommended a revision to one area concerning the percentage of poverty level for gross earned income for emergency assistance Staff has made the revision and is now asking for the Board’s approval before resubmitting it to the State Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner W Ray Woodall and carried by unanimous vote , the Board approved the revised Work First Block Grant Plan for 2003 - 05 for the Department of Social Services 8 Department of Social Services - Surplus Property - 15 Passenger Van As requested by the Department of Social Services , Commissioner W Ray Woodall moved the Board declare surplus a 1990 Dodge 15 - passenger van VIN # 2B7KB31Z2LK784377 with mileage of 135,869 , and authorize it to be sold at the next public auction to begin at 10 00 am on April 26 , 2003 at the County’s gas pump facilities off Hwy 301 North in Smithfield Commissioner Allen L Mims , Jr seconded the motion , which carried by unanimous vote 9 Establishment of Wilson’s Mills Fire District # 2 The Chairman noted the Board held a public hearing on April 10 , 2002 on the proposed Wilson’s Mills Fire District # 2 A new fire station has been built , and the Wilson’s Mills Fire Department is requesting the Board adopt the resolution establishing the new district Upon a motion by Commissioner Thomas M Moore , seconded by Commissioner Allen L Mims , Jr and carried by unanimous vote , the Board adopted the following resolution establishing the Wilson’s Mills Fire District # 2 RESOLUTION ESTABLISHING WILSON’S MILLS FIRE DISTRICT # 2 WHEREAS ; The Johnston County Board of Commissioners has been approached by citizens of Johnston County seeking the establishment of a fire district in a currently unserved area of the County , and WHEREAS , the Wilson’s Mills Fire Department has agreed to assist in the creation of the new fire district , including facilitating the construction of a fire station to serve the new district , and ; WHEREAS , all of the requirements of N C Gen Stat § 153A - 302 have been satisfied enabling the creation of a Fire District to be known as the Wilson’s Mills Fire District # 2 , including the preparation of a Report , made available to the public , consistent with the requirements of N C Gen Stat § 153A - 301 et seq ; 3 The initial tax rate within the Wilson’s Mills Fire District # 2 shall be identical to that of the Wilson’s Mills Fire District ; 4 There is established a Wilson’s Mills Fire District # 2 Commission , and the Board of Commissioners hereby appoints the same members to serve on this commission that serve on the Wilson’s Mills Fire District Commission with terms to be concurrent 5 There is established a Wilson’s Mills Firemen’s Relief Board of Trustees # 2 , and the Board of Commissioners hereby appoints the same members to serve on this commission that serve on the Wilson’s Mills Firemen’s Relief Board of Trustees , with terms to be concurrent 6 This resolution will become effective July 1 , 2003 Commissioner Thomas M Moore moved the passage of the foregoing resolution and Commissioner Allen L Mims , Jr seconded the motion , and the resolution was passed by the following vote Ayes James H Langdon , Jr , Cookie Pope , Thomas M Moore , Wade M Stewart , Allen L Mims , Jr , Jeffrey P Carver , and W Ray Woodall Nays None Not voting None 10 Public Hearing Scheduled - Proposed Abandonment of a Portion of Atkinson Mill Road Advertised in The Smithfield Herald on March 14 , 21 , 2003 and posted at both ends of the road The Chairman opened the public hearing and invited anyone who wished to address the Board on a request from the NC Department of Transportation to abandon a portion of the Atkinson Mill Road SR 1734 at the time the rest of the road is paved Jimmy Mac Narron , and Tim Narron , who both live on Atkinson Mill Road , stated if the requested portion of the road through the Atkinson Mill property is abandoned , and the remainder of the road paved , they would like to see a turn - around , similar to a cul de sac , on Mr Glenn Wheeler’s property Mr Wheeler’s family owns Atkinson Mill In response to questions and comments from the Board , Tim Narron stated he would prefer that the road remain open ; however , he could understand the Wheeler’s request to stop traffic through the mill property Lance Blakeslee , 413 Atkinson Mill Road , noted there is a sharp turn down near the mill , which creates a safety issue The old miller’s house , which has historic value , and the septic tank system are both located near the turn , which would make it difficult and costly to straighten out the turn It appears it would be easier to close off the road He stated he has talked with Glenn Wheeler , who told him he has offered to have the turn - around on his property He voiced his support for this request Glenn Wheeler spoke on behalf of the Mill and his own personal interest as he also lives on the road He pointed out his family only signed the petition after the Department of Transportation suggested it Closing the road would have both positive and negative aspects for his family It would eliminate the safety concerns from local traffic , however , if closed as proposed , the State abandoned portion would have to be maintained by the Mill owners as that would be the only entrance to the Mill In response to a question from Commissioner Wade M Stewart , he noted a berm would be built where the State paved road ends and there would be no through traffic He stated he would have no problem with the paved road ending at the Mill property line and the turn - Strickland’s Crossroads Area H M Johnson , who lives in the Strickland’s Crossroads area , spoke on behalf of his community He noted the citizens are concerned about the loss of the Quick Response Vehicle QRV now that Four Oaks Rescue has reached the paramedic level Due to the distance between the community and any rescue squad , including Four Oaks , the people feel they will not have the quality care that others in the County have He pointed out thePage2270 April 7 , 2003 Continued neighboring counties of Wayne and Sampson do not help out the way they used to He presented a petition with over 2100 names requesting the County keep a QRV at the Blackmon’s Crossroads Fire Department Phil Shaw , resident of Bentonville , noted the QRV has given the citizens in the southeast portion of the County the highest degree of care they have ever had Benton Johnson from Blackmon’s Crossroads community stated , in his opinion , his father would not be alive today if it weren’t for the QRV He asked the Board not to leave this area of the County without a plan for quality EMS service William Grantham noted the Blackmon’s Crossroads Fire Department built a facility to house the QRV He stated the community needs for it to stay Chairman James H Langdon , Jr explained the County’s agreement with the rescue squads concerning EMS service included discontinuing the QRV’s when the squads become paramedic certified Four Oaks Rescue has now attained that level , which was the reason the QRV was removed The Board , however , has heard the citizen’s concerns and realizes there is a real distance problem involved with these communities Staff is currently working with the Four Oaks squad on plans for a first responder satellite facility that would serve the area in question and be staffed 24 hours a day He suggested a small committee made up of people in the area work with the County and Four Oaks Rescue on this matter Mr Shaw stated he appreciated the interest and the effort to do something , however , if there is an emergency tonight in one of these communities , there is no one to help them He asked the Board to put the QRV back in service until something else can be worked out Commissioner Thomas M Moore agreed and asked Emergency Management Director , Dewayne West , if he could find staff to operate a QRV in the area on a temporary basis Mr West responded he felt he could find enough part - time help to keep the QRV in service for a short period of time , and would try to have it back in service before the end of the day Commissioner Wade M Stewart pointed out the problem was made worse when rescue service from Wayne County and Newton Grove quit coming into Johnston County He commended the Four Oaks Squad and its captain , April Matthews , for their willingness to help out , and thanked Dewayne and his staff for all their hard work in finding a solution to this situation He noted the lack of cooperation from Wayne County and Newton Grove has created problems not only in this area but in Princeton as well , which has put a major strain on Johnston County Todd Parker from Meadow thanked the Board and stated the people will do anything we can to help Connie Grady , who lives in Four Oaks , stated she would have no problem with Four Oaks helping out , as long as they continue to have paramedic service in the current Four Oaks service area Stanton Massengill suggested the QRV charge a fee like the rescue squads do Mr West noted this has not been a practice ; however , that could change Chairman Langdon thanked everyone for their comments 19 Public Hearing Scheduled - Proposed New Water District Engineer Tim Broome pointed out an area on the map which is proposed as a new water district The district would extend from Pine Level to the Stancil’s Chapel community and would border the Princeton - Kenly , Brogden , and Buffalo Water Districts , as well as the Towns of Pine Level and Kenly He suggested that since the proposed district is bisected by Little River , that it be called the Little River Water District In response to comments from the Board , Mr Broome noted that approval of this district would leave only one section of the County without public water The remaining area could be served with a single additional district Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Thomas M Moore and carried by unanimous vote , the Board scheduled a public hearing on the proposed Little River Water District for 10 30 am on May 5 , 2003 Page3271 April 7 , 2003 Continued 20 County Privilege License Tax Discontinued Tax Administrator , Pat Goddard , requested the Board approve the discontinuation of County privilege Licenses since only certain types of businesses are included , and the cost to administer the program is greater than the amount of revenue realized by the tax She noted this would free staff to concentrate on enforced collections Approximately one -
